05/11/1931 Special Meeting363 THE MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF DES PALINES HELD I' THE OFFICE OF THE CITY CLERK ON THE 11TH DAY OF MAY A. D. 1931. AT THE HOUR OF a O' CLOEK P. M. Mayor Hamm:erl called the meeting to order with Alderman Ahbe, Collet, auster, Pflughaupt, Kinder, Lacey, Wettin, Mein- shausen and snzenbacher answering to roll call, Alderman Huxmann being absent. Mr. Maloney, attorney introduced Mr. Arthur J. Weiner of Charles J. Andersen & Co., who displayed and explained a system of books to take care of the accounts of the Treasurer's Office and fit in well with the present books of the "'ity Clerk and City Collector. motion was made by Alderman Kinder and seconded by wettin that the Council adopt the forms displayed by Mr. Weiner and set up a new an4Yaddgaato'aet of books for the new Treasurer at a cost of appraximatly $300.00. The roll teas called with the followingresult. Ayes: Alderman, Ahbe, Collet, Suster, Pflughaupt, Kinder, Latey, settin, Meinshausen and Enzenbacher. Behrens to the new Treasurer Otto Rexses, a moCion was made by Alderman Wettin seconded by Alderman Collet that the City Clerk notify *. A. Jehrens in writing that the City Council demands that he bring his books up to date by' May 20th, ls!31 at which time he will be expected to turn them over to the new treasruer. The roll was called with the following result. Ayes. Alderman Ahbe, Collet, 5uster, Pflughaupt, -Kinder, Wettin, Lacey, Meinshausen and Enzenbacher. Nayea: none. Whereupon the Mayor declared the motion carried. A motion was made by Alderman Enzenbacher and seconded by -Alderman Ahbe that a copy of the City Clerk's letter to M. A. BehrensBehrens irstai.,Thltz Treasurer be sent to Mr. Behren's bonding Co.., marked tFinal". The roll was called with the following result. Ayes: Aldermen Ahbe, Collet, Suster, Pflughaupt, Kinder, Wettin, Lacey, Meinshausen, and Enzenbacher. .Nayesz none. Whereupon the mayor declared the motion carried. The following letter was read at this timei- April 30th, 1831. Hon. Charles Hammer-, Mayor of the city of Des Plaines, Des Plaines, Illinois. My dear Mayor: Following our conversation of a few days ago concerning my re-employment to represent the City of Des Plaines, I desire to say that 1 appreciate very deeply your offering me the opportunity of again representing the City of Des Plaines and 1 assure you that my relations with yourself and the yoard during the past two years have been -most pleasant. I have studied the matter carefully, however, and because of the large volume of work which I was required to do in order to handle the work of the City for which I received no compensation, and in addition to the face that as far as I am able to observe, the work for the coming two years will be equally as large, 1 feel that I will be required to request that a monthly retainer be paid for the services in representing the City on general matters. 1 am confident that the value of services rendered to the City in connection with general matters for the past two years was twice as much as 1 received in special assessment matters. You can redily'realize that 1 can not maintain an office and organization and work at a loss. In addition to this, 1 have learned that the City agreed to pay me 5% on special assessment matters. I believethat the Lity is the gainer on this agreement, and therefore, there should be no fault to find. However I have this suggestion to make --that the City of Des Plaines pay me the monthly fee of 25C.00 for which I will handle the work of the City, attending Coundil meetings, advising the officers of the City and taking care of any general business of the City. And this will be in payment of all services excepting the actual trial of cases in court. In. addition to this, for the trial of cases, 1 would expect a reasonable fee for tine spent in court. Any time spent in my office in the prepara- tion of cases would be included in the $250.00 mentioned. On special assessment work I would expect to receive a fee of 4% of the confirmed amount of the roll divided as follows: 3% for legal services, and 1% for services in advising commissioners and in the detailed worts in the pre- paration of assessment roll and examination of titles, ete. This, also to include the expense of witnessess on trials of any cases. However, in the event tItUity of Des Plaines desires to assume the expense of thetrail, such as witnesses, 1 would be glad to reduce the fees 10 more and to accept 20 for legal services and 17o for the spreading. This agreement, however, would have to be with the understanding that 1 would have the opportunity of hiring such witnesses as 1 deemed the right witnesses and such witnesses as 1 deem necessary for the cases. 1 would be pleased to prepare a contract along these lines if suitable to yourself and t$$ the Council. Altain thanking you for your offerand assuring you that I appreciate the same and also appreciate the confidence and goodfellowship of yourself and the members of the Council, I am Yours respectfully, DBM-HTL David B. Maloney. Mr. Maloney stated that he would embody the points set forth in the above letter in a new contract which he would draw up and sub- mit to the Council as soon as possible. Mayor H ammerl reported that he has been receiving repeated calls from a Mr. Charles Arnold and others regarding their con- tinaed paying of taxes on property which was. condemed and taken by the City for the opening of Ashland Ave. from Cora street to the river some ten years ago. in the discussion it developed that the condemnation proceedings had no dotbt been closed but that the final results had not been made a matter of records The motion was made by Kinder and Seconded by Alderman Ahbe that the attorney be in- structed to investigate the matter and make his recommendation. The motion was voted upon by acclamation and the Mayor declared the motion married. There being no further business to come before the Council adjorn*ent followed.
