03/25/1931 Adjourned Meeting331 THE MINUTES OF AN ADJOURNED MTING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE CITY CLERK's .OFFICE ON THE 25th DAY OF MARCH 1931. AT THE HOUR OF 8 o'CLOCK P. M. Mayor "ammerl called the meeting to order with Aldermen "Ahbe, Collet, Heesch, Suster, Kinder, Schlagel, Lacey, Wettin and Knabb answering to roll call. Alderman Enzenbacher being absent. Mayor Hammer' explained that this was an adjourned meeting of the City Council for the purpose of considering the passage of the annual appropriation ordinance. He instructed the City Clerk to proceed with the second reading of the ordinance. Second reading oft AN ORDINANCE MAKING APPROPRIATIONS TO DEFRAY THE EX- PENSES OF THE CITY OF DES PLAINES MR MUNICIPAL PURPOSES, DESIGNATED THE *ANNUAL APPROPRIATION BILL", FOR THE FISCAL YEAR COMMENCING JANUARY 1,1931 AND ENDING DECEMBER 31,,1931. Alderman Schlagel moved that the ordinance be passed as read. Alderman Wettin seconded this motion and the roll was called -with the following result: AYES, Alderman Ahb:e, Collet, Heeach, Suster, Kinder, Schlagel, Lacey,Wettin and Knabb. None voting 'naye the -Mayor declared the motion carried and the ordinance passed as read. Alderman Schlagel moved that the ordinance be published in the next issue of the Suburban Times according to law. Alderman Knabb seconded this motion and the roll was called with the following result: AYES: Alderman Ahbe, Collet, H eesch,'Suster, Kinder, Schlagel, Lacey, Wettin and Knabb. None voting naye the Mayor declared the motion carr3;7e6 and directed ordinance be published. The following resolution was presented to the City Council at this times RESOLUTIO N WHEREAS, the Board of County Commissioners of Cook County have provided for an improvement to be constructed in the City of Des Plaines known as the paving and improv- ing of River Road through the City of Des Plaines from Keeney Avenue to Rand Road to a width of forty (40) feet; and WHEREAS, heretofore the property owners abutting on the said River Road have, at their own personal cost and expense, provided for the paving of the center twenty- two (22) feet of the said River Road, and at their own expense have constructed on both sides of the said pave- ment a Portland Cement Concrete curb together with all drainage structures appurtenant thereto, which said curb and drainage appurtenances are in good condition and in the ordinary course of events the life of the said improvements would extend over a period of many years; and 332 WHEREAS, the said improvement as contemplated by the Board of County Commissioners of Cook County provides for the removal of the said curb and drainage appurten- ances without the restoration of the same, and that the said removal of the said curb and drainage appurtenances would be unfair and a burden upon the property owners; and WHEREAS, in view of the fact that the said central twenty-two (22) feet of pavement and the said curb and drainage appurtenances were paid for by the abutting pro- perty owners, in fairnens to the said property owners the Board of County Commissioners of Cook County should pro- vide for the reconstruction of the said curb and the re- placement of the -said drainage appurtenances; and WHEREAS, in the scheme of the construction of the said forty (40) foot street along the Des Plaines River, a re- taining wall is provided for along the westerly bank of the said Des Plaines River and that the said retaining wall is provided to be built so close to the said pavement st as to prohibit the construction of underground improvements and the laying of sidewalks by the City of Des Plaines, and that the laying of the said underground improvements and the construction of sidewalks along the easterly edge of the said pavement are necessary for the proper improving of the saidstreet; and WHEREAS, it is, in view of the circumstances, reasonable and necessary that the said retaining wall be moved easterly so that the westerly face of the retaining wall shall be at least six and one-half (6*) feet easterly of the easterly edge of the pavement, so that proper sidewalks and under- ground improvements can be constructed easterly of the, edge of the said pavement without interference by th°e said re - taming wall. BE IT, THEREFORE, RESOLVED by the City Council of the City of Des Plaines that the Board of County Commissioners of Cook County be and they are hereby respectfully peti- tioned and requested to direct the County Superintendent of Highways of Cook County to modify the said pians for the said improvement so as to provide for the restoration and reconstruction of the curb to be moved on the said River Road together with the replacement of any drainage appurtenances, and to also provide for the moving of the said retaining wall easterly as herein requested. BE IT FURTHER RESOLVED that the Mayor of the City of Des Plaines forward a copy of this Resolution to the Board of County Commissioners of Cook County together with the request that the Board of County Commissioners of Cook County comply with the requests therein made. BE IT FURTHER RESOLVED that a cony of this Resolution also be sent to the County Superintendent of Highways of Cook County. BE IT FURTHER RESOLVED that this Resolution shall be in full force and effect from and after its passage and the approval hereof according to law. PASSED this day of ,A.1). 1931. None voting Naye the Mayor declared the motion carried and the re- solution adopted. The finance committee submitted the following reports Des Plaines, Illinois March 25th, 1931 Mayor To the lies and City Councils, Your Committee on Finance has investigated the matter of reimbursing Axel Petterson for his loss of time and his car in the accident of March 9th,193O. We, your Committee on Finance, therefore re- commends That Axel Petterson be paid the amount of oat.00, same to be paid out of the Contin- gent Fund. Signed, Committee, Henry Heesch Alderman Heesch moved that the recommendation of the Finance Committee be accepted. Alderman Schlagel seconded this motion and the roll was called with the following results Alderman Ahbe, Collet, Heesch, Suster, minder, Schlagel, Lacey, Wettin and Knabb voting Aye. None voting naye the Mayor ddclared the motion carried. There being no further business to come before the Council at this time on motion duly made, seconded and unanimously carried same adjourned.
