OF THE CITY COUNCIL OF THE CITY OF
DES PLAINES HELD IN THE COUNCIL CHAMBERS
AT THE HOUR OF 8 O'CLOCK P. M. ON THE
19th, DAY OF JANUARY 1931.
Mayor Hammerl Called the meeting to order with Alder-
man Collet, Ahbe, Heesch, duster, Schlagel, Kinder, .Lacey,
Wettin, Knabb and Enzenbacher answering to roll call.
Alderman Collet moved that the minutes of the .Last
regular meeting be approved as written. Alderman Ahbe seconded
this motion and the same carried by vote of acclamation.
The report of the City Collector covering collections
to January,12th, 131 was read and ordered placed on file.
The Judiciary and Assessment Committee had no report
to matte at this time.
The Police & License Committee had no report to make
at this time.
The Public works Fire, .Building and City Plats Committee
had no report to make at this time.
The Sewer Drainage and Sanitation Committee had no
report to make at this time.
The Fire Committee had no report to make at this time.
The Water Committee had no report to make at this time.
Second Reading of: -
AN ORDINANCE
AMENDING SECTION 586 OF ARTICLE
15 OF THE MUNICIPAL CODE OF THE
CITY OF DES PLAINES OF 1928.
Alderman Collet moved that the Ordinance be passed as 'read.
Alderman Knabb seconded this motion considerable disscussion
fol*owed in which Alderman Schlagel questioned the time and Place
at which the Police & License Committee settled on the amount of
$75.00 as the annual License Fee. Alderman Lacey also questioned
the amount of $75.00 which in his opion was exsesive. following
the discussion the roll was called with the following result.
Ayes Alderman Collet, Ahbe, Heesch, Suster, Schlagel, Kinder,
Lacey, Wettin, Knabb and Enzenbacher. Whereon the Mayor declared
the motion carried and the Ordinance passed as read.
Second Reading Of :-
A N ORDINANCE
PROVIDING FOR THE ISSUANCE OF A TAX ANT I-
ipation warrant for corporate purposes.
Alder K er moved that the ordinance be passed as read.
A1derma°I nded this motion ane, the roll was called with
the following result. Ayes Alderman Collet, Ahbe, Heesch, Suster,
Schlagel, Kinder, Lacey, Wettin, Knabb and Enzenbacher. None
voting Naye the Mayor dekiared the motion carried and the
Ordinance passed as read.
A Notice from the N. C. Sorensen Motor Express Co.
relative to filling of an application for a Certificate of
Convenience and Necessity was read and referred to the Judiciary
and Assessment Committee on motion of Alderman Heesch seconded
*Alderman Collet and carried by vote of Acclamation.
The following letter from the ti. M. Cornell Co. was
presented to the Council at this time.

1 have recently had the opportunity of carefully
examining the estate Highway plans and specifications for
the grade separation at Northwest Highway (19} and Woif-
(zolf Road (58) near the CUMBERLAND railroad station. 1
have also gone over the plane and specifications of the.
Chicago and Northwestern Railway bridge over said Wolf-
Golf Road.
The Chicago and Northwestern Railroad is providing a.
stairway from each of the three station platforms to the
lower level sidewalk in the subway, and advised me that when the
said subway has been completed that they propose to fence off
the right-of-way so that pedestrains going to and from the_
Cumberland Station must use the subway and the stairways at
the platforms which they propose to use, doing away entirely
with the surface crossing for both pedestrian and automobile
and Bruck traffic at the Cumberland station.
I can find no place in the State Highway plans where a
stairway is provided from the sidewalks along the Northwest
Highway on the Cumberland side of the Highway to the lower
level sidewalk in the subway. This is an absolute necessity.
1 also find that the State highway proposes to build a bridge
structure over Wolf -Golf Road 44 feet wide, extending two
feet on each side of the 40 foot highway slab. They also
propose to construct a six foot sidewalk adjoining the 40
foot slab on the north. This will completely obstruct
traffic travelling on the 12- foot slab of pavement install-
ed by the City of Des Plaines on the north side of the high-
way by special assessment, and will eliminate to a great
extent the benefits of said pavement to the abutting property.
It will also create a very dangerous point at the bridge, as
automobiles in the middle of the night travelling at a high
rate of speed without street lights and without warning will
undoubtedly use this 12* foot pavement and come upon the
bridge so rapidly that they will be unable to make a tures
fast enough to avoid serious accidents.
Inasmuch as this State Highway improvement is con-
structed after the installation of the 12* foot pavement,
it appears to me that the City of Des Plaines should insist
that the bridge structure constructed by the State Highway
should come north as far as the present curb, making the
pavement a minimum of 52f feet wide across Wolf -Golf Road
submerged. Then if they :wish to economize by constructing
a six foot sidewalk instead of the extension of the present
1C foot sidewalk and place the sidewalksadjoining their 52*
• feet of paving, this jog in the sidewalk would not be so
serious for pedestrian traffic.
1 can find no provisions for a submerged sidewalk in
Wolf -Golf Road beyond the actual structure under tneNorth-
west Highway. This leaves a lack of sidewalk from the
structure north to the circle, which would naturally be sub-
merged and which, in my opinion, cannot be constructed by
special assessment, for the very reason that it would be of
no benefit to the adjoining property owners, inasmuch as the
walk would be submerged and of no use to said property owners,
and it is my opinion that the property owners adjoining said
submerged sidewalk would object to the construction of same by
special assessment and it would either have to be done out
of the general fund of the City of Des Plaines or not done at
all, which would leave an unfinished Job in this construction
wo rk .

It was my understanding at the time that we dedicated
this right-of-way, without cost to the State, that there
would be constructed a 15 foot sidewalk the entire length
of the cut in the submerged Wolf -Golf Read from the circle
in Cumberland south to where Golf Road turns west to Elgin.
As the official representative of both the owners and
residents of CUMBERLAND I bring this to the attention of
your honorable body with the hopes that the City Council
will insist upon the State Highway Department constructing
a grade separation bridge as wide as the existing pavement
along the Northwest Highway, including the i2* foot strip,
also that the City will insist upon proper sidewalk through
the entire length of the out from the circle on the north to
the point south of the tracks where golf Road turns west to
Elgin.
Cumberland is not merely a subdivision --it is an im-
portant part of the City of Des Plaines, having at the pre-
sent time 42 residences and one 2 apartment nuiding and at
least six homes under contract for spring construction, with
many more in prospect.
I will personally appear at your next council meeting
Monday, January 19th, se that 1 may have the opportunity of
discussing with the Council what action should be taken with
the State Highway Department relative to said grade separation
structure.

Mr. H. M. Cornell was present and spoke at length to the members
of the City Council on the question of the improper length of this
subway and the hazard to traffic. Engineer Jenkins also spoke at
length en this matter following which Alderman Enzenbacher moved
that the Mayor, City Engineer, and the City Attorney be given
authority to communicate with the State Highway Department relative to
a change in the present plans and specifications for the Wolf -Golf
Road subway. Alderman nnabb seconded this motion and the roll was
called with the following result. Ayes, Alderman Collet, Ahbe.
Heesch, Suster, Minder, Schlagei, Lacey, Wettin, linabb and Enzen-
bacher. None voting ivaye the mayor declared the mstien carried..

I note from the last statement rendered by the
Public Service Company for btreet Lighting in the sub-
division Known as Des Plaines Center,. that there is suff'i-
dient money in ahe Trust Fund to pay for the lighting during
the month of January, 1931 and that is all. There will be
a balance of $2.00 in the Fund following thepayment of the
January account.
it is my desire that you consider what action you
wish to take with regard to this matter and advise me in
order that I may instruct the Public ervice Company
regarding the action they should take on February 1st, when
the Trust fund deposited with them shall become ez*austed.

Alderman Enzenbacher moved that the City Clerk be instructed to
take the above matter up with the property owners Alderman Lacey
seconded this motion and the same carried by vote of acclamation.
Alderman Heesch moved that the matter also be referred to the
Sts. & Sidewalks Committee for their recommendation. Alderman
Enzenbacher seconded this motion and the same carried0y vote of
acclamation.
The City Clerk informed the members of the eouncil that he had
received one bid for the Sale of the Bond issue. Alderman
Enzenbacher moved that the bid be opened and presented to the
City Council. Alderman Buster seconded this motion and the same.

Following a short fecess during which time the above bid was
considered by the members of the City Council Alderman iieesch
moved that the bid of White Phillips Co., of par plus accrued
intrest plus cost of printed bonds and approving opiu en plus
a premium of $175.00 for *46,000.00 of Corporate purpose Bonds
of $1,000.00 denami%nations numbered 3 to 48 inclusive provided
for in an Ordinance adopted .iovember 17th, 1930 maturing *1,000.00
January 1st, 1938, *3,000.00 January 1st, 1939 to 1945 inclusive
and *4,000.00 January 1st, 1946 to 1951 inclusive be accepted.
Alderman Enzenbacher seconded this motion and the roll was called
with the following result. Ayes, Alderman Collet, Ahbe, hessch,
Sister, Kinder, Schlegel, I**Ofm, Lacey, Knabb and Enzenbacher.
None voting faye the Mayor declared the motion carried.
Alderman Heesch presented the following resolution:
RESOLUTION
WHEREAS, the Public Service any of iiiorthern Illinois has
a bona fide claim against the City of Des Plaines for Des
Plaines Terrace Lights, up to and including December, 1930,
of *1,074.15: for Homeriean Villas Lights, up to and including
December, 1930, of $4,625.00; and for street lights, up to
and including July 15, 1930, of *380.24, making a total of
*6,079.39, 9.39, and
WHEREAS, Clithero, Osborn & Stevens have an alleged claim
against the City of Des Plaines in tete sum of *2,554.00 which
last mentioned claim is disputed by said Oity of Des Plaines, and
WHEREAS, said Clithero, Osborn & Stevens have offered to
accept in full settlement of said claim the sum of $2,054.00,and
WHEREAS, it appears upon investigation that said
claim of said Public 6ervice Oompany of b orthern Illinois
is a bona fide claim and that the City of Des Plaines is
legally indebted therefor in said sum of *6,079.39, and
that said City of Des Plaines is legally indebted to said
Clithero, Osborn & Stevens in said sum of 42,054.00, and
WHEREAS, there is not sufficient money in the Treasury
of said City of Des Plaines to pay said claims or any part
thereof, and
WHEREAS, said Public service Company of Northern
Illinois and said Clithero, Osborn & Stevens have demanded
payment and now threaten to institute suit against said
City of Des Plaines to recover upon said claims;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of Des Plaines:
(I) That MALONEY, WOOSTER & WHITESIDE enter the appear-
ance of.said City of DesPlaines in any suit that may be
brought with respect to either of said claims and consent to
the entry of judgments therein in the following amounts, viz:
Public service Company of isiorthern Illinois, ►6,0`19.39
Clithero, Osborn & Stevens 2,054.00
(2) That all resolutions and orders, or parts thereof,
in Conflict with the provisions of this Resolution be, and
the same are, hereby repealed.
('3) That this Tesolution shall be in force and effect
Immediately on its passage and approval.
