273 THE MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON THE 5th DAY 0 F JANUARY 1931.. AT THE HOUR OF 8 O'CLOCK P. M. Mayor Hammerl called the meeting to order with Alderman Collet Ahbe, Heesch, Suster, Schlagel, Kinder, Lacey, and Wettin answering to roll call. Alderman Knabb and Enzenbacher being absent. Alderman Schlagel moved that the minutes be approved as written. Alderman Suster seconded this motion and the same curried by vote of acclamation. A report from the City Collector covering collections through January 3rd, 1y31 was read and referred to the finance Committee. First Reading oft— AN ORDINANCE AMENDING SECTION 586 OF ARTICLE 15 OF THE MUNICIPAL CODE OF THE CITY OF DFS PLAINES OF 1928. Same was laid over for second reading. Alderman Lacey moved that the City Clerk furnish each Alderman with a list of business houses not toying business license during the year 1930. Alderman Schlagel seconded this motion and the roll was called with the following result. Ayes: Alderman Ahbe, Schlagel, Lacey, Ind Wettin. Hayes Alderman Collet, Suster, Heesch and Kinder. Whereon Mayor Hammerl voting Aye declared the motion carried and directed the City Clerk to prepare the list. The Sewer Drainage and Sanitation Committee had no report to make at this time. The Fire Committee had no report to make at this time. The later Committee had no report to make at this time. The Public Works Building and City Plats Committee had no report to make at this time. MayorItammeri then appointed Alderar Ahbe, hinder, and Lacey as a Committee of three to canvass the result of the Special Election held December 31st, 1930_ iteabtive to issuing 48,00© in general obligation bonds. Following a ten minute recess the canvassing committee submitted the following report. January 5th, 1931. Alderman Collet seconded this motion and the same carried by vote of acclamation. Alderman Heesch then presented the followi e. resolution. RESOLUTION CANVASSING RESULT OF ELECTION HELD DECEMBER 3lst, 1930. AND FINDING FACTS AS TO NOTICE AND BALLOT IHEREAS, the City Council of the City of DoE Cooic County, Illinois, did, on the 17th day of november, 1930, adopt and Ordinance entitled "An Ordinance providing for a special election to be held in the City of Des Plaines Cook County, Illinois on the Slst day of December, 1930" directing that a certain issuance of bonds of the City of Des Plaines, Cooic county, Illinois, to the amount of forty eight thousand and 00/100 dollars, (148,000.00) for the purpose of paying valid and binding obligations of said City of Des Plaines and providing for the collection of a direct annual tax for the payment of the principal and interest of said bonds", be submitted for the approval of the voters of said City of Des Plaines at said special election to be held in said City of Des Plaines on said 3lst day of De cembe r 1930; and WHEREAS, said Ordinance directed tne Clerk of said City of Des Plaines to give proper notice of said election and to prepare proper ballots for use at said election; and WHEREAS, said election has oeen held, and proff of notice of, form of ballot used at, and the returns of said election have been suomitted to the City Council. of said City for canvass: New, therefore, IT IS HEREBY RESOLVED by the City Council of the City of Des Plaines, Cook County, Illinois as follows: Sectio it That notice of election meld in this City on December 31st, 1930 was given in manner and form required by the City Council of said City and by tne statute in such cases made and provided, as evidenced ay affidavit stating when and where said notices were posted, together with a true copy of the notice as posted, and by the certificate of publication, stating when and by whom said puolication was made, together with a true copy of the notice as published, all of which are hereby found to be correct, and which said proff is in words and figures as followst (Lir'. 'ID.AVIT OF POSTING NOTICES) (ELECTION NOTICE (CERTIFICATE OF PUBLICATION OF ELECTION NOTICE) and the City Council of said City also heresy finds as a fact that said above entitled Ordinance providing for the issuance of bonds was published as anAppropriaticn Ord. finance according to law as evidenced by the certificate of publication stating when and by whom said publication was made, together with a true copy of said Ordinance as published, all of which are hereby found to be correct, and which said proof is in words and figures following: (CERTIFICATE OF PUBLICATION OF ORDINANCE) and the City Council of said City also hereby finds as a fact that proper ballots ware used at said election and that the following are true and correct copies of the ballots so used: ( 6 0/1'1CIAL BALLOTS) 275 Section 2: That the Judges: and Clerks of said election did canvass the returns of said election in manner and form as provided by law and returned the same to the Gity'Clerk of said City of Des Plaines within twenty four hours after the closing of the polls on the day of said election. Section 5: That the City Council hereby finds from the returns of the election submitted to and canvassed by said City Council that four hundred sixty three (463) legal votes were cast at said election; that on the pro- position of issuing bonds or obligations for the purpose of paying valid and binding obligations of said City of Des Plaines in the sum of Yorty eight thousand dollars 048,000.00), Three hundred fifty four (354) votes were cast in,favor thereof and 0ne Hundred nine (109) votes were cast against the same. Section 4: That the City Council of said City hereby further finds as a fact that said Ordinance was approved by the majority of the legal voters of said City of Des Plaines voting at said election and that said City is now authorized to issue the bonds described in said Ordinance. Section 5: That all resolutions and orders, or parts thereof in conflict with the provisions of this resolution be, and the same are hereby repealed. Section 6: That this resolution shall be in force and effect immediately upon its passage and approval. Passed this day of January 1951. City Clerk Approved this day of January 1931. Mayor Ayes Nays Alderman Heesch moved that the resolution be adopted as read. Alderman Schlagei seconded this motion and the roll was called with the following result: Collet, Aribe, Heesch, Suster, Sonlagel, Kinder, Lacey, and Wettin. voting Aye. Mone voting say the Mayor declared the motion carried, and the resolution adopted. Alderman Heesch then presented the following resolution. RESOLUTION WHEREAS, the following persons, firms or corporations have bona fide claims against the City of Des Plaines in the following amounts, Viz: Ning Eley - - - *1017.65 Minnie Meyer557.05 H. H. Bremer: -T 1400.00 Chicago Title & Trust Company - - -4574.50 and WHEREAS, the following persons or firms allege that the City of Des Plaines is indebted to them in the following respective amounts, viz: Tolman, SextXon & Chandler - - - *1608.96 George A. Mason - - - - - - - - 5550.00 which two last mentioned claims are disputed by the City of Des Plaines and WHEREAS, the owners of said last two mentioned claims have offered to accept in full settlement of said calims the following respective amounts, Viz: Tolman, Sexton & Chandler George A. Mason and *1201.00 500.00 WHEREAS, it appears upon investigation txiat the first four above mentioned claims are bona fide claims and the said City of Des Plaines is legally indented to said per- sons, firms or corporations in said amounts, and that said City of Des Plaines is legally indebted to the owners of the last.two mentioned claims in tfte amounts which the owners thereof have offered to accept in full settiement, and WHEREAS, there is not eufficient money in the treasury of said City of Des Plaines to pay said claims er any part thereof, and WHEREAS, the Owners of all of said claims have demanded payment and have treatened to institute suit against said City to recover upon said claims: NOW, THEREFORE, it is hereby resolved by the City Council of said City of Des Plaines: Sectionl: That Maloney, Wooster & Whiteside enter the appearance of said 010 of Des Plaines in any suit that' may be brought with respect to any of said claims and consent to the entry of judgments in favor of said persons, firms or corporations and against said City of Des Plaines in the following respective amounts: ting Eley *1017.65 Minnie Meyer 557.05 H. Alderman then presented the following resolution: RESOLUTION-. REQUESTING THE STATES ATTORNEY OF COOK COUNTY TO PROCEED WITH THE FORECLOSURE OF FORFEITED GENERAL TAXES ON CERTAIN PROPERTY IN DES PLAINES, COUNTY OF COOK AND STATE OF ILLINOIS. OMIIIIMI•1•••••.•••.•••••••••• WHEREAS, the City of Des Plaines has heretofore in- structed Mr. David b. Maloney to prepare a bill to fore- close tne forfeited general taxes on three hundred forty- five (345) parcels of real estate located within said City of Des Plaines, which said bill will ne entitled "People of State of Illinois vs Agnes Anderson, Et al*, and filed in the Circuit Court of Cook County, and WHEREAS, the eounty Commissioners of Cook County, have heretofore passed a resolution authorizing the tate's Attor- ney of Cook County to proceed with the preparation of said. Bill of Complaint, and 277 WHEREAS., the City of yes Plaines anticipates that there will be bidders for the said property in the event of the sale of the said parcel or parcels of property involved in the said proceedings NOT, THEREFORE, BE IT RESOLVED by tree City Council of the Pity of Des Plaines that it request, and it does hereby request the honorable John A. Swanson, Mate's Attorney of the County of Coatc, to file the said bill of Complaint to be entitled "People of the State'sf illinois vs/ Agnes Anderson, et al" prepared by the said David b, Maloney in conjunction and in co-operation with the State's Attorney of the County of Cook, and that the said proceed- ings be expeditiously prosecuted to the end that a sale thereon may be had at the earliest date possible. Alderman Heesch moved that the resolution be adopted as read. Aderman Collet seconded this motion and Alderman Binder stated that he was opossed to this work for the reason of this work for the reason that it was to expensive at this time. Whereon the Mayor declared the motion carried and the resolution adopted. First reading of: - AN ORDINANCE PROVIDING FOR THE ISSUANCE OF A TAX ANTI, CIPATION WARRANT FOR CORPORATE PURPOSES. Same was laid aver for second reading. The matter of revising the zoning Ordinance to allow the operation of Laundries splaying mere than five persons within the Commercial district was referred to the Public Works Fire building and City Plats Committee for a report at a latter meeting. RESOLVED THAT THE FOLLOWING DILLS ARE MITE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AUTHORIZED TO ISSUE THE PROPER WARRANTS IN PAYMENT OF SAME. Walter H. Tallant If A.
