173 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL O1' THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON THE 9th DAY OF JUNE A. D. 1930 AT THE HOUR OF 9 o'clock P. M. Mayor Hammerl Called the meeting to order with Alderman Collet, Ahbe, Heesch,• Buster, Kinder, Ochlagel, Lacey, Wettin, Knabb and Enzenbacher answering to roll call. Mayor Hammerl stated this was a special meeting of the City Council being held by the unanimous consent of all members for the purpose of considering a report of the Finance Committee regarding the question of tax forfeited lots. The Finance.Committee submitted the following report: Des Plaines, Illinois June 9th, 1930 To the Mayor and City Councils Your Commiittee on Finance considered the Tax Forfeitures in the City of Les Plaines and found it very necessary that all the delinquent lots be foreclosed and put on a Tax Paying Basis. We, your Committee on Finance, therefore recommend$ That Mr. D. B. Maloney be employed to enter these foreclosures. Signed, Committee, Henry Heesch, Hobart M. Ahbe. G. M. Enzenbacher Alderman Knabb moved that the report of the Finance Committee be accepted. Alderman Enzenbacher seconded this motion and consider- able discussion followed. Alderman Kinder was not in favor of going any further with the matter until an agreement was reached with the other taxing bodies relative to the part they were to pay in the cost of cleaning up these lots. Attorney Maloney stated that the cost no doubt would be around $20,000.00 and that in River View Section alone there were three -hundred and forty-six (346) of these delinquent lot*. Mayor Hammerl stated that this condition was hurting the sale of our bonds and that Bond Attorneyfs had stated that only the cleaning up of these delinquent lots would help the situation. Following all this discus* sion the following Resolution was presented to the Councils - RESOLUTION NKEREAS the records of the county Treasurer and the Recorder's office of Cook County, aswell as the records of the City Collector of the City of Des Plaines, show various lots, blocks, and parcels of property in the City of Des Plaines to be forfeited for non- payment of taxes and special assessments; and, IR REAS by reason of the said forfeitures of record, the City of Des Plaines is not receiving any revenue by way of taxes from the said property and the income from taxes of the City of DesPlaines is being lessened by reason of the said condition, and the expense on all tax payers of the 'ity is being increased, and by reason of the many forfeited lots in the said City, that in add- ition certain special assessments have been levied against the property which is now forfeited and the said forfeited lots are causing a deficiency in the said assessments and are generally causing damage to the City of Des Plaines; WHEREAS the City of Des Plaines has heretofore caused an, ex- amination of: the titles to be made on said Lots and has received a letter on December 18,1929 from David B. Maloney agreeing to take the necessary legal steps in the handling of the said fore- closure proceedins in court including the entry of decree and handlingof all proceedings up to the sale of the property for the sum of 35.0© per lot, the City to pay all the costs of title ex- aminations and other incidental expenses. WHEREAS it is to the best interest of the City of Des Plaines that the said lots be foreclosed and title cleared and. that the said David B. Maloney is capable of and equipped to handle the said proceedings; WHEREAS, David H. Maloney is not an officer of the City of Des Plaines, but is acting as attorney for the City of Des Plaines in accordance with the directions of the Mayor and City 'ouncil of the City of Des Plaines; RE IT, THEREFORE, RESOLVED that the proposition of David B. Maloney to handle the foreclosure proceedings of forfeited lots in the City of Des Plaines, be and the same is here by accepted. BE IT FURTHER RESOLVED that the City of Des Plaines pay to David B. Maloney the sum of $35.00 per lot for all forfeited lots foreclosed when all of the legal proceedings have been Completed and sale properly had. This resolution shall be in full force and effect from and after its passage and the approval hereof. PASSED this 9th day of June , A. D. 1930. AYES: Nine NAYS: One APPROVED this 9th day of Tune , A. Alderman Enzenbacher moved that the resolution be passed as read Alderman Collet seconded this motion and the roll was called with the following result: (Ayes) Alderman Collet, Ahbe, Heesch, Suste-r, Schlagel,Lacey, Wettin, Anabb and Enzenbacher, Alderman Kinder voting Naye. Whereon the Mayor declared the motion carried and the resolution passed as read. Attorney Maloney brought up the matter of making a bond call and also thematter of passing a general obligation to take care of judgements and the over -draft in the Cities accounts. Following some discussion regarding these two matters,Alderman Knabb moved that the Finance Committee be instructed to investigate the above matters and bring in a report at the next regular Council meeting. Alderman Lacey seconded this motion and the same carried by vote of acclamation. There being no further business to come before the Council at this time on motion of Alderman Enzenbacher, seconded by Alderman Knabb and carried by unanimous vote the Council adjourned.
