MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, HELD IN THE COUNCIL CHAMBERS ON THE 2ND DAY OF DECEMBER, AT THE HOUR OF 8100 O'CLOCK P.M. Mayor Hamrnerl called the meeting to order with Aldermen Collet, Ahbe, Heesch, Suster, Schlagel„ Lacey, Schroeder, Kinder, Knabb and Enaenbacher answering to roll call. Alderman Schaigel moved that the minutes of the regular meet- ing held November 18th 1929 be approved as written. Alderman Collet sec- onded this motion and the same carried by vote of acclamation. The monthly report of the Police Department covering activities for the month of November 1929 was read and refered to the Police & Lic- ense Committee. The report of the City Collector covering collections up to and including November 15th 1929 was read and refered to the Finance Com- mittee. The Police and License Committee had no report to make at this time. Alderman Schroeder as Chairman of the Building and Plates Com- mittee,, brought up the matter of the permit on the Mennen Building and the matter was laid over to be taken up after the regular Council meeting. Alderman Schlagel presented a Plat and discription of the pro- possed new Fire Limits. The matter was refered to the City Pian Comm- ission for approval. Engineer Jenkins submitted a report on the Margaret Street. sewer and the matter was refered to the sewer Drainage and Sanitation Committee and the Superindent of Public Works for their action. Alderman Enzenbacher reported that the damaged sidewalk on Prospect Avenue had been taken care of by the LaVonte Grocery Company. Alderman Schlagel brought e<p the matter of the Stop Signs on Prairie Avenue and after considerable discussion he moved that the signs be removed from Laurel Avenue, Vebford Avenue, Parsons Avenue, and Arl- ington Avenue. Aldermen Kinder ammended the above motion to include all Stop Signs except on State Highways. Alderman Enzenbacher seconded this motion and the roll was called with the following result. (Ayes) Alder- men Kinder, Schlagel, Knabb, Enzenbacher and Ahbe. (Nays) Aldermen Collet, 'Heesch, Suster, Schroeder and Lacey. The vote being a tie the City Clerk requested the Mayor to cast his vote which he did Oy toting bay and de- claring the motion as lost. • Alderman Enzenbacher moved that this matter be refered to the Police and License Committee for a report at the next Council meeting, Alderman Knabb seconded this motion and the same carried. Alderman Collet brought up the matter of driving over sidewalks with material and Supplies for new Buildings and questioned the amend- ing of the Code to cover this matter. After some little discussion the matter was refered to the Streets and Sidewalks Committee for a report at the next regular meeting. Alderman Schlagel brought up the matter of having the City Engineer prepair an Atlas of the City during the winter months. After some discussion regarding the form to be used alderman Schlagel moved that the Engineer be instructed to set up a few sample sheets and present them with cost of same to the City Council for its consideration. Alderman Knabb seconded this motion and the rola, was called with the following res.- ult. "`Ayes" Collet, Ahbe, Heesch, Suster, Kinder, Schlagel, Schroc: er, Lacey, Knabb and enzenbacher. None voting '"Nay" the Mayor declared the motion carried. Considerable time was spent here in discussing the matter of the .completion of the Mennen building The question of changing the iurilding line, and also the matter of allow- ing the building to be pat under roof following which the question of the garage would be decided was discussed at length. The matter was firmly disposed of without any official action. Alderman Collet brought up the matter of the moving the mush- room lights from the Street Intersections. This question and also the question of marking the parking space along the curb lines.'as discussed at length and refered to the Street Committee for a further report. The following letter from the Public Service Company was read at this timet - 911 Church Street Evanston, Illinois November 21, 1929. City of Des Plaines Des Plaines, Illinois C-entlement it has been called to my attention that several of the Dee Plaines street lighting accounts are consider- ably in arrears. I feel that our Company has been very considerate in carrying your accounts thus, far and it, is only logical that we should expect the same consideration from you. Our Mr. McCollum was recently informed that the City of Des Plaines is in a position to obtain money through the sale of Tax Anticipation 'garrants. 1 trust that you will endeavor to make a sub stantial payment on the delinquent street lighting acc- ounts prior to December 1st so as to permit us to include it in closing our business for November. Alderman Heesch as Chairman of the Finance Committee moved that $800.Q0 be transfered from the Judiciary and Assessment Fund to the Streets and Sidewalks Yund with the understanding that same was to be returned as soon as money was available in the Streets and Sidewalk Fund. Alderman Schlegel seconded this motion and the roll Was called With the following result. *Ayes* Aldermen Collet, Ahbe, leesch, Stutter, Kinder, Schlagel, Schroeder, Lacey, Knabb and Enzenbacher. None voting 'Kay" the Mayor declared the motion as carried and directed the transfer be made. The following letter from the city Engineer was read at this time. fir.Henry- Heesch Charman, Finance Committee Des Plaines City Council Des Plaines, Illinois Dear Sir s - 43 December 2, 1929 In making up the final, estimate on Cumberland paving, Wa rrant f140, I have included the amount of Five Thousand Six Hundred Dollars (45600.00) for maintenance of light standards, bonds for which will De issued to the contractor; he will sell them at the market price and return the cash to t*e city or to such trustee as the city Council may appoint for that purpose. Under the terms of the agreement *Lth the owners of the eubdiviaion, this money is to only be used for lighting the streets for as long a period of time as the money will last. Warrant 4/140 Cumberland Pavement 15,600.00 at not less than 9b 6,520.GO Very sincerely, Carter Jenkins Engineer for City of Des Plaines The Clerk was instructed to return the letter to the City Engineer and request that the smatter be taken up with the contractor and the Public Service Company direct. The following letter from the City Treasurer was presented and read. Dee Plaines, ill. November lath, 1929. To The Honorable Payor and City Council, Des Plaines, 111. C entiemen s M 1 have heretofore assured you, I desire, in the con- duct of my office, to cooperate with you in every possible way. I also, of course wish to comply with the statutes of the State of Illinois insofar as they relate to my office. I am advised that the statute provides that the city treasurer may be required to Keep all moneys in his hands, in suds place or places of deposit as may be designated by ordinance, and that the bank or banks in which such moneys are deposit, aihould give bond in such sum, and with such security as the city council shall direct, sufficient to sale the municipality from any loss, which sum shall not be less than the estimated receipts for the current year from taxes and special assessments levied, or to be levied, by the municipality. In view ofthe foregoing provision of the law, I now ask you, by ordinance, to designate the place or places of deposit, and to fix the amount of the bond and the security to be furnished by the bank or banks so designated, and assure you that when such ordinance is passed, its provisions will be strictly complied with by me. Martin A. Behrens City Treasurer Following the letter Alderman Heesch presented the following Ordinance for First reading. AN ORDINANCE DESIGNATING AN OFT/GILL DEPOSITORY FOR THE CITY 07 DES PLAINES. Alderman Heesch moved that the Ordinance be put on for passage. Alder- man Collet seconded this motion and the roll was called with the foll- awing result Nkpm* Aldermen Collet, Ahbe, Heesch, Schlagel, Suster, Kinder, Schroeder, Lacey, Ehabb and Enzenbacher. None voting "lay* the Mayor declared the motion carried. Alderman Knabb moved that the Ordinance be passed as read. Aldeonsit Heeseh seconded this motion and the roll was called with the following result. Aldermen Collet, Ahbe, Suster, Heesch, Kinder, Schlagel, Schroeder, Lacey Knabb and Enzenbacher. None voting *Nay* the Mayor de- clared the motion carried and the Ordinance passed as read. The City Clerk then read the bond presented by the First Nat- ional Bank as the OffiCal depository and after some discussion the bond was refered to the finance Committee to be returned for corection. Cor- ection to include deposits of both the City Treasurer and City Collector. The following letter relative to out standing bonds on special Ko. 12 was*presented at this time Des Plaines, 111. December 2nd, 1929. Mr. F. O. Merrill City Clerk, Dear Sirs The following is a description of the outstanding in Special Number 12: Bond #2 Series 4 Dated April 16 1907 $500. Bond due December 1st 1912 has the unpaid coupon attached, so that in addition to this coupon for $25,00 there is due the interest from December 1st 1911 on $700.00 and interest from December lst 1912 at 5%, on $700.00 These bonds as Speoial Assessment #12 for the purpose of improving water mains in ira Browns Subdivision, and are signed by David J Gillespie as Village Clerk and. L. V. Schar- ringhausen, kresident. These bonds are held by F. R. Phelps an official of the First Bank of Harvard, lii. I have had a talk with Mr. Phelps and the reason that the matter was not pushed very much was on account of this being held in trust by Mr. Phelps as Trustee for one of his relatives. I MIPS 116 A. The Clerk was instructed to refer ' the matter to the City Attorney. The following letter was presented and read at this time. November 22nd, 1929. Des Plaines Library#aard, Des Plaines, Illinois. Gentlemen:- Att'n Arthur Webster - Pres. I hereby tender my resignation as member of the Des Plaines Library Board on account.of going to California to live. The same to take effect at once. Sincerely yours, Laura Bro bs t. Alderman Schlagel moved that the resignation be accepted. Alderman Collet seconded this motion and the same carried by vote of acclamation. Alderman Heesch as Chairman of the Finance Committee presented the Following Resultion. RESOLVED THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AUTHORIZED TO ISSUE THE PROPER WARRANTS ON THE CITY TREASURER IN PAYMENT OF THE SAME. None voting "Nay* the Mayor declared the motion carried, the resultion adopted and further directed that the proper Warrants be issued. There being no further business to come before the City Council at this time no motion duly made, seconded and carried'the meeting adjourned
