MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL, CITY OF DES PLAINES, ILLINOIS
HELD IN THE COUNCIL'CHAMBER, MONDAY, DECEMBER
1, 1952, at 8:00 P.M.
CALL TO ORDER The meeting was called to order by Mayor Kenneth
G. Meyer who presided with Alderman Hansen, Wolf, Tures, Behrel, McKay,
Morava, and Auck responding to roll call.
APPROVAL 01 MINUTES. The motion was made by Alderman Morava
and seconded by Behrel to approve the minutes of the adjourned meeting
of November 10, and rerular meeting of November 17, 1952. The motion
was voted upon by acclamation whereupon the Mayor declared the motion
carried.
Mr. Don Hansen a representative of the Chicago Motor Club
presented the council members with copies of a Parking Survey which
their Safety and Traffic Engineering Department had made. He informed
the Council to call upon them for any additional information.
Official reports. The City Clerk submitted the monthly report
of Building Inspector.
Alderman Behrel reported he had the contracts for the North
and South Maine Fire Districts but that due to some changes desired to
refer the contracts,to the City Attorney for his approval: On motion
by Alderman Behrel and second by Hansen they were so refered.
On motion by Alderman Behreland seconded by Auck the item
regarding red flasher lights for school children at Wolf and Thacker
Streets, Algonquin and Center Streets, and on Des Plaines Avenue near
Perry Street, was refered to City Engineer. On motion by Alderman Behrel
and second by Auck the item of traffic lights at Lee and Thacker Streets
was refered to City Engineer.
The Council discussed bus service with Mr. Schuemann of the
Motor Coach Co. for about half an hour and then requested to have some
changes made in route.
Adopt Sanitary District Ordinance. The Clerk read for second
reading the following proposed ordinance entitled:
AN ORDINANCE
The motion was made by Alderman Auck and seconded by Behrel to adopt
the proposed ordinance. The Mayor put the question and the Clerk called
the roll with the following result: Ayes: Alderman Hansen, Wolf, Tures,
Behrel, McKay, Morava, and Auck. Nays: None. The Mayor thereupon
declared the motion carried.
Adopt Jeannette - Van Buren Paving Ordinance. The Clerk read
for second reading the following proposed ordinance entitled:
AN - ORDINANCE FOR THE CONSTRUCTION OF A HARD SURFACED
ASPHALT STREET ON VAN BUREN STREET AND JEANNETTE AVENUE
IN DES PLAINES, ILLINOIS, INCLUDING CONCRETE CURBING,
GUTTERS AND NECESSARY APPURTENANCES THERETO.
The motion was made by Alderman Behrel and seconded by Auck to adopt
the proposed ordinance. ihe Mayor put the question and the Clerk called
the roll with the following result: Ayes: Alderman Hansen, Wolf, Tures,
Behrel, McKay, Morava, and Auck. Nays: None. The Mayer thereupon declared
the motion carried and the proposed ordinance adopted.
Ado t traffic ordinance, Graceland and Miner Streets. The
Clerk read for first reading the following proposed ordinance entitled:
AN ORDINANCE TO PROVIDE FOR PARKING METERS
ON GRACELAND AVENUE.
The motion was made by Alderman Behrel and seconded by Hansen to suspend
the rules and adopt the proposed ordinance. The Mayor put the question
and the Clerk called the roll with -the following result: Ayes: Alderman
Hamsen, Wolf, Tures, Behrel, McKay, Morava, and Auck. Nays: None. The
Mayor thereupon declared the motion carried. The motion was then made by

Alderman Behrel and seconded by Hansen to adopt the proposed ordinance.
The Mayor put the question and the Clerk called the roll with the
following result: Ayes: Alderman Hansen, Wolf, Tures, Behrel, McKay,
Morava, and Auck, Nays: None. The Mayor thereupon declared the Motion
carred.
First reading parking,.ordinance Jefferson Street. Ihe Clerk
read for first reading the following proposed ordinance entitled:
AN ORDINANCE TO RESTRICT PARKING ON JEPTLRSON STREET
The Mayor ordered the proposed ordinance placed on file for second reading.
Adopt parking meter ordinance for parking lots No. 1. and No. 4
read for first reading the following proposed ordinance:
AN ORDINANCE TO PROVIDE FOR THE INSTALLATION OF PARKING
METERS IN THE GRACELAND AVENUE AND WEBFORD AVENUE PARKING
LOTS.

The motion was made by Alderman Hansen and seconded by Behrel to suspend
the rules and adopt the proposed ordinance. The Mayor put the question
and the Clerk called the roll with the following result: Ayes: Alderman
Hansen, Wolf, Tures, Behrel, McKay, Morava, and Auck. Nays: None. The
Mayor thereupon declared the motion carried. The motion was made by
Alderman Behrel and seconded by Auck to adopt the proposed ordinance.

With reference to your question about the neer of signatures
necessary on aldermanic petitions in view of the revision of the ward
boundaries, I should like to report as follows:
While all of the law on this subject is supposed to be
statutory, I find nothing in the statutes that covers our present situation.
The Cities and Villages Act in the various sections on aldermen and on
redistriction for additional wards are silent on the subject. The Elections
Act only says the following:
".... Not less than 5 nor more than 8% of the number
of voters who voted at the next preceeding election
in such district of political subdivision
Obviously, if such "district or political subdivision" such as any one
of the new wards in Des Plaines did not even dxist the preceeding
general election, this section is of no help.
I checked with the City Clerk and City Attorney Stoeffels
of Park Ridge, who of course had the same situation several years ago.
Attorney Stoeffels verified my own conclusion that the statutes do not
adequately cover the situation. Park Ridge solved the problem as follows:
The City Clerk and the City Attorney met with the representatives
of each of the two Park Ridge political parties and they estimated the
population of the new wards. The estimate was relatively easy to arrive
at in Park Ridge by reason of a school census that had just been taken
which gave a reasonably accurate estimate of each neighborhood. After
fixing the population of dach ward they then arrived at what might have
been the number of voters by applying the same percentage of voters to

the population as existed in the old wards. This figure then was taken
as the base figure against which the 5% to 8% for nominating petitions
was applies. All parties concerned than entered into an unofficial agreement
that no charge of invalidity would be made by any one of them by reason of
technical defect in the number of signers to the nominating petitions.
I did not ask Attorney Stoeffels of Park Ridge at the time
whether the figures were ever validated by a resolution of the City
Council. I am not sure at this moment whether it would be better or
worse for the City Council to establish the figure by resolution. Whether
or not we do, I would suggest thatlthe Park Ridge plan be followed,
for lack of any better plan.

maximum of 50 names and a minimun of 32 names for each of the seven
wards for petitions of nominations.
Attorney Howard letter on Memorial Park tat title. The Clerk
read a letter from the City Attorney regarding the request of Des Plaines
Park District to turn over the tax title of Memorial Park. The Mayor
instructed the attorney to prepare a notice of bid for sale for Memorial Park.

This has reference to your letter of November 18, 1952 concerning the
use of Algonquin Road by carriers operating in interstate commerce.
If it is pollicle for carriers entering your city on Algonquin Road
to use other streets which would enable them to again leave the city
on Algonquing Road, there is nothing to prevent proceedings initiated
by your City government todesignate streets which could be used by
driers while operating through Des Plaines, Illinois.

Your Zoning Board of Appeals, sitting as a commission, had referred to
it the application of the Herzog Construction Company to rezone the
following described real estate from its present classification residence
District Area A to Commercial District G, to wit:
The Northerly Two Hundred Sixty and 25/100 (260.25) feet
of the West Half (W-) of the Northeast Quarter (NEe) of the
Southeast Quarter (SE+) of Section Nineteetl(19), Township forty -One
(41) North, Range Twelve (12) East of the Third Principal

considered the evidence and being fully informed of the premises on a
vote of five for the change and none against the change in the ordinance,
therefore recommends to the Mayor and City Council that the proposed
amendment to the Zoning Ordinance hereinbefore described, be adopted.

Zoning Board - Algonquin & Wolf Roads Cont.
After discussion on motion by Alderman Behrel and seconded by Morava the
report was concurred in and the City Attorney instructed to draft the
proper ordinance. On motion by Alderman Hansen and seconded by Behrel
the City Attorney was instructed to draft a set -back ordinance for the
above property.
Request to rezone on Prairie Avenue at Laurel. The City Clerk

The Des Plaines Traffic Commission offers the following
recommendations to the City Council:
We reeammend that since the parking lots No. 1 and 4 are
now available for use that a two-hour parking restaictionbe created
on both sides of Lee Street from Prairie Avenue south to about the
Luthernan School Property.
We recommend the removal of signs designating two-hour
parking restrictions on Jefferson Street between Graceland Avenue
and Lee Street. We believe that this restriction is not warranted
and that the motorists will merely move their cars another block to a
marrower street, creating an additional hazard in another location.

The Mayor refered the letter to the Street Committee to consider with
the survey from Motor Club.
Chicago Sanitary District Sewer Permit 1952-154. The Clerk
reported he had a sewer permit from the Sanitary District regarding
sewer at Algonquin and Wolf Roads. On motion by Alderman Auck and second
by Morava the Council approved the execution by Mayor and City Clerk.
Division Highway Maintenance Agreement flasher light on Mannheim
near Everett. The Clerk informed the Council he had received an
agreement from the State Highway Dept. for the City to pay for the
electrical energy used in operation of flashing beacon. On motion
by Alderman Auck and secon by Behrel the Mayor and Clerk were authorized
to execute the agreeiient.
Alderman Behrel requested to have the request of some people
west of Mt. rrospect Rd. on Algonquin Rd. to be included in a fire
district with our City. They are in a alt. Prospect fire district at
present and Alderman Behrel desires legal information regarding same.
The question if Des Plaines would give fire department service west of
Mt. Prospect Road is to be decided after information is received.
The Clerk was instructed to write to the Protective Coatings
Corporation and Forest Trailor Park that they were not in a fire district
and would not receive fire service from the Des Plaines Fire Department
after December 31, 1952.
Fire Department Service for Benjamin Electric after December
31, 1952. was refered to the Public Protection Committee.
On motion by Alderman Tures the City Clerk was instructed
to advertise bids for two panel trucks for the Water Department with
Superintendent Warnicke to submit specifications.
Richard G. Arthur appointed fireman December 1, 1952. The
City Clerk informed the Council he received information from the
Secretary of the Board of Fire and Police Commission that Richard G.
Arthur was appointed fireman, Ray Kolze permoted to Captain and Fred
Arndt to Lieutenant to take effect December 1, 1952
Alderman McKay requested that City Clerk write or phone the
president, secretary, and treasurer of the Nurse & Welfare to appear
at the meeting at 7:30 P.M. Friday, December 5, 1952, regarding appropriation.
ADJOURNMENT. The motion was made by Alderman Hansen and second
by Behrel to adjourn to Monday, December 8, 1952, at 8:00 P. M. The
motion was voted upon by acclamation whereupon the Mayor declared the
motion carried and the meeting adjourned to December 8, 1952 at 8:00 P.M.
