ROLL CALL. The meeting was called to order by Mayor Kenneth
G. Meyer; who presided with Alderman Hansen, Davis, Wolf, Behrel, Schallawitz,
McKay, Morava, and Auck responding to roll call.
APPROVAL OF MINUTES. The motion was made by Alderman Morava and
seconded by Hansen to approve the minutes of the adjourned meeting September
29, 1952 and the regular meeting of October 6, 1952. Alderman McKay requested
a correction on zoning report. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried and the minutes approved with correction made.
Attorney M. S. Howard's report on cgntractors license. The Clerk read

Gentlemen:
Some time ago I was asked to prepare a general licensing ordinance
which would license all forms of building contractors and sub -contractors.
At the following council meeting I advanced my opinion that such
an ordinance would be invalid and void if challenged. It was then stated
that it was the practice in many other municipalities to se license building
contractors in such a manner and I was asked to check the practice in
adjoining municipalities and recheck the lsw on this subject.
I have discussed the matter both with the city attorney of Park
Park Ridge, the Village Attorney of Mount Prospect and the attorneys of a
number of other municipalities. It is perfectly true that both of our adjoining.
neighbors,;; Mount Prospect and Park Ridge, require a license from all
types of building contractors and sub -contractors. It is also true, however,
that both the City Attorney of Park Ridge and the Village Attorney of Mount
Prospect agree with me that sone of the licensing ordinances, if not all
of them, would be invalid if challenged.
A recheck on the law on my own part verifies my previous opinion
that such ordinances would be substantially invalid if challenged.
I shall, of course, be glad to prepare such an ordinance if
specifically requested. It would seem to me, however, that the better
practice would be to discuss with the neighboring municipalities an agreement
to eliminate invalid licensing for mutual benefit, rather than to follow
suit of the others and enact. ordinances which we believe in advance to be invalid.
I shall await your further instructions in the matter.

After discussion the item was tabled.
Alderman Behrel reported regarding the vacating of an alley in
block 12 cumberland and made the following recommendation:
Your Municipal Development Committee recommends, by majority vote,
that upon receipt of satisfactory evidence that lots 1 to 16 inclusive and
lot 48 in block 12 in Cumberland subdivision have been acquired by the American
Foundrymen's Society as a site for its modern office building and upon dedication
to the City of Des Plaines to be used for alley purposes of a strip 20 feet wide
along the southerly side of lot 48, that the City of Des Plaines vacate the alley
extending southerly from State Street between lots 4 and 3-48. The dedication of
the 20 foot strip of lot 48 above referred to will provide adequate turn -around
space at the rear of lots 45, 46, and 47, will remove the irregularly-shaped alley-
end at that location, and should off -set any objection which might arise because of
the creation of a dead-end.

The motion was made by Alderman Behrel and seconded by Hansen to concur in
the report. Alderman McKay requested a roll call. The Mayor put the question
and the Clerk called the roll with the following result: Ayes: Alderman
Hansen,Wolf,Behrel, Schallawitz, McKay, Morava, and Auck. Alderman Davis
passed. Nays: None. The Mayor thereupon declared the motion carried.
Alderman Behrel reported on t}e Park Ridge Manor and Hawthorne-
Baand Fire Contractors. The motion was made by Alderman Behrel and seconded
by Hansen to authorize the Mayor and City Clerk to execute the contracts- after
the two districts' officials had signed. The Mayor put the question and
the Clerk called theroll with the following result: ayes: Alderman Hansen,
pavis, Wolf, Behrel, Schallawitz, McKay, Morava, and Auck. Nays: None.

Alderman Schallawitz-t,reported on the letter from G. W. Prassis & C0%
requesting to amend the liquor license ordinance and grant them a license.
The license committee recommended that there is no license available at the
present time and do not wish to amend the present ardinance. On motion by
Alderman Schallawitz and seconded by Behrel the report was concurred in.
A_ lderman Hansen reported on the p diking at ijbrary and Jeff z'son St.
The motion was made by Alderman Hansen and seconded by Davis -that meters
be installed on the east side of Graceland Avenue from Miner Street to Jefferson
Street with 30 minute parking, meters be installed on the south side of
Jefferson Street and Park Place from Graceland Avenue to Lee Street with
one hour parking, two hour parking on the north side of Jefferson Street
from Graceland to Lee Street and that parking meters be purchased and installed.

Ordinance on Arlington Avenue tabled. The Clerk read for second
reading the following proposed ordinance entitled;
AN ORDINANCE TO RESTRICT PARKING ON A PORTION OF LAUREL
AVENUE AND ARLINGTON AVENUE.
On recommendation of Alderman Behrel and Schallawitz the ordinance was tabled.
Adopt Ordinance on reflecting tape for bicycles. The Clerk read
for second reading the following proposed ordinance entitled:
AN ORDINANCE AMENDING SECTION 21 OF ARTICLE VIII
RELATING TO BICYCLES IN THE TRAFFIC CODE OF THE
CITY OF DES PLAINES, AS HERETOFORE AMENDED.
The motion was made by Alderman Schallawitz and seconded by Behrel to adopt
the proposed ordinance. The Mayor put the question and the Clerk called the
roll with the following result: Ayes: Alderman Hansen,oDavis, Wolf, Behrel,

declared the motion carried.
Adopt Thacker St. no parking ordinance. The Clerk read for

The motion was made by Alderman Hansen, and seconded by Behrel to adopt the
proposed ordinance. The Mayor put the question and the Clerk called the

that the train crews would be instructed to avoid blocking Golf and Wolf Roads
crossing.
The Clerk read a rsp],y letter from the Sanitary District of Chicago
regarding the damage to Columbia Avenue by trucks used on installing intercepting
sewer that they have informed Healy Bros. & Co. the Contractors about the damage.

The City Ledger has an item of 1943 and prior taxes receivable
a total of $182,330.58. I'believe this is a flase asset and that all but
then percent should be removed from: the ledger. The amount remaining
would be $18,233.06.
The City hasieeeived 89 percent plus on 1944 and 1945 taxes.
Therefore, I request permission to remove a total of $164,097.52
of 1943 and prior taxes.

relative to the property located at the intersection of Pearson and Des
Plaines Avenue, and commonly known as Memorial Park. An examination of the
recorder's records discloses that the City,of Des Plaines acquired a tax
title to these premises and the Park District as for many years last past,
maintained the Park.
Inasmuch as the obligation of maintaining these grounds has been
a Park obligation, request is made that the city convey its title to the
Park board so that the title and operation will vest in the Des Plaines
Park District. Your earliest consideration of this matter will be appreciated.

The Mayor refered the ordinance to the Municipal Development Committee.
Resignation of Mrs. Ruth F. Lueck from Library Board. The Mayor
informed the Council that Mrs. Ruth F. Lueck had requested her resignation
and recommended Mrs. R. H. Morehart, 850 '!hacker Street to succeed her to
that office. On motion by Alderman Hansen and seconded by Behrel the resignation
was accepted and the appointment approved. The Clerk instructed to write a
letter to Mrs. Lueck.
Agreement between Ma City of Des Plaines And Henning Animal
Hospital Ism boarding dogs. Alderman Wolf, Chairman Of Public Buildings Committee
presented an agreement for boarding dogs, which ere pinked up by dog catcher,
between the City of Des Plaines and Harmening Animal Hospital. On motion
by Alderman Wolf and seconded by Hansen the Mayor and Clerk were authorized
to execute the agreement.
Howard Clement was granted permission to speak regarding Meyer Coal
& Material Co. considering erecting another cement mixing hopper. -On motion
by Alderman Behrel and second by Auck the City -Attorney, was instructed to
amend zoning ordinance considering the above hopper Heavy Industry.
Alderman Hansen reported about parking on narrow streets, suggesting
the parking on one side of the street on even street numbers on even year number
and changing to the odd numbered side of street on the odd numbered year.
The Mayor refered the parking to the Street Committee, City Engineer and Superintendent
of Public Works to check on the narrow streets.

The law is very strict in regard to the One Year and the Five Year
Programs and no work can be done with Motor Fue3.: Tax Funds unless it has been
included in these programs. The selection of the Five Year Program should be
given serious thought by not only the street committee but by the entire, council.
For your guidance I have selected the following work which I recommend
we include in the Five Year Program;

The Mayor suggested that tree trimming and lights in the residential areas should
be included. The report was refered to the Street Committee.
Fire Marshall -Ray Kolze reported that there were 106 fire calls in
October and 15 so far for November and suggested that the Mayor issue and ultimatum
that there were to be no rubbish fires during the present dry weather. The Mayor
said he would issue the ultimatum.
Attorney to draft ordinance vacating a part of Birchwood Avenue4
The Clerk read the following report of the Plan Commission
Your Commission on City Planning: -has investigated the above and has found:
The dedicated half street known -as Birchwood Avenue, serves no useful
purpose west of lot 9 in Welwyn Subdivision, and that development west of Cedar
Street, precludes the possibility of ever extending this street westward,
Development of the area to the north of Birchwood ave, indicates that lots will
be oriented in a different manner, and will not use Birchwood Avenue as a means
of access:.
We, your Committee on Planning, therefore recommend:
That Birchwood Avenue be vacated westward from a line extended
northward, which line is the common boundary between lots 8 & 9 in Welwyn
subdivision. The area to be vacated is shown in red on the -Plat attached hereto.

Alderman McKay reported that he had informed the City Clerk to write
a letter to the county zoning Board objecting to the rezoning for a chemical
plant on Howard Avenue, near Mt. Prospect Road. On motion by Alderman McKay and
seconded by Morava the Council approved the action of the Clerk writing the ]s ttet.

Alderman Hansen reported about meters on parking lots one endAtwo.
On motion by Alderman Tures and second by Morava the Council approved for parking.
lot No. 1, two hour parking at five cents and hour and one cent for twelve minutes.
On motion by Alderman Wolf and seconded by Morava the council approved for parking,
lot No. 4 ten hour parking with maximum of twenty five cents, and with four hours
at five cents for each two hours. The Mayor instructed City Attorney to draft
ordinances. for the above,
On motion by Alderman Hansen and seconded by Morava it was approved
to modify the ordinance that $sere be no meters on Jefferson Street.
Alderman Davis requested that an application for two large signs
be refered to his committee.
Alderman Davis requested that the City Clerk write t� the Chicago
and Northwestern Railway regarding the smoke from locomotives in the morhiat
from side track.
Alderman Davis and McKay spoke about the mosquito abatement, and it
is to be considered in the 1953 appropriation Ordinance.
Alderman Davis and McKay reported on the meeting with a representative
of the Insurance Brokers Asstn. They reported that they received a satisfactory
report and that were to receive some suggestion on insurance.
Pass Laurel Avenue Parking Ordinance. Alderman Behrel read for first
reading the following proposed ordinance entitled:
AN ORDINANCE TO RESTRICT PARKING ON A PROTION OF LAUREL AVENUE.
The motion was made by Alderman Hansen and seconded by Behrel to suspend the rules
and adopt the proposed.ordinance. The Mayor put the question and the Clerk called
the roll with the following result: Ayes: Alderman Hansen, Davis, Wolf, Tures,
Behrel, Schallawitz, McKay, and Morava. Nays: None. The Mayor thereupon declared
the motion carried and the proposed ordinance before the Council for adoption. On
motion by Alderman Wolf and seconded by McKay the p oposed ordinance was amended
to three hour parking. The motion was made by Alderman Hansen and seconded by
Behrel to adopt the proposed ordinance. The Mayor put the question and the Clerk

Bouton Foster sub. -lease. The Clerk read the follwoing letters

Gentlemen:
There has been turned over to me a lease in triplicate between
Bouton Foster Company and William H. Banks Warehouse, Inc., providing for the
sub -leasing by the said Bouton Foster Company to the said Banks Warehouse of the
entire warehouse building at the rear of 1856 Miner Street, which Bouton -Foster
rents from the City.
,I know nothing of the circumstances of the sub -leasing, but both the
Bouton -Foster Company and the Banks Warehouse Company have asked that the City
execute its agreement to the sub -lease. The sub -lease provides for storage only-
for
nlyfor a nominal rental and gives vary little other inforiztion. The agreement
to the sub -lease which they request the City of Des Plaines to sign does specifically
say that nothing in the agreement of sub -lease shall release the Bouton -Foster Co.
from any of the terms or conditions of their lease with us.
The Bouton Foster Company -have asked me to submit this for your
approval tonight, if possible.

Saintary District of Chicago Sewer Permit. The Clerk informed the
Council he had a sewer permit for Howard and Des Plaines which was requested by
Engineer Fletcher. On motion by Morava and seconded by Davis the Mayor and Clerk
were authorized to execute the permit.
Alderman Davis suggested that a yellow blinker light be installed on
Northwest Highway at Cumberland Station. On motion by Alderman Davis and second
by McKay the item was refered to the City Engineer Fletcher.

Alderman McKay reported of a meeting with a representative of the Middle
States Telephone Co. regarding a new franchise. Be said the Alderman were not
satisfied with the franchise and would meet again.

Mayor Meyer reported on a letter he received from the Commuters Ass'h.
of Chicago regarding their opposing the increase of railroad fares. The City of
Park Ridge contributed $250.00 and the Association desired Des Plaines to contribute.
The Mayor thought it may be illegal for the City to contribute and thought the
people interested should organize to get funds. He requested the local. papers to
give publicity to same.
Motion to Adjourn. The motion was made by Alderman Morava and seconded
by Davis to adjourn to Monday November 10, 1952, at 8:00 P.M. The motion was
voted upon by acclamation whereupon the Mayor declared the motion carried and
the meeting` ad j ourned to Monday November 10., 1952.

The Council discussed several chapters of the code.
Adjournment. The motion was made by Alderman Auck and seconded by
Behrel to adjourn. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried.

Call to Order. The meeting was called to order by Mayor Kenneth G.
Meyer who presiced with Alderman Hansen, Davis, Wolf, Tures, Behrel, Schallawitz,
McKay, Morava, and Auck responding to roll call.
Approval of Minutes. The motion was made by Alderman Hansen and seconded
Morava to approve the minutes of the adjourned meeting October 16 and 27, 1952
and the regular meeting of November 3, 1952. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried.
Reports of Officials. The Clerk submitted the report of City Treasurer
for October, 1952.
Approval of bills. Alderman McKay Chairman of the Finance Committee
presented the following proposed resolution:
BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DES PLAINES THAT THE FOLLOWING
BTLLS ARE DUE AND PAYABLE AND THAT THE
MAYOR AND CITY CLERK BE AND ARE HEREBY
AUTHORIZED TO MAKE PAYMENT FOR SAME.

and on file with Cith Clerk.) The motion was made by Alderman McKay and seconded
by Morava to adopt the proposed resolution. The Mayor put the question and the
clerk called the roll with the following result. Ayes: Alderman Hansen, Davis,
Wolf, Tures, Behrel, Schallawitz, McKay, Morava and Auck. Nays: None. The
Mayor thereupon declared the motion carried.
