The Clerk read a petition from property owners on Linden Street regarding the condition of street. It was refered to Superintendent Warnicke. Sanitary District Sewer Permit 1952-67-68. The Clerk informed the Council he had two sewer permits from the Sanitary District. On motion by Alderman Morava and second by Auck the Mayor and Clerk were authorized to sign the permits. Adiournment. The motion was made by Alderman Davis and seconded by Morava to adjourn. The motion was voted upon by acclamation whereupon the Chair declared the motion carried and the Council regularly adjourned. MINUTES OF THE REGULAR MEETING OF THE CITY COUI•ICIL, DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY, AUGUST 1a, 1952, AT 8:00 P.M. Roll Call. The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Alderman Hansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay, Clement, Morava & Auck responding to roll call. Alderman Clement at this time informed the Council that he had moved out of his ward and therefore no longer could serve as Alderman. He said he would be willing to be of service to the Council for the balance of his term. The Mayor invited him to sit in at the Council Meetings but that he would not be able to vote. Approval of Minutes. The motion was made by Alderman Hansen and seconded by Morava to approve the minutes of August 4, 1952. Alderman Auck requested that it be recorded in the minutes that the City Attorney had given the opinion that the sewer on Wicke Avenue, which had been installed at the expense of a property owner was now the property of the City. The motion was voted upon by acclimation whereupon the Mayor declared the motion carried and the minutes approved with correction made. Zoning Board rejects variation at 1714 Oakton Street. The Zoning Board rejected a variation at 1714 Oakton Street. The request was from Commercial to Light ManufacttrA, The Mayor ordered the letter placed on file. On motion by Alderman Behrel and second by Tures the City Council officially thanked the Johnson Trailer Boat Company for their presentation to the City of a trailer boat. Failure of passage of Prairie Avenue two Hour Parking Ordinance. The Clerk read for second reading the two hour parking ordinance on Prairie Avenue. The motion was made by Alderman Hansen and seconded by McKay to pass the proposed ordinance. The Mayor put the question and after discussion the Clerk called the roll with thefollowing results: .Ayes: Aldermen Hansen and McKay. Narys: Aldermen Davis, Wolf, Tures, Behrel, Schallawitz, Morava and Auck. The Mayor, thereupon, declared the motion lost. City Attorney Letter on Special Assessment Lien. The Clerk read the following letter: July 25, 1952 Honorable Mayor and City Council City of Des Plaines City Hall Des Plaines, Illinois Gentlemen: There has been submitted to me an application to settle certain special assessment liens for the principal amount only by sale and 7/2 8/1S/52 MARSHALL HOWARD LETTER CONTINUED assignment of the lien, as we have done on several occasions before. !y investigation in this matter discloses that back in 1930 the City voluntarily reduced the special assessments assessed in this case from close to $100.00 a lot down to $25.00 per:lot. The title company, however, refuses to recognize the validity of the reduction order and has set up the specia Lassessments as a lien against the property involved for the full original amount. I believe that the reason the City voluntarily sought to reduce the assessment was because it was discovered that one of the City's water mains runs underneath the lot in question. The owner of the lot is willing to give a release of damages for the water main and an easement to permit it to remain in return for a waiver of the interest and penalties on the special assessments. The lot is vacant and unimproved. I am therefore attaching an ordinance to sell and assign the liens for the full principal amount thereof. This has the effect, of course, of waiving the payment by the owner of the interest and penalties. I would suggest the matter be referred to the Finance Committee for full investigation. First, Reading Annexation Ordinance Southeast Corner Wolf and Algonquin Roads. The Clerk read for first reading the following proposed ordinance entitled: AN ORDINANCE ANNEXING CERTAIN LANDS TO THE: CITY OF DES PLAINES. The Mayor referred the proposed ordinance to the Plan Commission pending second reading. Petition obiecting to Kennel License. The Clerk read a petition signed by fifteen residents in the 1500 block of Forest Avenue objecting to the issueing of a kennel license to Mr. Timroth, 1536 Forest Avenue. The Chief of Police is to be instructed to investigate and order dogs be removed from premises until question is settled. Izaak Walton League Letter. The Clerk read the following letter: Mayor and City Council, Des Plaines, Illinois Gentlemen: August 13, 1952 The Des Plaines Chapter of the Izaak Walton League have for a long time been working on cleaning up the Des Plaines River with some success. Now that the Chicago Sanitary District will have extension made on the intercepter sewer to Mt. Prospect we believe more of an effort should be made to rid the River of all Polution. The Tillage of Wheeling, St. Mary's Training School and Forest Sanitarium we believe are dumping_;their sewerage in the River, therefore, we desire that the City Council contact the State Waterways Department to see if they will not help to clear up all the pollution. 1 With good fishing in the Des Plaines River many young people would have something to do and stop some of the deliqueney. Alderman McKay, Chairman of the Finance Committee presented the following proposed resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DFS PLAINES, THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. (Schedule of bills placed before each Alderman and affixed to resolution and on file with the City Clerk.) The motion was made by Alderman McKay and seconded by Schallawitz to adopt the proposed resolution. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay, Taira, and Auck. Nays: None. The Mayor thereupon declared the motion carried. Alderman McKay read a letter from H. C. Speer and Sons regarding the delay in delivery of Parking Meter Revenue Bonds. The motion was then made by Alderman McKay and seconded by Behrel that the City refund to H. C. Sperr and Sons the $476.00 premium. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay, Morava, and Auck. Nays: None. The Mayor thereupon declared the motion carried. Alderman McKay presented an ordinance on vacating an alley in Homerica. The Mayor referred the proposed ordinance to the City Attorney to redraft. On motion by Alderman Morava and second by Davis the City Clerk was instructed to write the State Highway Department to reroute the trucks from Algonquin Road and to replace the 12,000 pounds load limit signs. Alderman Tures presented a resolution regarding the installation of water mains to supply lake water by a private company. The Mayor referred the resolution to the City Attorney to redraft. The Mayor informed the Council that the Benjamin Electric Company will install equipment to eliminate the dust to be ready when they start:. using coal this winter. Alderman Davis read a letter from Kimball Hill regarding their building a temporary display home in the Farrell Park on Rand Road southeast of Miner Street. On Alderman Davis and second by Morava they will be granted the home but the building to be removed in one year. City Attorney Howard reported there was no objection to the zoning variation on Rand and Grove. and Associates, Inc. section known as Motion by a permit to build The Mayor informed the Council about investing Parking Meter Revenue Bond cash. The motion was made by Alderman McKay and seconded by Schallawitz that the City Clerk be instructed to purchase $75,000.00 of Treasury Bills at the First National Bank with the Parking Revenue Bond cash. The Mayor put the question and the Clerk called the roll with the following result: Ares: Alderman Hansen, Davis, Wolf, Tures, Behrel, McKay, Morava and Auck. Nays: None. The Mayor thereupon declared the motion carried. On motion by Alderman Hansen and seconded by Auck, Superintendent Warnicke is permitted to have installed in the new sidewalk at First National Bank equipment for the new street lights to be paid from Parking Meter Fund but fund to be reimbursed when lights are installed. Alderman Auck presented a petition with 155 signatures regarding the hazard at curve on Mannheim at Bittersweet. On motion by Alderman Auck and second by Morava the Clerk is to contact the Highway Department regarding a flasher, danger sign and change of speed signs. Adjournment.
