Call to Order The meeting was called to order by City Clerk , Otto W. J. Henrich, and adjourned the meeting to Monday July 14, 1952, at 8:00 P.M. due to no gnrtml. MINUTES OF THE ADJOURNED MEETING OF THE CITY COUNCIL, DES PLAINES, ILLINOIS, HELD IN MHE COUNCIL CHAMBERS MONDAY JULY 14, 1952, at 8:00 P. M. Call to Order The meeting was called to order by Mayor Kenneth G. Meyer who presided with Alderman Hansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay, Clement, Moraua, and Auck responding to roll call. Approval of minutes. The motion was made by Alderman Clement and seconded by Auck to approve the minutes of the regular meeting June 16, 1952, and the 6pecial meeting June 23, 1952. Alderman Clement reported errors in terms of Spiegler and Carroll. Attorney M. S. Howard requested to change the motion on Parking Revenue Bond Ordinance to "place the proposed ordinance oft passage." The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the minutes approved as corrected. Traffic Commission Reports: The Clerk read a letter from Traffic Commissioner recommending that the City -Council ask the State to widen Algonquin Road from Des Plaines Avenue to Mount Prospect Rd. The Mayor informed the Council Engineer Fletcher has contacted the State regarding same. The Clerk read a letter from Traffic Commissioner suggesting a few "Slow Children Playing" signs be placed on Greenview Avenue between Second and Fifth which were requested by residents. The Superintendent was instructed to place the signs. First reading of Ordinance parking on City Hall property. The Clerk read for first reading the following proposed ordinance entitled: AN ORDINANCE TO REGULATE PARKING ON CITY HALL PROPERTY. The Mayor ordered the proposed ordinance placed on file for second reading. First reading of Ordinance posting bills on posts The Clerk read for first reading the following proposed ordinance entitled: AN ORDINANCE TO ANENT SECTION 1250 OF CHAPTER 29 OF THE REVISED ORDINANCES OF THE CITY OF DES PLAINES, 1928, AS AMENDED, RELATING TO THE POSTING OF BILLS. The Mayor ordered the proposed ordinance placed on file for second reading. First Reading of Ordinance of sprinkling. The Clerk read for first reading the following proposed ordinance entitled: AN ORDINANCE TO AMEND SECTION 1287 OF CHAPTER 30 OF THE CITY CODE OF DES PLINES, AS AMENDED, REGARDING YARD FOUNTAINS AND SPRINKLING. The Mayor refered the proposed ordinance to the Water Committee. Nebel Trailor camp. The Clerk read a letter from Superintendent Wernicke reporting 108 trailors at the Nebel Trailor Camp. The Clerk was instructed to bill for same. Alderman Cement reported on the meeting of July 7 regarding the public hearing on Garland property zoning and said that Mrs. Garland's attorney Mr. Stoeffels was present to discuss the matter with the Council. Alderman Davis made the minotity report for reeoning and Alderman Hansen spoke against. After Mr. Stoeffels spoke it was approved to hold the committe report until next meeting on motion by Alderman Clement and second by Wolf. Pass Alle Vacation Ordinance Block 10._ 0. Salinger & Company Touhy Avenue Subdivision.. The Clerk read for second reading the following proposed ordinance entitled: AN ORDINANCE VACATING PUBLIC AT,LFY The motion was made by Alderman Clement and seconded by Morava to pass the proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay, Clement, Morava, and Auck. Nays: None. The Mayor thereupon declared the motion carried. Pass Alley vacationOrdinance Block 12 & 13 0. Salinger & Lo. Tows Avenue Subdivision. The Clerk read for second Leading the following proposed ordinance entitled: AN ORDINANCE VACATION PUBLIC ALLEY. The motion was made by Alderman Hansen and seconded the proposed ordinance. The Mayor put the question the roll with the following result: Ayes: Alderman Tures, Behrel, Schallawitz, McKay, Clement, Morava, The Mayor thereupon declared the motion carried. by Clement to pass and the Clerk called Hansen, Davis, Wolf, & Auck. Nays: None. On motion by Alderman Tures and seconded by Morava the Council approved that Engineer Fletcher prepare plans and estimates for a new well. On motion by Alderman Tures and seconded by Clement the Council approved the Engineer Fletcher prepare plans and estimates for addition to water softening plant. Approval of Bills. Alderman McKay presented the following proposed resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PIA INES, THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. (Schedule of bills placed before each Alderman and affixed to resolution and on file with the City Clerk.) The motion was made by Alderman McKay and seconded by Behrel to adopt the proposed resolution. The Mayor put the question and the clerk called the roll with the following result: Ayes: Alderman Hansen, Davis, Wolf, Tures, Behrel, Schallawitz. McKay, Clement, Morava, and Auck. Nays: None. The Mayor thereupon declared the motion carried. The Clerk read a letter from the State Highway department that orders have been issued to place the correct census City sign at "City limits" on West end of Golf Road. Rezoning Application Hines Lumber Co.. The Clerk read the following letter: June 19, 1952 ![ayor Kenneth G. Meyer City of Des Plaines City Hall Des Plaines, Illinois Dear Mayor Meyer; In accordance with your suggestion of June 11, 1952, I have re1'ised the application of Herbert and Mary Seegers to rezone their property at Wolf Golf Road, and I am enclosing the revised application herewith; I previously forwarded a check to the City in the amount of $45.00 to cower the filing and publication costs. As you will notice from the attached application, the petition is to request the Zoning Board to either rezone the property from residential to light manufacturing or in'the alternative to request the Zoning Board to name a new classification to the City Council, namely heavy commercial, and to further require heavy commercial zoning for the operation of a retail lumber yard. 70/ I shall appreciate very much if you will see that thi8 matter is referred to the Zoning Board and publication made at the earliest date. I have had an engineer working on a proposed lay -out and sketch of the buildings to be erected and also, location of the buildings on the premises which shall be available at the time of the hearing on this petition. On motion by Alderman McKay and seconded by Behrel the. application was refered to the Zoning Board of Appeals sitting as a Commission to call a hearing. Side -walks for Wolf Road and Greenview Avenue. Alderman Clement suggested that proper legal steps be taken to provide side -walks on the West side of Wolf Road between Greenview and Hose Avenue. Also on the east side of Wolf Road between Greenview and Prairie Avenues. The Mayor refered the matter to the City Attorney. First reading ordinance City Ward Boundaries. The Clerk read for first reading the following proposed ordinance entitled: AN ORDINANCE TO`AMENT SECTIONS 190 to 194 INCLUSIVE OF CHAPTER 6 OF THE REVISED ORDINANCES OF THE CITY OF DES PLAINES, 1928, AS AMENDED, RELATING TO WARD BOUNDARIES. The Mayor ordered the proposed ordinance placed on file for second reading. Pass 19 2 Tax Levy Ordinance. The Clerk read for second reading the following proposed ordinance entitled: AN ORDINANCE PROVIDING FOR THE LEVYING OF AN ASSEMENT OF TAXES FOR THE FISCAL YEAR OF THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS, COuisENCING JANUARY 1st, 1952 AND ENDING DECEMBER 31, 1952. The motion was made by Alderman McKay and seconded by Auck to pass the proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman nansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay, Clement, Morava, and Auck. Nays: None. The Mayor thereupon declared the motion carried. Alderman Hansen requested a two hour parking ordinande for the following streets: Thacker Street from Graceland Avenue to Soo Line tracks. Graceland Ave. from Thacker to merlon Streets Laurel from Thacker to Marion. Arlington from Laurel to Prairie. The motion for an ordinance was made by Alderman Hansen and seconded by McKay, but on motion by Alderman Clement and second by McKay was approved to refer to Traffic Commission: On motion by Hansen and seconded by Behrel to investigate two hour parking or parking meters for Lee Street between Prairie and Thacker was refered to the Traffic Commission. Alderman Behrel made the motion which was seconded by Schallawitz that the Fire Department purchase and install used radio equipment for crash truck at a cost of $120.00. The Mayor put the question send the Clerk called the roll with the following result. Ayes: Alderman Hansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay, Clement, Morava and Auck. Nays: None. The Mayor thereupon declared the motion carried. Alderman Davis requested that an investigation of parking on Miner Street at Rand Park be investigated. The Mayor refered the matter to tfid Traffic Commission for iemtediate study. On motion by Alderman Auek and second by Clement the City Engineer is to prepare plans and estimates on connecting the 24 inch Thacker Street sewer under Soo Line Tracks from First Avenue to Laurel Avenue. boa On motion by Alderman Auck and seconded by Davis, Engineer Fletcher is to prepare plans and estimates for =newer pumping station on Oakton Street and Des Plaines Avenue. Alderman Auck refered a pla regarding the request to vacate a part of Birchwood Avenue to Street ommittee. William Meyer 1955 Illinois Street was granted permission to speak on request of Alderman Auck regarding having an alley on rear of their property. The Mayor informed the council he would refer the item tp Plan Commission. Zoning Variation 1714 Oakton Street. jhe Clerk read the following application: City Clerk Des Plaines, Illinois Application is hereby made for a change in zoning variation of premises located in the City of Des Plaines, "ook Vounty, Illinois, owner by: Edward P. Cook and Ray Koch, 1714 Oakton Street, and described as follows: Lots 12 and 13 in Block 13 in Arthur T. The Mayor refered the application to the Zoning Board of Appeals. The Mayor refered a letter from Carl Reikert regarding a calf to the City Attorney and Police Department. Escrow Agreement to demolish part of:building on new City Parking Lot. The ity Attorney had prepared an excrow agreement which on motion by Alderman Behrel and seconded bby Hansen the Council authorized the Mayor and City Clerk to sign. Oakton Gardens Annexation. The Llerk read a letter from R. Vane of Oakton Gardens requesting the Council to call the. election about Oakton Gardens annexation within the 90 days. Alderman McKay made the motion to reconsider the vote on the annexation ordinance. the Mayor ruled that he could not make the motion to reconsider because he did not vote with the majority. After considerable discussion Aldermen McKay made the motion which was seconded by Clement to appeal to the Council on the Mayor's ruling. The Mayor put the question and. the Clerk called the roll with the following result. Ayes: Alderman Davis, 'olf, Tures, Behrel, Schallawitz, and Auck. Nays: Alderman Hansen, McKay, Clement, and Morava. The Mayor declared the motion lost. The Clerk was instructed to write to Mr. Vana and an request of Alderman McKay to inform him it was Richard W. Manke,letter. The Clerk read the following letter: June 17, 1952 The'ity Council City of Des Plaines Des Plaines, Illinois Gentlemen: We have just consummated a deal with your City for a parcel of property in connection with your Municipal Parking Program. As a resident of a neighboring community, Ly interest was greater than just the personal business involved. Your mayor, KENNETH G.NEINR, and your City Attorney, MARSHALL S. HOWARD,gave a great deal of their time in assisting in the closing of our trans -action which involved numerous complications due to easements and other matter. 703 I was in an unusual position to observe two of your City officials giving unstintingly of their time to help carry our your parking relief program. I.am sincere when I say that they should be commended publically through your newspaper for their civic -minded cooperation. Yours very truly, RWM:j RICHARD W. MANKE The Mayor informed the Council he had received a letter regarding the request for an ordinance not allowing chickens or any foul in the City limits. He refered the item to the City Attorney for an ordinance. The Clerk informed the Council he had received a letter from Illinois Commerce Commission regarding increase of Chicago and Northwestern Railway fares. Sanitary District Sewer Permit No. 1952-63. Engineer Fletcher had reguested a permit from the Sanitary District:regarding sewer on Bussee Highway. On motion by Alderman Hansen and seconded by Behrel the Mayor and Clerk were authorized to sign and execute the permit. _ The Clerk informed the Council he had received complaints of zoning violations at the following places: Lutz's Floor Ccuerings, 1705 Stockton Avenue Robert I. Syverson, 605 Greenview Avenue Robert: Ekvalli 893 Hollywood Avenue The Mayor refered the violations to the Building Commissioners. Eugene Grupe appointed regular police patrolman. The Clerk informed the Council the Board of Fire and Police Cennissioners had appointed Eugene Grupe regular police patrolman as of June 23, 1952. The Clerk informed the Council he had received the audit reports on the Water and General°Accounts, also that the Special Sssessment audity had been completed last week. The Mayor refered the item of charging a fee for garbage collection to the Finance and Garbage Committees. Adiournment. The motion was made by Alderman Schal lawits- and seconded by Davis to adjourn. Investigation - - 7-17-52 Mr. Ekvall is in the printing business in ''hicago and because of moving his location recently, he has some painting paper stored in his base- ment, and each mor*ing he removes some of the paper in his car and takes it to his place of business.
