04211952GNU MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL,, CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY APRIL 21. 1952. AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Aldermen Hansen, Davis, Wolf, Behrel, Schallawits, Many, Clement, Morava and Auck responding to roll call. APPROVAL OF MINUTES. The motion was made 4. Alderman Morava and seconded by Alderman Schallawita to approve the minutes of the regular meeting, April 7, 1952 and the adjourned meeting, April 14, 1952. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. Alderman Tures made his appearance atthis time. OFFICIAL REPORTS. The Clerk submitted the report of Treasurer L. C. Barrett for March. CITY ATTORNEY REPORT. The Clerk read the following report: April 21, 1952 Honorable Mayor and City Council Des Plaines, Illinois Gentlemen: I have made a careful checkup of the latest statutory provisions regarding annexation of territory by a. municipality. There is no provision in the law for involuntary annexation, that is, annexation without consent of the owner, excepting only where the property in question is 60 acres or less and is wholly surrounded by the sunioipality or is surrounded by the municipality and a lake or river. The Clerk read for second reading the following proposed ordinance entitled: AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF DES PLAINES. ILLINOIS The motion was made by Alderman Hansen and seconded by Alderman Morava to pass the proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: Oyes: Aldermen Hansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay, Clement, Morava and Auck. Nays: None. The Mayor thereupon declared the motion carried. SECOND READING REZONING ORDINANCE LOT 17. GARLAND DIVISION. The Clerk read for the second reading the following proposed ordinance entitled: AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE' CITY OF DES PLAINES. ILLINOIS The Clerk then read a petition with 54 signatures, opposing the rezoning. Yr. Brand, Spauling, Lawrance and Schubert spoke opposing the rezoning. The notion was then made by Alderman McKay and seconded by Alderman Auck to pass the proposed ordinance. After discussion by the Aldermen, Oh motion by Alderman McKay and second by Alderman Davis, the ordinance was referred to the Municipal Development Committee to contact Commissioner Fred Howe to inquire why he opposed the rezoning. 4,77 ZONING BOARD RECOMMENDATION. The Clerk read the following recommendation: April 16, 1952 Mayor and City Council City of Des Plaines, Illinois Gentlemen: Tour Zoning Board of Appeals sitting as a commission had referred to it the application of George P. Burgess to rezone certain real estate included in the following, from its present classification, Commercial Area District C to Residential Area District A, to wit: Lots 1 to 4 incl. in Block 12 and Lots 1 to 10 incl. in Block 13, in Oliver Salinger & Company's Touhy Avenue Szbdivision of part of South j- of Section 28, Township 41.N0rth, Range 12 East, of the Third Principal Meridian. advises as follows: 1. That due notice to the parties and to the public of this proceeding and of the public hearings herein was given as required by law And that the Board has jurisdiction of the subject matter and of the subject matter and of the parties. 2. That the Major portion of the property in question is now being utilized for residential purposes. 3. That there were no objectors to the proposed rezoning at the public hearings on March llth and April 15th, 1952. The Zoning Board of Appeals, sitting as a Commission, having heard and considered the evidence and being fully informed in the matter, on a vote of four for the proposed amendment and of none against the change, recommends to the Mayor and City Council that the proposed amendment to the Zoning Ordinance, hereinbefore described be adopted. Alderman Auck the Attorney was instructed to draft an ordinance for the rezoning of Lot 1 to 4 inclusive Block 12, in Oliver Salinger and Company's Touhy Avenue Subdivision. APPROVAL OF BILLS. Alderman McKay, Chairman of the Finance Committee presented the following proposed resolutions BE IT RESOLVED BY TIE ,CITY COUNCIL OF THE CITY OF DES PLAIINES, THAT THE FOLLOWING BILLS ARE DDE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. (Schedule of bills placed before each Alderman and affixed to resolution and on file with the City Clerk.) The motion was made ty Alderman McKay and seconded bd► Alderman Hansen to adopt the proposed resolution. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Aldermen Hansen, Davis, Wolf, Behrel, Schallawits, McKay, Clement, Morava and Auck. Nays: None. The Mayor thereupon declared the motion carried and the proposed resolution passed. KIMBALL HILL AND ASSOCIATES LETTER. The Clerk read the following letter: April 18, 1952 City Council Des Plaines, Illinois Gentlemen: Attention: Mr. Otto Henrich We have been working with the Plan Commission to arrive at the bestsolution for platting the left -over piece of acreage lying between the original Oliter Salinger Subdivision and the city limits at Cedar Street. It is our understanding that the final preliminary draft will be sent to you by the Plan Commission. We will appreciate, if it is in order, your approving this proposed subdivision subject to the- preparation of the formal plat by a registered land surveyor in confofmity with the draft of the subdivision submitted to you by the Plan Commission.. We are anxious to have the surveyor prepare this so that we may proceed to install the sewer and water prior to our starting houses on the east side of Scott Street, which is already platted and known as the Oliver Salinger Subdivision. The Clerk read the following letter: April 17, 1952 Mr. Otto A. J. Hendrich City Clerk, City of Des Plaines, Municipal Building Des Plaines, Illinois Dear Mr. Henrich: In compliance with the request of E. N. Fletcher, Engineer for the City, Sanitary District Sewer Permit No. 1952-31 has been issued to the City of Des Plaines, to cover the construction of a 12" Sewer in Cornell Avenue, as further described in said permit. Three copies of the permit are enclosed, and it is requested that the permit be duly accepted, signed, and sealed try the proper officials, and that the copy marked "The Sanitary District of Chicago" be returned to this office, and that the copy marked "Contractor's Copy" be given to the contractor. Construction is srfb&tei`Ithe permit marked "The Sanitary District of Chicago" properly signed, has been received in the office of the Chief Engineer of The Sanitary District of Chicago, and arrangements have been made with the Sanitary District Field Engineer (Call Bishop 2-3144, Local 349) for the method of procedure and inspection of the work. The Clerk informed the Council that he had received letters from the Board of Fire and Police Commissioners that the above men were appointed as of April 16, 1952. MAYOR APPOINTS POLICE RESERVE OFFICERS. On motion by Alderman McKay and second by Alderman Behrel, the Mayor's appointments of the following Police Reserve officers were approved: E. Spryison - Captain, W. Ziehn and T.R. Smith - Lieutenants, A. Baker, W. Howard, W. Eigenbrod and W. Eggers, - Sergeants. The Mayor informed the Council about settlement on parking lots. The motion was made by Alderman McKay and second by Alderman Clement, that Carl Teutsch be paid $1,000.00 for release of his easement and to reduce by $250.00 the payment of Sigwalt property upon release of easement. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Aldermen Hansen, Wolf, Tures, Behrel, SchallaWitz, McKay, Clement and Morava. Nays: Aldermen Davis and Auck. The Mayor thereupon declared the motion carried. On suggestion of Alderman Behrel, the item of insurance for Police Reserves was referred to the Finance and Public Protection Committees. On suggestion of Alderman Behrel, the Mayor referred to the City Engineer, the item of some type of control of Graceland Avenue traffic lights with the Fire Department. On suggestion of Alderman Behrel, the Mayor referred to the City Attorney the drafting of an ordinance regarding parking in back of City Hall. On suggestion of Alderman Behrel the Mayor referred to the City Attorney the amending of ordinance regarding election signs on posts on election days, Alderman Clement requested a change in the alley vacation resolution regarding charge per lot. The Mayor referred the item to the City Attorney to redraft a resolution with a charge of twenty cents per foot on alley lot lime. ADJOURN. The motion was made by Alderman Clement,andseconded by Alderman Behrel to adjourn to Monday, April 28, 1952, at 8:00 P.M.
