MONDAY. MARCH 24. 1952. AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer,
who presided with Aldermen Hansen, Davis, Wolf, Tures, Behrel, Schallawitz,
McKay, Clement and Auck responding to roll call. Alderman Morava was absent.
The City Attorney informed the Council that he desired to close
the deal on Frisbie property and explained what -was necessary,
The motion was then made by Alderman Auck and seconded by Alderman
Davis that the City Attorney be authorized to provide that if settlement
has not been made with all the property owners within six months, that the
title to property and purchase money be returned to Chas. Frisbie or
any other property owner requesting such a provision. The Mayor put the
question and the Clerk called the roll with the following result:
Ayes: Aldermen Hansen, Davis, Wolf, Tures, Behrel, Schallawitz, McKay,
Clement and Auck. Nays: None. The Mayor thereupon declared the motion
carried.
Alderman Clement reported on the rezoning hearing of Amling
property, Lee and Oakton. He said the meeting was continued for another
hearing.
The Council discussed several chapters of the City Code. The
Clerk was instructed to write to the County Coroner regarding discontinuing
the holding of inquests in Council Chambers.
The motion was made by Alderman Davis and seconded by Alderman
Hansen to adjourn. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried and the Council regularly adjourned.

APRIL 7. 1952. AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor
Kenneth G. Meyer, who presided with Aldermen Hansen, Davis, Wolf, Tures,
Behrel, Schallawitz, McKay, Clement and Morava, responding to roll call.
Alderman Auck was absent.

APPROVAL OF MINUTES. The motion was made by Alderman-Behrel and seconded
by Aderman Clement to approve the minutes of the regular meeting, March 17, 1952,
and the adjourned meeting, March 24, 1952. Alderman Behrel requested a correction
of the minutes. The roll call on the Parking Meter bonds had been eliminated.
With the correction made, the motion was voted upon by acclamation, whereupon
the Mayor declared the motion carried.
Alderman Clement informed the Council, there was some people present
regarding the Amling rezoning. Mr C. E. Clemens of 1338 Briar Ct., was granted
permission to talk. Due to a telephone call, on motion by Alderman Schallawitz,
and second by Alderman Behrel,,Alderman Clement was appointed Mayor pro tem.
After several others were allowed to talk, on motion by Alderman Davis and
second by Alderman Morava, the question about rezoning was tabled.
OFFICIAL REPORTS. The Clerk submitted the monthly reports of
the Building Commissioner and City Clerk.
CIT' ATTORNEY REPORT. The Clerk read the following letter:

Gentlemen:
In the furtherance of our campaign to enforce Building and Zoning
Ordinances through -out the City, I wish to advise that I have commenced a
suit for injunction against one JACOB HEINRICH to enjoin the continuation
of a zoning violation at 1284 Prairie Avenue. Mr. Heinrich is the owner of a
building at this address which is in a "Single Family Residence" area and is
reported to be using the premises as a two -flat building.
The suit is to enjoin continued violation of the ordinance and to require
if necessary, returning the building to a single family state by remodeling.

Alderman Hansen reported that the Street Committee had investigated
regarding traffic lights on Des Plaines Avenue and Perry Street and that they
recommended the subject be tabled until the need is apparent. On motion
by Alderman Hansen and second by Alderman Behrel the report was concurred in.
Aderman Tures reported about the purchase of a tractor. Alderman
Tures then made the motion which Alderman Hansen seconded to waive bids on purchase
of a tractor. The Mayor pro tem put the question and the Clerk called the
roll with the following result: Ayes: Aldermen Hansen, Davis, 'Wolf, Tures, Behrel,
Schallawitz, McKay, Clement, and Morava. Nays: None. The Mayor pro tem
thereupon declared the motion carried. The motion was then made by Alderman
Hansen and seconded by Alderman Davis to purchase the tractor from Mr. Osborn
at the price of $4,100.00. The Mayor pro tem put the question and the
Clerk called the roll with the following result: Ares: Aldermen Hansen, Davis,
Wolf, Tures, Behrel, Schallawitz, McKay, Clement and Morava. Nays: None.
The Mayor pro tem thereupon declared the motion carried. Mayor Meyer returned
to the chair at this time.
The Mayor referred the building permit of the Rothery property
to the Building Permit Committee.
FIRST READING OF ORDINANCE -REZONING 1382 PRAIRIE. The Clerk
read for the first reading the following proposed ordinance entitled:

ZONING ORDINANCE OF THE
CITY OF DES PLAINES. ILLINOIS
The Mayor ordered the proposed ordinance placed on file for second reading.
The Clerk informed the Council he received a letter from the Public
School Board stating that the North School property was not for sale and that
they intend to hold the property for an indefinite period.
The Clerk informed the Council he received a letter from Mr. F. O'Reilly
swing he had -received the Nebel Trailer Camp sewer contract for signature and
he would contact his clients regarding same. He would then contact the
City Attorney or the Clerk.
The Clerk informed the Council he had received a letter from Frank Opeka,
regarding the Park Ridge Manor fire contract and desired one week time to
examine same.
The Clerk informed the Council he had received a letter from Kimball
Hill and Associates regarding heir resealing, objecting to the rezoning of the
entire block. The motion was made by Alderman Davis and seconded by Alderman
Clement to instruct the City Attorney to prepare an'ordinance on the
rezoning of the land involved.
APPROVE REZONING OF LONE GARLAND ON MINER STREET ACROSS FROM RAND PARK,

Gentlemen:
Your Zoning Board of Appeals sitting as a commission had
referred to it the application of Lavene Garland to rezone the following
described real estate from its present classification Residence District
Area A to Commercial Area District C, to wit:
The South Two Hundred and Eighty- Five (285)
feet, except the West Sixteen (16') feet thereof,
of Lot Seventeen (17) in part of Garland division
of land in the South one-half of the South one-
half of Section Sixteen (16) Township Forty -One
'(41) North, Range Twelve (12) East of the Third
Principal Meridian.
advises as follows:
1. That due notice to the parties and to the public of this
proceeding and of the public hearing therein was given as required by law
and,that the Board has jurisdiction of the subject matter and of the parties.
2. That the intended purchaser of the property wishes to utilize
it for an office building. According to his statement, the building -will
occupy less than ten per cent of the land area, the balince to be devoted
to off -the -street parking and appropriate landscaping.
3. That there were five objectors to the proposed amendment at the
public hearing.
4. That the property in question has been proposed for rezoning
several times in the past few years and has never been utilized for residential
construction.
5. That the property to the North is commercial and the property
across Miner Street is a public park with considerable activity.
6. That the highest and best use for said property is for commercial
purposes.
7. That the evidence presented was convincinuas to the desirability
of reclassifying the property to a Commercial District.
The Zoning Board of Appeals, sitting as a commission, having heard
and considered the evidence and being fully informed on the proposed amendment,
on a vote of four for the proposed amendment and one against, recommends to the
Mayor' and City Council that the proposed amendment to the Zoning Ordinance
hereinbefore desctibed, be adopted.

GARDEN CLUB LETTER. The Clerk read the following letter:
April 4, 1952
Honorable Mayor and City Council:
On September 6, 1951, the Club directed your attention to the damage
of the evergreen plantings at the Pearson and Miner Street intersections.
Inasmuch as the traffic signals aren't operating, we assume we will hear
from you at a later date as to replacement. The season for planting
these trees is this month.
Also, will you advise us as to the latest information relative to
making parking areas of the Northwestern Railroad right -of -war. An order
for 100 flats of wanted colors in petunias was placed some time ago; it is
important to the Club to known whether to proceed with these flower beds.

plantings had all been replanted and that if there are any of the plants damaged
it is due to people walking on them. Also that they could plant the gardens this
year because they would not interfere with any parking lots and they should ask
the Park District to replace the wire fence.
The Clerk informed the Council he received a letter from the Wom mis
Club regarding garbage and waste matter around the bridge on Miner Street and
River Road. The Magor referred the matter to Supt. Wernicke. '
The Clerk informed the Council he received a letter from Coroner A. L.
Brodie, that he would hold the inquests at the undertakers.

exceed $2,800.00.
APPROVAL OF BILLS. Alderman McKay, Chairman of the Finance Committee,
presented the following proposed resolution:

in 13y the April 21, 1952, Council meeting, was referred to Supt. Warnicke and
Engineer Fletcher.
Mr. Vana of Oakton Gardens was granted permission to talk on the
annexation which had been referred to the Plan Commission, December 17, 1951.
Mr Yana was asked to notify the people of that subdivision that the Council
would take action on the ordinance at the Monday, April 14, 1952, adjourned
meeting.
The Mayor referred the matter of the Hines Lumber Company to the Municipal
Development Committee.
Alderman Davis reported on the request for Manilow Construction Company
signs. The Mayor referred the permits back to the Building Permit and
Municipal Development Committee.
