OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES,ILLINOIS, HELD IN THE
COUNCIL CHAMBERS, MONDAY, DECEMBER
17th.1951. at 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth
G. Meyer, who presided with Alderman Hansen, Davis, Tures,Behrel,Schallawitz,
Mclay,Clement,Morava and Auck, responding to roll call. Alderman Wolf was
absent.
OFFICIAL REPORTS. The Clerk submitted the report of Treasurer,
L.C.Barrett for November.
City Attorney Marshall reported the petitioner for County
rezoning at Ballard and Western Avenue, failed to appear so the County
Zoning Board dismissed the petition.
Alderman Clement reported on the Zoning Application hearing for
Mannheim and Devon Avenue. The petitioner desired to operate new and used
trailer business: The property owners in the Orchard Place school district
objected because this would invite more trailer homes in the district. Mr.
Eaterly and Kelley of°the school district were allowed to speak. Alderman
Clement's opinion was that as it was only a sales business be thought the
City should not object. Therefore he said he would make no recommendation.
On the rezoning at Western and Golf Road he also made no recommendation.
Alderman Davis said he thought the City should protest so on his motion
which was seconded by Hansen that the City protest the rezoning on Mannheim
and Devon Avenue,_ the City Clerk was instructed to inform the County Zoning
Board of the objection.
Alderman SchalliWits reported that the License Committee recommended
no increase in the liquor licenses fees. 06-1:0tidelsr:AldermwSchallaWitz
and seconded by Alderman Morava the report was concurred in.
Alderman Auck reported that at the hearing on the south side sewer
the sentiment was about five to one against the project and that he did not
wish to approve a project which the people apposed. Alderman Auck then
made the motion which was seconded by Alderman Schallawitz that the previous
resolution of the City Council regarding this project be squashed and the
project dropped.
The motion was then made by Alderman McKay and seconded by Clement
to table the proceedings of the storm sewer. The Mayor put the question and
the Clerk called the roll with the following result: Ayes: Alderman hansen
Davis,Tures,Behrel,Schallavitz�McEay,Clement, Morava and Auck. Nays: None.
The Mayor thereupon declared the motion carried and proceedings tabled.
E.N.FIETCHER LETTER ON DOWN SPOUTS. The Clerk read the following letter:

Gentlemen:
December 17,1951
I herewith recommend that an Ordinance be prepared making it unlawful
to connect the down spouts of any new building to an existing Sanitary Sewer
or to any sewer carrying sanitary sewage.
It is wish much reluctance that I recommend such an ordinance. I
hesitate to recommend it for two reasons:
1. It will remedy nothing.
2. Itmeay givemany people a false sense of security.
During the next two years, we will probably build 700 homes in the
City of Des Plaines. If we do not permit any of these homes to connect down
spouts tO the sewers we still will have times, when, due to rain or heavy
melting of snow, every drop of water will find its way to the sewer and the
flooding will be just as bad as if they had connected their down—spouts.
In recommending this ordinance I have one particular area in mind,
that is the area north of Thacker Street and west of the Soo Line tracks which
will be affected when Homerican Villas is developed. This may give this
area some relief during most of our storms.

5 YEAR STREET IMPROVEMENT PROGRAM RESOLUTION. The Clerk read
the following resolution:
RESOLUTION
5 Year Street Improvement Program -City of Des Plaines, Illinois
WHEREAS, House Bill 820, as passed by the 66th General Assembly.
requires all Municipalities to submit a One Year and a
Five Year Street Improvement Program to the State Highway
Department on or before December 31,1951, and
WHEREAS, the Engineer for the City of Des Plaines together with the
Committee on btreets has recommended definate improvements
for the one year and for the Five Year Plan, NOW THEREFORE,
BE IT RESOLVED, BY THE CITY COUNCIL of the City of Des Plaines, that
the One Year Street Improvement Program for the City of
Des Plaines for the year 1952 shall consist of the following:
1. Jefferson Street, Graceland to Lee- Widdened and resurfaced
2. Park Place, Jefferson to Lee- Widden and resurface
3. Graceland, Jefferson to Miner -,Widden and resurface
4. Crossing Gates at Graceland and the Soo Line Railroad

On July 17th,1951, I forwarded my statement for $800 for services rendered
in the Middle States Telephone case before the Illinois Commerce Commission,
Case No. 39,022.
The statement which I forwarded covered my entire compensation for the
time which I spent on this case and also for my out-of-pocket traveling
expenses.
The time covered my preparation time here in Washington plus nine days
(July 8 throught July 16, when I was in Chicago working with Mr. Harry
R.Booth, the attorney, and presenting the testimony to the Commission.

services in connection Stith the Middle States Telephone case.
I wish to advise that the City Council did not authorize the employment
of any experts in connection with this caseso I have no knowledge of your
employment on behalf of the City of Des Plaines. The City Council did authorize
an expenditure up to $500.00 toward the rose of trying this case, and said
amount has already been transmitted to Mr. Harry R.Booth, the attorney who
handled the major part of the defense.
I am informed by Mr. Marshall Howard, our City Attorney, that you werre
advised of these facts quite some time ago.
Under the circumstances, I cannot recognize your statement for services, but
suggest you take the matter up with whoever engaged you.

set -back in industrial zoning which had been mentioned with the Littlefuse
Zoning. The Mayor referred the item to the Plan Commission and City
Attorney.
The Clerk informed the Council he received a thank you card
from Mrs. Kingery.
FIRST READING OF LIQUOR LIMITATION ORDINANCE. THE Clerk

permit for three street entrances at Chase,Jarlath, and Hickory Streets.

rate laws as they.affect the Corporate bund, and pursuant to that law

MARSHALL S. HOWARD'S LETTER.CONT'D.
you passed a Corporate Fund Ordinance which set our Corporate Fund limit at
a 10% increase over the current maximum.
The Tax rate laws, however, affect all other funds for which we
levy taxes, in that they provide that the City may set the maximum rate by
.ordinance and provide in an additional sub -paragraph, that in the event the
City does not set a maximum rate, that then the maximum rate shall be 80%
of the current maximum rate. In other words, in order to retain'the taxing
power that we have now on eht Policemen's Pension Fund, Public Library Fund,
and various other funds, we must pass a separate ordinance for each of such
funds setting the maximum rate at the current maximum. If we do not do so,
the rate will be automatically reduced.
I, therefore submit herewith six ordinances, each of which merely,
establishes the maximum tax rate for each of the funds that exist at the
present time. The funds involved are:
Policemen's Pension Fund.
Public Library Fund
Public Benefit Fund
Fire Protection Fund
Garbage Fund
Street Lighting Fund
It is.imperative that thesesbe passed at the current meeting,
as the statute requires they be passed by December 31,1951, in order to be
effective.

OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD
IN THE COUNCIL CHAMBERS MONDAY,
JANUARY 7. 1952. AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth
G. Meyer, who presided with Aldermen Hansen,.Davis, Wolf, Tures, Behrel,
Schallawits, McKay, Clement, Morava and Anok, responding to roll call.
OFFICIAL REPORTS. The Clerk submitted the reports of the Building
Commissioner and City Clerk for December.
Alderman Behrel reported about the men on the Police Reserve. On
motion by Alderman Behrel and second by Alderman Hansen, the City Attorney
was inetruoted to draft an ordinance on the Police Reserve.
On motion by Alderman Wolf and second by Alderman Morava the City
Engineer and Superintendent of Public Works were instructed to draft
specifications for a heating plant in the warehouse in order to advertise
bids.
The Mayor referred to the Street Committee, the change of parking
from diagonal to parallel the west side of Pearson Street from Ellinwood
Street south to the alley.
Alderman Auck reported the following on the matter of issuing a
permit to the Nebel TSrailer Camp, for a charge to connect their sanitary
sewer to City sewers:
Tour Committee on SEWERS has investigated the above and has found:
(a) that Mr. O'Reilly (Nebel's attorney) agrees that the
City is rendering a service to the trailer park by dis-
posing of the park's sanitary sewerage and that the
City is entitled to a fair service charge for rendering
that service.
(b) that any service chargeestablished should be retro -
.active to 7-1-1951, about the time these negotiations
started.

that O Reiliy's proposal of $1 per month per trailer
for the first 50 units and 50, per month per unit for
the remainder is not acceptable to the Committee. In
fact, it should have been set up in reverse order, i.e.,
a lesser amount for the first block of units and a higher
amount for the greater number of units, because as the
number of trailers increases, the amount of sewerage and
the service performed by the City increases.
