CALL TO ORDER The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Alderman Hansen, Wolf, Tures,Behrel, Schallawitz, McKay,Clement, and Auck responding to roll call. Alderman Davis and Morava were absent. The Mayor informed the Council, Alderman Morava was absent due to the death of his brother. READING OF THE CALL NOTICE OF SPECIAL MEETING. REPORT OF FINANCE, WATER AND MUNICIPAL DEVELOPMENT COMMITTEES OF PROPOSED ANNEXATION OF ILLINOIS TOOL WORKS LAND. Mayor Kenneth G. Meyer read the following report: October 25,1951 City Council Des Plaines, Illinois Gentlemen: The Chairmen of the Finance Committee, the Water Committe and the Municipal Development Committee and the Mayor, ex officio member of all Committes, have give diligent study to the proposed annexation to Des Plaines of certain property South of and contiguous to Algonquin Road and West of and Contiguous to Chicago and North Western Outer Belt Line Railroad tracks, and to the use of said property for light industrial purposesby the Illinois Tool Works. ANNEXATION OF ILLINOIS TOOL WORKS CONT'D. In considering this problem the Committee's first consideration was the protection of the City's water supply and the prevention of overdrowding existing sewer and drainage facilities. Several meeting were had by the Committees without the presence of represent- ativies from Illinois Tool Works and meetings were also held with represent- ativies of Illinois Tool Works, and upon conclusion of discussion and deliberations the following recommendations are made to the City Council: 1.) That the annexation of the territory above mentioned be accepted by the City Council of the City of Des Plaines. 2.) That in due course said land will be zoned from unrestricted area to light industrial uses. That in the event Illinois Tool Works constructs their plant upon said premises, they will, within fifteen months after construction starts, provide a means for impounding storm waters from roofs of their structures and parking areas so that such waters will not reach the city's sewers or other drainage facilities until after the peak load of those sewers, in time of storms, have passed. 4.) That Illinois Tool Works, at its own expense, install a ten inch water main as recommended by the City Engineer from Wolf and Algonquin Roads to the plant of Illinois Tool Works, said water main to be public property. 5.( Illinois Tool Works will make a payment to the 'ity to be used as the City Council sees fit for the betterment and welfare of the City. If the City desires to dig a new well, Illinois Tool Works will, if requested by the City, grant a 99 year lease at $1.00 per year for a parcel of property not exceeding one-half acre, for the purpose of constructing a well by the City. The lease to be conditioned that in the event said well is abandoned, then said lease to be cancelled and the City to have the right to remove its equipment from said site. Any building constructed on said site would revert to Illinois Tool Works. A further condition of said lease would be that a water connection for fire protection purposes would be made, if requested by Illinois Tool Works, directly from such well site to the plant of Illinois Tool Works. 6.) All water used by Illinois Tool Works would be metered and paid for at the existing or then existing water rates as provided by Ordinance of the City of Des Plaines. 7.) It is the recommendation of the Committees also that the funds received from Illinois Tool Works as a gift will be apportioned one-half to sewer improvements and betterment, and one-half for increasing our present water supply or bettering and improving our existing water facilities. 3.) Gentlemen: Your petitioners, Herman Kempke and Hannah Kempke, 1439 Ashland Avenue, Des Plaines,Illinois, hereby state that they are the sole owners of record of the following legally described land, to wit: That part of the North ' - of the Southwest fractional of Section 19, Township 41 North, Range 12 East of the Third Principal Meridian, lying East of the East line of the West 10 acres of the North 695 feet ( as measured on the West line of said Southwest fractional i) and the same East line extended South, ( More simply,; described as the East line of the West 627.33 feet of said North-- ;of the Southwest fractional ) in Cook Gounty,Illinois. The Mayor thereupon declared the motion carried and the proposed ordinance before the Council for final passage. The motion was then made by Alderman McKay and seconded by Auck to pass the proposed ordinance. BOARD OF EDUCATION PETITION FOR ANNEXATION OF RIVER -RAND SCHOOL SITE. The Mayor ordered the ordinance placed on file for second reading. PASS SPECIAL ASSESSMENT PROCEEDING NO.512453 REPEALING ORDINANCE. The Clerk read the following letter: October 29th,1951 Honorable Mayor and City Council of the City of Des Plaines City Hall Des Plaines, Illinois Gentlemen: Score time ago I called your attention to the existence of a special assessment proceeding for the paving of Spruce Street and other streest that has long since been abandoned by the City, but which continued to be a source of 2tajor irritation to many property owners in the City of Des Plaines, because the special assessment for it had been levied and confirmed. You thereupon authorized the purchase of the few vouchers out standing against this assessment so it could be dismissed and the lien of the special assessment removed from the many properties which it covered. Since that time, pursuant to your authority, the vouchers have been acquired and canclled, I have also located and obtained the written consent of the contractor to whom the job had been let to formally abandon the proceeding and dismiss it. It has been suggested, however, by the Chicago Title & Trust Company and by the Torrens office, who pass upon these titles and who will have to remove the liens, that inasmuch as the proceeding was started by an ordinance, it ought to be repealed by a repealer ordinance instead of a mere motion. I am therefore submitting at this time an ordinance to repeal the ordinance authorizing this improvement and the assessment for it. Inasmuch as there are a number of deals now pending, which have been delayed some time waiting for this assessment to be removed, and inasmuch as you have heretofore thoroughly considered the problem, I take the liberty to ask that the rules be suspended and the ordinance put on passage, and if it meets your approval, that it be passed tonight. The Mayor thereupon declared the motion carried and the proposed ordinance passed. APPLICATION FOR LIQUDR LICENSE FOR BERSALtS. The Clerk read the following letter: Mr. Mayor & Members of the City Council City of Des Plaines,Illinois Gentlemen. October 29,1951 I would like to inform you that I have again placed an application with the City Clerk for a liquor license for BerSalls Diniig Room located at Oakton and Center Streets, Des Plaines. In the past four years I have repeatedly inquired and applied for license, but with no results: I am earnestly trying to build a reputation as a good eating establishment in the City of Des Plaines, but find progress very slow and the loss of many customers because of no liquor. Am contemplating an addition to the present building in which section I would place a service bar only. Liquor to be served at tables only. This would give me two separate dining rooms, one where cocktails and meals would be served and one for those who desire meals only. I am positive that the new dining room would attract only the clientele who enjoy a cocktail or two before dinner. I fail to see where this type of service could be a detriment to the public welfare or in any way infringe on the reputation of the City of Des Plaines as a good city to live in. To the Mayor and members of the City Council, I would appreciate your kind consideration of my present application. LETTER FROM REV. R.V.LAYMAN, CHURCH OF NAZARENE The Clerk read a letter from Rev. Layman objecting to City Manager form of government. The item of construction at Meyer Coal Co. was referred to the Building Permit Uommittee and Building Inspectors to make a check of same. On motion -by Alderman Clement and seconded by Schallawitz the house area and minimun lot frontage in Homerica was referred to the Zoning Board of Appeals. ADJOURNMENT. The motion was made by Alderman Hansen and seconded by Behrel to adjourn. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the meeting regularly adjourned.
