THE CITY COUNCIL OF DES PLAINES,

CHAMBERS, MONDAY, SEPTEMBER 17,
19511 AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth
G. Meyer who presided with Alderman Hansen,Davis,Wolf,Tures,Schallawits,
McKay,Morava and Auck responding to roll call. Alderman Behrel and
Clement were absent.
OFFICIAL REPORTS. The Clerk submitted the report of City Treasurer
for the month of August. The Clerk read the following reports

Gentlemen:
The City treasurer was instructed to call Bonds #31 to #35 of
the 1947 Water Revenue Bonds issue for payment November lst,1951. This
Completes payment of the Twenty-five bonds which were callable. This leaves
a total of ten bonds, $10,000.00, unpaid out of the issue of $55,000.00.
For the benefit of the new alderman, I wish to explain that once
a month you notice a cash transfer of "water cash" to "water revenue bond
cash" in the resolution of disbursements. The 1935 and 1947 Water Revenue
Bond Ordinances are similar in this respect. At the end of each month before
any other disburs ement of water sales cask is made, the transfer of the
amount of money for the bond accounts must be made first.
The Water Revenue Bond Accounts fiscal year begins November 1st,
of each year. In October of each year, therefore, it is the duty of the
City Clerk to check to see the amount of money to be prorated monthly for
these bond accounts. In November 1949, the 1935 Bond account had sufficient
funds for two years, so no cash transfers were needed. On approval of Mayor
Meyer at that time, we started to transfer $1,500.00 monthly to the 1947
Water Revenue Bond Account. With this amount transferred, it was possible
to call ten bonds totaling $10,000.00 in 1950, and fifteen bonds totaling
$15,000.00 this year.' In calling these bonds in advance, there was a saving
of $3,918.75 in interest ( interest is at 2 3/4% per year.)
The ten outstanding bonds will be paid in 1952 and final in 1953.
The final payment of the bonds would have been in 1958 if they had not been
called.
The total of 1935 Water Revenue Bonds outstanding.which are not
callable is $68,000.00, with final payment on November lst,1964.
The transfer of "water cash" beginning November 1st, 1951 for the
next year will be a total of $1,000.00, with $500.00 going to each bond account.

Mr reason for making this report is that the public, and sometimes
the city alderman, do not hear of items where there has been a saving
of money for the taxpayers.

No doubt you all know the City of Des Plaines' finances are
in better condition than most cities and villages, and this has been
done without the employment of a high salaried city manager.

CITY FUEL OIL CONTRACT AWARED TO SHALL OIL COMPANY WITH NORTHWEST
HEATING AND AIR CONDITIONING ENG. INC. AS AGENT. On motion by Alderman
Wolf and seconded by Schallawitz the Shell Oil Company was awarded the
contract to supply the City Hall with fuel oil.
Alderman Tures reported the Water Committee has met with Mr.
Klein of Town Improvement corp., regarding to supply the territory south
of Touhy Avenue with water in an emergency. On motion by Alderman Tures
ans seconded by Schallawitz the council turned down the request for a water
main extension with valve to supply the water,Alderman Tures made the
motion to supply tke.corporation water with fire hose connection for one
week during an emergency. The motion was lost for want of a second.
On motion by Alderman McKay and seconded by Auck the Council approved
that the corporation contact the City when they have an emergency.
Alderman Auck made a report on Nebel Trailor Park using City
sewer on rental charge. The Mayor referred the matter back to the sewer
Committee,City Engineer, Mayor and City Attorney.
APPROVAL OF BILLS. Alderman McKay, Chairman of the Finance
Committee presented the following proposed resolution:

ARE DUE AND PAYABLE AND THAT THE MAYOR AND

The motion was made by Alderman McKay and seconded by Morava to adopt

I have your letter of September 5,requesting that,town
name signs be placed on Mannheim Road and on River Road at the south City
limits.
It was my understanding that the town name signs qn River Road
was re -located to Touhy Avenue in connection with the extention of the
speed zone on River Road but a check will be made,to see if the sign is
.at the proper location.
It will be necessary to conduct a speed survey on Mannheim
to determine what posting is justified between Howard and Touhy Avenue
before the sign can be re -located. This surveys will be done at the
time the speed zones on Wolf Road are checked.

and attested to by your secretary, who should also affix your corporate
seal. When this has been done, return all copies to this office for similar
attention on behalf of the Railway Company. When license has been fully

RESOLUTION ON BUILDING AT 1122 CAMPBELL AVENUE. The Clerk read
the following proposed resolution:
RESOLUTION
WHEREAS numerous complaints have come to the attention of the
appropriate officers of the City of Des Plaines and to the City Council, regarding
the safety and sanitary condition of the property known as 1509 Campbell Avenue,
Des Plaines,Illinois; and acting upon the said complaints, the City Council
has caused an investigation to be made by the Building Commissioner, Fire
Department, and Health Inspector of the City of Des Plaines; and whereas,
after due investigation by said officials and based upon their reports, it
appears to the Council that said building is in a dangerous condition, is
dilapidated,unsanitary and hazardous to occupants and neighbors, and constitutes
a fire hazard both to the persons occupying it and to surrounding residents.
NOW, THEREFORE, ,BE IT RESOLVED that the City Council of the City
of Des Plaines finds that said building known as 1509 Campbell Avenue, Des
Plaines,Illinois, is a dangerous building in the following particular respects:
1. The building is old, dilapidated,dangerous and unhealthful.
2. It has not been painted or cared for in years.
3. Wood shingles on the front porch roof are loose and blow
off in strong winds.
4. Front and rear porch steps are in dangerous condition.,
5. There are two bedrooms on the second floor, a stairway
leads up to them from the first floor.
6. The chimney is at the head of the stairs- no railing or
guard around stair opening or leading down, this is most
hazardous.
7. There is a sink in the kitchen which is the only source
of water in the house; there is no bathroom in this
dwelling, the toilet is in the basement on the dirt floor.
8. The rear room in the basement has a wood floor over dirt
floor, and behind this is another scall room for storage
purposes.
9. The garage to the rear of the lot is also in bad condition.
10. A fire occurred in this building on July 29th,1951, some
hundred dollars damage was done.
11. A second fire occurred in this building on September 1st,
1951, causing $3,000.00 damage.

BE IT FURTHER RESOLVED that a period of thirty
days shall be granted to the pwners and occupants of the said building
in which to put the same in a safe and sanitary condition, or in the
alternative to forthwith demolish the same. Said building shall be
repaired and reconditioned in such a manner as to eliminate all of the
above described defects.

BE IT FURTHER RESOLVED that in the event the building is
not put in a safe and sanitary condition within the aforesaid time limits,
it is hereby ordered by the City Council of the City of Des Plaines that
same be demolished.
BE IT FURTHER RESOLVED that notice of the action of the
City Council and a copy of this resolution, shall in accordance with
the ordinance in such case made and provided, be served upon the occupants
of said building by the Building Commissioner of the City of Des Plaines
or by some person authorized and directed by him to do so and that a copy
be mailed John F.Ryan,who is purported to be the attorney and agent for
the property, at 111 W. Washington Street, Chicago 2,Illinois.

LETTER FROM PROPERTY OWNERS ON FARGO AVENUE. The Clerk read the
following letter which was signed by eight owners:

We the undersigned being residents of the south side of Fargo
Avenue,(lot numbers indicated below ) respectfully request relief from the
building code which prohibits building closer than 25 feet from a street.
This restriction, if applied, would force us to build garages in the middle
of our yards as Jarvis Street is laid out immediately behind our lots.
We request the lowering of this restriction to allow us to build to within
10 feet of the back lot line.
This situation parallels a similar situation that existed on the
north side of Welwyn Street and was remedied in like manner as our request.

The Mayor referred the letter to the Building Permit Committee.
The Clerk read a letter from the Des Plaines Garden Club regarding
the damage of shrubs in park by workmen on traffic lights. The Mayor
referred the letter to the Street Committee and Engineer.
COUNTY ZONING HEARING "TOUHY AVENUE" WEST OF MT. PROSPECT ROAD.
The Clerk reported receiving a notice of Zoning hearing on Touhy Avenue 3/8
of a mile west of Mt. Prospect road. The Clerk *as instructed to mail a
report to Alderman Clement and to the Clerk of Mount Prospect.
Alderman Schallawitz reported the arches at entrance of
Homerican Subdivision were falling down. The Mayor referred the
matter to the Superintendent of Public Works.
Alderman McKay reported about the poor condition of fences
around Miss Bennett's to resident excavations in Cumberland Terrace.
The Mayor referred the item to the Building Permit Committee.
Alderman McKay requested that a fence or some retaining wall
be placed around the ditche which the Hannifin Corp. has made at their
location. 75 Feet from Wolf Road. The Clerk was instructed to write
to that corporation.

Alderman Clement reported on the County Zoning Hearing at Mount
Prospect regarding property on Touhy Avenue. 3/8 of a mile west of Mount
Proppect Road. The request was to rezone from Farming to B-1 Business
for a Trailor Park. On motion by Alderman Clement and seconded by
Hansen,the Clerk was instructed to write the County Zoning Board that the
Council objected to the rezoning.
Alderman Davis reported on variation request on Fargo Avenue
regarding set -back of garages, that the variation be granted. Alderman
Davis made the motion which was seconded by Morava to concur in the report.
After discussion themotion was withdrawn. The motion was then made by
Alderman Clement and seconded by McKay that the variation be referred
to the Zoning Board of Appeals, with the application fee to be waived amd
only the $15.00 publication fee be charged. The Mayor put the question
and the Clerk called the roll with the following result: Ayes: Alderman

Alderman Davis reported that the building permits have expired
on the Bennett excavations in Cumberland Terrace and the Committee
recommended that the City Clerk write to inform her to fill in the excavations
within 30 days or the City will do so at her expense. The Clerk was so
instructed.
