08201951MINUTES OP THE REGULAR MEETING OP THE CITY COUNCIL OP DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY AUGUST 20,1951, AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G.Meyer, who presided with Alderman Hansen,Davis,Wolf, Tures,Behrel, Schallawits,MoKay,Clement, Morava and Auck responding to roll call. OFFICIAL REPORTS. The Clerk submitted the July monthly report of Treasurer L.C.Barrett. ATTORNEY N.S. HOWARD FINAL REPORT ON DR. STEINFELDT CASE. The clerk read the following letter: August 17,1951 Honorable Mayor and City Council of the City of Des Plaines City Hall Des Plaines,Illinois Gentlemen: I am pleased to report to you that the Steinfeldt case has now been completely disposed of. Judge Courtney entered a final decree today enjoining the Cita* of Des Plaines from interfering with the operation of Dr. Steinfeldt's institution as a "rest home". In the same decree he entered an injuotion on behalf of the City of Des Plaines enjoining DD,Steinfeldt from ever treating or keeping at this institution any insane or psychopathic patients• He also enjoined Dr. Steinfeldt from using the institution as an office or place of business for the treatment of patients of any kind. This is in accordance with the proposed settlement heretofore discussed with you and I think represents a very satisfactory settlement of this long -pending case. Respectfully submitted, Marshall S. After discussion the motion was made by Alderman Tures and seconded by Wolf that the Council authorise-: the purchase of two hydraulic valves from the American Car and Foundry Company at a cost of $960.00. Lys: None The Mayor thereupon declared the motion carried. REZONING BOARD RECOMMENDATION OF LITTLEFUSE,INC.APPLICATION. The Clerk read the following letter: Mayor & City Council City of Des Plaines,Illinois August 13,1951 Gentlmen a Your Zoning Board of Appeals sitting as a commission had referred to it the application of Littlefuse,Ino. to resone certain real estate located at 1865 Miner Street, Des Plaines, consisting of a Twentdytwo (22) foot strip which included the following: The West eight(8) feet of lot 24 in Cook County Clerk's Division of Lands in the Northwest Quarter of Section 21, Township 41 North,Range 12,East of the Third Principal Meridian in Cook County,Illinois Also ( ZONING BOARD'S LETTER CONTINUED) The eight (8) feet lying fourteen (14) feet West of the East Boundary of that part of Lot 169 lying South of Miner Street and West of Lot 39 in Albert E.Clark's Subdivision, in the City of Des Plaines, County of Cook and State of Illinois; Advises as follows: 1. That due notice to the parties and to the public of this proceeding and of the public hearing therein was given as required by law and that the Board has jurisdiction of the subject matter and of the parties. 2. That the petitioner wished to utilize the property for Indus- trial use in conjunction with about 220 feet west of and contiguous to the property. 3. That there were three (3) objectors to re -zoning the entire twenty-two (22) feet but who agreed to re -zoning seven (7) feet at the public hearing. 4. That the land is not suitable for residential use. 5. That the easterly fourteen (14) feet,of the twenty-two (22) foot strip in the original petition should remain residential and thus act as a buffer zone for the benefit of the residents on the West side of Mason Land and'that the Westerly eight (8) feet ( the property described above) should be rezoned to Industrial Use for•the benefit of the owners of the property,Littlefuse. The Zoning Board of Appeals, acting as a commission, having heard and considered the evidenee and being fully informed on the matter, on a vote of four (4) for the proposed amendment and one (1) against the proposed amendment, recommends to the Mayor and the City Council that the proposed amendment to the Zoning Ordinance hereinbefore described, be adopted. Gundelach Secretary After discussion with two representatives of the Littlefuse,Inc, the motion was made by Alderman Hansen and seconded by McKay to concur in the recommendation to re -zone to industrial the Westerly eight feet, the City attorney to. draft an ordinance, but that the Zoning Board of Appeals reconsider the zoning of the westerly fourteen feet and re -zone to Industrial. The motion was voted upon by acclaimation whereupon the Mayor declared the motion carried. JUNIOR LEAGUE TO OPERATM SERVICE MEN'S CANTEEN. Alderman Clement read a letter from Ike. P. Hooker of the Junior League regarding the Service Men's Canteen. $60.00 from the City to operate was requested. The motion was made byAlderman Clement and seconded by McKay that the City Council approve the payment of $60.00 to the canteen. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Haneen,Davis,Wo1f,Tures,Behrel,Schallawitz,MoKay,Clement,Morava and Auck. Naves: None . The Mayor thereupon declared the motion carried. APPROVAL OF BILLS. Alderman McKay presented the following proposed resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERM BE AND ARE HEREBY AUTHORIZED TO !AKE PAYMENT,FCR SAME. (Schedule of bilis placed before each alderman and affixed to resolution and on file with the City Clerk.) The motion was made by Alderman McKay and Seconded by Hansen to (APPROVAL OP BILLS CONTINUED) adopt the proposed resolution. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen, Davis,Wolf,Tures,Behrel,Schallawitz,McKay,Clement,Morava and Auck. The Mayor thereupon declared the motion carried and the proposed resolution adopted. REQUEST TO INCREASE LIQUOR STORE LICENSE TO FOUR. Alderman Morava made the motion that the Liquor Control Ordinance of this City as amended, be, amended so as to increase the permissable number of package store licenses from its present maximum of three, to a maximum of tour such licenses. The motion was then made Wideman Davis and seconded by McKay to refer to the Council sitting as Committee of the whole. The motion was voted upon by acclaimation,whereupon the Mayor declared the motion carried. ATTORNEY HOWARD'S REQUEST TO AY DR.PURVES $45.00 AS CIK`Y'S SHARE OF TAXES. The Clerk read a letter from Attorney Howard requesting the City to pay its share of 1950 Taxes as agreed on purchase of six- teen feet of land for Prairie Avenue. The motion was made by Alderman Davis and seconded by Behrel that the City pay Dr. Purves $45.00 as the City's share of 1950 Taxes. The mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen,Davis,Wolf,Tures,Behrel,Schallawitz,MaKgy,Clement,Morava and Auck. Nays: None. The Mayor thereupon declared the motion carried. COOK COUNTY _ 7P FOR WATERMAIN AT THAdKER STREET AND MOUNT PROSPECT ROAD. The Clerk informed the Council he had received a permit requested by Engineer Fletcher from the Cook County Highway Department for watermain at Thacker Street and Mount Prospect Road which required the signature of Mayor and City Clerk. In motion by Alderman Wolf and seconded by Behrel the Mayor and Clerk were authorized to sign the permit. PETITIONS FOR SEWER AND WATERMAIN ON DES PLAINES AVENUE BETWEEN HOWARD AND BIRCHWOOD STREETS. The Clerk read the petitions for sewer and watermain for the above street which the Mayor referred to the Board of Local Improvements. The Clerk read a letter which was received'by Alderman Auck from the Bureau of Census that the Des Plaines 1950 Census figure was 14,975 subject to minor changes. The Mayor referred the letter to the Municipal Development Committee. The Clerk informed the Council he had received a copy of stream pollution report on the Des Plaines River from the State Sanitary Water Board. The Mayor said he would take the oopyand later return same to City Clerk so that any of the Alderman desiring to study same. PASS MOTEL AND TOURIST CAMPS ORDINANCE. The Clerb read for second reading the following, proposed ordinance entitled: AN ORDINANCE REGULATING THE CONSTRUCTION AND OPERATION OF MOTELS AND TOURIST CAMPS. The motion was made byAlderman Davis and seconded by Hansen to pass the proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen,Davis,Wolf,TUres Behrel,Schallawit*,and Morava. Nays:.Alderman MoKay,Clement and Auck. The Mayor thereupon declared the motion carried and the proposed ordinance passed. PASS FOUR WAY STOP AT CENTER STREET AND PRAIRIE AVENUE. The Clerk read for first reading the following proposed ordinance entitled: AN ORDINANCE PROVIDING A FOUR WAY STOP AT THE INTERSECTION OF CENTER STREET AND PRAIRIE AVENUE. The motion was made by Alderman Davis and seconded by Hansen to suspend the rules and pass the proposed ordinance. The City Clerk read for first' reading the following proposed ordinance entitled: AN ORDINANCE TO PROHIBIT PARKING ON THE SOUTH SIDE OF PRAIRIE AVENUE FROM SECOND AVENUE TO WOLF ROAD The motion was made by Alderman McKay and seconded by Clement to suspend the rules and pass the proposed ordinance. The motion was made by Alderman Clement and seconded by McKay to suspend the rules and pass the proposed ordinance. The motion was made by'Alderman McKay and seconded by Behrel to suspend the rules and pass the proposed ordinance. The Mayor - thereupon declared the motion carried and the proposed ordinance passed. FIRST READING OF ORDINANCE MAKING HARDING AVENUE ARTERIAL STREET AT LEE STREET TO WESTERN AVENUE. The clerk read for the first reading the following proposed ordinance entitled: AN ORDINANCE MAKING AN ADDITIONAL PART OF HARDING AVENUE AN ARTERIAL HIGHWAY WITHIN THE CITY OF DES PLAINES. The Mayor ordered the proposed ordinance placed on file for second reading. On request of Alderman Clement the Clerk was instructed to write to the Park District to see if they would allow the City to cut the weeds on the property at Greenview Avenue and Wolf Road, which the district has purchased for a park. This is to be done to all allow the Childred to play ball. .576' The Clerk was instructed to write a letter to the Des Plaines Park District inquiring if they will extend the sub -lease of C. & N.W. Patk. ;Also informing them that the C. & N.W. Railway Company have given permission to maintain the S.W. corner of Miner Street and Graceland Avenue. CIVIL SERVICE COMMISSION TO CALL EXAMINATIONS. In motion by Alderman Hansen and seconded by Auck the Civil Service Commission is to be instructed to call examinations for the following positions: Opirator,serviceman for Water Department, and Laborer for Street Department. APPROVAL OF MINUTES.. The motion was made by Alderman Behrel, and seconded by Tures, to approve the minutes of August 6,1951.
