08061951LUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY,AUGUST 6TH.1951. at 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Alderman Hansen, Davis, Wolf, Tares, Behrel, Schallawits, McKay, Clement, Morava and Auck responding to roll call. OFFICIAL REPORTS.The Clerk submitted the reports of Building Inspector and Clerk's report for July. CITY ATTORNEY REPORTS. The Clerk read the following report: August 6,1951 Honorable Mayor and City Council of theCity of Des Plaines City Hall Des Plainee,Illinois Gentlemen: I an pleased to report to you that on July 30,1951 Judge Harry M• Fisher of the Circuit Court decided in favor of the City of Des Plaines in the lawsuit against us i;y Clifford 0. Lund, involving coning on his lot on Lincoln Avenue in Des Plaines. On that date I had an order entered rendering judgement in favor of the city of Des Plaines and dismissing the suit. The Clerk read the following report: August 6,1951 Honorable Mayor and City Council of Des Plaines City Hall Des Plaines,Illinoia Gentlemen: Sometime age in an automobile accident one.of our street lights was run down and knocked over. It was replaced at a cost to us of approximately $480.00. Since that date I have spent.a considerable amount of time attempting to collect for this loss from the insurance company insuring the driver. In spite of the fact that I have submitted receipted bilis, they deny that our dollar damage could have been anywhere near as great and originally offered $200.00 in settlement. After a long series of negotiations and discussions, they have now reached an offer of $375.00 I am convinced that this is their maximum offer and would recommend its acceptance. In the. event we fail to accept this settlement, I shall have to sue the driver and prove that it was his negligence which caused the accident and resulting damage to our property. In ay opinion such a case would be a doubtful one. If you agree with me, will you please authorise the acceptance of this settlement and authorise, the Mayor and City Clerk to sign the proper releases. Yours very truly, MARSHALL S. The Clerk read the following report which had four letters from property owners desiring to have building condemned attached. August 3,1951 Honorable Kenneth G. Meyer, Mayor and Members of the City Council Des Plaines,Illinois Gentlemen: We wish to bring to your attention the unhealthful,dangerous and dilapidated condition of the fram house at 1509 Campbell Avenue, Des Plaines, Illinois. Mr. Arthur F.Rieck, Building Commissioner and Mrs. L.A.Willer, Health Inspector and Mr. Racy Kolse, Fire Inspector, made an inspection of this building on July 27th,1951 and wish to report the following: 1. The building is old, dilapidated, dangerous and unhealthful. 2. It has not been painted or cared for in years. 3. Wood shingles on the front porch roof are loose and blow off in strong winds. 4. Front and rear porch steps are in dangerous condition. 5. There are two bedrooms on the second floor, a stairway leads up to them from the first floor. 6. The chimney is at the head of the stairs-- no railing or guard around stair opening or leading down, this is most hazardous. 7. There is a sink in the kitchen which is the only source of water in the house; there is no bathroom in this dwelling, the toilet is in the basement on the dirt floor. 8. The rear room in the basement has a wood floor over dirt floor, and behind this is another small room for storage purposes. 9. The garage to rear of lot is also in bad condition. 10. A fire occurred in this building on July 29th,1951, sone hundred dollars damage was done. John F.Ryan, lawyer for the owner, was in the City of Des Plaines on July 30th,1951. He went through the building with Mr. Rieck, Mrs. Willer, and Mr. Hodlmair. Mr. Ryan had these suggestions to offer: a. Repair the building and put it in good condition. b. Sell it and the new owners would have to do the repairing and reconditioning. c. Tear it down. Mr. Rieck and Mrs. Willer requested that the building be torn down. W. REZONING LOTS 2 AND 10,BLOCK 2,ADDITION TO RIVERVIER.The Clerk read the following letter: August 2nd,1951 Mayor and City Council City of Des Plaines,Illinois Gentlemen: Your Zoning Board of Appeals, sitting as a commission, had referred to it the petition of residents of an area near the intersections of White, Everett and Linden Streets, Des Plaines, to re -sone the following described real estate from its present classification of Multi -family Residence Area District "B" to Single Family Residence Area District "A" to wit: Lots 9 and 10, Block 2, of Arthur T.MoIntosh & Co.'s 2nd Addition to Riverview, being a subdivision of the N( of the Sift of Section 28, Township 41 North,Range 12 East of the Third Principal Meridian, in Cook County,Illinoie. advises as follows: 1. That due notice to the parties and to the public of this proceeding and of the public hearing therein was given as required by law and that the Board has jurisdiction of the subject matter and of the parties. 2. On•motion by Alderman Hansen and seconded by Behrel the City Attorney was instructed to draft an ordinance. On motion t' Alderman Behrel and seconded bykuck the Council approved the Mayor's order to the City Clerk to write "Fire Contracts" to end December31,1951. Alderman Behrel reported receiving a letter with four questions regarding a contract for "Fire District". He said he could answer all but the question on amount of money desired by the City. On motion by Alderman Behrel and seconded by Clement the Clerk was instructed to reply to the letter.. TO ADVERTISE FOR BIDS ON FUEL OIL FOR CITY HALL. Alderman Wolf reported the committee investigated and found it would be advantageous to have competitive bidding on the fuel oil contracts and recommended that the City Clerk be instructed to advertise for bids to be returned at the September 4th,1951, meeting. On motion by Alderman Wolf and seconded by clement the report was concurred in. Alderman Wolf reported the Committee investigated the matter of an auto mechanic and found that in the last three years the equipment and maintenance had not been over $2,800.00 any one year. They recommended that at the present time this matter warrants no action. Alderman Schallawits reported that the Committee investigated the matter of increase in taxicab fares and found the increase in fares suitable to the committee. On motion by Alderman Schallawits and seconded by Behrel the report was concurred in, the attorney was instructed to draft an ordinance. Alderman Hansen reported an appraisal of parking lot and the motion was made by Alderman Hansen and seconded by Morava that the City Attorney was to contact the owners of the property. The motion was•then made byAlderman Davis and seconded ty Schallawits to refer.the matter to the Council as a committee of the whole for study. Alderman Auck reported that Engineer Fletcher had some new specifications on the south side storm sewer and the bond company would soon take action. Alderman Auck also reported the School Board had tabled the draining of storm water at South School. On motion by Alderman Davis and seconded by Hansen, the City Attorney was to draft &proper ordinanoe to adopt the Suburban Building Code. On motion by Alderman -Davis and seconded by Auck the City, Attorney was instructed to re -draft the Motels and Tourists Camp Ordinance. APPROVAL OF BILLS. Alderman McKay presented the following proposed resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. (Schedule of bilis placed before each alderman and affixed to resolution and on file with the City Clerk.) The motion was made by Alderman McKay and seconded by Tures to adopt the proposed resolution. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Hansen,Davis,Wolf, Auck, Behrel, Sohallawits,Mclay,Clement, ]brava and Auck. Nays: None. On motion by Alderman Behrel and seconded by Davis the Clerk was instructed to open the bids on police car. The Mayor put the question and the Clerk called the roll with the following results Ayes: Alderman Hansen, Davie,Wolf, Tures, Behrel, Schallawits, MoKay,Clement, Morava and Auck. The Mayor thereupon declared the motion carried. OPEN BIDS ON MAINTENANCE OF ARTERIAL STREETS.M.0n motion by Alderman McKay and seconded by Clement the Clerk was instructed to open the bids on maintenance of arterial streets. The Mayor thereupon declared the motion parried. TWO SANITARY DISTRICTS OF CHICAGO -PERMITS 1211.1g AND 195112. The Clerk informed the council he had two Sanitary District Sewer Kraits No. 1951-38 and 1951-39, which must be accepted, signed and sealed. On motion by Alderman McKay and seconded ba+ Morava, the permits were accepted and the Mayor and City Clerk were authorized to sign and seal the permits. COOPER LETTER ON LIGHTPOST. The Clerk read a letter regarding a light post which Mr. Cooper,1632 Spruce Street, claims is on his property. The Mayor referred the letter to the City Attorney, Superintendent of Publio Works and the Street Committee. KATHERINE KR! LETTER OF RESIGNATION. The Clerk read the following letter: City Council and Mayor City Hall Des Plaines, Illinois Gentlemen: August 1,1951 I,Katherine Kruger, am resigning from 4 duties of deputy clerk on October 31st,1951. However, if a replacement is not obtained before this time, I shall be glad to work for a short time afterward or whenever help_is needed. I am taking this opportunity to say that it has really been a x'70 KATHERINE KRUGER'S LETTER OF RESIGNATION CONT'D. pleasure to work for Mr. Henrich and am sure that the replacement, like those continuing to serve him, will soon realize that a better boas could not be found. Also to promote assistant, Deputy Clerk, Ptatsy Ann Benderwald, to Deputy Clerk. Mayor Meyer reported to the Council of his meeting with officials of Benjamin Electric Manufacturing Company regarding dust nuisance. On request of the Superintendent Wernicke the Mayor referred the matter of purchase of a rubbish dump to the Sanitation Committee. APPROVAL OF MINUTES. The Motion was made by Alderman Clement and seconded b9 Behrel to approve the minutes of July l6th,1951. The motion was voted upon by acclamation whereupon the Magor declared the motion parried and the minutes approved. ADJOURNMENT.
