07091951DALE L. MENSCHING AND RAYMOND E. STOWE APPOINTED POLICE PATROLMEN, EFFECTIVE JUNE 121'2, 1951. The Board of Fire and Police Commissioners ap- pointed Dale L. Mensching and Raymond E. Stowe as police patrolmen, effective June 15, 1951. The Mayor requested the Council to meet as a committee of the whole on Monday, June 25th regarding the insurance report. The Mayor suggested that due to the Fourth of July, the Council postpone the July 2nd meeting to July 9th. On suggestion by Alderman Auck, it was approved on motion by Alderman Auck and second by Behrel, that the Fire Department make applica- tion for membership in the National Fire Protection Association. Alderman Clement reported that he had received a letter from Electro -Seal corporation for a street light on North Avenue. The Mayor referred the item to the Streets Committee. APPROVAL OF MINUTES. The motion was made by Alderman Clement and seconded by Morava to approve the minutes of June 4, 1951. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried and the minutes approved. ADJOURNMENT. The motion was made by Alderman McKay and seconded by Morava to adjourn. The meeting was called to order by the City Clerk, Otto W. J. Henrich. Due to the weekend holiday, there was no member of the Council present. Because there was no quorum, the City Clerk presiding ordered the meeting adjourned until Monday, July 9, 1951, at 8:00 p. m. OTTO W. J. HENRICH CITY CLERK MINUTES OF THE ADJOURNED MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY. JULY 9. 1951. AT 8:00 P. M. CALL TO CRDER. The meeting was called to order by Mayor -Kenneth G. Meyer, who presided with Aldermen Hansen, Davis, Wolf, Tures, Behrel, Schalla- witz, McKay, Morava and Auck responding to roll call. Alderman Clement was absent due to vacation. OFFICIAL REPORTS. The Clerk submitted the monthly reports of Building Inspector, Arthur Rieck and City Treasurer, L. C. Barrett and the City Clerk, Otto W. J. Henrich's report for June. The semi-annual report of the receipts and disbursements for 1951 was also submitted. COMMITTEE REPORTS. Alderman Behrel reported that the Public Pro- tection Committee investigated and found the Studebaker squad car is in need of repairs and new tires. The committee, therefore, recommended that we COMMITTEE REPORTS, CONT'D. advertise for bids for a new squad car, trading in the Studebaker. The bids are to be returned by the August 6th meeting. Specifications as per those in possession of the City Clerk are to be approved by the police marshal. On motion by Alderman Behrel and second by Schallawitz, the report was con- curred in. On motion by Alderman Schallawitz and second by Behrel, the City Attorney was instructed to write letters to the business people who have not paid their licenses, allowing ten days to pay or be prosecuted. having Alderman Tures reported about/a fire hydrant on Wolf Road at the Hannifin building. After discussion, on motion by Alderman Tures and second by McKay, the City is to install a fire hydrant on the west side of Wolf Road. Alderman Auck reported concerning the Nebel Trailer Camp connecting to the City sewer. He stated that another meeting would be held with their representatives in regard to this matter. The Mayor referred the Motel and Tourist Camp Ordinance back to the Building Permit Committee. Alderman McKay reported for Alderman Clement, Chairman of the Municipal Development Committee, that the committee recommended the installation of gates at Prairie, Thacker, Graceland and Lee Streets and the closing of Walnut and Oakwood Avenues at the tracks. On motion by Alderman McKay and second by Behrel, the report was concurred in. ZONING VARIATION AT 1944 CHESTNUT STREET APPROVED. The Clerk read a letter from the Zoning Board approving the variation at 1944 Chestnut Street. ZONING BOARD LETTER ON SIDE YARD ORDINANCE. The Clerk read the following letter: June 22, 1951 Mayor and City Council City of Des Plaines, Illinois Gentlemen: Your Zoning Board of Appeals, sitting as a commission had referred to it the reconsideration of the present provisions of the Zoning Ordinance relating to the side yard or side line requirements in residence districts, and advises as follows: 1. That due notice to the public of this proceeding and of the public hear- ing was given as required by law and that the Board has jurisdiction of the subject matter. 2. That the present provisions of the Zoning Ordinance are not reasonable and just when applied to the construction of garages or other accessory buildings, particularly where the main building has already been erected. 3. That there were no objectors to an amendment to provide for smaller side yards for accessory buildings aa presented below, at the public hearing. 4. That the following amendments be made to the Zoning Ordinance: Accessory buildings may be built in a required rear yard but such accessory buildings shall not be nearer than three (3) feet to any side or rear lot line, nor nearer than five (5) feet to any alley abutting the rear of the lot, nor shall any such accessory building occupy more than thirty (30) per cent of the required rear yard. Where lots now have existing main buildings with a side yard of less than the above requirements, ac- cessory buildings may be built with side yards of not less than that of the main building. ACCESSORY BUILDINGS. A subordinate building, the use of which is incidental to that of the main building. The Zoning Board of Appeals, sitting as a commission, having heard and considered the evidence and being fully informed, on a vote of five (5) for the proposed amendment and none (0) against, recommends to the Mayor and the City Council that the proposed amendment to the Zoning Ordinance hereinbefore described, be adopted. 6"58 ZONING BOARD LETTER., CONT'D. The motion was made by Alderman Behrel and seconded by Hansen to pass the proposed ordinance. The Clerk read for second reading the following proposed ordinance entitled: AN ORDINANCE FOR THE SALE AND ASSIGN- MENT OF SPECIAL ASSESSMENT LIENS OF SPECIAL ASSESSMENT WARRANTS NUMBERED 12 AND 14 ,,_OF THE CITY OF DES PLAINES. The motion was made by Alderman Hansen and seconded by Morava to pass the proposed ordinance. Alderman Davis reported about a meeting of property owners in Cumberland regarding the dust from Benjamin Electric Manufacturing Company. On motion by Alderman Davis and second by Auck, the Mayor is to confer with Hoyd Steele, an official of Benjamin Electric. APPROVAL OF BILLS. Alderman McKay, Chairman of the Finance Com- mittee, presented the following proposed resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOL- LOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. The motion was made by Alderman McKay and seconded by Morava to adopt the proposed resolution. "The Finance Committee recommends Fire and Ext. coverage for the incinerator building in the amount of $31,000.00. Three year premium to be approximately $111.60, or an average annual cost of about $37.20. "No auto fleet collision insurance at this time. "Under general liability, sidewalks and streets only. Behrel On motion by Alderman McKay and second by Davis, the report was concurred in. PASS RESOLUTION TO BECOME MEMBER OF TRI -COUNTY HOME RULE ASSOCIATION. The Clerk read the following proposed resolution: A RESOLUTION Authorizing and directing the Mayor and Clerk to make the City of Des Plaines a Municipal Corporation, a member of the TRI -COUNTY HOME RULE ASSOCIATION and to pay the membership dues provided by the By -Laws of said Associ- ation. WHEREAS, an association of municipalities, known as the TRI -COUNTY HOME RULE ASSOCIATION, has been formed for the purpose of coordinanting the government functions of municipalities within Gook, Lake and DuPage Counties, outside of the City of Chicago, for the purpose of promoting legislation desirable for the mutual welfare of its membership and to oppose all legis- lation designed to violate the political integrity of its members, and to use all honorable means to secure and preserve the right of suburban com- munities to home rule on all matters of purely local concern; and WHEREAS, Mayor and City Council have determined that it will be to the best interests and advantage of the City of Des Plaines to belong to said Association, and to.become a (Class "A" or "B") member thereof; NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED THAT Mayor of the City of Des Plaines, Illinois, and the City Clerk, of said City, be and they are hereby authorized and directed to take the necessary steps to enroll the City of Des Plaines, a Municipal Corporation, in the organi- zation known as the TRI -COUNTY HOME RULE ASSOCIATION, all in accordance with its By -Laws adopted at Oak Park, Illinois, at a general meeting of said Association on June 7th, 1951. BE IT FURTHER RESOLVED that the said Mayor and the Clerk be and they are hereby authorized and directed to issue a warrant, in payment of dues, for the year beginning July 1st, 1951 and ending June 30th, 1952. That said warrant for annual dues be in the sum of fifteen (15.00) as pro- vided in Article IV of the By -Laws of said Association. BE IT FURTHER RESOLVED THAT Kenneth G. The Clerk read a letter from the Cumberland Maintenance Corporation regarding their street lighting system. The Mayor referred the letter to the Street Committee. TWO LETTERS FROM THE WEST DES PLAINES CIVIC ASSOCIATION. June 21, 1951 City Clerk City Hall Des Plaines, Illinois Gentlemen: Once again Wolf Road is being torn up for the purpose of installing utilities. It has been the practice in the past for the city or the contractors to tear up the parkways and in replacing, to put the top soil on the bottom of the ditch, and the clay on the top, leaving the parkways in a very unsightly condition. It has been up to the property owners to replace bushes, sod and plant new grass. I think it is only fair that in the awarding of contracts that call for digging up the parkways, that the contractor be required to replace all bushes and lawns, as he found thew. Tapper Chairman, Streets & Safety Committee July 9, 1951 We would like to call your attention to the holes and the breaking up of the pavement on Thacker Street between Wolf Road and the Northwestern Railroad tracks. This breaking up is caused by the heavy trucks of the Meyer Coal and Material Company. Some time ago, the County put eight ton load limit signs on Thacker Street, which are being ignored. Some years ago, the city council passed a fifteen mile an: hour speed limit for Thacker Street in order to protect the pavement. There has never been any attempt to enforce the law. We strongly urge that the City of Des Plaines enforce the speed ordinance as well as pass an ordinance governing load limits. We urge that a five ton limit be placed on Thacker Street. Mannheim Road at Oakton Street Des Plaines River Road at Algonquin Road This Department has a policy that when traffic signals are installed and maintained by us, the Municipality is to pay for the electrical energy used in operating these signals within their limits. Attached hereto, are two sets of an agreement in triplicate for the payment of the electrical energy used to operate the signals at the intersection of Des Plaines River Road and Algonquin Road and for the southeast corner of Mannheim Road and Oakton Street. Alderman Auck reported in regard to Changing the districts in the City Wards. Alderman Auck made the motion to redistrict the wards. The Mayor, however, said the motion was not in order because the City has not received the official notice of census. After some discussion, the Mayor referred the matter to the 'Municipal Development Committee. Alderman Behrel reported of the traffic hazard at Graceland and Prairie Avenues.
