The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Aldermen Hansen, Vavrinek, Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava responding to roll call. OFFICIAL REPORTS. The City Clerk submitted the monthly report of Building Inspector, Arthur Rieck and his own report for the month. COMMITTEE REPORTS. Alderman McKay reported the following: May 7, 1951 Subject: Proposed re -zoning for Trailer Park near Orchard Place, Mr. Louis Van Selow, petitioner Mayor and City Council: With further reference to our report of April 30, also hearing before the Council on April 30. Your Municipal Development Committee is unanimously agreed that the City of Des Plaines should object to this re -zoning. Even without the school problem which is regrettable but real, we feel the plan for sewage disposal and water supply might prove in- adegnate and dangerous. Also that the presence of a trailer park in this location would have an adverse effect on other property values. We are sincerely sympathetic to the plight of the personnel at O'Hare Field'duo to lack of housing, but we cannot overlook the fact that their problem is a temporary one and it would be unjust to attempt to solve it be inflicting permanent injury on other people. COMMITTEE REPORTS, CONT'D. Mr. Mayor, your Committee recommends that the City Clerk file an objection to this re -zoning with the County Clerk, and that a copy of the objection be sent to Mr. Robert Kingery, Chairman of the Cook County Zoning Board of Appeals. WESTFIELD GARDENS REQUEST FOR WATER BY SPECIAL ASSESSMENT. The Clerk read the following letter: May 7, 1951 The Honorable Mayor and City Council City of Des Plaines - Gentlemen: Herewith find petition requesting installation of water mains in the subdivision known as Westfield Gardens that has recently been annexed to the city of DesPlaines. The legal description is as follows: Westfield Gardens, being a Subdivision of the North Half of the Northwest Fractional Quarter of Section Nineteen (19), Township Forty-one (41) North, Range Twelve (12), East of the Third Principal Meridian, in Cook County, Illinois. The petition represents only a fraction of the property owners, but before the legal work progresses very far, we will hand you additional signatures of the owners petitioning for the water main. There is a growing•demand for lots on which somewhat less ex- pensive buildings can be built, and we anticipate a rapid development of Westfield Gardens once water is available and will, therefore, appreciate anything that can be done to expedite the installation of water. The Clerk read the following letter: Mary 7, 1951 City Council Des Plaines, Illinois Gentlemen: We represent- Mr. George Koehler, Jr., who is the owner of Lot 18 in Biock 1 in Mechanic's Addition to Des Plaines. There remains unpaid against this property the third, fourth and fifth installments of special assessment warrant No. 12, the principal of each installment being $2.99, or a total of $8.97. There also remain unpaid the third, fourth and fifth installments of special assessment warrant No. 14. Each of these installments is for $3.10 or a total of $9.30. There are no bonds outstanding against these warrants and Mr. Koehler is prepared to pay the City one hundred percent of the principal remaining unpaid and receive from the City an assignment of its lien under said warrants as they effect the said Lot 18. The Council has adopted a rule that in cases where there are no bonds out- standing, they may sell its lien to the property owner if one hundred per cent of the principal is paid. Will you kindly have this matter referred to the proper committee for report at an early date with respect to the offer of our client. Des Plaines, Illinois Gentlemen: This is to inform you that on Wednesday, May 9, 1951, Judge Fisher ruled upon the appeal of George Brautigan from the Civil Service Commission of the City of Des Plaines and affirmed the decision of our Civil Service Commission in dei-ing any relief to Mr. Brautigan. May 2, 1951 Honorable Mayor and City Council of the City of Des Plaines City Hall Des Plaines, Illinois Gentlemen: A long time ago a special assessment proceeding was filed by the City of Des Plaines in the County Court that is known as Special Assessment 512453. It was filed for the purpose of opening and widening certain streets in the south side of town. The land necessary for the street was obtained and paid for and several vouchers for a total principal sum of $2,000.00 payable from the special assessment were sold in order to pay for the street. After this was done the depression hit and the entire project was abandoned. The special assessment was confirmed in the County Court and in spite of the fact that it has been abandoned and nothing further done, the same stands as a lien against innumerable properties in the area affected by it. It is particularly irritating to the numerous property owners who burr and sell real estate in the area because nothing can be done about it. Even if the owner wanted to pay, it could not be done, for he could not obtain a bill and pay it and there is no legal way in which it can be discharged and satisfied except by legal action as herein outlined. In order to obtain mortgages affected by it and in order to make sales of property affected by it, property owners have put up literally thousands of dollars with the -Chicago Title & Trust Company as an escrow or guaranty deposit against completion of the special assessment. In some cases it has prevented sale or mortgage of properties because insurance companies making mortgages have refused to accept the title with a special assessment lien and purchasers relying on such mortgages have been forced to abandon deals.
