OTTO W.JJIA 'ICH CITY C MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY. APRIL 2t 1951. AT 8:00 P. M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Aldermen Hansen, Davis, Wolf, Behrel, McKay, Clement, Halverson and Morava. Alderman Baines was absent due to illness and Alderman Vavrinek was out of the city on business. OFFICIAL REPORTS. The City Clerk submitted the report of Inspector Rieck for the month of March. RESOLUTION ON LFASE WITH WALTER E. JORDAN. The Clerk read the following resolution: Resolved that lease be executed with Walter E. Jordan, doing business as Jordan Manufacturing Company, for a portion of City Ware- house located at 1856 Miner Street, said space to be leased to be in rear of the brick partition separating the main garage from the re- mainder of the building, and said space being 1,586 square feet, for a term expiring July 31st, 1952, at annual sum of $1,200.00 a year, payable in advance in monthly installments of $100.00. All alterations necessary to make said space suitable for the needs of Jordan to be done at his expense and to be done to the satisfaction of the City Engineer. Jordan to install at his own expense such electrical miring and heating facilities as he may need; heating equipment affixed to the building is to remain the property of the City. Jordan is to furnish his own heat or arrange with Bouton Foster Company for his own heat at no expense to the City. The City agrees to furnish necessary water for toilet facilities, but Jordan is to improve or enlarge the toilet facilities at his own expense and such improvements or new installations are to remain the property of the City at the expiration of the lease. The City grants unto Jordan the option to lease the second floor, the space above the first floor area, if he desires to rent second floor space, he is to pay one hundred dollars (100.00) per month for the use thereof and to install necessary stairways at his own expense, and the said upstairs quarters will be leased for a term not exceeding July 31st, 1952. Be it further resolved that the City Attorney prepare a lease in accordance with this resolution and the Mayor and Clerk be authorized to sign such lease. On motion by Alderman Morava and second by Hansen, the resolution was adopted. The Mayor referred the matter of wrecked autos located at the southwest corner of Oakton and Des Plaines Avenue to the Chief of Police and City Attorney. gIM ATTORNEY'S REPORT ON TAXICABS. The Clerk read the following report: April 2, 1951 Honorable Mayor and City Council of the City of Des Plaines City Hall Des Plaines, Illinois Gentlemen: At the meeting of February 19, 1951, a complaint was made about the imposition of individual charges to each passenger by taxicab drivers in the City of Des Plaines where more than one rider rode the cab to the same destination. I was requested to check the ordinance for regulation of taxicabs to check the legality of such procedure. I find that the ordinance regulating fares provides that said rates shall not exceed the following: "For the first one-half mile or fraction thereof - 25¢ For each additional one-half mile or fraction thereof - - 10¢ For each 3 minutes of waiting . . . . . . . . 10¢ For each additional or extra passenger carried . 05¢" Any charge Made by a taxicab driver which exceeds the regular meter fare for the distance travelled, plus 5¢ for each passenger over and above the first one, is an unlawful charge and should be reported to the Police Department and action taken to prosecute the driver and the company for violation of the law. The Ordinance also provides that the cab be equipped with a meter which shall be operating and clearly show the -passenger the rate for the service rendered. Complaint was also made, I believe, about some of the cabs taking more than one passenger over the protests of the first passenger. The ordinance does not cover such a practice. I believe the rule of common sense ought to govern such a practice, although I believe that technically and legally, when a cab driver picks up a passenger he assumes an implied contract to deliver that passenger to his or her destination without defy and without imposing on the passenger an additional passenger or taking the first passenger out of his or her way to accomodate another. Violation of such an implied contract, however, would be a matter to be settled between the cab driver and the passenger, and of no concern to the City. If it is desired to cover such a practice, I believe it can be lawfully regulated but the taxicab ordinance would have to be amended to cover it. Respectfully submitted, Marshall S. PASS RESOLUTION IN RE PRAIRIE -LEE LIGHTS ADDITIONAL APPROPRIATION. The Clerk read the following le ttert April 2, 1951 Honorable Mayor and City Council Des Plaines, Illinois Gentlemen: When the appropriation for the Traffic Lights at Lee and Prairie Avenue was made we appropriated for four Traffic Lights. It was later found necessary to install six lights at this intersection. RESOLUTION, CONT'D. The original appropriation for the four lights was $4,500.00. The final cost of the six lights, which we installed, is $5,490.15. Mr. R. P. O'Brien, 973 Margaret Street, was granted permission to talk at the request of Alderman Clement. Mr. O'Brien said he thought that the punch boards were about the same as slot machines, because they paid off in money, therefore he thought the elected officials should have the law enforced by not allowing them in the City. On questioning by the Mayor, he stated that he had seen the punch boards in four taverns. The Mayor asked Mr. O'Brien to stay after the Council adjourned so that he could meet with him in the Mayor's Office because as Mayor, he was the Liquor Commissioner and the matter was under his jurisdiction. The Mayor reported that he had been contacted by the Chicago and North Western Railway regarding the resolution on their train service. Alderman Davis and the Mayor are to meet with the Superintendent of the Wisconsin Division and requested the aldermen to give him any information they have on complaints of the service. The Mayor also reported that the police department had checked the taxicab meters. letter: UNIVERSAL OIL PRODUCTS REZONING.
