The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Aldermen Hansen, Davis, Yavrinek, Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava responding to roll call. OFFICIAL REPORTS. The Clerk submitted the treasurer's report for January and the City Clerk's 1950 annual report. The annual report of the City Engineer and Superintendent of Public Works was also submitted. Engineer Fletcher reported concerning water main extensions. On motion by Alderman Halverson and second by Morava, the City Clerk was in- structed to advertise for bids on water mains on Algonquin and Wolf Roads, to be returned ter March 5, 1951. COMMITTEE REPORTS. Alderman Davis reported on the defense movie. The Mayor instructed the Clerk to write a letter of thanks to the theatre. PUBLIC BUILDINGS COMMITTEE. Alderman Morava reported the follow- ing on a fuel oil bid: "Your Committee on Public Buildings and Land and Finance has in- vestigated the above and has found that it would be unwise at this -time to ask for bids for fuel oil to heat the Municipal Building. In view of the uncertain conditions that prevail today and the heating season almost over, your Public Building and Finance Committees agreed it would be better to advertise for bids before the next heating season." The Clerk read the following proposals February 19, 1951 Honorable Mayor and. City Council City of Des Plaines Cook County, Illinois Gentlemen: We understand that your City centemplates construction of certain improve- ments to your Sewerage System, said improvements to be made in a particular BENJAMIN ,AND LANG PROPOSAL, CONT'D. locality of the south side -of your City to correct certain present deficien- cies to the Sewerage System in that area. As specialists in financing improvements to municipally owned utilities, we hereby submit this letter outlining our services as financial advisors and underwriters of sewerage revenue bonds necessary to finance construction of your contemplated sewerage improvements for this particular locality. The following services will be rendered by us: 1. We will coordinate all information relative to the sewerage con- struction project so as to present such information to the citizens of Des Plaines within 6 months. 2. We will prepare a report covering the establishment of a sewerage utility for this particular locality describing the method of financing the contemplated sewerage system improvements through the issuance of sewerage revenue bonds payable from the revenues of a particular locality as authorized by Illinois Law (1949) Chapter 24, Section 60, Paragraph 11, etc. These bonds will be payable solely and only from rates and charges billed users of the sewerage system for the particular locality designated. Taxes will not be increased under the terms of this type of bond issue and general taxes cannot be levied for payment of these bonds. 3. We will assist the engineers engaged by the City in the preparation of suitable rates and oharges for the use and service of the sewerage system for this particular locality. 4. We will recommend an accounting, billing and collection system for the proper recording of the financial transactions of the sewerage utility department. The following municipal bond underwriting services will be rendered by us: A. We agree to purchase your proposed issue of sewerage revenue bonds issued under authorization of the section of the Statutes afore- mentioned in the amount of $300,000 more or less at an interest cost'. basis to the City of 3.85% computed to maturities according to standard tables of bond values. Accrued interest .from date of bonds to date of delivery to us shall be paid to the City at the time of delivery and payment. Maturities, interest rates and other technical specifications of the bond issue shall be mutually agree- able after analysis of our financial report. B. We will engage the legal firm of Chapman and Cutler of Chicago to cooperate with your City attorney in the preparation of all neces- sary ordinances, resolutions and other legal documents establishing a separate sewerage department, authorizing the proper principal amount of Sewerage Revenue Bonds and all other matters in connec- tion with your proposed financing program. It is understoodthat this offer is subject to an unqualified approving legal opinion of Messrs. Chapman and Cutler covering the bond issue. The legal fee of Messrs. Chapman and Cutler will be paid by us. C. As these bonds will not be read for immediate delivery and in view of the possible fluctuation of the municipal bond market between the date hereof and the date of delivery, the interest cost named above at which we agreeto`sell shall be increased or decreased in accordance with the increase or decrease, if any, of the Dow -Jones average of municipal revenue bonds as published weekly between the date hereof and the date of delivery of the bonds. D. The ordinance authorizing the bond issue shall provide that the City shall maintain sewerage rates and charges in the area served sufficient to pay the costs of operation and maintenance, provide an adequate depreciation fund and cover average annual interest and principal requirements of these sewerage revenue bonds by at least one and one-half times. Interest during construction for a period of eighteen months shall be provided in the bond issue. The contractor shall furnish a completion bond satisfactory to our counsel warranting completion of the project. E. The City shall supply us with the report of the Des Plaines City engineer setting forth a description of the construction project, estimate of cost of such construction, estimated income based upon recommended rates and charges for sewerage service and estimated cost of operation of the sewerage system. Both the City and our- selves must be satisfied that the financing plan is feasible as Ak-to purchase these bonds and you agree BENJAMIN AND LANG PROPOSAL, CONT'D. shown by such engineering report and our surveys, and that the bonds proposed to be issued are marketable before a decision is made to proceed with authorisation of the bond issue. F. We will pay such costs of publication in one newspaper only as are required by bond counsel and will furnish at our expense printed bonds ready for the signatures of the proper City officials. G. If the afore described sewerage revenue bonds are authorized, issued and purchased by us, it is hereby understood and agreed that if similar financing for other; particular localities within the City of Des Plaines are contemplated, then Benjamin and Lang, Incorpo- rated, and Barcus, Kindred and Company shall have an option to purchase said bonds under the same terms and conditions as set out herewith for a period of two years from date hereof. H. In the event Sewerage Revenue Bonds described above are not issued for any reason whatsoever, it is hereby understood that the City of Des Plaines is not obligated to reimburse us for any expenses incurred by us in connection with the services outlined in this letter. I. It is hereby agreed that this contract may be terminated upon thirty days' notice in writing by either party if bonds are not issued within two years from date hereof. Acceptance of this proposal by resolution of the City Council, shall consti- tute a contract for the purchase and sale of the Sewerage Revenue Bonds described above when, as and if issued by the City. FIRST READING OF ORDINANCE VACATING ALLEY IN THE 1600 BLOCK BETWEEN CAMPBELL AND ALGONQUIN. All documents are now in the City Hall and are available to the proper authorities at any time. They consist of minutes taken at public hearings and private meetings, written evidence furnished by petitioners and others, copies of legal notices, plats of areas under consideration, etc. Officers of the city and members of the City Council should consider that the records are available to them for reference in connection with current actions relating to zoning or in regard to the past actions of the Zoning Board. The Clerk read the following letters To the Mayor and members of the City Council of Des Plaines, Illinois. Honorable Gentlemen: At a recent meeting of the Village Board of Trustees of Mount Prospect a decision was made to enter into a contract with Fred Hildebrandt of Arlington Heights for the removal of garbage and rubbish within the village limits beginning with the month of February. We of Mount Prospect deeply appreciate your kindness in allowing us to dispose of all garbage through your facilities during the past years and we wish to assure you that this courtesy which you have extended to us will not soon be forgotten. Again, our sincere thanks to you for the Village Board of Mount Prospect, Theodore A. Lams Chairman of Health and Sanitation The Mayor ordered the letter placed on file. Alderman Clement requested the City Attorney to check on taxi -cab fares in regard to overcharging and report back to the Council. Alderman Baines reported that he had received complaints on the building material in the street at Lee and Ellinwood Streets. After dis- cussion, the motion was made by Alderman Baines and seconded by Behrel that the City Clerk write to the owner of the building, George W. Presses & Company, 111 Washington Street, to remove all material from street b9 February 28th, or the City will take action to have same removed. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. February 8, 1951 On suggestion by Alderman Baines, the City Clerk was instructed to write the Soo Line to repair the railroad crossings. On Mayor Meyer's request and motion by Alderman Behrel which was seconded by Baines, the Clerk was instructed to inform the Fire and Police Commissioners to revoke the order of appointing another fireman. On suggestion of Alderman Clement, the Clerk was instructed to Brite to the United Motor Coach regarding the 6:15 P.M. bus. When the driver of this. bus is late, he drives to the garage because it is his last trip, instead of making another trip. APPROVAL OF MINUTES. The motion was made by Alderman Behrel and seconded by Clement to approve the minutes of February 5, 1951. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried.
