MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
JANUARY 2, 1951, AT 8:15'P. M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth G.
Meyer, who presided with Aldermen Hansen, Davis, Vavrinek, Wolf, Behrel, McKay,
Clement, Halverson and Morava responding to roll call.
OFFICIAL REPORTS. Due to the illness of the City Clerk, Otto W. J.
Henrich, the Deputy Clerk, Katherine Kruger, submitted the December and yearly
reports of Arthur Rieck, Building Inspector. The Mayor ordered the reports
placed on file.
The Mayor commented that Chief Wigham and himself had inspected
taverns last Saturday, December -30, 1950. They discovered one irregularity,
however, and the owner stated he would correct the matter. The Secretary of
the Board of Health, Mrs. L. A. Willer, had also made inspections the week
before and found everything in good order.
City Engineer, E. N. Fletcher, spoke in regard to the extension of
the water system; this involved the Wolf Road and Algonquin Road and Thacker
Street extensions. The Mayor referred this matter to the Water and Finance
Committees.
Marshall S. Howard, City Attorney, gave an oral report on the Meyer
Coal and Material Company situation. Mr. Howard stated that the judge refused
a temporary injunction because he claimed it would be•••prejudging the case,
therefore, the matter will be heard on permanent injunction.
Alderman Baines appeared at this time.
The Mayor, Mr. Howard and aldermen then discussed the possibility of
having a test made of the car shaker; this test will measure vibration rather
than sound. It was agreed that the citizens will be advised of this test to
be made in conjunction with their attorney. The motion was made by Clement
and seconded by McKay that the City Attorney be authorized to handle this
vibration test, the cost not to exceed $100.00. The Mayor• put the question,
and the Deputy Clerk called the roll with the following result: Ayes: Alder-
men Hansen, Davis, Vavrinek, Baines, Behrel, McKay, Clement, Halverson and
Morava. Nays: Alderman Wolf.
MUNICIPAL DEVELOPMENT COMMITTEE. Alderman McKay read the following
report on alley vacation request:

Alley vacation request -location 1600 Block Campbell and Algonquin
Mayor and City Council:
The Municipal Development Committee has considered above request,
also the Streets Committee. It is my understanding the Streets Committee is
in favor of vacation, subject to resolution recently adopted covering such
vacations.
All lots involved both directly and indirectly, are represented on
petition by owners' signature and in some cases where there are tenants, by
tenants' signatures also.
The request is for vacation of only that portion of the alley east
of lot 25 (on Campbell) and 36 (on Algonquin). The rear of these two lots are
opposite. It is stated that this end of the alley, that is the east end, is
unused and has never been opened. The portion of the alley back of lots 25
and 36 and extending to White Street is to be kept open and available as alley
to serve lots 25 to 30 on Campbell and lots 31 to 36 on Algonquin.
One of the members of the Municipal Development Committee favors
vacation and that the provision in our recent resolution on vacation of streets
and alleys to the effect that all lots benefitted pay a fee of $10.00 per lot
to the City, be waived, but that the owners pay all costs of vacation and
creation of easement. He feels that this $10.00 fee should not be collected
because the resolution was adopted since this particular petition was received.
Another member of Committee opposes vacation, and if Council should
vote for vacation is prepared to urge that a fee for each lot be applied per
our recent resolution on vacation of streets and alleys.
The third member of Committee favors granting petition to vacate,
and inasmuch as almost all lots directly affected are but 25' wide, he favors
charging all lots directly benefitted a fee of $5.00 per 25 feet of lot width,
plus proportion of necessary fees for vacation and easement apportioned on the
same basis. Because of the irregular shape of lot number 3 and of the Zaleski

lot immediately south thereof, which causes the alley to terminate in a tri-
angular wedge, it will be necessary to make special adjustment in the case of
these two lots, also the Kuhlman lot adjacent and west of the Zaleski lot.

No recommendation was given, however, Alderman McKay made a motion
that this report be recorded in the minutes and Alderman Clement seconded it.
The motion was voted upon by acclamation, whereupon the Mayor declared the
motion carried.
Alderman McKay then made a motion that the City Attorney draw up
an ordinance for alley vacation at the amount of $5.00 per twenty-five feet
or fraction thereof, to be paid by abutting property owners. Alderman Davis,
however, requested the preceding motion be amended by eliminating the fee.
Alderman Clement seconded the motion. The Mayor put the question, and the
Deputy Clerk called the roll with the following result: Ayes: Aldermen
Hansen, Davis, Vavrinek, Baines, Behrel, Clement, Halverson and Morava. Nays:
Aldermen Wolf and McKay. The Mayor thereupon declared the amendment approved.
The Mayor then put the question on the original motion as amended, and the
Deputy Clerk called the roll with the following result: Ayes: Aldermen
Hansen, Davis, Vavrinek, Baines, Behrel, Clement, Halverson and Morava. Nays:
Aldermen Wolf and McKay. The Mayor thereupon declared the motion carried as
amended.
The Mayor at this time spoke to Mrs. Slams in regard to her roomers.
Alderman Hansen stated that he had no report, however, he commented
on the marvelous job done in cleaning up of snow recently by Superintendent
of Public Works, E. R. Warnicke.
WATER AND SEWER COMMITTEE REPORTS. Alderman Halverson stated that
the City. Engineer, E. N. Fletcher, suggested that the Cater Well be pulled
and repaired when the weather breaks. The material has already been obtained
for this job. This well has not been pumping its capacity; 25% loss of ef-
ficiency of well was noted. Alderman Halverson said one well is pulled each
year. It is estimated that repairs will amount to $2,500.00 on the Cater Well.
Alderman Halverson also mentioned that he had been informed by the City Engi-
neer that the line for determining the water tower pressure is now available.
SPECIAL SEWER RELIEF COMMITTEE. Alderman Wolf stated that they
are still debating the acceptance of "Special Sewer Relief" and a meeting
will be held sometime soon and a report given.
BUILDING PERMIT COMMITTEE. Alderman Clement commented on the
yearly report which had been submitted by Arthur Rieck, Building Inspector.
Alderman Clement also mentioned that he would like to have a meeting
of the Building Permit Committee and A. L. Sengstock to set up policy arrange-
ment for dispatch in a program of enforcement.
PASS 1951 SALARY ORDINANCE. The Deputy Clerk read for second read-
ing the following proposed ordinance entitled:
AN ORDINANCE
DEFINING AND DESCRIBING THE SALARIES AND
COMPENSATION TO BE PAID TO THE MUNICIPAL
OFFICIALS AND EMPLOYERS OF THE CITY OF_
DES PLAINES, ILLINOIS, FOR THE FISCAL
YEAR, 1951.
The motion was made by Alderman Halverson and seconded by Hansen
to pass the proposed ordinance. The Mayor put the question, and the Deputy
Clerk called the roll with the following result: Ayes: Aldermen Hansen,
Davis, Vavrinek, Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava.
Nays: None. The Mayor thereupon declared the motion carried and the ordinance
adopted.
OPEN BIDS FOR GARBAGE TRUCK. Upon opening the bids received from
Brown -Orth Motors, Inc. and Purnell and Wilson, Inc., both of Des Plaines,
the motion was made by Alderman Behrel and seconded by Baines to refer these
bids to the Street and Finance Committees for study. A short recess was de-
clared by the Mayor.
Upon reconvening, the motion was made by Alderman Hansen and
seconded by Halverson that the bids be rejected.
Alderman Hansen made a motion to readvertise for bids requesting
a 1951 two -ton truck according to specifications, the bids to be turned in no
later than January 15th, the next Council meeting. This motion was seconded
by Halverson. Alderman Wolf, however, requested the preceding motion be
amended by advertising for a 1950 or 1951 two -ton truck. Alderman McKay
seconded the motion. The Mayor put the question, and the Deputy Clerk called
the roll with the following result: Ayes: Aldermen Hansen, Davis, Vavrinek,
Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava. Nays: None. The
Mayor thereupon declared the motion carried as amended.
CITY CLERK'S LETTER REQUESTING AN ASSISTANT BILLING CLERK. The
Deputy Clerk read the following letter:

Commission to appoint an assistant billing clerk.

The motion was made by Alderman Baines and seconded by Behrel to have
Civil Service Commission appoint an "assistant billing clerk."
The motion was made by Alderman Behrel and seconded by Hansen to
have the Fire and Police Commissioners hold an examination or certify the
positions of one fireman and two policemen. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
SUPERINTENDENT E. R. WARNICKE'S LETTER REQUESTING TWO MEN FOR
DRIVERS:! HELPERS IN THE GARBAGE DEPARTMENT AND ONE MAN IN THE STREET DEPART-
MENT. The Deputy Clerk read the following letter:

Gentlemen:
I wish to request the City Council to instruct the Civil Service
Commission to certify two (2) men to the positions of Drivers' Helpers in
the Garbage Department.
Also one (1) man to the position of laborer in the Street Depart-
ment.

The motion was made by Alderman Vavrinek and seconded by Baines to
have the Civil Service Commission appoint men for these positions. The motion
was voted upon by acclamation, whereupon the Mayor declared the motion carried.
LEGAL NOTICES OF PUBLIC HEARING * COUNTY ZONING. The Deputy Clerk
reported of two zoning hearings of the County Zoning Board to be held on
January 19, 1951, in the Des Plaines City Hall. The notices concerned the
property located in Gewecke's Subdivision at the Northeast corner of Grove
Avenue and Rand Road for set -backs, and the property located on the north
side of Golf Road and C. & N. W. R. R., approximately 1,000 feet east of
Rand Road to be changed from farming to light industry.
Alderman McKay requested a copy of these notices.
The Mayor commented on a letter which had been received from
Arthur H. Lewis in regard to the report on Des Plaines by the Cook County
Inspection Bureau, resulting from their inspection of water and fire fight-
ing facilities last July.
RESOLUTION - FRED NELSON. The following resolution was read:
RESOLUTION
WHEREAS, Fred A. Nelson died on December 23rd, 1950,
AND, WHEREAS, the said Fred A. Nelson had during his lifetime
rendered valuable assistance and service to the City of Des Plaines in having
served on the first Board of Fire and Police Commissioners and having served
faithfully in this position until the date of his death,
NOW, THEREFORE, be it resolved by the City Council of the City of
Des Plaines that they do hereby acknowledge their gratitude for the faithful
services performed by said Fred A. Nelson and do hereby extend to his widow,
Elizabeth I., their sincere sympathy in her bereavement.

The motion was made by Alderman Baines and seconded by Davis to
pass the above resolution. The motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried and the resolution adopted.
ARCHITECTURAL COMMISSION APPOINTMENT. On motion by Alderman Hansen
and second by Davis the temporary appointment of Theodore Napier to the
Architectural Commission was approved.
The Mayor stated that he will not fill vacancies for the Police
and Fire Commission and the Plan Commission until suggestions are obtained.
Mayor Meyer commented that on January 15th, the heads of the Civil
Defense Committee and himself were going to attend a meeting at the Museum of
Science and Industry.
A motion was made by Alderman Davis and seconded by Behrel that the
City Attorney draw up the proper ordinances for the control of smoke, boilers,
refrigeration use, pressure vessels, etc. The -motion was voted upon accla-
mation, whereupon the Mayor declared the motion carried.
APPROVAL OF BILLS. Alderman Baines, Chairman of the Finance Com-
mittee, presented the following proposed resolution:
BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DES PLAINES THAT THE FOL-
LOWING BILLS ARE DUE AND PAYABLE AND
THAT THE MAYOR AND CITY CLERK BE AND
ARE HEREBY AUTHORIZED TO MAKE PAYMENT
FOR SAME.

The motion was made by Alderman Baines and seconded by Halverson to
adopt the proposed resolution. The Mayor put the question, and the Deputy.
Clerk called the roll with the following result: Ayes: Aldermen Hansen,
Davis, Vavrinek, Wolf, Baines, Behrel, McKay, Clement, Halverson, and Morava.
Nays: None. The Mayor thereupon declared the motion carried and the reso-
lution adopted.
APPROVAL OF MINUTES. The motion was made by Alderman Halverson
and seconded by Davis to approve the minutes' of December 18th, 1950. The
motion was voted upon by acclamation, whereupon the Mayor declared the motion
carried and the minutes approved.
ADJOURNMENT. The motion was made by Alderman Wolf and seconded by
Vavrinek to adjourn. The motion was voted upon by acclamation, whereupon
the Mayor declared the motion carried and the meeting regularly adjourned.
