12181950MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, DECEMBER 18, 1950, AT 8:00 P. M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Aldermen Davis, Vavrinek, Baines, McKay, Clement, Halverson and Morava responding to roil call. Aldermen Hansen, Wolf and Behrel were absent. November OFFICIAL REPORTS. The Clerk submitted the/report of City Treasurer, L. C. Barrett. The annual report of the Firemen's Pension Fund was made up by R. A. Kolze and submitted at this time also. CITY ATTORNEY, MARSHALL S. HOWARD'S REPORTS. December 18, 1950 Honorable Mayor and City Council of the City of Des Plaines City Hall Des Plaines, Illinois Gentlemen: I submit herewith a completely revised and rewritten ZONING CODE. In accordance with may suggestion of several weeks ago, which was approved by you, I temporarily dropped work on the main code and switched to the Zoning Code. There seemed to be a continual necessity to refer to the zoning laws which, like the City Code, consisted of scattered zoning amend- ments, which had been bound together by our City Clerk in a temporary binder. Only one copy existed of this binder. It is therefore very essential that the zoning ordinances be reorganized and brought up to date. Then a number of copies can be made for ready reference. I believe that consideration of this revised zoning ordinance should be given immediate attention and suggest that you not only personally review the draft herewith submitted, but that it be referred to the Zoning Board of Appeals for their immediate, urgent consideration. A revised, com- plete ordinance will make consideration of zoning questions much easier for the citizens of Des Plaines, for yourselves as a City Council, for the Zoning Board of Appeals who must work with it continuously, and for the undersigned. Please note that I have not, in this draft, changed the zoning applicable to any area. I have left the current zoning intact and only re- organized the wording of the ordinance. Whether the Zoning Board of Appeals wishes, in connection with the consideration of this revised ordinance, to make any changes in the zoning of specific areas, should be left solely to its discretion. December 9, 1950 Honorable Mayor and City Council City of Des Plaines City Hall Des Plaines Gentlemen: This is to advise you that on or about December 6th, 1950, after a long delay due to disagreement over the legal description, the purchase of sixteen (16) feet of Dr. Purves' property at Lee and Prairie Avenue has been completed. Howard City Attorney The Mayor ordered the report placed on file. X79 REPORT OF LIEUTENANT R. A. KOLZE, FIRE INSPECTOR ON A ZONING VARI- ATION. To the Honorable Mayor and City Council Gentlemen: Complaint of a rooming house operating at 715 Laurel Avenue. Inspection of these premises was made on December 6, 1950 by the building inspector and fire inspector. This building is owned by Mr. and Mrs. Frank Slama and at the time of inspection was occupied by 3 roomers, there are facilities for sleeping eleven people if all beds are occupied to capacity. Listed as follows are the rooms wherein beds were found: South sun porch, 1st floor - one cot, one double bed. East bed room,2nd floor - one single bed, one double bed. South bed room, 2nd floor - 2 twin beds. (occupied) West bed room, 2nd floor - 2 twin beds. North room, 2nd floor - one single bed. Living room, front sun porch, dining room and kitchen contained no furniture with the exception of a small kitchen table. Second floor is equipped with one complete bath room. Alderman McKay reported on the alley vacation in the 1600 block of Campbell and Algonquin. The Mayor informed the Council it required a three-fourths vote of the Council on an alley vacation, he, therefore, requested that no action be taken until the next Council meeting. Alderman McKay reported that he had visited the Hannifan Corporation factory with the Mayor, and he thought that this may be the type of factory dessirable to locate on Wolf Road. BUILDING PERMIT COMMITTEE. Alderman Clement reported the following on the item of subdividing lots: Your Committee on Building Permits has investigated the above and has found: This matter is at present covered by the Official Plan Ordinance. The splitting of individual lots falls within the definition of a "subdivision" in this plan, and the Planning Commission is given the power and the duty to approve such subdividing. We, your Committee on Building Permits, therefore recommend: That the responsibility for enforcing this ordinance rests, by the wording thereof, in the Planning Commission. Arrangements have been completed with the Planning Commission to begin enforcing this ordinance with care. H. W. Clement Wm. Davis On motion by Alderman Clement and second by McKay, the report was concurred in. APPROVAL OF BILLS. Alderman Baines, Chairman of the Finance Com- mittee, presented the following proposed resolution: BE IT RESOLVED BY THE CITI COUNCIL OF THE CITY OF DES PLAINES THAT THE FOL- LOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. (Schedule of bilis placed before each alderman and affixed to resolution and on file with the City Clerk.) The motion was made by Alderman Baines and seconded by Halverson to adopt the proposed resolution. The Mayor put the question, and the Clerk called the roll with the following result: Ayes: Aldermen Davis, Vavrinek, Baines, McKay, Clement, Halverson and Morava. Nays: None. The Mayor thereupon de- clared the motion carried and the proposed resolution adopted. 1110 C. H. APPLE, DISTRICT ENGINEER'$ LETTER. The Clerk read the follow- ing letter: Mr. Otto W. J. Clerk read for second reading the following proposed ordinance entitled: AN ORDINANCE TO AMEND "AN ORDINANCE REGULATING THE SALE OF ALCOHOLIC LIQUORS IN THE CITY OF DES PLAINES" AS HERETOFORE AMENDED. The The motion was made by Alderman Halverson and seconded by Morava to pass the proposed ordinance. The Mayor put the question, and the Clerk called the roll with the following results Ayes: Aldermen Davis, Vavrinek, Baines, McKay, Clement, Halverson and Morava. Nays: None. The Mayor there- upon declared the motion carried and the proposed ordinance adopted. ORDINANCE TO RESTRICT PARKING ON PRAIRIE AVENUE BETWEEN SECOND AND FIRST AVENUES. The Clerk read for first reading the following proposed ordinance entitled: AN ORDINANCE TO RESTRICT PARKING ON A PORTION OF PRAIRIE AVENUE The Mayor ordered the ordinance placed on file for second reading. ORDINANCE TO REQUIRE ALLEY FACILITIES IN COMMERCIAL AREAS. The Clerk read for first reading the following proposed ordinance: AN ORDINANCE TO REQUIRE ALLEY FACILITIES IN COMMERCIAL ZONE AREAS. On motion by Alderman Baines and second by Clement, the proposed ordinance was referred to the Zoning Board of Appeals sitting as a commission to call a public hearing. APPROVE PLAT OF DES PLAINES COUNTRYSIDE NO. 6. The Clerk presented a plat of Des Plaines Countryside No. 6 which the Plan Commission had approved. After a short recess, the motion was made by Alderman McKay and seconded by Halverson to approve the plat with a correction of "No. 5" to "No. 6." The Mayor put the question, and the Clerk called the roll with the following result: Ayes: Aldermen Davis, Vavrinek, Baines, McKay, Clement, Halverson and Morava. Nays: None. The Mayor thereupon declared the motion carried and the plat approved. SANITARY DISTRICT PERMIT FOR SEWER ON WOLF ROAD. The Clerk read the following letter: Mr. Otto W. J. Henrich City Clerk, City of Des Plaines Municipal Building Des Plaines, Illinois December 14,1950 Dear Mr. Henrich: In compliance with the request of E. N. Fletcher, City Engineer, Sanitary District Sewer Permit No. 1950-101 has been issued to the City of 4q/ SANITARY DISTRICT LETTER, CONT'D. Des Plaines, to cover the construction of certain sanitary sewers, as further described in said permit. Three copies of the permit are enclosed,. and it is required that the permit be duly accepted and signed by the proper City officials. It is further required that you return to us the copy stamped "The Sanitary Dis- trict of Chicago," and furnish the Contractor his copy. The Mayor ordered the proposed ordinance placed on file for second reading. CITY CLERK REQUESTED TO ADVERTISE FOR BIDS ON GARBAGE TRUCK. On motion by Alderman Halverson and second by Morava, the Clerk was instructed to advertise for bids on a garbage truck. The bids are -to be in the hands of the City Clerk no later than January 2, 1951. CITY CLERK'S OFFICE AND CITY TREASURER'S OFFICE TO BE REMODELED. On motion by Alderman Morava and second by Davis, the Clerk was instructed to have Victor Pagel remodel the Clerk's and Treasurer's offices not to ex- Geed the cost of $400.00. The Mayor informed the Council of the high cost of ornamental lights and said he had instructed Superintendent Warnicke to obtain informa- tion on the cost of new light posts for replacing the underground cable system. APPROVE PLANS AND SPECIFICATIONS FOR WIDENING PRAIRIE AVENUE FROM LEE TO PEARSON STREETS. Engineer Fletcher presented plans and specifications for widening Prairie Avenue from Lee to Pearson Streets. On motion by Alder- man Halverson and second by Morava, the plans and specifications were approved. APPROVAL OF MINUTES. The motion was made by Alderman Baines and seconded by Morava to approve the minutes of December 4, 1950. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried and the minutes approved. ADJOURNMENT.
