The motion was made by Alderman Baines and seconded by Behrelto. adopt the proposed resolution. The Mayor put the question, and the Clerk called the roll with the following result: Ayes: Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava. Nays: None. The Mayor thereupon declared the motion carried and the proposed resolution adopted. BOY SCOUT DAY AS CITY OFFICIALS. On motion by Alderman Wolf and second by Morava, the City Council approved of having a Boy Scout Day when the boys will fill the positions of the City Officials. This was requested by Alderman Davis. APPROVAL OF MINUTES. The motion was made by Alderman Halverson and seconded by Morava to approve the minutes of November 6, 1950. Alderman McKay requested that a correction be made regarding the E. A. Nester letter; change the word "valid" to "invalid." The motion was voted upon by acclama- tion, whereupon the Mayor declared the motion carried and the minutes approved with correction made. ADJOURNMENT. The motion was made by Alderman Wolf and seconded by Behrel to adjourn. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried and the meeting regularly adjourned. MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, DECEMBER 4, 1950, AT 8:00 P. M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Aldermen Hansen, Davis, Vavrinek, Baines, Behrel, McKay, Clement, Halverson and Morava responding to roll call. OFFICIAL REPORTS. The Clerk submitted the reports of Building In- spector, Arthur Rieck and the City Clerk's report for the month of November,1950. CITY ATTORNEY HOWARD'S REPORTS. The Clerk read the following reports which were ordered placed on file: December 4, 1950 Honorable Mayor and City Council of the City of Des Plaines City Hall Des Plaines, Illinois Gentlemen: This is to inform you that George Brautigan, who had filed a pe- tition for re -instatement before the Civil Service Commission of the City, and whose petition had been denied by it, has filedan appeal to the Circuit Court of Cook County. This past week I filed an answer to his petition consisting of a transcript of the record of the Civil Service Commission, as required by law. The appeal is decided by the Circuit Court on the transcript of the record without further evidence. I will advise you of further developments. Respectfully, MSH:rj M. S. Howard City Attorney HOWARD'S REPORT, CONT'D. December 4, 1950 Honorable Mayor and City Council of the City of Des Plaines City Hall Des Plaines, Illinois 2/75 Gentlemen: This is to inform you that on Friday, December 1st, I filed in the Circuit Court of Cook County a suit against Meyer Fuel and Material Company of the City of Des Plaines for an injunction against the Meyer Fuel Company to prevent them from continued operation of the ready -mix cement hopper and of the car -shaker, and all of the machinery and equipment incidental thereto. I also requested the Court to issue a mandatory injunction against the Meyer Company to compel them to remove the hopper and machinery. Attorney Walter Senne and his assistant, Mr. O'Connor, representing the property owners in the neighborhood of the Meyer plant, have been working with me and are now in the process of obtaining the necessary affidavits and evidence for a temporary injunction, which we will go into court with some- time within the next one or two weeks, to stop operation of the hopper and car -shaker. I will report further on this matter as developments occur. Respectfully submitted, MSH:rj M. S. Howard, City Attorney CITY ENGINEER FLETCHER'S REPORT ON CITY GASOLINE. The City Clerk read the following report: December 2, 1950 Honorable Mayor and City Council City of Des Plaines, Illinois Gentlemen: At your request I have studied the matter of the City of Des Plaines buying and handling its own gasoline. There are two ways of doing this. One is to contract for Standard Grade gasoline, or any grade desired, on a long term basis, the supplier to furnish and install tank, or tanks, and pump. This is the method most used by Cities the size of Des Plaines. Another method is for the City to install its own tanks and pump and to purchase gasoline on a transport basis, 5000 to 6000 gallons at a time. This method is used by the City of Elmhurst and they feel that they save l2 to 2 cents per gallon over the first mentioned method. This re- quires a tank storage capacity of 5000 gal. Under this method bids would be taken every 60 days, or as required for transport delivery. The cost of tanks and pumps installed would be about A750.00. At the present time the City uses about 24,000 gallons per year or two thousand (2,000) gallons per month. Over a long period of time the second method would be the cheaper, however, tanks are now in short supply and the first method may be the prefer- able method to use at this time. A suggested form of bid is attached hereto. Respectfully submitted, E. N. Fletcher City Engineer to The Mayor referred the report/the Finance and Building Permit Committees. COMMITTEE REPORTS. Alderman Vavrinek reported on the air rifle ordinance (proposed ordinance). The Public Protectionnrecommends that the proposed ordinance be drafted similar to the National Rifle Association Ordinance, but to include sling shots and be referred to the City Attorney. On motion by Alderman Vavrinek and second by McKay, the report was concurred in. Alderman Hansen reported that the Street Committee recommended to vacate the alley in the 1600 block of Campbell Avenue and Algonquin Road and that the matter be referred back to the Municipal Development Committee. It was so referred. Alderman Wolf made his appearance at this time. Alderman Clement, Chairman of the Building Committee, reported on a building violation. On motion by Alderman Clement and second by Behrel, the City Attorney was to recommend the Building Inspector, Arthur Rieck, of action to be taken regarding a building violation of Rupert Moser, 1944 Chest- nut Street. SECOND READING OF MOTELS AND TOURIST CAMPS ORDINANCE. The Clerk read for second reading the following proposed ordinance entitled: AN ORDINANCE REGULATING THE CONSTRUCTION AND OPERATION OF MOTELS AND TOURIST CAMPS The Mayor referred the proposed ordinance back to the Building Permit Committee for study. The Mayor ordered the proposed ordinance placed on file for second reading. REMOVE UNCOLLECTIBLE GARBAGE AND WATER BILLS FROM LEDGER. The Clerk read the following letter: City Council Des Plaines, Illinois Gentlemen: 1 have three uncollectible bills, totaling garbage from the years 1949 and 1950. The Clerk read a letter from J. N. Miller in Dexter Acres requesting city water. Mr. Miller also inquired as to whether any consideration had been given to incorporating this section. The Clerk was instructed to write and inform Mr. Miller that the property owners should organize to consider annexation, so they may apply for water. CUMBERLAND TERRACE CIVIC CLUB LETTER. The Clerk read the follow- ing letter: To the Mayor and City Council City of Des Plaines, Illinois November 26, 1950 Dear Sirs: At a recent meeting of the Cumberland Terrace Civic Club the secretary was instructed to write a letter to you regarding the Meyer Redi- Mix plant. This is to inform you that the residents of Cumberland Terrace are heartily in favor of the steps being taken to rid the neighborhood of this eyesore. The Civic Club will do all in its power to assist you. The Redi-Mix plant is a direct nuisance to many of us, due to the stream of trucks passing through the subdivision, and due to the vibrations of the car dumper which have been felt as far as a quarter of a mile from the plant. Lamb, Wilmette, Illinois, expressing his appreciation for the courtesy given to his family and himself of a Des Plaines family in Cumber- land Terrace when his auto failed to operate on Thanksgiving Day, and he had to call the Motor Club. The Clerk also informed the Council of a letter which had been received announcing a talk by Dr. R. Scott, sponsored by the American Association of University Women, on December 13th, at the Congregational Church. The talk to be given concerns Red China. Mr. Byron Bacon Black was allowed to talk in regard to the Middle States Telephone Company's request for increase of rates. The Mayor referred the matter to the Public Relation and Finance Committees. APPROVAL OF MINUTES. The motion was made by Alderman Halverson and seconded by Morava to approve the minutes of November 20, 1950.
