08281950MINUTES OF THE ADJOURNED MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY, AUGUST 28. 1950, AT 8:00 P. M. CALL TO ORDER. Due to absence of the mayor, the meeting was called to order by Otto W. J. Henrich, City Clerk, with Aldermen Hansen, Vavrinek, Wolf, Baines, Clement, Halverson and Morava responding to roll call. Aldermen Davis, Behrel and McKay were absent. The motion was made by Alderman Hansen and seconded by Vavrinekto elect Alderman Halverson Mayor pro tem. On discussion, City Attorney Howard said that Alderman Halverson would continue to be mayor pro tem due to this being an adjourned meeting, but if the council desired to correct the minutes of August 21, 1950, to chairman pro tem, they could do so. Aldermen Hansen and Vavrinek withdrew their motion. Alderman Baines made the motion to appoint Alderman Halverson Chairman pro tem, but it was lost for want of a second. RESOLUTION ON RENT CONTROL. The City Clerk read the following pro- posed resolution: RESOLUTION DECLARING NECESSITY FOR FEDERAL RENT CONTROL WHEREAS, the City Council of the City of Des Plaines hereby finds that a serious public emergency exists in the housing of a considerable number of persons in the City of Des Plaines which emergency has been created by war, the effects of war and the aftermath of hostilities; that such emergency has necessitated the intervention of the federal government in order to prevent speculative, unwarranted and abnormal increases in rent; that such emergency has produced an acute shortage in dwellings by a diversion and reservation of essential materials and manpower needed successfully to prosecute the war; that the federal law pursuant to which rents in buildings have heretofore been regulated and controlled by its terms expired on the thirtieth day of June nineteen hundred fifty; and WHEREAS, a bill was enacted at the 2nd session of the 81st Congress, (Public Law 574) effective July 1, 1950, which amended the Housing and Rent Act of 1947, as amended; that the said bill amended Section 4 (e) and Section 204 (a) of the Housing and Rent Act of 1947, as amended; by striking out "June 30, 1950" and inserting in lieu thereof "June 30, 1951", and amended Section 204 (f) of the same Act to read in part as follows: "(f) (1) The provisions of this title, except section 204 (a) shall cease to be in effect at the close of December 31, 1950, except that they shall cease to be in effect at the close of June 30, 1951. "(A) in any incorporated city, town or village which, at a time when maximum rents under this title are in effect therein, and prior to De- cember 31, 1950, declares (by resolution of its governing body adopted for that purpose, or by popular referendum, in accordance with local law) that a shortage of rental housing ac- commodations exists which requires the con- tinuance of rent control in such city, town or village;***" NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Des Plaines, Illinois, that for the purposes of the said Act, we declare that a shortage of rental housing accommodations exists in the City of Des Plaines which requires the continuance of rent control in this city; and BE IT FURTHER RESOLVED, that the City Clerk be, and he is hereby directed,to transmit a copy of this Preamble and Resolution, duly certified, to the Housing Expediter, Washington, D. C. VOTE Approved: Adopted by the City of Des Plaines the day of August, 1950. AYES NAYS City Clerk Mayor RESOLUTION ON RENT CONTROL, CONT'D. The clerk read the following letter from Mayor Kenneth G. Meyer: Eagle River, Wisconsin Wednesday, August 23rd, 1950 To the members of the City Council: In connection with the question of whether the City of Des Plaines should adopt rent control, I wish to state that I am opposed to the passage of such a resolution. Des Plaines is primarily a "Home owners" city, and I do not believe that conditions exist in Des Plaines to warrant extending rent controls beyond December 31, 1950. Furthermore, our country today is having imposed upon it too many governmental controls and regulations --we are gradually finding ourselves faced with a socialistic state --a condition which every true American should resist. Should our nation be in an "all out state of war," we should of course abide by every regulation to assure victory. Until such time arrives, the City of Des Plaines should not continue rent controls. Kenneth G. Meyer Mayor The motion was wade by Alderman Vavrinek and seconded by Wolf to adopt the proposed resolution. Alderman Vavrinek read the following report of the Public Protection Committee: "We, your committee on Public Protection, therefore recommend: "That the City Council adopt the resolution continuing rent controls and if after a careful study it finds that controls are not necessary after December 31, 1950, that the City Council then go thru the process of de -controlling." The Chair put the question, and the Clerk called the roll with the following result: Ayes: Aldermen Vavrinek, Wolf, Clement and Morava. Nays: Aldermen Hansen, Baines and Halverson. The Chair thereupon declared the motion lost. ADJOURNMENT. The motion was made by Alderman Morava and seconded by Vavrinek, to adjourn. HENRICH TY CLERK MINUTES OF THE REGULAR MEETING OF THE .CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, SEPTEMBER 5, 1950, AT 8:00 P. M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Aldermen Hansen, Vavrinek, Baines, Behrel, McKay, Clement, Halverson and Morava.responding to roll call. Aldermen Wolf and Davis were absent. OFFICIAL REPORTS. The City Clerk submitted the reports of Building Inspector, Arthur Rieck and the clerk'for the month of August. COMMITTEE REPORTS. Alderman McKay reported that at the County Zoning hearing, Mr. Bestman's attorney withdrew the petition for rezoning for tavern and business at Potter and Ballard Roads. COMMITTEE REPORTS, CONT'D. Alderman McKay presented a survey of the Prairie Avenue crossing of the Soo Line which was made by members of the West End Civic Association. At Alderman.McKay's request, the Mayor referred the above matter to the City Attorney to be presented with the Lee Street survey. Alderman Morava made the following report concerning the rental of a room in the Warehouse to Jordan Manufacturing Company: "Your Committee on Public Buildings and Land has investigated the above and has found: "In going over the space in our Municipal Garage, we find that this space is not being used at this time and feel that the rental of $10.00 per month to the Jordan Manufacturing Company for storage is a fair price. This rental is on a month iz month basis and when the time comes that we need this space, a thirty day notice will be given to the Jordan Manufacturing Company to vacate. The revenue derived from this rental can be applied to making necessary changes required in the warehouse." On motion by Morava and second by Halverson, the report was concurred in. ESTELLE B. BENNETT "FORECLOSURE." The Clerk read the following letter: July 26, 1950. City Council, Des Plaines, Illinois. Gentlemen: The undersigned wishes for leave to foreclose special assessments on the following described piece of real estate: Lots Twenty -Four (24) and Twenty -Five (25) in Block Four (4), in Ira Brown's Addition to Des Plaines, in Section 17, Township 41 North, Range 12, East of the Third Principal Meridian in Cook County, Illinois. Schedule of special assessments on these lots is attached hereto. Lots 24 and 25 are in one tract, and lot 25 is improved with a very old house. The address of this property is 1305 Brown Street, Des Plaines, Illinois. Our bid on the above lots will be One Hundred Seventy-seven Dollars (177.00), or 40% of the amount of the principal. Bennett The Mayor referred the letter to the Finance Committee and City Alderman Halverson reported that he had met with the Park Board in regard to the sidewalk at Wolf Road and Prairie Avenue. He said that the Park Board realized the need of a sidewalk but had no money for such a project, but they would see what could be done. Alderman Clement inquired as to what was being done about con- demnation of the Minnich building. The Mayor referred the matter to the City Attorney to adtise the proper City Official of what action should be taken for condemnation proceedings. Alderman Clement also reported that he received complaints from several home owners on Crestwood Drive regarding the vibrations of their homes, which they claim is due to work at Meyer Coal Company. Alderman McKay stated that he had received complaints of sand blowing from this same place of business. The Mayor instructed the Clerk to write a letter to the Meyer Coal Company concerning this nuisance.
