MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
JULY 17th,1950 AT 8:00 PM.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer
who presided, with Alderman Hansen,Davis, Vavrinek, Baines, Behrel, McKay,
Clement, Halverson and Morava responding to roll call.
OFFICIAL REPORTS: The Clerk submitted the seiai-annual report of receipts &
disbursements. Alderman McKay reported the following on County Zoning Hearing:
Atter?ed hearing on July 13,;wn petition of Mr. L. Klein of Des Plaines.
Countryside for rezoning of about 33 acres south of Touhy Avenue between Maple
and Scott Streets. Offered no objection part of City of Des Plaines inasmuch
as water supply to be from some central zone, no wells to be placed on the
individual lots. There will be sewers for surface storm water drainage,
and County will.•octieck as to the ability of the ground to absorb the drainage
from septic tanks.
PARK DISTRICT LETTER: Clerk read the following letter:

Dear Sir:
Your letter calling attention to the condition of Park Property
located at Wolf, Prairie and Greenview Avenues, was brought to the attention
of the Park Commissioners at their last meeting.
I was instructed to inform you that the matter would be given
due consideration.
It was also suggested by one of the Commissioners that, inasmuch
as there are several matters of mutual interest, in which the co-operation
of City Council and the Park Commissioners was necessary, a meeting of a
committee representing the two bodies be arranged to discuss them.

PETITION TO VACATE BIRCHWOOD STREET: The Clerk read the following petition
signed by owners of 12 lots:

We the undersigned being the owners of all the Lots ( Numbers 1,2,3,4,5,6,7,8,9,
10,11, and 12) in the Welwyn subdivision which abutes on Birchwood Street
(Birchwood was dedicated as a part of the original Salinger subdivision),
petition that Birchwood Street be vacated.
In consideration, we agree to pay the cost of preparing a plat and the recording
fees. We also agree that an easement will be granted to replace Birchwood Street
as vacated.

The Mayor referred the letter to the Municipal Development Committee.
COOK COUNTY ZONING HEARING: The Clerk read a hearing notice from the Cook County
zoning Board for the southeast Corner of Dempster and Rand Road. The Mayor
referred the notice to the Municipal Development Committee.
RECOMMENDATION OF ZONING BOARD on C. & N.W. RAILROAD PROPERTY: The Clerk
read the following recommendation:

Your Zoning Board of Appeals, sitting as a Commission, had referred
to it by the City Council of Des Plaines application for confirming of the
following described real estate as Class A residential property, to wit:
Parcel No. 1
The east half of the east half of the south west fractional quarter of
section 18 and all that part of the west half of the south east quarter of said
Section 18 which lies west of a line drawn parallel with and 800 feet distant at
right angles easterly from the center line bf the West Wye tract of the Chicago
and Northwestern Railway Company as said track is now located and established, and
northwesterly of the southeasterly right of way line of the maine line right
of way of the so-called Des Plaines Valley Company, except that part of the west
half of the south east quarter of Section 18 described by beginning at a point on the
west line of the said west half of the south east quarter of Section 18, which
is 850 feet south of the North west corner thereof; thence running east on a line
pareliel with and distant 850 feet southerly from the north line of said west half
of the south east quarter of Section 18, a distance of 523 feet, more or less, to
the west right of way line of wolf road; thence running southeasterly along the
said right of way of Wolf Road 500 feet, more or less, to the northwesterly right
of way line of the main line of the Chicago and North Western Railway Company's
Des Plaines Valley Line: thence running along said northwesterly right of way
line in a southerly and westerly direction to the center line of Thacker Street;
thence running west along the center line of Thacker Street to the west line of said

in, consisting of a strip 680 feet long by 50 feet wide beginning at the center line
of Thacker Street and running in a Northeasterly direction 680 feet, in the south
east quarter of Section 18, Township 41 North, Range 12, east of the Third Principal
Meridian;
ADVICE IS AS FOLLOWS:
1. Due notice to the parties and to the public of this proceedings
and of the public hearing was given as required by law, and that the Board has
jurisdiction of the subject matter and of the parties.
2. The petitioner wishes to confirm that the above described
property should remain Class Aresidential property.
3. That there were no objectors to the proposed Amendment.
4. That the tract of land in question is owned by the Chicago
and Northwestern Railroad Company, and that they were in agreement on the above
described property.
Your Zoning Board of Appeals, sitting as a Commission, having heard
and considered the evidence, and being fully informed in the premise, and a vote
to have the above described property remain Class A residential, was 5 for and none
against. Therefore, your Board recommends to the Mayor and City Council that the
proposed Amendment to the Zoning Ordinance hereinto before described, be adopted.

PASS ORDINANCE ON_C. & N.W. RY. PROPERTY ZONING : The Clerk read for first
reading the proposed ordinance entitled:
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE
CITY OF DES PLAINES, ILLINOIS, AS HERETOFORE
AMENDED, BY ESTABLISHING, CERTAIN REAL ESTATE AS
RESIDENCE DISTRICT AREA DISTRICT A PROPERTY
The motion was made by Alderman McKay and seconded by Clement
to suspend the rules and place the proposed ordinance on passage. The
Mayor put the question and the Clerk called the roll with the following
result: Ayes: Alderman Hansen, Davis, Vavrinek, Baines, Behrel, McKay,
Clement, Halverson and Morava. N ays: None. The Mayor thereupon declared
the motion carried,the rules suspended and the proposed ordinance before the
council for final passage. The motion was made by Alderman McKay and
seconded by Clement to pass the proposed ordinance. The Mayor put the
question and the Clerk called the roll with the following results: Ayes:
Alderman Hansen,Davis, Vavrinek,Baines, Behrel, McKay, Clement, Halverson
and Morava, Nays: None. The Mayor thereupon declared the motion carried

The motion was made by Alderman Baines and seconded by Halverson
to suspend the rules and place the ordinance on passage. The Mayor put the
question and the Clerk called the roll with the following result: Ayes:

and Morava. Nays: None. The Mayor thereupon declared the motion carried -
the rules suspended and the proposed ordinance before the Council for final

FIRST READING OF ORDINANCE REGISTRATION OF SOLICITORS: The Clerk read the
following letter:

Gentlemen:
July 17th 1950
The Supreme Court has on several occasions recently held that
a municipality may not license solicitors. In view of such holdings and
to bring our solicitors' ordinances up-to-date. I have with the assistance of
City Clerk Otto uenrich, prepared a new form of ordinance which calls for
the registration rather than licensing of solicitors. In view of the wording
of some of the decisions in the licensing ordinances, I have severe doubts
that even a simple registration ordinance, such as the enclosed one, is
valid. I believe the Municipal League has similar doubts, but many

municipalities have passed a similar ordinance which provides some type of
protection against indiscriminate soliciting, at least until it is tested
in the courts.

The Clerk read for first reading the following proposed ordinance
entitled:
AN ORDINANCE PROVIDING FOR THE REGISTRATION
OF SOLICITORS.
The Mayor ordered the proposed ordinance placed on file for second
reading.
Alderman Wolf made his appearance at this time.
PLAT OF AM -Rose MANOR:
The Clerk presented a plat of Am -Rose Manor which had been approved
by the Des Plaines Plan Commission. After a recess the Mayor referred the plat
to the Municipal Development and Building Commission.
DES PLAINES SAFETY COUNCIL LETTERS: The Clerk read a letter from the Des Plaines
Safety Council about speeding autos. Several letters from other organizations
about speeding, were attached. After some discussion the Mayor requested
Marshal oligham to check on the speeding.
Alderman Clement requested letters to be written to the Highway
Department and Chicago Motor Club, regarding four-way stop at Thacker and
Wolf. Alderman Baines suggested to included Algonquin and Lee Streets.
Alderman Halverson askedto included Lee and Oakton Streets,also Des Plaines
Avenue and Oakton Street.
Alderman Baines reported on the hazard at island at Walnut and
Leestreets. The Mayor referred the item to Street Committee and Supt. of
Public Works..
APPROVAL OF BILLS: Alderman Baines, Chairman of the Finance Committee
presented the following proposed resolution:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DES PLAINES,ILLINOIS THAT THE FOLLOWING BILLS
ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY
CLERK BE"AND ARE HEREBY AUTHORIZED TO MAKE
PAYMENT FOR SAME.

The motion was made by Alderman Baines and seconded by Halverson
to adopt the proposed resolution. The Mayor put the question and the
Clerk Called the roll with the following result: Ayes:Alderman Hansen,Davis,
Vavrinek,Wolf, Baines, Behrel, McKay,Clement, Halverson and Morava. Nayes:
None. The Mayor thereupon declared the motion carried and the proposed
resolution adopted.
APPROVAL OF MINUTES: The motion was made by Alderman Halverson and Seconded
by Hansen to approve the minutes of the adjourned meeting of July 10th,1950.
The motion was voted upon by acclamation whereupon the Mayor declared the
motion carried and the minutes approved.
ADJOURNMENT:
The motion was made by Alderman Davis and seconded by Morava
to adjourn. The motion was voted upon by acclamation whereupon the
Mayor declared the meeting regularly adjourned.
