ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY, APRIL 3, 1950, AT 8:00 P. M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth G.
Meyer, who presided with Aldermen Hansen, Davis, Wolf, Baines, Behrel, McKay,
Clement, Halverson and Morava responding to roll call. Vavrinek was absent.
OFFICIAL REPORTS. The clerk submitted the monthly reports of
Inspector Scharringhausen and the City Clerk for March. An annual report
was also submitted from B. C. Foote, Secretary of the Police Pension Fund.
OPEN BIDS FOR WATER MAINS. On motion by Halverson and second by
Behrel,the Clerk was instructed to open the bids on Water Maine.

Gentlemen:
Mr. Arthur Rieck and the Civil Service Commission have both referred
to me the following problem:
Mr. Rieck, as electrical inspector, would like to come under the
provisions of the Civil Service Act and have the position of electrical
inspector classified under the Civil Service Ordinance. Under the pro-
visions of the state statute relating to civil service, elected officials
and all officials appointed by the Mayor with the advice and consent of the
City Council are excepted from the operation of Civil Service.
Under Section 158 of the Municipal Code of Des Plaines it is pro-
vided that the Chief Electrical Inspector shall be a member of the Electri-
cal Commission and that all members of the Commission shall be appointed
for one year by the Mayor with the consent of the City Council. I have
advised the Civil Service Commission, therefore, that Mr. Rieck and the
office occupied by him may not be classified under the Civil Service Ordi-
nance.
Mr. Rieck, however, would like to have the ordinance changed so
that he may be classified under Civil Service and I understand the Civil
Service Board agrees that this ought to be done. If the Council and the
Mayor agree that this should be so, it would be a relatively simple matter
to amend the ordinance making the electrical inspector a deputy in the
office of the Building Inspector, or otherwise providing for the job and
eliminating the appointive part.
If you will advise me what you wish to do, I will prepare the
ordinance, or not, as you direct.

Gentlemen:
I am pleased to report to you that after two days spent on trial
before Judge Schnackenberg, in the Circuit Court, we were successful in our
suit to condemn the so-called "Hunt property" at 1643 Prospect Avenue. With
the able assistance of Frank Scharringhausen, Building Inspector; Mrs. Willer,
Health Officer and Lt. Kolze of the Fire Department, we satisfied the Court
that the property was a structural, fire and health hazard.
The Judge ordered Mr. Hunt, the occupant, and Mr. Roberts, the
owner, to make substantial structural repairs to the interior and exterior
of the property and substantially improve the appearance thereof within
sixty days. He ordered the work to be done substantially, in compliance
with the Building Code of the City of Des Plaines and after the procuring
of proper permits, and that the work is to be done in permanent, workmanlike
manner and not by use of temporary supports, jacks or other similar expedients.
If the repairs and remodeling are not completed in satisfactory form
by June 5th, he will order the premises torn down without further delay.

This is to advise that pursuant to the order of the Council, I
attended the hearing on March 24th on the application of the Chicago &

Northwestern Railway Company for an increase in the suburban railroad fares.
At the Illinois Commerce Commission the Railroad introduced its testimony in
support of its claims for the fare increase, and the hearing has been con-
tinued by the Commerce Commission to April 26th, for the purpose of giving
objecting municipalities a chance to cross examine the Railroad's witnesses
and express their objections.
I shall be glad to have any member of the Council attend the Commerce
Commission hearing on that date with me and express their own objections if
they desire.

COMMITTEE REPORTS. Approval of Bills. Alderman Baines, Chairman
of the Finance, presented the following proposed resolution:

The motion was then made by Alderman Baines and seconded by Davis,

The mayor thereupon declared the motion carried and the proposed resolution
adopted.
PUBLIC RELATION COMMITTEE. Alderman Davis informed the Council
that the mayor had the report of the count of postal cards returned on the
public opinion regarding the unclaimed dogs at pound. The mayor made the
following report:

The cards were counted by Mayor Kenneth G. Meyer, Alderman Percy
Baines and City Clerk Otto Henrich and H. I. Southerwick of Rand Park Dog

The motion was made by Alderman Halverson and seconded by Clement
that the City Attorney be instructed to draft an ordinance regarding the
dogs to be delivered to the University for research. The motion was voted
upon by acclamation, whereupon the mayor declared the motion carried.
STREETS COMMITTEE. Alderman Hansen reported that the Streets Com-
mittee recommended to vacate the alley south of Thacker Street from west to
east of Webster Lane to Second Avenue. On motion by Alderman Hansen and
second by Halverson, the report was concurred in.
Alderman Hansen reported that the Streets and Water Committees
recommend that no two-way radio be installed at this time in Superintendent
E. R. Warnicke's auto but recommended that same be installed in 1951 ap-
propriation. On motion by Alderman Hansen and second by Morava, the motion
was concurred in.
FOREST PRESERVE LETTER. The Clerk read the following letter:

use of the land is to build a Youth Center on this
property.
3. As explained by Mrs. Ruby Fletcher, the Youth Center,
which is a non-profit corporation, plans to build a club
house for the Youth Center, approximately 40 by 100 feet.
4. That there were eight objectors to the proposed
granting of a variation on this property, at the public
hearing.
5. That the property in question is a vacant lot along
the north side of Miner Street, approximately directly
opposite the field house. The other property on this
side of Miner Street to the intersection of Rand and
Miner, is residential property.
The Zoning Board of Appeals having heard and considered the evi-
dence and being fully informed in the premise, recommends that the variation
be not granted.
The Zoning Board of Appeals feels that such a project would be a
duplication of existing facilities in the City, and under its present lo-
cation in certain seasons of the year, would be a hazard from the safety
standpoint for young people, since the proposed location is on a highly
traveled street, with existing facilities just opposite.
This action was adopted by the concurrent vote of five members of
the Board.

Alderman Davis reported that Mr. T. Napier was present and had a
petition of the property owners of Welwyn Drive regarding a five-foot set-
back line on the Birchwood Avenue side of their property for garages.
Mr. Napier presented the petition. On motion by Alderman Baines and second
by Behrel, the petition was referred to the Zoning Board of Appeals..
REPORT ON WATER. MAIN BIDS. City Engineer Fletcher, having tabulated
the bids, recommended that the four low bids be held for ten days --these bids
being referred to the Water Committee. Mr. Fletcher recommended that the
checks on other bids be returned. On motion by Alderman Hansen and second
by Halverson, the recommendation was concurred in.
The Clerk read a letter from R. L. McLane, 956 Lee Street (owner of
Texaco Service Station) who desires to increase his driveway ten (10) feet.
The mayor referred the letter to the Street Committee.
COOK COUNTY ZONING LETTER. The clerk read a letter from the Zoning
Board of Appeals of Cook County; a request to rezone property at the north-
east corner of Dempster and Greenwood to District 2 (Business, Tavern and
Amusement.) On motion by Alderman Baines and second by McKay, the clerk was
instructed to write a letter to the Zoning Board objecting to the rezoning
due to location near Maine High School. Alderman Davis and the City Attorney
will attend the meeting.

PASS ORDINANCE ON 100% PRINCIPAL PAYMENT OF SPECIAL ASSESSMENTS. The
Clerk read for first reading the following proposed ordinance entitled:

The motion was made by Alderman Baines and seconded by Hansen, to
suspend the rules and place the proposed ordinance on passage. The mayor
put the question, and the clerk called the roll with the following result:
Ayes: Aldermen Hansen, Davis, Wolf, Baines, Behrel, McKay, Clement, Halverson
and Morava. Nays: None. The mayor thereupon declared the motion carried,
the rules suspended and the proposed ordinance before the Council for final
passage. The motion was then made by Alderman Baines and seconded by Davis
to pass the proposed ordinance. The mayor put the question, and the clerk
called the roll with the following result: Ayes: Aldermen Hansen, Davis,
Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava. Nays: None.
The mayor thereupon declared the motion carried and the ordinance adopted.
The clerk read a letter from the property owners on Harvey Avenue
east of Wolf Road regarding street in need of repair. The mayor requested
the Street Committee, Superintendent of Public Works and Alderman McKay to
meet with him on Friday, April 7, 1950.
Alderman McKay reported of hazard to the people on Golf Road at
Cumberland Station. The mayor referred the matter to the Safety Council
for investigation.
Alderman Clement inquired regarding a former request for a four-
way stop at Thacker Street and Wolf Road. The clerk was asked to write
the Highway Department in regard to this matter.
APPROVAL OF MINUTES. The motion was made by Alderman Behrel and
seconded by Morava to approve the minutes of March 20, 1950. The motion
was voted upon by acclamation, whereupon the mayor declared the motion
carried and the minutes approved.

COMMITTEE REPORTS. Alderman Vavrinek reported that patrolman
William Radlein had resigned and then made the motion which was seconded by
Baines, that the Police and Fire Commission be instructed to appoint a
patrolman from the eligible list. The motion was voted upon by acclamation,
whereupon the mayor declared the motion carried.
LICENSE COMMITTEE. Alderman Behrel reported that the License Com-
mittee had investigated the matter of a kennel license for Mr. Yates.
Mr. Yates, who lives at 1761 Wicke Avenue, has applied for a dog kennel
license. The license was refused because of operating a commercial enter-
prise. Investigation Proves this to be true. The committee, therefore
