The check for $464.22 has been turned over to the City Treasurer. Yours very truly, MSH:AR Marshall S. Construction Co., Chicago, I11. . . . 18,735.00 1 1 CITY ATTORNEY'S REPORT, CONT'D. April 3, 1950 Honorable Mayor and City Council of Des Plaines City Hall Des Plaines, Illinois Gentlemen: Mr. Arthur Rieck and the Civil Service Commission have both referred to me the following problem: Mr. Rieck, as electrical inspector, would like to come under the provisions of the Civil Service Act and have the position of electrical inspector classified under the Civil Service Ordinance. Under the pro- visions of the state statute relating to civil service, elected officials and all officials appointed by the Mayor with the advice and consent of the City Council are excepted from the operation of Civil Service. Under Section 158 of the Municipal Code of Des Plaines it is pro- vided that the Chief Electrical Inspector shall be a member of the Electri- cal Commission and that all members of the Commission shall be appointed for one year by the Mayor with the consent of the City Council. I have advised the Civil Service Commission, therefore, that Mr. Rieck and the office occupied by him may not be classified under the Civil Service Ordi- nance. Mr. Rieck, however, would like to have the ordinance changed so that he may be classified under Civil Service and I understand the Civil Service Board agrees that this ought to be done. If the Council and the Mayor agree that this should be so, it would be a relatively simple matter to amend the ordinance making the electrical inspector a deputy in the office of the Building Inspector, or otherwise providing for the job and eliminating the appointive part. If you will advise me what you wish to do, I will prepare the ordinance, or not, as you direct. Yours very truly, Marshall S. Howard City Attorney The motion was made by Alderman Wolf and seconded by Baines, that the City Attorney draft an amendment to the Civil Service Ordinance. April 1, 1950 Honorable Mayor and City Council City of Des Plaines City Hall Des Plaines, Illinois 389 Gentlemen: I am pleased to report to you that after two days spent on trial before Judge Schnackenberg, in the Circuit Court, we were successful in our suit to condemn the so-called "Hunt property" at 1643 Prospect Avenue. With the able assistance of Frank Scharringhausen, Building Inspector; Mrs. Willer, Health Officer and Lt. Kolze of the Fire Department, we satisfied the Court that the property was a structural, fire and health hazard. The Judge ordered Mr. Hunt, the occupant, and Mr. Roberts, the owner, to make substantial structural repairs to the interior and exterior of the property and substantially improve the appearance thereof within sixty days. He ordered the work to be done substantially, in compliance with the Building Code of the City of Des Plaines and after the procuring of proper permits, and that the work is to be done in permanent, workmanlike manner and not by use of temporary supports, jacks or other similar expedients. If the repairs and remodeling are not completed in satisfactory form by June 5th, he will order the premises torn down without further delay. Respectfully submitted, MSH:rj Marshall S. Howard City Attorney The Mayor ordered the letter placed on file. April 1, 1950 Honorable Mayor and City Council City of Des Plaines, City Hall Des Plaines, Illinois Gentlemen: This is to advise that pursuant to the order of the Council, I attended the hearing on March 24th on the application of the Chicago & 390 CITY ATTORNEY'S REPORT,O NT'D. Northwestern Railway Company for an increase in the suburban railroad fares. At the Illinois Commerce Commission the Railroad introduced its testimony in support of its claims for the fare increase, and the hearing has been con- tinued by the Commerce Commission to April 26th, for the purpose of giving objecting municipalities a chance to cross examine the Railroad's witnesses and express their objections. I shall be glad to have any member of the Council attend the Commerce Commission hearing on that date with me and express their own objections if they desire. Respectfully submitted, MSH:rj Marshall S. Howard City Attorney The mayor ordered the letter place on file. COMMITTEE REPORTS. Approval of Bills. The Mayor and City Council City of Des Plaines Des Plaines, Illinois March 27, 1950 Gentlemen: Your Zoning Board of Appeals, sitting as a Commission, had referred to it the application of E. M. Stockton and William L. Kunkel to rezone the following described real estate from its present classification residential district AA, to commercial district C, to wit: Lots 1 to 10 inclusive in block one, in White's Riverview Addition, section 28, township 41, north, range 12, east of the Third Principal Meridian, in Cook County. Advices are as follows: to 1. Due notice to the party and/the public of this proceeding and of the public hearing, was given as required by law, and that the Board has jurisdiction of the subject matter and of the parties. 2. That the property proposed to be reclassified from resi- dential area district AA to area district C - commercial, consists of ten lots that are vacant on the south side of Oakton Street. 3. That there were no objectors to the proposed amendment. 4. That the tract of land in question faces on Oakton Street, and was originally reclassified to class AA residential district through an error in the original petitioner's application for rezoning part of Riverview for duplex dwellings. 5. That the Zoning Board sees no objections to the use of this property for commercial purposes since it is located on a street that is zoned for commercial purposes at the present time. 6. That the evidence presented was convincing as to the desirability of reclassifying the petitioner's property for commercial use. The Zoning Board of Appeals, sitting as a Commission, having heard and considered the evidence, and being fully informed in the premise, on a vote for a change of five for, and mne against the change, recommend to the Mayor and City Council that the proposed amendment to the Zoning Ordinance hereinto before described, be adopted. Therefore, an ordinance in accordance with the recommendations as herein contained, is submitted for your consider- ation. Respectfully submitted, Zoning Board of Appeals, City of Des Plaines, Illinois. James J. Carroll W. H. McConnell Albert L. Gundelach Fred K. Howe EWG By: Alvah H. James Secretary On motion by Alderman Wolf and second by Halverson, the recommenda- tion was concurred in. REJECT REZONING APPLICATION OF PROPERTY FOR YOUTH CENTER ON MINER STREET OPPOSITE RAND PARK. The clerk read the following report: March 27, 1950 The Mayor and City Council City of Des Plaines Des Plaines, Illinois Gentlemen: Your Zoning Board of Appeals had referred to it the application of Mrs. Frank Garland, to grant a variation on the use of the following described real estate, which is residential district area A, to wit: „3 REJECTION OF REZONING APPLICATION FOR YOUTH CENTER, CONT'D. That part of lot 17, consisting of the southeast corner of lot 17; thence west along the south line of said lot 17, 125 feet; thence north on a line parallel to the east line of said lot 17, 200 feet, to a point 125 feet west of the east line of said lot 17; thence east 125 feet to the east line of said lot 17; thence 200 feet along the east line of lot 17 to the place of beginning, Garland's Division of land in the south half of the south half of section 16, township 41, north range 12, east of the Third Principal Meridian, in Cook County, Illinois. Advice is as follows: 1. Due notice to the party and to the public of this pro- ceeding and of the public hearing, was given as required by law, and that the Board has jurisdiction of the subject matter and of the parties. 2. That the property proposed to be granted a variation on, is now residential area district A, and the proposed use of the land is to build a Youth Center on this property. 3. As explained by Mrs. Ruby Fletcher, the Youth Center, which is a non-profit corporation, plans to build a club house for the Youth Center, approximately 40 by 100 feet. 4. That there were eight objectors to the proposed granting of a variation on this property, at the public hearing. 5. That the property in question is a vacant lot along the north side of Miner Street, approximately directly opposite the field house. The other property on this side of Miner Street to the intersection of Rand and Miner, is residential property. The Zoning Board of Appeals having heard and considered the evi- dence and being fully informed in the premise, recommends that the variation be not granted. The Zoning Board of Appeals feels that such a project would be a duplication of existing facilities in the City, and under its present lo- cation in certain seasons of the year, would be a hazard from the safety standpoint for young people, since the proposed location is on a highly traveled street, with existing facilities just opposite. This action was adopted by the concurrent vote of five members of the Board. Respectfully submitted, Zoning Board of Appeals, City of Des Plaines, Illinois. James J. Carroll W. H. McConnell Albert L. Gundelach Fred K. Howe EWG By: Alvah H. James cc -Building Inspection Dept. Secretary On motion by Alderman McKay and second by Baines, the recommendation was concurred in. Your Zoning Board of Appeals, sitting as a Commission, having heard and considered the evidence, and being fully informed in the premise, on a vote for a change of five for, and none against the change, recommends to the Mayor and City Council that the proposed amendment to the zoning ordi- nance hereinto before described, be adopted.
