committee recommends to sell the special assessment lien at 100% principal
on Warrants 80 and 88, of which Mr. Kunkel owns all the bonds and that the
city attorney be instructed to draw up the proper ordinance. On motion by
Alderman Baines and second by Behrel, the report was concurred in.
Alderman Baines also reported on the William Kunkel letter request-
ing the city council to sell the liens on special assessment warrants on
Lots 22 and 21, Block 1, Norrie Park. The Finance Committee recommends
that the city council sell the liens on the special assessment warrants
at 100% to William Kunkel and that the city attorney prepare the proper
ordinance. On motion by Alderman Baines and second by Halverson, the
report was concurred in.
Engineer E. N. Fletcher asked the Mayor to refer the matter of
enlarging the softening plant to the Water Committee. This was so referred.
APPROVAL OF MINUTES. The motion was made by Alderman Halverson
and seconded by Hansen, to approve the minutes:of December 19, 1949. The
motion was voted upon by acclamation, whereupon the Mayor declared the
motion carried and the minutes approved.

ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY, JANUARY 16, 1950, AT 8:00 P. M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth G.
Meyer, who presided with Aldermen Davis, Hansen, Vavrinek, Wolf, Baines,
Behrel, McKay, Clement, Halverson and Morava responding to roll call.
OFFICIAL REPORTS. The City Clerk submitted the report of Treasurer
Barrett and the City Clerk's report for the month of December. The clerk also
submitted the 1949 Fire Department report by Lieutenant Raymond Kolze and the
Building Inspector's 1949 report.
Marshal John Wigham requested the purchase of a new squad car. The
mayor referred the item to the Public Protection Committee.
PLAN COMMISSION REPORT. Secretary Henrich of the Plan Commission
reported the following on the petition for the dedication of Cedar Street
from Howard to Birchwood: "The Plan Commission recommends the approval of
dedication of Cedar Street as requested in petition."

Gentlemen:
A short time ago there was referred to me a complaint regarding
the storage of automobile wrecks at Oakton Street and River Road. It was
indicated that a number of automobile wrecks were stored on two corners
at that intersection, namely the northeast and southwest corners.
It is my opinion that if either of the premises complained of
were being used as junk yards and places of storage for an indefinite time
of any number of wrecked automobiles, that complaint could be filed in the
local police courts for the maintenance of a nuisance on the premises.

If evidence is offered to me that such is the case, and if the Council so
directs, I will commence such suits.
I might say, however, that I personally visited both corners and,
that on the two or three occasions that I have been there, there has not
been what I would consider to be any violations of law such as would sustain
a prosecution for nuisance. On one corner there was a single wrecked auto-
mobile and on the other, some distance to the rear, an old truck body. Both
places are gasoline service stations and apparantly operate towing trucks
for the express purpose of removing wrecked automobiles. I believe that
the temporary storage of an occasional wrecked automobile pursuant to this
business, would not constitute any violation of the law.
I shall be pleased to take any action in the matter that the
Council may direct.

Gentlemen:
Sometime ago there was referred to me the matter of the zoning
violation of the Louton Paint Company at 1293 Oakwood Avenue. I addressed
a letter to the Louton Company requesting that they let me know when they
could cease the zoning violation. A little later press reports indicated
that the company was building a new plant in Woodstock. I also asked the
Louton Company for verification of the press reports.
Last week I received a brief letter from Mr. K. Louton of the
Company, stating that he would be out of town for two weeks, but would
answer my letter upon his return to Des Plaines. In the meantime, I
believe the Police Chief has been requested to make a personal check-up
on when and if the zoning violation will cease.
Unless the Council otherwise directs, I shall not take any
further action in the matter until I hear from Mr. Louton.

COMMITTEE REPORTS. Alderman McKay reported the following on the
A. L. Webster letter to vacate alley south of lots 50 and 51, block 7 in
Robinson's Iddition to Des Plaines:
"The Plan Commission and the Municipal Development Committee
recommend favorable action in the matter of the alley vacation, conditioned
upon the dedication of an alley of suitable width along the railroad track,
running from Walnut Street south. Petitioner for vacation to assume all
expenses incident to transactions involved.
"It is recommended that city clerk be instructed to so advise
Mr. Webster in answer to his letter attached, which is not dated."
On motion by Alderman McKay and second by Davis, the report was
concurred in.
The Mayor referred this item to Engineer Fletcher to make up a
plat for dedication and vacation of alley.
Alderman McKay reported the following on the three-foot side yard
ordinance:
"Your Committee conferred with Building Inspector and Architectural
Commission on the proposedthree-foot side yard ordinance on January 9th.
The Building Inspector requests that this ordinance be held up pending his
presentation of a more comprehensive ordinance change and which would
include the three-foot side yard feature with modification to permit a
one -foot overhang for eaves, etc. This was agreed to by the mayor, who
was present, as well as the Municipal Development Committee and representa-
tives of the Architectural Commission.

"It is recommended by the Municipal Development Committee therefore
that the Building Inspector's request as above outlined be granted by this
Council."
On motion by Alderman McKay and second by Wolf, the report was
concurred in.
Alderman McKay reported the following on Fred I. Gillick's letter
regarding the annexation of the southeast corner of Rand and Dempster Roads:
"The Municipal Development Committee met with the Plan Commission,
City Attorney and the Mayor on January 5, and gave consideration to the
letter from the Fred I. Gillick Company dated December 9, above referred to.
"It was agreed that it would be desirable to include the area in
question in the City of Des Plaines, and the Municipal Development Committee
will recommend favorable action if application is made for annexation.
"However, your Committee is unwilling to make any promise or
forecast in connection with any re -zoning proceedings which might be in-
stituted to cover the parcel in question, if said parcel is annexed to the
City.
"It is recommended by your Committee that the city clerk be in-
structed to reply to Mr. Gillick's letter accordingly."
On motion by Alderman McKay and second by Hansen, the report was
concurred in.
Alderman McKay also reported the following on Mobil homes:
"Your Committee on Municipal Development met with the Building
Inspector and the Architectural Committee on January 9th and gave consider-
ation to the attached letter from Mr. Norman Woods, Vice President of the
Mobilhome Division of the Chicago Steel Structures, Inc., dated December 12.
"Mr. Woods' letter includes a request that the present City ordi-
nance on the Van Packer chimney which permits the use of same in basementless
houses be amended to permit use of this chimney in houses with full basements.
His letter seems to be based on the assumption that there would be no ob-
jection to the placing of Mobilhomes in the City of Des Plaines.
"It is the opinion of the Building Inspector and the Architectural
Committee, in which the Municipal Development Committee concurs, that if
the Van Packer chimney is acceptable for houses without basements it should
be satisfactory for homes with basements, it being understood that in all
cases suitable support would be provided.
"It is recommended, therefore, that the City Attorney confer with
the Building Inspector, and prepare necessary amendment permitting the use
of the Van Packer chimney in houses with basements the matter of safe and
suitable support for the chimney to be given particular attention.
"As to the matter of whether or not we should encourage the
placing of Mobilhomes in the City of Des Plaines, your Committee recommends
that any application for permit to move such a home into Des Plaines be re-
ferred to this Council for consideration before permit is granted. Plans
and specifications of course to be furnished the Building Inspector. If
the plans and specifications and proposed location of the building prove
satisfactory to the Building Inspector and the Architectural Committee,
and their approval is concurred in by the Council, then permission to be
granted, it being understood that all regulations of our ordinance on moving
of buildings to be observed. Among other things, this ordinance provides
that the applicant shall get the written consent of the owners of the
majority of the frontage on both sides of the street where it is proposed
to locate such building, lying between the nearest intersecting streets.
"It is understood that the present proposal, plans and specifica-
tions being in the Building Department, is satisfactory to the Building
Inspector and the Architectural Commission, that the location on Van Buren
Street between White and Cora is also satisfactory.
"It is recommended therefore that this present proposal to move
a Mobilhome into Des Plaines, for placement on Van Buren Street, be approved
by this Council, all provisions of the ordinance on moving of buildings to
be observed and payment of license fee in accordance with the current
schedule to be paid.
"Mr. Mayor, I move that this report of the Municipal Development
Committee, including recommendation for amendment to ordinance on Van Packer
Chimney and recommendation for moving a Mobilhome into the City of Des Plaines
be concurredin."
The motion was seconded by Morava and voted upon by acclamation,
whereupon the mayor declared the motion carried.

Alderman McKay reported the following on the alley in the First
National Bank block:
"On January 5th your Municipal Development Committee met with the
Planning Commission, Streets Committee, City Engineer, City Attorney and
Mayor.
"The City Engineer presented a plan but after consideration and
discussion he was directed to revise it to include a connection to Graceland
and a branch into Prairie, along lines indicated and agreed to after dis-
cussion. Revised plat to be ready for Council consideration at meeting of
January 16.
"If, or when, this plat is ready for inspection by this Council,
it is recommended by your Committee that it be given very careful consider-
ation before any action is taken thereon.
"Also, inasmuch as the Chairman of your Committee has been con-
tacted by the attorney for Mr. Frisbie since our meeting of January 5th,
in fact as late as last Friday, the 13th, it is recommended that any repre-
sentatives of Mr. Frisbie who may be present be given full opportunity to
examine the plat, if it is available tonight, or whenever it is, and that
they be given opportunity to express themselves, even if it is necessary
to defer action by this Council on this plat, until some later meeting."
On motion by Alderman McKay and second by Hansen, the report was
concurred in.
On motion by Alderman McKay and second by Davis, the matter was
referred back to the Municipal Development Committee.
PUBLIC PROTECTION COMMITTEE. Alderman Vavrinek reported that the
committee recommended the purchase of a new squad car. On motion by Alder-
man Vavrinek and second by McKay, the clerk was instructed to advertise for
bids for the purchase of a new squad car to include trade-in of old car.
PUBLIC BUILDINGS. Alderman Morava reported that he has received
several estimates regarding an oil burner but the committee did not have
time to study them. On motion by Alderman Morava and second by McKay, the
estimates were referred back to the committee.
STREETS AND SANITATION. On motion by Hansen and second by Halverson,
the City Clerk was instructed to advertise for bids for the purchase of a
garbage truck.
APPROVAL OF BILLS. Alderman Baines, Chairman of the Finance Com-
mittee, presented the following proposed resolution:

THE CITY OF DES PLAINES THAT THE FOL-

Gentlemen: -
At our special meeting of Jan. 9th, 1950, at which time the Mayor,
Attorney, the Aldermen and myself were present, and at the conclusion of this
meeting I pledged myself at that meeting that there would be no publicity
eminating from myself, as to the results or contents of this meeting.
This I have honestly abided by and no information to the press,
although was called by them for a story I told there would be no release
of story at this time.
I assumed that this would be the way the council would wish it
to be, and that they would do likewise.
However some information was released to the press by someone
present regarding action taken regarding the vote of confidence voted for
the Mayor and Attorney in their method conducting the case in question.
Further quoting letter in journal, contents of Scharringhausen's
letter were explosive enough as to cause several aldermen to feel that the
inspector would be asked to resign.
Therefor request that a roll call be taken at this meeting on a
vote of confidence for the Building Inspector, who has nothing to hide and
is determined that the continuance in office as Building Inspector for
better government control, depends on this vote as no government body will be
successful unless they work together, for the betterment of conditions within
our city.
If I cannot get this confidence vote; to continue would seem hope-
less and inadvisable.
Therefor it is now up to the council to vote.

seconded by Clement to give the Inspector a vote of confidence. The motion

LETTER FROM METHODIST WOMEN'S SOCIETY. The Methodist Women's
Society requested thatthree-hour parking signs be restored on Park Place.
Alderman Vavrinek informed the Council that three-hour parking was still
in force on Park Place, but he believed new signs are needed to replace the
rusted signs. The Superintendent of Public Works was instructed to put up
new signs.
The clerk informed the Council that he had received notice of the
date of hearing on Mrs. Clark's case. The Mayor referred the summons to the
City Attorney.
RESOLUTION FOR MAINTENANCE OF ARTERIAL STREETS. The City Clerk
read the following proposed resolution:

Gentlemen:
I am submitting at this time Chapter 3 of the proposed new City Code.
This chapter deals with city officials. I should like to make the following
observations regarding the revised paragraphs.
No provision is made for an Inspector of Weights and :Measures as in
the old code. No provision is made for either a City Collector or an Oil In-
spector, as in the old code.
The chapter is incomplete in the sense that appointment, qualifica-
tions and duties of the Engineer ought to be included in this chapter. This
will be added as soon as I can locate the present ordinance covering this
office.
The Building and Electrical Inspectors are covered by this ordi-
nance only by brief mention of the existence of the office. Reference is
made in the rewritten code to the Building Code for further details covering
these offices.
Chapter 4, covering departments, boards and commissions, is about
half written and should be presented shortly.

REQUEST FOR LIQUOR STORE LICENSE. Alderman Morava informed the
Council that Mr. and Mrs. P. J. Gillespie have requested to increase the
limit of liquor stores so he may receive a license and suggested amending
the Liquor Ordinance. The Mayor referred the item to the License Committee.
Alderman Clement spoke about the speeding of autos at Wolf Road
and Thacker Street section.. The City Clerk was instructed to write the State
Highway Department to make Thacker and Wolf Road a four-way stop on motion by
Alderman Clement and second by McKay.
Alderman McKay presented a temporary draft of an ordinance regard-
ing alleys in commercial sections which was referred to the Municipal Develop-
ment Committee, Streets Committee and Plan Commission.
MAYOR APPOINTS THE BUILDING PERMIT COMMITTEE. The Mayor appointed
the following new committee to work with the Building Inspector: Alderman
Clement, Chairman, and Aldermen Davis and Behrel.
APPROVAL OF MINUTES. The motion was made by Alderman Halverson and
seconded by Morava to approve the minutes of January 3, 1950. The motion was
voted upon by acclamation, whereupon the Mayor declared the motion carried

COMMITTEE REPORTS. Alderman McKay reported that it would be neces-
sary to call another meeting in regard to the Frisbie alley. He set the date
of the meeting for Monday evening, February 13, 1950, at 8:00 p.m.
Alderman McKay reported the following on requiring alleys in sections
re -zoned to commercial, and commercial sections in new subdivisions:
"The Municipal Development Committee, Streets Committee and Plan
Commission being in joint meeting the night of January 23rd, this subject
was considered and draft of proposed ordinance as prepared by City Attorney
Howard was turned over to the Plan Commission with request that they study
same and submit their recommendation to the City Council in connection there-
with."
Alderman Morava reported on the purchase of buildings on Miner
Street for city garage. The original price was $106,000.00, but due to the
Chicago Real Estate Board's appraisal of $92,000.00, the price had been de-
creased to $99,000.00. The motion was then made by Alderman Morava and
seconded by Halverson, that the city attorney prepare papers for the refer-
endum and bond ordinance. The Mayor put the question, and the Clerk called
the roll with the following result: Ayes: Aldermen Davis, Vavrinek, Wolf,
Baines, Behrel, McKay, Clement, Halverson and Morava. Nays: None. The
Mayor thereupon declared the motion carried.
