OAA T• W. J. H ICH CITY CLERK MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY, NOVEMBER 7, 1949, AT 8:00 P. M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava responding to roll call. OFFICIAL REPORTS. The City Clerk submitted his report for the month of October and also the report of Building Inspector Scharringhausen. ADVERTISE BIDS FOR STOP LIGHTS AT PRAIRIE AVENUE AND LEE STREET. City Engineer Fletcher reported that the cost of the stop lights had to be increased because six lights instead of four would have to be installed. On motion by Hansen and second by Halverson, the Clerk was instructed to adver- tise for bids for installation of six stop and go lights at Prairie Avenue and Lee Street. COMMITTEE REPORTS. Alderman McKay reported that the Municipal Development Committee recommends following the meetings with the Plan Com- mission, that petitioners be advised that the City Council is unwilling to agree to vacate any portion of north Fourth Avenue at this time. On motion by Alderman McKay and second by Wolf, the recommendation was concurred in. Alderman Vavrinek reported the following on the Minnich building at 1569 Ellinwood Street: November 7, 1949 Letter regarding Minnich building on Ellinwood Street To the Mayor and City Council: Your Committee on Public Protection has investigated the above and has found that while this building may be in an unsafe and unsanitary condition, it has been pointed out by the State Fire Marshall that the building can be put in safe and sanitary condition. 7e also find that Mrs. Hattie Schwaubauer, who resides there with her 3 children, depends somewhat on the rental from the laundry to assist in support of her family. Your Committee on Public Protection therefore recommends that the Mayor appoint a special Committee to meet with Mrs. Schwaubauer to determine what steps she can take to make this building comply with the recommendations of the State Fire Marshall, and report back to the Council. In the event the owner is willing to make these corrections it is the recommendation of this Committee that she be given every opportunity and that any condemnation procedure come as a last resort. Your Committee on Public Protection cannot see their way clear in recommend- ing the condemnation and demolition of a home which may produce considerable hardship on the owner and her children. If satisfactory arrangements cannot be made with the owner, and it appears that condemnation proceedings are then in order, it then is the recommendation of this Committee that the City attempt to purchase this property for use as a thoroughfare to connect the extension of Prairie Avenue with Ellinwood Street. The mayor informed Alderman Vavrinek that the Public Pro- tection Committee would be the special committee. Alderman Vavrinek also reported the following on the letter from J. E. Gallup, President of the Safety Council, in regard to bicycles: November 7, 1949 Letter from Mr. J. Gallup on bicycles To the Mayor and City Council: Your Committee on Public Protection has investigated the above and has found that while Mr. Gallup has done some very fine work in trying to promote safety for our children who ride bicycles, the Committee does not see eye -to -eye with Mr. Gallup on some of his recommendations. Your Com- mittee feels that a 12.00 fee for bicycle license, even for a two-year period iB entirely too high. The Committee is also reluctant to promote - the sale of any private manufacturer's patented article even though this article may be good and may contribute to the safe operation of bicycles at night. This Committee also finds that this matter was given careful consideration by the Public Protection Committee approximately one year ago and was re- jected. We, your Committee of Public Protection, therefore recommend that the City does not increase the bicycle license fee to include the cost of Scotch Lite tape for bicycles nor the fee of bicycle shops for attaching this material. It is our recommendation that the sale of scotch lite tape be promoted .by the bicycle shop as a private enterprise and that it be left to the descretion of the parents of the children to determine whether or not they wish to purchase and apply this material to the bicycle. We further recommend that our present Ordinance, which requires a new bicy- cle license each year be amended to call for permanent licensing similar to that used by the City of Park Ridge. This would require the bicycle owner to obtain only an original license which would have the words "Bicycle" and "Des Plaines" and a serial number and would be good for the period of time that the owner retained the bicycle. The fee for this registration would probably be somewhere in the neighborhood of 75¢ and would not be renewed from year to year. This would also include a provision that all previously registered bicycle owners could obtain this permanent license plate for about 25¢. LeRoy J. Vavrinek H. H. Behrel S. E. McKay After discussion on motion by Alderman Davis and second by Halverson, the matter was referred back to the Public Protection Committee, Public Relation Committee and Safety Council for further study. Alderman Davis, Chairman of the Public Relation Committee, pre- sented a petition with 300 signatures protesting the erection of a drive-in theatre east of the Benjamin Electric Company. On motion by Alderman Davis and second by Halverson, the Clerk was instructed to write a letter to the Essaness Theatre Corporation and also to the Cook County Zoning Board of Appeals, informing them of this petition and the opposition for the erection of the drive-in theatre. Alderman Halverson made themotion which was seconded by Morava, that the City Clerk purchase a Remington billing machine. The Mayor putthe question, and the Clerk called the roll with the following result: Ayes: Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava. Nays: None. The Mayor thereupon declared the motion carried. APPROVAL OF BILLS. Spiegler, Secretary October 24, 1949 Dear Mr. Henrich: In reply to your letter of July 13 we have approved the moving of the bus parking section now blocking the railroad crosswalk on the north side of Miner Street. It should be moved west to clear the crosswalk, and the parking spaces and parking meters that would be voided are to be replaced east of the crosswalk. In a conversation with Mr. Manuel, we hoped that he could have the sidewalk repaired creating a regular curb, for without building the curb, the parking meters would be hit continually by cars attempting to park. City Engineer and City Superintendent are planning to visit with Mr. Manuel to make final arrangements for the repair of the sidewalk and curb. It has been brought to our attention several times that there is double parking of buses. We recommend, therefore, that all passengers be loaded or unloaded at the designated bus stops throughout the city, and that all persons entering or leaving the bus should do so directly adjacent to the curb. Attorney Howard reported that Smith & Hill, Incorporated are now in bankruptcy and that when time comes, he will file claim for the $648.00 water bill owed the City of Des Plaines. The attorney reported that the Dr. Steinfeld case came up for hearing on November 3rd and will again be heard November 9th. The attorney stated that if any of the aldermen had evidence or witnesses, he would be glad to hear from them. The attorney advised that the City could not place a penalty on vehicle licenses after April 1st. FIRST READING OF ZONING ORDINANCE * LOT 3, BLOCK 3 IN PARSON & LEE'S ADDITION. Wells Street, Chicago; setback variations at Rand & River Road. The Mayor re- quested equested the City Attorney to attend the hearing. PLAN COMMISSION LETTER RECOMMENDING REZONING PART OF LEE STREET. The Clerk read the following letter: October 26, 1949 City Council City of Des Plaines Des Plaines, Illinois Gentlemen: The Plan Commission recommends that the section which is not zoned on Lee Street between Prairie Avenue and the Soo Line, one-half block south of Oakwood Avenue be zoned to "commercial classification," due to the expansion of the commercial area. SANITARY DISTRICT SEWER PERMIT NO. 1949-41, NORTHWEST CORNER OF TOUHY AND DES PLAINES AVENUES. City Engineer Fletcher recommended that the Mayor and City Clerk be authorized to sign the above sewer permit. On motion by Alderman Wolf and second by Hansen, the Mayor and City Clerk were author- ized to sign and execute Sanitary District Sewer Permit No. 1949-41. CARL WITT AWARDED CITY HALL PAINT BID. On motion by Alderman Morava and second by '-Iansen, the Clerk was instructed to open bids for paint- ing the outside of the City Hall. The following bids were received: Carl Witt, 1553 Walnut Avenue. . . . One coat $450.00 Second coat 350.00 TOTAL $'800.00 Imperial Decorators, Des Plaines . . One coat 644.00 Second coat 595.00 TOTAL 1239.00 The motion was made by Alderman Morava and seconded by Halverson, to award the bid to Carl Witt at the bid of $800.00 for two coats of paint. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. The Clerk informed the Council that the City Attorney had submitted Chapter Two of the City Code. On motion by Alderman Baines and second by Hansen, the reading of the Code was deferred to a future meeting. Alderman McKay requested that the City Clerk write another letter to the State Highway Department regarding the traffic signs on Golf Road. On motion by Halverson and second by Morava, the Clerk was in- structed to write the Cook County Highway Department regarding the placing of speed signs on Oakton Street, between Des Plaines Avenue and Mannheim Road. Alderman Clement said he had a complaint that there was no light on a section of Crestwood Drive. The Mayor referred the matter to the Street Committee. STREET SWEEPER DAMAGED IN AUTO ACCIDENT. The Mayor referred the item of damaged street sweeper to the City Attorney and the Finance and Street Committees. This was done in order to determine if it will be necessary to purchase a new sweeper. APPROVAL OF MINUTES. The motion was made by Alderman Clement and seconded by Behrel,to approve the minutes of October 17, 1949. OPEN BID ON LEE STREET STOP LIGHTS. On motion by Alderman Morava and second by Davis, the Clerk was instructed to open the bid on Lee Street "Stop -and -Go Lights; The following bid was received: H - H Electric Company, River Grove, Illinois . . . $4,994.75 The mayor declared a recess so that the Street Committee could study the bid with the representative of the State Highway Department. After reconvening, the motion was made by Alderman Hansen and seconded by Morava that the bid be awarded to the H - H Electric, subject to the approval of the State Highway Department. It was explained that the bid was lower than the estimate, and the State Highway Department representative, therefore, recommended theawarding of the bid. The mayor put the question, and the clerk called the roll with the following result: Ayes: Aldermen Hansen, Davis, Vavrinek, Baines, Behrel, Clement, Halverson and Morava. Nays: Alder- man Wolf and Alderman McKay. The mayor thereupon declared the motion carried and the bid awarded, subject to approval of the State Department of Highways. COMMITTEE REPORTS. Municipal Development Committee. Alderman McKay reported that he had written a letter to J. G. Jamieson, Supervisor of the Building and Zoning Bureau of Cook County, regarding the Nebel property on trailers. After reading this letter, Alderman McKay desired the approval of the Council for having sent this letter. On motion by Alderman McKay and second by Wolf, approval was made. (The City Clerk has a copy of the above mentioned letter on file.) FIRST READING ON PROPOSED MOTEL ORDINANCE. Alderman McKay re- ported that the City Clerk had a proposed ordinance on motels which he desired to be read and then referred to the Building Inspector for study and. approval. The Clerk read for first reading the following proposed ordinance entitled: AN ORDINANCE REGULATING THE CONSTRUCTION AND OPERATION OF MOTELS AND TOURIST CAMPS The mayor referred the proposed ordinance to the Building Inspec- tor for study and approval. PUBLIC PROTECTION COMMITTEE. Alderman Vavrinek reported the following on the meeting of the Public Protection and Public Relations Committee and the Safety Council regarding bicycles: Your Committee on Public Protection and Public Relations has in- vestigated the above and has found: 1. That we could not reach an agreement with the Safety Council. 2. That we cannot see our way clear to recommend an ordinance whereby a bicycle license is required to equip his bicycle with the patented product of a manufacturer.
