The Clerk read the following letter: August 16, 1949 Mayor and City Council City Hall Des Plaines, Illinois Gentlemen: The City Clerk, Otto W. J. Henrich, has turned over to me the matter of a question as to whether or not the City of Des Plaines has any right to inquire into the question of sewer and water facilities in the matter of the approval of a plat of subdivisions beyond the city limits. This is to advise you that I am of the opinion that these matters are legally of no concern to the City of Des Plaines. As in many other things, as a practical matter I suppose we could inquire into and suggest changes in sewer and water facilities as a condition of approving the plat. However, I believe that if the owner wereto refuse to abide any suggestions or recom- mendations of the City with respect to these matters, that he would have a legal right to do so. The only authority given to the City Council over property beyond the city limits is that as to such property within one and one-half miles of the corporate limits no plat thereof shall be entitled to be recorded or be valid: "Unless the subdivision shown thereon provides for streets, alleys and public grounds in conformity to the applicable requirements of the official plan." Respectfully submitted, MSH:AR Marshall S. Howard City Attorney BESTMAN'S ACRES UNIT NO. 2 PLAT. The Council discussed the item of sewer and water in subdivisions outside the city limits. The motion was then made by Alderman McKay and seconded by Morava that the Bestman Acres Unit No. 2 Plat be approved, with the understanding that a covenant be placed on the plat that they will comply with State and County sanitary requirements. *SEE BELOW LETTER FROM GOVERNOR STEVENSON. The clerk read the following letter: August 29, 1949 STREAM POLLUTION - Weller Creek Mayor and Council Des Plaines, Illinois ATTENTION: Otto W. J. Henrich, City Clerk 812 Lee Street, Des Plaines, I11. Gentlemen: As you know, the State Sanitary Water Board has recently written to the Villages of Arlington Heights and Mt. Prospect advising them that the State Sanitary Water Board would not issue permits for sewer extensions in these villages until such time as adequate provisions have been made to abate the pollution of Weller Creek caused by these Villages. They, furthermore, recommend that no more permits be issued by either Village for connections to the existing sewer system. The Cook County Department of Public Health concurs in this recommendation. Every permit issued for a connection to the existing sewer systems will in all likelihood cause an increase in the present sewage pollution load being discharged into Weller Creek. May we call your attention to the fact that a rather similar situation prevails in the Cumberland and Cumberland Terrace areas in Des Plaines. These areas are served by Imhoff tanks, one operated by the City of Des Plaines and the other by the Sanitary District of Chicago. An Imhoff tank, even if operated continuously and properly, can only remove about 30 to 40 per cent of the organic matter present in the incoming sewage. Unless sufficient dilution water is available in the receiving stream, the effluent from an Imhoff tank would cause or contribute to the pollution of the stream. We, therefore, recommend that the City of Des Plaines take immediate action to prevent any increase in the quantity of pollution being discharged into Weller Creek. This could be accomplished by discontinuing issuance of building permits in the Cumberland and Cumberland Terrace areas, pending completion of necessary sewerage improvements. We would appreciate a reply advising this Department what action will be taken by the City of Des Plaines in this matter. BJL:hl cc- Mrs. Louis Willer Health Officer cc - Des Plaines, I11. - I11. The clerk read the following resignation: 1221 Prairie Avenue Des Plaines, Illinois August 3, 1949 Honorable Kenneth G. Meyer Mayor of the City of Des Plaines City Hall Des Plaines, Illinois Dear Mayor Meyer: Mr. Dana Schubert has shown me the opinion of the City Attorney in which the legality of my appointment to the Board of Fire and Police Commission was questioned. Apparently the State Constitution, as well as the enabling legislation, bar an employee of the federal government from serving on this board. Moreover, there appears to be a restriction on federal em- ployees against holding state or local office. In order that there will be no cloud on the actions of the board, I here- by submit my resignation from membership on the Board of Fire and Police Commissioners. I shall be glad, however, to assist the Commission in its examining activities if the members so desire. Sincerely yours, Charles H. Bentley The motion was made by Alderman Behrel and seconded by Vavrinek to accept the resignation. The motion was voted upon by acclamation, where- upon the mayor declared the motion carried.
