Mrs. Wallen from Westgate Road was granted permission to talk on the
Dog Kennel Ordinance. Mrs. Wallen is the owner of dogs and has a kennel license.
The mayor informed Mrs. Wallen that the Dog Kennel Ordinance would be up for
second reading at the next meeting, and at that time any changes would be made
if necessary.
APPROVAL OF MINUTES. The motion was made by Alderman Morava, and
seconded by Behrel, to approve the minutes of July 18, 1949. The motion was
voted upon by acclamation, whereupon the mayor declared the motion carried.
ADJOURNMENT. The motion was made by Alderman Wolf, and seconded by
Davis, to adjourn. The motion was voted upon by acclamation, whereupon the

ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY, AUGUST 15, 1949, AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by City Clerk, Otto W. J.
Henrich, due to the absence of Mayor Meyer who was on vacation. Aldermen Hansen,
Davis,Vavrinek, Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava re-
sponded to roll call.
ELECT MAYOR PRO TEM. The motion was made by Alderman Baines and
seconded by Hansen to elect Alderman Vavrinek mayor pro tem. The Clerk put
the question and called the roll with the following result: Ayes: Aldermen
Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, McKay, Clement,Halverson and
Morava. Nays: None. The Clerk thereupon declared the motion carried, and
Alderman Vavrinek then took the "chair."
OFFICIAL REPORTS. The City Clerk, Otto W. J. Henrich, submitted the
report of City Treasurer, Lawrence Barrett, for the month of July.
COMMITTEE REPORTS. Alderman McKay reported the following in regard
to the request of F. J. Feldt to build a "Motel":
Your Committee on Municipal Development held a meeting on'request of
Mr. F. J. Feldt for permission to erect a "motel" on premises at 1850 Oakton
Street. Mr. Feldt attended the meeting and advised that he had decided not to
proceed with the project at this time.
After discussion, the motion was made by Alderman Halverson and
seconded by McKay to refer the matter of motels to the Municipal Development
Committee, Building Inspector and the City Attorney regarding an ordinance on
motels.
Alderman McKay also reported on a letter from the L. Wyman Associates
on costs for "city planning." The mayor pro tem, on suggestion of Alderman
McKay, referred the letter to the Plan Commission for study and recommendation.
The Clerk read the following report from the Public Protection Com-
mittee regarding the letter from the Board of Police and Fire Commissioners
requesting change in ordinance eliminating desk clerk in the Police Department:
Your Committee on Public Protection recommends that the ordinance be
changed to abolish the office of "desk clerk" and that the number of "patrolmen"
be increased to ten.
The motion was made by Alderman Baines and seconded by Behrel to concur
in the report. The motion was voted upon by acclamation, whereupon the mayor pro tem
declared the motion carried. The City Clerk was instructed to notify the Board of
Police and Fire Commissioners and the City Attorney.
PARK RIDGE GARBAGE CONTRACT. Alderman Hansen, Chairman of Streets and
Sanitation Committee, made the motion, which was seconded by Halverson, to
approve the Park Ridge Garbage Contract. The motion was voted upon by accla-
mation, whereupon the mayor pro tem declared the motion carried.
PRAIRIE AVENUE IMPROVEMENT. The motion was made by Alderman Hansen and
seconded by Morava that the Superintendent of Public Works be instructed to
grade Prairie Avenue east of Pearson Street. Upon completion, the City Clerk
is to advertise bids for the completion of the street.
The mayor pro tem declared a recess so that the aldermen could study
the plans. After reconvening, the mayor pro tem put the question, and the
City Clerk called the roll with the following result: Ayes: Aldermen Hansen,
Davis, Vavrinek, Wolf, Baines, Behrel, McKay, Clement, Halverson and Morava.
Nays: None. The mayor pro tem thereupon declared the motion carried.
SEWER RELIEF. Alderman Wolf, Chairman of the Special Sewer Relief
Committee, reported holding a meeting on the sewer relief. Alderman Wolf
then made the motion, which was seconded by Morava, that the City Engineer
prepare revised plans for the relief sewer in the Oakton Street section and
south streets. The motion was voted upon by acclamation, whereupon the
mayor pro tem declared the motion carried.

Gentlemen:
The City Clerk, Otto W. J. Henrich, has turned over to me the matter
of a question as to whether or not the City of Des Plaines has any right to
inquire into the question of sewer and water facilities in the matter of the
approval of a plat of subdivisions beyond the city limits.
This is to advise you that I am of the opinion that these matters are
legally of no concern to the City of Des Plaines. As in many other things,
as a practical matter I suppose we could inquire into and suggest changes in
sewer and water facilities as a condition of approving the plat. However, I
believe that if the owner wereto refuse to abide any suggestions or recom-
mendations of the City with respect to these matters, that he would have a
legal right to do so. The only authority given to the City Council over
property beyond the city limits is that as to such property within one and
one-half miles of the corporate limits no plat thereof shall be entitled to
be recorded or be valid:
"Unless the subdivision shown thereon provides for streets,
alleys and public grounds in conformity to the applicable
requirements of the official plan."

1. That due notice to the parties and to the public of this proceeding
and of the public hearing therein was given as required by law, and

over gardens.
Would appreciate anthing the City Council will do to put a stop to

These lots each have a frontage of 25 feet and are heavily encumbered

This letter accompanies a petition requesting the adoption of an ordi-
nance vacating that portion of North Fourth Avenue in the City of Des Plaines
which lies to the North of Golf Road (Illinois State Route 58). The petition
bears the signatures of the record owners of all the lots which abut the portion
of the street sought to be abandoned, in both the Cumberland and the Cumberland
East subdivisions.
A sketch accompanies this letter upon which is indicated the location
of the lots owned by your petitioners with respect to the portion of North
Fourth Avenue affected by the petition.
Authority for the adoption of an ordinance vacating any street or
alley or portions of either by an ordinance adopted by your body is granted
by Chapter 24, Sections 69-11 and 69-13, Illinois Revised Statutes, 1947, and
your favorable consideration of the petition will be appreciated.

TELEPHONE COMPANY TO REPAIR ALLEY IN BACK OF ALLES STREET. Alder-
man Hansen reported that the telephone company had torn up the alley and put
in cables back of Alles Street, however, they have failed to repair property.
The mayor pro tem instructed the City Attorney to write to the telephone
company and advise them that no permit for any opening will be issued by the
Superintendent of Public Works until this alley is repaired.
Alderman Davis stated that he had received reports of low water
pressure in Cumberland and would like an explanation for this condition.
Alderman Halverson and City Engineer Fletcher informed Alderman Davis
of what they were doing and planning to do to increase water pressure.

CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer,
who presided with Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, McKay,
Clement,Halverson and Morava responding to roll call.
OFFICIAL REPORTS. The City Clerk submitted the reports of Building In-
spector, Frank Scharringhausen and the City Clerk's report for the month of
August.
COMMITTEE REPORTS. Alderman McKay, Chairman of the Municipal Development
Committee, reported that the Plan Commission requested to hold the item of vacating
a portion of N. Fourth Avenue for some time, that is, until the School Board has
made a decision on property in that area.
Alderman Behrel, Chairman of the License Committee, reported that two
meetings had been held with the Chamber of Commerce Committee on unpaid licenses.
The License Committee recommended that the present license ordinance be enforced
and consideration be made for a change of license ordinances for 1950. The mayor
requested Alderman Behrel to notify the proper authorities about the enforcement.

COOK COUNTY DEPARTMENT OF PUBLIC HEALTH'S LETTER IN REGARD TO
WELLER CREEK POLLUTION. The clerk read the following letter:

Gentlemen:
As you know, the State Sanitary Water Board has recently written
to the Villages of Arlington Heights and Mt. Prospect advising them that the
State Sanitary Water Board would not issue permits for sewer extensions in
these villages until such time as adequate provisions have been made to abate
the pollution of Weller Creek caused by these Villages. They, furthermore,
recommend that no more permits be issued by either Village for connections
to the existing sewer system.
The Cook County Department of Public Health concurs in this
recommendation. Every permit issued for a connection to the existing sewer
systems will in all likelihood cause an increase in the present sewage
pollution load being discharged into Weller Creek.
May we call your attention to the fact that a rather similar
situation prevails in the Cumberland and Cumberland Terrace areas in
Des Plaines. These areas are served by Imhoff tanks, one operated by the
City of Des Plaines and the other by the Sanitary District of Chicago. An
Imhoff tank, even if operated continuously and properly, can only remove
about 30 to 40 per cent of the organic matter present in the incoming
sewage. Unless sufficient dilution water is available in the receiving
stream, the effluent from an Imhoff tank would cause or contribute to the
pollution of the stream.
We, therefore, recommend that the City of Des Plaines take
immediate action to prevent any increase in the quantity of pollution being
discharged into Weller Creek. This could be accomplished by discontinuing
issuance of building permits in the Cumberland and Cumberland Terrace areas,
pending completion of necessary sewerage improvements.
We would appreciate a reply advising this Department what action
will be taken by the City of Des Plaines in this matter.

The mayor said that because this was a very important item, the
City Council would meet as a committee at 8:30 P.M., Monday, September 12, 1949.
After considerable discussion, the motion was made by Alderman Clement and
seconded by Davis that Inspector Scharringhausen be instructed not to issue
any building permits in Cumberland Terrace, Cumberland and Cumberland East
until further advised by the City Council after its committee meeting on
Monday, September 12, 1949.

ployees against holding state or local office.
In order that there will be no cloud on the actions of the board, I here-

tax deeds acquired by the Village of Des Plaines, there is an outstanding
tax deed to Henry L. Glos, which was acquired on April 19, 1900.
Mr. and Mrs. La Placa, on whose behalf this letter is written,
are desirous of clearing up this property and placing it back on the tax
rolls and accordingly offer you $75.00 for a quit claim deed covering the

BURGESS' RESUBDIVISION. The city clerk presented a plat of
Burgess' Resubdivision which had been approved by the Des Plaines Plan
Commission. Because a part of Jarvis Street and an alley are to be vacated,
the council was unable to approve the plat. The motion was made by Alderman
McKay and seconded by Clement that the city attorney draft ordinances
vacating that part of Jarvis Avenue and the alley. The motion was voted
upon by aaiamation, whereupon the mayor declared the motion carried.
APPROVAL OF MINUTES. The motion was made by Alderman Baines
and seconded by Clement to approve the minutes of August 15, 1949. Attorney
Howard called attention to one error in regard to "patrolmen." The item
should be corrected from "increased to two" to "increased to ten." With
correction made, the motion was voted upon by acclamation, whereupon the
mayor declared the motion carried.
The mayor informed the council that the Chicago University in-
quired regarding stray dogs in dog pound. This matter was referred to the
Public Relation Committee.
The mayor referred the item of an ordinance for employees of
food stores and restaurants to take tuberculosis tests to the city attorney
and the Public Protection Committee.
OPEN BIDS ON PRAIRIE AVENUE IMPROVEMENT. The motion was made by
Baines and seconded by Halverson to open the bids on the improvement of Prairie
Avenue, east of Pearson Street. The motion was voted upon by acclamation,
whereupon the mayor declared the motion carried. The following bids were
