07111949291 Pa PeiKfP MINUTES OF PND MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY, JULY 11, 1949. AT 8:00 P. M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer, who presided with Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, Clement, Halverson and Morava responding to roll call. Alderman McKay was absent due to illness of Mrs. McKay. OFFICIAL REPORTS. The City Clerk submitted the reports of City Treasur- er, L. C. Barrett and Building Inspector, Frank Scharringhausen and the City Clerk for the month of June. The City Clerk also read the report of Inspector Scharringhausen in re- gard to the building at 1569 Ellinwood Street. The report stated that the City Council should take some action according to the building code. The Mayor re- ferred the matter to the City Attorney for study and report. CITY ATTORNEY'S REPORT ON RECODIFICATION OF THE CITY'S ORDINANCES. The Clerk read the following letter: Mayor and City Council of Des Plaines City Hall Des Plaines, Illinois July 8, 1949 Gentlemen: At the request of Mayor Meyer I have checked into the work involved in getting started on a recodification of the city's ordinances. Mr. Frank Opeka, former City. Attorney, has turned over to me a large number of ordinances in a series of files which purport to be all of the existing valid ordinances, which amend the printed code book. Mr. Opeka has also sorted these ordinances out into general classifications and put them, with some minor exceptions, in a numerical order, roughly corresponding to the order of the code book. With this ground work done, it should not be too difficult, with your cooperation, to proceed to actually making a beginning on the code itself. With your ap- proval I will submit from time to time, as I am able to do it, a chapter or an article at a time. The rewritten chapter or article can then be sumbitted to the Council as a whole for analysis, or to a Code Committee, or to what- ever appropriate committee of the Council, which the chapter or article deals with, for analysis and recommendation. When you have put such chapter or article in final form, it can then be rewritten in a loose leaf book to be set up and retained for that particular purpose. Subject to your approval, I would suggest renumbering the amended and revised code in a manner similar to that in which some of our present State Statutes are now being handled so that Section 1, for instance, under Chapter 1 is called Section 1.1, Section 2 of Chapter 1 is called Section 1.2. In other words, at any time a section is quoted, such as Section 10.14, you will automatically know that it is Section 14 of Chapter 10. Yours very truly, MSH:AR M. S. Howard City Attorney The Mayor informed the Council that after the above had been completed, the entire ordinance book must be read and passed. AERONAUTIC COMMISSION'S REPORT. The Clerk read the following report in regard to low flying planes Sunday mornings: Your Committee on Aviation has investigated the above and has found: That low flying airplanes of A-26 and AT -6 type have been causing the disturbance noted, and these originated from the Orchard Place base of the Air Force Reserves, and the National Air Guard. The flight operations office of the two bases was contacted and favorable cooperation was demonstrated on the complaint, with no complaints coming through since. We, your Committee on Aviation, therefore recommend: That the Flight operations office post all flights leaving the airport between the hours of 8 A. M. and 12:00 noon on Sundays stay clear of the church areas as designated on a map furnished them, and runway patterns away from these areas be used during the hours given. C. A. Hodlmair The Mayor ordered the report placed on file. z9'/ LETTER FROM WELLER CREEK DRAINAGE DISTRICT. The Clerk read the follow- ing letter: Mr. Otto W. J. Henrich: In your letter June the 23 you wrote that it has been suggested that the District try to keep the debris cleaned out of Weller Creek. I and Herman Lineweh went along the ditch and had everything cleaned out, that was May 27. But the boys along Welter Creek can throw it in faster than we can take it out. On motion by Davis and second by Baines, an inquiry was made of the City Attorney in regard to whether the Village of Mount Prospect could be stopped from issuing any more building permits until they make provision for their sewer- age to discontinue from draining into Weller Creek. PASS QUIT CLAIM DEED ORDINANCE, LOT 27, BLOCK 2, IRA BROWN'S ADDITION TO DES PLAINES. The Clerk read for second reading the following proposed ordi- nance entitled: AN ORDINANCE AUTHORIZING QUIT CLAIM DEED The motion was made by Alderman Baines and seconded by Hansen to pass the proposed ordinance. The Mayor put the question, and the Clerk called the roll with the following result: Ayes: Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, Clement, Halverson and Morava. Nays: None. The Mayor there- upon declared the motion carried and the proposed ordinance passed. ALDERMAN BAINES, CHAIRMAN OF THE FINANCE COMMITTEE, reported on a letter from Hugo J. Thal, in regard to the foreclosure of several lots. Mr. Thal said he was instructed to offer a bid of 35% of the principal on unpaid special assessments. Alderman Baines said the committee recommended that the Clerk write and inform Mr. Thal, requesting an offer of 40% of the principal. The motion was made by Alderman Baines and seconded by Hansen to concur in the report. The motion was voted upon by acclamation, whereupon the Mayor de- clared the motion carried. APPROVE PLANS & SPECIFICATIONS OF LEE & PRAIRIE TRAFFIC LIGHTS. The motion was made by Alderman Hansen and seconded by Baines to approve the plans and specifications for Lee and Prairie Traffic Lights. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. PASS AMENDMENT OF BUILDING CODE * ARCHITECTURAL COMMISSION. The Clerk read for second reading the following proposed ordinance entitled: AN ORDINANCE AMENDING BUILDING CODE OF THE CITY OF DFS PLAINES OF 1939, AS AMENDED The motion was made by Alderman Halverson and seconded by Davis to pass the proposed ordinance. The Mayor put the question, and the Clerk called the roll with the following result: Ayes: Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, Clement, Halverson and Morava. Nays: None. The Mayor thereupon declared the motion carried and the proposed ordinance passed. PLANS AND SPECIFICATIONS TO IMPROVE PRAIRIE AVENUE EAST OF PEARSON STREET. The Clerk read the following letter: July 9, 1949 Honorable Mayor and City Council Des Plaines, Illinois Gentlemen: Attached are plans and specifications for the improvement of Prairie Avenue east of Pearson Street for a distance of 650 feet. This improvement to be made for use as all day parking. The estimate cost of clearing, grading, placing 8 inches of stone and sealing with liquid asphalt, and including Engineering is $7,500.00. This does not include any curb or lights, which no doubt will be desirable but will have to be done at a later date due to lack of funds at the present time. The proposed improvement will furnish parking for 65 cars in addition to the 20 to 25 cars now using part of this street for all day parking. In view of the present condition of the street, your city Engineer recommends that the Superintendent of Public Works be authorized to hire men and equipment to clear the right-of-way of trees, brush and debris and to do the grading, and that bids be taken for the construction of the water bound macadam base and liquid asphalt surfacing. The Clerk read the following letter and resolution: July 8, 1949 Mayor and City Council of Des Plaines City Hall Des Plaines, Illinois Gentlemen: There has been turned over to me fir collection the matter of the claim of the City of Des Plaines against one John Szendt in the sum of $245.00 for cash paid out by the City of Des Plaines in re -installing a lamp post knocked down by the negligent driving of Mr. Szendt. After some negotiations with the Travelers Insurance Company, insuring Mr. Szendt, in which they tried to cut down the amount of our claim by means of alleged depreciation of the old post which was knocked down, the company reluctantly agreed to pay the 9245.00 after my threat of an immediate law suit. I will, therefore, need a resolution, which is here- to attached, authorizing the Mayor and City Clerk to execute the necessary re- lease to Mr. Szendt and the insurance company. MSH:AR Encl. The Clerk informed the Council that he received a card of thanks from the Charles Larson family for the flowers which the City Council had sent. LETTER FROM SEARL E. SUTER, NORTH LAKE, ILLINOIS. The Clerk read the following letter: June 20, 1949 City Council Des Plaines, Illinois Dear Sirs: I would like to obtain a permit to dump garbage in your city. This is a new city and there is no place here for the disposal of refuse. Forcing us to look elsewhere for its removal. This is a newly formed government of North Lake. The Clerk read a letter of thanks from the Cumberland Maintenance Corporation in regard to the installation of light on State Street. LETTER FROM G. F. WILLIAMS, !12 WARRINGTON ROAD. The Clerk read the following letter: The City Council Des Plaines, Illinois 419 Warrington Road Des Plaines, Illinois July llth, 1949 Gentlemen: This is relative to the section of Warrington Road from Washington Street south to the end of city line, a distance of 155 feet. There are three families of us living on the east side of the street, each lot being 55 feet wide. We aren't isolated by any means. We all get mail service and every service but maintenance of the street. We are entitled to all services other citizens of Des Plaines get. It is the city's duty to main- tain this section of Warrington Road. I have lived in the last house south since August 1947,,and in that length of time Des Plaines hasn't spent a dime on this piece of road, and I believe the city has never given it even a thought, let alone any attention. However the other section of Warrington Road is maintained. G. F. WILLIAMS' LETTER, CONT'D. I have paid for over 100.00 worth of crushed stone and have kept the section in condition so the public could serve us citizens. I think the city should reimburse me for the money spent and the time consumed in keeping the section in -repair and maintenance. The Civic Center of Cumberland Terrace is located off the south end of the street and citizens use the south section of Warrington Road to get to their meeting place. Please direct this request for future maintenance of the section mentioned to the person or parties responsible for street maintenance, and direct the section get the same attention and repair other streets of the city receive. The Mayor thereupon declared the motion carried. RESOLUTION TO AMEND ZONING ORDINANCE. The Clerk read the following resolution: RESOLUTION BE IT RESOLVED by the City Council of the City of Des Plaines, Illinois, that the Zoning Board of Appeals of this City consider the matter of amending that part of Section 14 of the Zoning Ordinance of the City of Des Plaines, de- fining the amount of side yard required in area District A, so that the side yard must not be less than 3 feet from any part of a building constructed on any lot. BE IT FURTHER RESOLVED that the said Zoning Board of Appeals call a meeting in manner required by law,to consider amending that part of Section 14 of the Zoning Ordinance of this City having to do with the minimum side yard in Area District A to read substantially as follows: "Side Yard." There shall be a side yard on each side of each lot or parcel of ground, having a width of not less than 3 feet from any part of a building erected on any lot or parcel of ground. The motion was made by Behrel and seconded by Vavrinek to adopt the proposed resolution. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. Alderman Clement reported that he had received complaints about the buses parking on north side of Miner Street crosswalk at the railroad station. He suggested they change the parking to eliminate this hazard. The Mayor re- ferred the matter to the Traffic Commission. Alderman Wolf reported that he had received complaints of people on Des Plaines Avenue who put their garbage out on parkway during the day on Sunday for Monday pick-up and suggested their pick-up day be changed. The Mayor referred the matter to the Sanitation Committee. APPROVAL OF MINUTES. The motion was made by Alderman Halverson and seconded by Behrel to approve the minutes of June 20, 1949. At this point, the City Clerk, Otto Henrich, informed the City Council that Mayor Meyer was out of town on vacation, and it was necessary to elect a mayor pro tem. Nays: None. The Chair thereupon declared the motion carried. CITY ATTORNEY, MARSHALL HOWARD, SUBMITS FIRST CHAPTER OF CITY CODE. The Clerk read the following letter: July 18, 1949 Hon. Mayor and City Council City of Des Plaines Des Plaines, Illinois Gentlemen: I submit herewith Chapter 1 of the proposed new City Code for your consideration. This chapter deals with the office and duties of the Mayor. I have changed Sections 2 and 3 to conform to the current statutes of the State of Illinois and have changed the term from two years, as provided in the printed code book, to four years.
