MONDAY. JUNE 6, 1949, AT 8:00 P. M.
CALL TO ORDER. The meeting was called fib order by Mayor Kenneth G. Meyer,
who presided with Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, McKay, Clement,
Halverson and Morava responding to roll call. Alderman Behrel was absent the
entire meeting.
OFFICIAL REPORTS. The City Clerk submitted the reports of Building
Inspector, Frank Scharringhausen and City Clerk, Otto Henrich's report,for the
month of May. The Clerk also read the following report of City Attorney Howard:

Gentlemen:
I attended the Illinois Commerce Commission hearing on Tuesday, May 24,
of the application by the Higgins Water Company for a permit to supply water to
an additional unit of land. The additional unit consisted of approximately
fifty lots located North of Devon Avenue and South of Higgins Road and triangular
in shape since the property is just West of the intersection of these two high-
ways. The Higgins Tater Company now has a permit to serve 396 lots in this area.
They also now have in existence a deep well located on the Southeast corner of
the intersection of Rose Avenue and Stillwell Drive. Testimony was introduced
that this well and present pumping facilities will be sufficient to service
the proposed new unit so that there will be no need at the present time for
the digging of a new well. This area is probably sufficiently removed from
the City of Des Plaines and from the present wells that there is little danger
of interference with the water supply of the City of Des Plaines.
It is my opinion that there is no need for further attendance of any
future Illinois Commerce Commission hearings on this matter since the position
of the City of Des Plaines has been placed of record and there is no intention
of digging additional wells.

Gentlemen:
I have examined the letter turned over to me at the last Council meet-
ing from one M. Campbell of 322 Columbia Avenue, complaining of a dog kennel
next door to his home in a residential section. It is my opinion that the
operation of a dog kennel for profit constitutes a business and is a violation
of residential zoning. However, if the dog kennel existed in this same location
since prior to the zoning ordinance, it would be entitled to continue oneration
as far as the zoning laws were concerned under the classification of a "Non
Conforming Use".
If, however, the dogs maintained by the kennelconstitute a nuisance
in that the same are noisy, unsanitary or dangerous, the use might be abated
by court action, even if the zoning were legal.
I enclose an extra copy of this letter and suggest that it be sent to
"fir. Campbell with instructions to get in touch with me and furnish me with
additional facts on the question of the Non Conforming Use and on the possi-
bility of the kennel's constituting a nuisance.

Alderman Halverson asked the Mayor to refer the $275,000 Sewer Ordi-
nance to the Special Sewer Relief Committee, and that the Clerk would see that
the Committee receives a copy of the ordinance.
STREET COMMITTEE. Alderman Hansen reported that the property at
Mannheim and River Roads had been leased. The Chamber of Commerce had re-
quested to install a sign on this same property, however, it will now be neces-
sary for them to find a new location. The Clerk was instructed to notify the
Chamber of Commerce on this matter.
Alderman Hansen reported to the Council that some of the meters on
Graceland Avenue would be hooded, except Friday and Saturday. Alderman Hansen
stated that the City Attorney should amend the Parking Ordinance, the south side
of Prairie Avenue from Lee Street to the alley west of Lee Street, and meters be
installed at that place. ;Meters are to be taken from the north side of Ellinwood,
east of Pearson Street. The motion was made by Alderman Halverson, and seconded
by Wolf, to refer the report back to the Street Committee. The motion was voted
upon by acclamation, whereupon the Mayor declared the motion carried.
Alderman Hansen also reported the following on Inspector Scharringhausen's
letter regarding the change of house numbers:
Your Committee recommends that the City Clerk be authorized to make
necessary changes and to notify the taxing bodies and election commissioners
of such action. The motion was made by Alderman Vavrinek, and seconded by
Baines, to concur in the report. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
BUILDING AND LANDS COMMITTEE. Alderman Morava, Chairman of the Building;
and Lands Committee, made the following report on the condition of the pumphouse
land and removal of unnecessary equipment to the water softening plant:
Your Committee has investigated the above and has found:
That the above condition at the Pump douse on River Road has been
corrected and the unnecessary equipment has been moved and the land surrounding
the Pump House has been covered with white crushed stone.

WHEREAS, the party of the second part finds it necessary to procure
a water supply to service the homes of its members and the homes of others in
the Hawthorne Lane Area in Maine Township and is desirous of procuring such a
supply from the City of Des Plaines in accordance with its ordinances; and
WHEREAS, the City of Des Plaines is willing to supply said party
of the second part with water service in accordance with its ordinances;
NOW, THEREFORE, in consideration of the premises and the covenants
hereinafter set forth, it is agreed as follows:
1. The City of Des Plaines hereby agrees to furnish water service
to the party of the second part insofar as it will not jeopard-
ize the citizens of the City of Des Plaines during any e-
mergency that may arise as hereinafter set forth.
2. The City of Des Plaines will not be required to furnish water
service (a) when water is not available because of any break-
down of its pumping system; (b) when the Fire Marshal decrees
that all the available water is necessary during any serious
fire and (c) when an emergency for the protection of public
safety and welfare is determined by resolution of the City
Council.
3. The party of the second part agrees to:
(a) Pay the cost of construction and installation of the
water main from the nearest main to the respective
properties of the members of the second party and
agrees to pay all permit fees.
(b) Pay for all engineering and inspection fees for
such installation which is to be made in accordance
with the plans and specifications of the -Cie -City
and under direct supervision of the City Engineer.
(c) Pay for such water service measured through indi-
vidual meters to be installed in the homes of each
and every user hereunder, the sum of 66 cents per
hundred cubic feet of water, which said amounts
shall be payable quarterly and in addition there-
to shall be entitled to a graduated rate in
accordance with the ordinance of the City of
Des Plaines when water in excess of amounts set
forth in the ordinance is used. Minimum charge
for a quarter shall be $3.00.
(d) To purchase a water meter from the City of
Des Plaines so that there may be uniformity in
reading and usage.
4. It is further mutually agreed that the party of the second
part agrees to procure all necessary easements for lands
over which this pipe extension is to be made and to cause
such easement to be made to the City as well as to the said
second party.
5. It is mutually agreed that no other person shall connect on
said water main extension except upon the joint consent of

Mayor Kenneth Meyer asked Alderman Vavrinek to take the chair while
he vacated same to debate the question. The Mayor voiced his opinion with
reasons opposing the City furnishing water to residents outside the City. The
Mayor asked the Council to vote "no" on authorizing the execution of the agree-
ments. Mayor Meyer stated that he would use his power of veto if necessary.
Alderman Halverson said that he thought that at the time the motion was made
for the City Attorney to draw up the agreements, that the motion had included
the authorization for the Mayor and City Clerk to sign and execute tiie agree-

E. A. HERZOG LETTER ON MODERATE COST HOMFS. The Clerk read the follow -

Gentlemen:
I am interested in building a number of moderate cost homes in
Des Plaines. These houses contain an area of approximately seven hundred eight
(708) square feet.
Under present City ordinances, the Building Code and the Zoning ordi-
nance, construction of these homes is prohibited, since each requires a minimum
area of eight hundred square feet.
I respectfully request that the Building Code and the Zoning ordinance
be amended so as to reduce the minimum area requirement for dwelling houses from
the present eight hundred (800) square feet to a minimum area requirement of
seven hundred (700) square feet.

ROBERT NIMEL LETTER. ON "ELLER CREEK POLLUTION. The Clerk read the
following letter:

Gentlemen:
I would like to call your attention to the fact that Teller Creek,
which flows tnru parts of Des Plaines, represents a definite health hazard to
many of our citizens. This matter has been taken up with our local Health
Department, the Cook County Health Department, and the State Health Department.
In each case they feel that untreated or partially treated sewage represents a
definite health hazard but are unable to do anything about it. I would appreci-
ate very much having the City Council pass a resolution asking the governor to
see that the State Laws governing this are enforced. Saving a single child
from typhoid, polio, or some similar disease will more than repay all of us for
our efforts.
Much work has been done locally by many of our citizens and local
groups,such as the Isaac Walton League and the Civic Associations.
I would personally appreciate a definite move by the council to have
the City of Des Plaines eliminate the two violations of the law we are responsi-
ble for. A small appropriation should clean up both of our own violations.

CHAMBER OF COIMERCE LETTER ON CENTER STREET PARKING LOTS. The Clerk

Gentlemen:
At our last meeting, the Chamber of Commerce voted to write to you
suggesting that a portion of the parking meter revenue be allocated for the
payment of rent on the two parking lots located on Center Street.
These lots are used by shoppers and all -day parkers and have been
paid by merchants on that street for the past several yoars.

The Road and Bridge Laws of the State of Illinois provide that the
County may maintain such extensions of State Aid Roads within cities and
villages upon the respective municipality petitioning the County to assume
such maintenance, and upon the approval of the State Highway Department.
In the event that such procedure is not followed, the maintenance of
the road .is the responsibility of the municipality.
I am therefore calling this matter to your attention, so that if it

I have been receiving complaints of low flying airplanes during church
services on Sunday mornings. I was told that there was almost a continuous
noise last Sunday from planes that at times, the congregation was unable to
hear the sermon.
These people desire to know whether something could be done about
eliminating this flying of planes over our City churches on Sundays from
ten o'clock a.m. to twelve o'clock a.m.

The Mayor referred the letter to the Aeronautic Commission.
POLICE DESK CLERKS - CIVIL SERVICE. Alderman Vavrinek, Chairman of
the Public Protection Committee, recommended that the City Attorney draft an
amendment to the Police Department Ordinance, adding "desk clerks" as the
lowest ranking officer under Police Civil Service. The motion was made by
Alderman Vavrinek, and seconded by Halverson, to concur in the recommendation.
The motion was voted upon by acclamation, whereupon the Mayor declared the
motion carried.
On suggestion by Alderman McKay, the Mayor referred to the City
Attorney the section in the dog ordinance in regard to kennels for the
following amendment: "that no dog kennel license be issued without the
consent of residents in a 300 foot area." *See page 282
Alderman Hansen suggested that the City Clerk write a letter to the
Soo Line Railway in regard to the poor condition of their crossings.
A CHARGE OF $2.00 FOR CUTTING WEEDS IN N FOOT LOTS. On motion by
Alderman Baines, and second by Morava, the Superintendent of Public Works was
granted permission to cut weeds on a 50 foot lot for a payment of $2.00 in
advance, payable to the City Clerk.

APPROVAL OF MINUTES. The motion was made by Alderman Baines, and
seconded by Wolf, to approve the minutes of May 16, 1949. The motion was
voted upon by acclamation, whereupon the Mayor declared the motion carried.
WILLIAM LANHAM, JR. APPOINTJiD PATROLMAN JUNE 4, 1949. Mayor
Kenneth G. Meyer informed the Council that the Fire and Police Commissioners
had appointed William Lanham, Jr. as a patrolman.
REX HARSHBARGER APPOINTED AS DESK CLERK. On motion by Alderman
Vavrinek, and second by Baines, the Council confirmed the Mayor's appoint-
ment of Rex Harshbarger as police desk clerk.
PFLUGHAUPT AND MURPHY APPOINTED TO CIVIL SERVICE COMMISSION. On
motion by Baines, and second by Morava, the Council confirmed the Mayor's
appointment of G. Walter Pflughaupt and Edwin F. Murphy as members of the
Civil Service Commission.
CITY CLERK TO TAKE CHARGE OF WATER DEPARTMENT OFFICE. The Mayor
informed the Council that he had instructed the City Clerk to take charge
of the Water Department office which had been separated from the City Clerk's
office by Mayor Garland in 1944..

Vavrinek, to adjourn. The motion was voted upon by acclamation, whereupon the

MONDAY, JUNE 20, 1949, AT 8:00 P . v.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer,
who presided with Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, McKay,
Clement, Halverson, and 1orava responding to roll call.
OFFICIAL REPORTS. The Clerk submitted -the report of City Treasurer,
L. C. Barrett, for the month of May.
City Engineer, E. N. Fletcher, stated that they had used transite pipe
instead of cast iron pipe for the water main to go under the Belt Line track, an
estimated saving of $2,000.00. However, E. N. Fletcher said that it would be
necessary to purchase cast iron pipe to be used under tho tracks at a cost of
approximately $800.00. The motion was made by Alderman Halverson, and seconded
by Vavrinek, to purchase cast iron pipe for not more than $800.00. The Mayor
put the question, and the Clerk called the roll with the following result:
Ayes: Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, McKay, Clement,
Halverson, and Morava. Nays: None. The Mayor thereupon declared the motion
carried.

Gentlemen:
Following is a report of flooding conditions which occurred after the
exceptionally heavy rainfall the night of June 14, 1949.
The flooding was of short duration, but was more general than the
previous floods of this year.
Residents reported water in their basements from every section of
the City, most of which was caused from overloaded sewers backing up, and
from seepage.
The sections hardest hit were the South Side, which from Forest Avenue
South depends on the Oakton Street sewer to carry off the storm waters, and the
West part of Cumberland Terrace.
