a request for a light in the center of 1400 block on Henry Avenue: Your Committee
has investigated and has Bound that the conditions are as outlined in basic communication.
However, thereare a number of long blocks in Des Plaines that could stand lights
in the center of the block. The Street Committee recommends that the new Council
investigate the possibility of placing additional street lights in the center of all
long blocks in Des Plaines. The motion was made by Alderman Vavrinek and secoOded
by Kehe to concur in the report. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.

CALL TO ORDER. The meeting was called to order by Mayor G. Walter
Pflughaupt, who presided with Aldermen Johnson,.Hansen, Vavrinek, Wolf, Kehe,
Baines, McKay, Halverson and Morava responding to roll call. Harm was absent
the entire meeting.
OFFICIAL REPORTS. The Captain of Police made the monthly report of
the Parking Meter Fines.
CITY ATTORNEY OPEKA'S FINAL REPORT. The Clerk read the following
reports:

Gentlemen:
I submit herewith a brief report as your City Attorney.
During my tenure of office, I have prepared and carried three cases to
the State Supreme Court; one of them was decided there, another one was trans-
ferred to and decided in the Appellate Court and the third case involving title to
the south half of Thacker Street between Wolf Road and the Belt Line was settled,
in which the City of Des Plaines acquired title by deed to that portion of Thacker
Street.
Four special assessments were undertaken and completed during my term of
office. Also there were numerous matters of litigation and a great many of them
were prosecution for failure to pay sign fees, and license fees. I attended the
Police Magistrate Court on many occasions in connection with violations of traffic
and other ordinances and particularly in the matter of enforcement of our Building
and Electrical Codes.
There are presently pending the following cases:
1. City of Des Plaines vs. William H. Hunt. Complaint to demolish unsafe structure,
Circuit Court case No. 46 C 12496. The case was assigned to Judge Leonard C. Reid
and is now pending on his call. The complaint will have to be amended to bring in
the new owners who acquired title before a lis pendens could be filed.
2. Nelda A. Miller vs. City of Des Plaines. Circuit Court case No. 48 C 7808
pending on motion to strike. Complaint at law for damages as a result of sustain-
ing injuries because of an alleged sidewalk defect.
3. Julius I. Steinfeld vs. City of Des Plaines, Circuit Court of Cook County case
No. 49 C 2491. Complaint for injunction. Assigned to Judge Cornelius J. Harrington
and now pending before Arthur A. Sullivan, Master in Chancery.

4. People ex rel Oscar C. Umbach vs. Frank Scharringhausen, et al. Circuit Coarct
of Cook County case No. 49 C 3038. Assigned to Judge Harry Fisher. Now pending
on motion to strike and set for May 27, 1949. Petition for Mandamus to compel
Building Inspector to stop work on Veterans Housing.
5. City of Des Plaines vs. Dr. Steinfeld, before Judge A. L. Sengstock for vio-
lation of the Zoning Ordinance. This case is not prosecuted pending the dispo-
sition of the Circuit Court case.
Of the matters turned over to me at the time I took office, there was
the question of special assessment No. 512453 (Superior Court) entitled City of
Des Plaines vs. Peoples Trust & Savings Bank, as Trustee,_.. The action was for
paving and for condemnation of private property for street purposes in Baker's
Addition and other subdivisions lying .south of the S curve on the south side.
Every effort was made to secure a vacation of the special assessment confirmation
judgment and to satisfy the condemnation award for a strip of land 33 feet wide
which was to complete an existing half street. Every agreement entered into was
not carried out by one of the beneficiaries of the trust, who subsequently filed
a complaint for mandamus in the Superior Court, Case No. 44 S 12455. The City
filed its appearance and Answer and when reached on the call was dismissed for
want of prosecution. It is recommended that this matter be prosecuted to a final
determination to relieve the property owners of the onus of a special assessment
judgment for work that was never done and on which the Attorney for, the City
secured a judgment and collected it.
In addition to the foregoing, I attended meetings of the Library
Board; The Fire and Police Commission; the Police Pension Fund; The Firemen's
Pension Fund, as well as those of the other Boards and Commissions in connection
with their problems and interpretations of ordinances and establishing duties
and powers.
I also counselled with and attended all public hearings held by the
Zoning Board of Appeals, whether acting as such Board or sitting as a Commission.
Many written opinions have been submitted to the members of the City
Council, the Administrative heads and the various Commissioners and Boards.
Work on the revision of the Ordinances of the City of Des Plaines
with the object of having an ideal Municipal Code was begun. The pressure of
city business indicated a need for the engaging of a Code Specialist in order
that the time within which it could be prepared could be lessened. A request
to engage help was submitted to the Council in writing and referred to a
Committee, who rejected the request. Much work has been done in this regard by
way of making copies of .all ordinances passed since the 1928 Code was published,
together with the examination of some 360 opinions of the Appellate and Supreme
Courts of this State. In addition considerable research work was done by ex-
amining and studying the various text books on the various subjects. It would
normally take an expert about one year to prepare and draft -a complete code, if
he were to devote his full time to that project and have ample funds to pay for
his clerical hire. It is difficult for any City Attorney to undertake this
type of work and complete it during his four year term if he can do so only
in his spare time.
Since the need for a new Code is very great and inasmuch as a suf-
ficient appropriation has been made for that purpose, it is recommended that
the Mayor and City Council appoint one or more competent persons to prepare and
submit such an Ordinance. Such persons should devote their entire time to this
ordinance, thereby making it possible to submit a draft for the Council's con-
sideration within a year.
In terminating my duties as your City Attorney, I want to express
my appreciation for the fine cooperation given me during the tenure of my office
and I want to assure you that it has been a pleasure to serve you and the citizens
of this splendid community.

force in the City of Des Plaines in accordance with the results of an election
held for that purpose you are advised as follows:
It is the duty of the Mayor of each city which shall adopt the Civil Service Act,
not less than 40 nor more than 90 days after the taking effect of this Act in
such City, appoint three persons who shall constitute and be known as the Civil

Service Commissioners; one for three years, one for two years and one for one year
from the time of appointment and until their respective successors are appointed
and qualified; and in every year thereafter, the Mayor shall in like manner appoint
one person as the successor of the Commissioner whose term shall expire in that
year to serve as such Commissioner for three years and until his successor, is
appointed and qualified. All appointments, both original and to fill vacancies
shall be so made that not more than two members shall at the time of the appoint-
ment be members of the same political party. Each Commissioner before entering
upon the duties of his office shall take the oath prescribed by the Constitution
of this State.

STREET COMMITTEE REPORT. Alderman Vavrinek, Chairman of the Street
Committee made the following report regarding Cumberland Terrace Civic Association
letter for improvement of Warrington Road, Washington Street and Cumberland Parkway:
Your Committee on Streets has investigated the above and has found:
1. That these streets are on a bus route.
2. That these streets have numerous holes and are in need of repair.
3. That these streets are not arterial streets.
We, your Committee on Streets, therefore recommend:
1. That these streets be recommended as arterial streets.
2. That they be included in the next program for resurfacing with

MUNICIPAL DEVELOPMENT COMMITTEE REPORT. Alderman McKay made the
following report:

Mayor and City Council, City of Des Plaines. May 2, 1949.
As Chairman of the Municipal Development Committee I attended a hear-
ing in this chamber last Thursday evening, April 28th, held by the Zoning Board
of Appeals of Cook County. The hearing was for the purpose of considering pe-
tition to rezone from classification F -farming to B-1 business, the property
located northeast corner of Wolf Road and Touhy Avenues.
This property is owned by a Mr. Walther and is the same parcel in
connection with which effort was made to rezone from F -farming to B-2, about a
year ago. At that the City of Des Plaines objected to the rezoning, as did a
number of people living in the area affected, primarily because the classifi-
cation B-2 would permit establishment of a tavern.
In objecting to the B-2 classification, the City stated it would have
no objection to change to B-1, under which a tavern would not be permitted.
At the hearing last Thursday I stated as representative of the City
that there would be no objection at this time for a change to a B-1 classifi-
cation. This classification would permit the establishment of a general store,
grocery store, barber shop, etc.
However, it developed at the hearing, that while the petitioner had
no plans to submit for study, it was his desire to erect a fire -proof building
on the lot, to be divided into four units to be used as stores, with perhaps
living quarters on a second floor. This sectional building would be in addition
to two buildings already on the site, and would be placed south of those exist-
ing structures.
The size of the lot involved is 210 x 135, the greater dimension
fronting on Touhy Avenue.
Sewage disposal at present is by septic system, and an additional
septic tank system would have to be installed for the 4 -unit building proposed.
Another problem brought out by the hearing was that of water supply which at
present is furnished by a well about 106 feet deep, according to Mr. Walther,
who claims this well could serve in addition to his family of three, the occupants
of the proposed L, -unit building.

It was finally decided by the chairman that the petitioner would be
given 15 days to submit an outline•of just what he desired to erect on the
property, and also to show on the plan present sewerage disposal system, and
location of water supply; also to indicate where additional septic system would
be located. The City of Des Plaines was given the same period in which to submit
its views on the project.
It is the recommendation of the Municipal Development Committee that
the zoning board of appeals of Cook County be advised that the City of Des Plaines
has no objections to a reclassification of the property to B-1 for the purpose of
providing stores which may be needed; that careful consideration be given to the
entire situation including the problem of water supply and sanitation and possible
health hazards; that if the petition is granted and it is possible to do so that
a limit be placed upon the extent of usage for business and residential on a lot
of this size because of the impracticability of furnishing adequate sanitation
and water supply.
Mr. Mayor, I move that the foregoing recommendation be concurred in.

RESOLUTION TO AMEND ZONING
ORDINANCE.
WHEREAS, it appears that there may be some defects in the proceedings
concerning the amendatory zoning ordinance duly adopted on September 8th , 1942,
effecting the real estate hereinafter described; and
WHEREAS, it is desirable and necessary that any and all defects be
corrected so that the validity of the Ordinance may be established.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

RESOLUTION TO AMEND ZONING
ORDINANCE, CONT'D.
Quarter of Section 18 to the place of beginning; all
situated in Township 41 North, Range 12, East of the
Third Principal Meridian;
shall remain classified as Residence District Area A or be changed to
District Area I - Light Industry.
SECTION 2. That this resolution shall be in full force and
with upon its passage and approval, according to law.

The motion was made by Alderman Vavrinek, and seconded by Halverson,
to adopt the proposed resolution. The motion was then made by Alderman McKay,End
seconded by Wolf, to refer the proposed resolution to the Municipal Development
Committee. The Mayor so referred the resolution to report back at next meeting.
Alderman Halverson made some comment in regard to the untiring efforts
of retiring City Attorney, Frank M. Opeka
ADJOURNMENT. The motion was made by Alderman Baines, and seconded by
Vavrinek, to adjourn. The motion was voted upon by acclamation, whereupon the
Mayor declared the motion carried and the Council regularly adjourned.

MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY, MAY 16, 1949, AT 8:00 P. M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer,
who presided with Aldermen Hansen, Davis, Vavrinek, Wolf, Baines, Behrel, McKay,
Clement, Halverson and Morava responding to roll call.
OFFICIAL REPORTS. The City Clerk submitted the reports of City Treasurer,
L. C. Barrett and Building Inspector, Frank Scharringhausen and the City Clerk for
the month of April, 1949. •
Chief Wigham spoke to the Council about having stickers for automobiles
of visitors at meetings or conventions for parking privileges. The motion was made
by Alderman Wolf, and seconded by McKay, to refer the stickers to the Public Pro-
tection Committee, who are to contact the Chamber of Commerce. The motion was
voted upon by acclamation, whereupon the Mayor declared the motion carried.
COMMITTEE REPORTS. Street Committee. Re: H -H Electric Company
Contract - The motion was made by Alderman Hansen, Chairman of the Street Committee,
and seconded by Baines, that the Mayor and City Clerk be authorized to cancel the
H -H Electric Company contract, as of December 31, 1949. The Mayor put the
question, and after an explanation by Alderman Hansen, the t'lerk called the
roll with the following result: Ayes: Aldermen Hansen, Davis, Vavrinek, Wolf,
Baines, Behrel, McKay, Clement, Halverson and Morava. Nays: None. The Mayor
thereupon declared the motion carried.
Alderman Hansen, Chairman of the Street Committee, reported the follow-
ing on the letter from Sears Roebuck and Company in regard to the renting of the
parkway at Jefferson and Pearson Streets: "It is not advisable to rent the above
mentioned section, and your Committee on Streets therefore recommends that the
request be denied." The motion was made by Baines, and seconded by Halverson,
to concur in the report. The motion was voted upon by acclamation, whereupon the
Mayor declared the motion carried.
