MINUTES OF THE ADJOURNED MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY, APRIL 25, 1949, AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor G. Walter
Pflughaupt who presided with= Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe,
Harm, McKay, Halverson, and Morava responding to roll call.
The City Clerk having a cold had his Deputy Katherine Schmidt assist
him in his duties.
OFFICIAL REPORTS. The Deputy Clerk K. Schmidt submitted the report of
Treasurer H. J. Ahbe for the month of March also the report of City Attorney
Opeka on the Umbach case that the hearing on a motion to dismiss on April 19, 1949
was continued by Judge H. Fischer to May 27, 1949.
City engineer Fletcher informed the Mayor that they were ready to
start on widening of Prairie Avenue and would like the inspector"appointed. On
motion by Vavrinek and second by Harm the appointment of Charles Fdrberg as
inspector for Prairie Avenue widening was approved.
CANVASS VOTES OF CITY ELECTION OF APRIL 19, 1949. Mayor Pflughaupt appointed
Alderman Kehe and Johnson and Harm as a committee to canvass the Votes of the City
Election held April 19, 1949 and the Mayor declared the recess for that purpose.
Alderman Baines made his appearance at this time. `
RESOLUTION DECLARING RESULTS OF ELECTION. After about one hour recess
the Council reconvened and the Deputy Clerk read the following proposed resolution:
RESOLUTION DECLARING THE RESULTS OF
THE CITY ELECTION HELD ON APRIL 19th.
1949.

WHEREAS, a regular election was held on Tuesday, April 19th, 1949, in the
City of Des Plaines for the purposeof electing a Mayor, a City Clerk, a City
Treasurer, a Police Magistrate and one Alderman for each of the five (5) Wards
in said City; and at said election, the proposition for the adoption of the Civil
Service Act was submitted to the voters of said City; and
WHEREAS, the MgTor and City Council, as by statute in such case made and
provided, have canvassed the votes cast at said election, find as' follows:

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, COOK
COUNTY, ILLINOIS:
SECTION 1. That the proposition:
Shall the City of Des Plaines, Cook County,
Illinois, adopt and become entitled to the
benefits of an Act entitled "An Act to Reg-
ulate the Civil Service of Cities," approved
and in force March 20th, 1895, as amended?
having received a majority of the votes cast upon said proposition, the said pro-
position be and the same is hereby declared carried and the proposition adopted.
SECTION 2. That KENNETH G. MEYER having received the highest number of
votes cast, be and he is hereby declared duly elected to the office of the Mayor
of the City of Des Plaines, Illinois, to serve the full term of four (4) years,
as is by law provided.
SECTION 3. That OTTO W. J. HENRICH having received the highest number
of votes cast, be and he is hereby declared duly elected to the office of City
Clerk of the City of Des Plaines, Illinois, to serve the full term of four (4)
years, as is by law provided.
SECTION 4. That LAWRENCE C. BARRETT having received the highest number
of votes cast, he and he is hereby declared fuly elected to the office of City
Treasurer of the City of Des Plaines, Illinois, to serve the full term of four (4)
years, as is by law provided.

SECTION 5. That ALBERT L. SENGSTOCK having received the highest number
of votes cast, be and he is hereby declared duly elected to the office of POLICE
MAGISTRATE of the City of Des Plaines, Illinois, to serve the full term of four (4)
years, as is by law provided.
SECTION 6. That WILLIAM N. DAVIS; REINHARDT G. WOLF; HERBERT J. BEHREL;
HOWARD W. CLEMENT and WALTER L. MORAVA; having received the highest number of votes
cast, be and they are hereby declared duly elected to the office of Aldermen of the
1st, 2nd, 3rd, 4th, and 5th Wards, respectively, of the City of Des Plaines, Cook
County, Illinois, to serve for a full term of four (4) years, as is by law provided.
SECTION 7. That this resolution shall be in full force and effect from
and after its passage and approval.

The motion was made by Alderman Kehe and seconded by Johnson to adopt
the proposed resolution. The Mayor put the question and the Clerk called the
roll with the following result: Ayes; Aldermen Johnson, Hansen, Vavrinek, Wolf,.
Kehe, Baines, Harm, McKay, Halverson, and Morava. Naves: None. The Mayor
thereupon declared the motion carried and the proposed resolution adopted.
PROCLAMATION ELECTION ON CIVIL SERVICE. The Deputy Clerk read the
following proclamation:

WHEREAS. at the regular City Election held on April 19, 1949, there
was submitted to the voters of the City of Des Maines, pursuant to order of
the County Court of Illinois, the following proposition:
Shall the City of Des Plaines, Cook County,
Illinois, adopt and become entitled to the
benefits of an Act entitled "An Act to Reg-
ulate the Civil Service of Cities," approved
and in force March 20th, 1895, as amended?
and
WHEREAS, THE City Council according to the statute in such case made
and provided, has canvassed the results of said election and has found that
the said proposition has received the majority of the votes cast upon such
proposition and has declared said proposition carried and was duly adopted.
NOW, THEREFORE; I, G. WALTER PFLUGHAUPT, the duly elected, qualified
and acting Mayor of the City of Des Plaines, Cook County, Illinois, do hereby
proclaim and declare that an Act entitled "An Act to Regulate the Civil Service
of Cities," approved March 20, 1895, be and the same is in force in the City
of Des Plaines, Cook County, Illinois.

The motion was made by Alderman Johnson and seconded by Hansen to proceed
with the recount of the votes in the Second and Fourth lards. Due to protest by
Alderman Wolf the motion was withdrawn. The motion was made by Alderman Johnson
and seconded by Hansen to proceed with the recount of contest in the Fourth Ward.
The motion was voted upon by acclamation whereupon the Mayor declared the motion carried.
The motion was then made by Alderman Kehe and seconded by Johnson to proceed with
the recount of the contest in the Second Ward. The Mayor instructed the Depu
Clerk to call the roll with the followinc result: Ayes: Johnson, Hansen,
Kehe, Baines, Halverson,and Morava. Nayes:.kldermean Vavrinek, Wolf, Harm and McKay.
Alderman Wolf again protested anal said he desired to have the Judges and Clerks
of election of the Second Ward presentat the meeting. The motion was then made
by Alderman Wolf and seconded by McKay to call a special meeting on Friday, April
29, 1949, at 8:00 P. M. for the 'recount of votes on contest of the Alderman in the
Second Ward. The motion was voted upon by acclamation whereupon the Mayor declared
the motion carried.
FOURTH WARD BALLOTS OPENED. The motion was made by Alderman Hansen and
seconded by Halverson to open the ballots of the Fourth Ward. The Mayor put the
question and the Deputy Clerk called the roll with the following result: Ayes:
Alderman Johnson, Hansen, Vavrinek, Wolf, Kehe, Baines, Harm, McKay, Hai verson, and
Morava. Nayes: None. The Mayor thereupon declared the motion carried. Attorney
J. R. Van Gorken requested permission as attorney for Howard Clement to watch with
Mr. Clement the recounting. Attorney K. G. Meyer and Wm. Leyns were also granted
permission to watch the recount.
The Mayor appointed the followinoas clerks and judges: Judges:
Aldermen Kehe, Johnson and Harm; Clerks: Aldermen Vavrinek and Morava.
At 1:05 A. M. the Council reconvened and Alderman Vavrinek reported the
result as follows: William R. Leyns, 397 votes and Howard W. Clement 399 votes.
K The motion was made by Alderman Kehe and seconded by Baines that the
canvass of the ballots had been completed in line with the recount and have found
that William R. Leyns received 397 votes and Howard W. Clement 399 votes, and canvass
of the tally sheets stands and Howard W. Clement is hereby declared elected Alderman
of the Fourth Ward.
The motion was voted upon by acclamation whereupon the Mayor declared
the motion carried.
APPROVAL OF BILLS. Alderman Kehe, Chairman of the Finance Committee,
presented the following proposed resolution:

ZONING BOARD OF APrEALS GRANT VARIATION AT 1096 LEE STREET. The City Attorney
read the following letter:
April 25th, 1949.

City of Des Plaines, Illinois
Gentlemen:
Your Zoning Board of Appeals sitting as a Commission had referred to it the
application of Mrs. Percy Baines to rezone the following described real estate from
its present classification Residence District Area - A to District C - Commerdial, or
to grant a variation for such use, to -wit:
Lots 2 and 3 in Block 8 in Des Plaines Gardens, a
Subdivision in Section 20, Township 41 North, .Range
12, East of the Third Principal Meridian in Cook
County, Illinois (also known as 1096 Lee Street, Des
Plaines, Illinois)
and advises as follows:
1. That due notice to the parties and to the public of this proceeding of the public
hearing was given as required by law and that the Board has jurisdiction of the sub-
ject matter and of the parties.
2. That the property proposed to be reclassified from Residence Area District A to
Area District C - Commercial, or a variation to permit the use of said premises as
a Gift Shop, consists of two lots on which is a residence located at 1096 Lee St.,
Des Plaines, Illinois.
3. That petitioner wishes to utilize the property in question for a Gift Shop by
making a few minor alterations in the building.
4. That there were no objectors to the proposed amendment or variation at the public
hearing.
5. That the premises in question are in a block devoted to residential use. The
area directly across the street is utiliaed for commercial purposes. The area
to the north on the same side of the street as the premises in question is utilized
as commercial. The trend in the area appears to be commercial. _
6. That an amendment to rezone these two parcels within thatblock is not practical un-
less the remaining lots in said block facing Lee Street are also rezoned.
7. That a variation is practical in view of the surrounding uses and is hereby granted.
The Board of Appeals having heard and considered the evidence and being fully
informed in the -remises, recommend to the Mayor aid the City Council that the pro-
posed amendment to the Zoning Ordinance tie not adopted but that a variation is hereby
granted by this Board to the peititioner to use said premises as a Gift Shop and that
any necessary permits for remodeling or altering such structure to make it useful for
such purpose be granted.
This action was adopted by the concurrent dote & 5 members of the Board.

Gentlemen:
Your zoning Board of Appeals sitting as a Commission had referred to it
the application of the Chicago and North Western Railroad Comapny to rezone the follow-
ing described real estate from its present classification Residence District Area A
to Industrial District I - Light Industry, to -wit:
That part of the West half of the South East Quarter--0f---
Section 18, Township 41 North, Range 12, East of the Third
Principal Meridian, bounded and described as follows, to -
wit: Beginning at the Southwest corner of the South East
Quarter of said Section 18, thence North along the West
line thereof 1791 feet, more or les-, to a point, distant
850 feet south of the Northwest corner of the South East
quarter of said Section 18, thence East along a line drawn
parallel with the North Line of the South East Quarter of
said section 18 a distance of 523 feet, more or less, to
the Southwesterly line of Wolf Road as now located and
established; thence Southeasterly along the Southwesterly
line of Wolf Road 395 feet, more or less>, to a point, dis-
tant 30 feet Northwesterly, measured at right angles from
the center line between the two main tracks of the Des Plaines
Valley Line of the Chicago and North 7lestern Railway

way center line 1620 feet, more or less, to the South line
of the South East Quarter of said Section 18; thence West

1. That Due notice to the parties and to the public of this proceeding and of the
public hearing therein was igiven as required by law and that the Boardtas
jurisdiction of the subject matter and of the parties.
2. That petitioner wishes to utilize the property in question for light
industrial uses. A part of said premises are now occupied under lease, by the
Lake Cook Supply Company, who for many years have maintained a bulk oil storage
plant; Meyer Coal and Material Company, under lease, who for several years have
used a portion of said Premises for the storage of building materials, and the Coffman
Coal yard; under lease, which has been on siad premises for many ;;ears, The property
is question has been devoted to industrial uses for many years, and are presently
non -conforming ^use.
3. That there were five (5) objectors to the proposed amendment at the public
hearing.
4. That the tract of land in question, triangular in shape, lies between two
main freight lines of the Des Plaines Valley Railroad forming a wy_e and it was
agreed by all present that said premises are not suitable for residential use.
5. That a hearing on the same subject matter -as held about a year ago and it
was then recommended by this Bo;rd that the proposed amendment be granted; and that
sence that time there have been no changes which would warrant A change of that
recommendation.
6. That the highest and best use for said property is for light industrial pur-
poses based on its location and the fact that said premises cannot be used for
any other purposes.
7. That the evidence presented was convincing as to the desiraUility of reclass-
ifying the petitioner's property into a light industrial district.
The Zoning Board of Appeals, sitting as a Commission, having heard and
considered the evidence and being fully informed in the premises, on a vote of

The City Attorney read for first reading the following proposed
ordinance entitled:
AN ORDINANCE AMENDING THE,
ZONING ORDINANCE OF THE CITY
OF DES PLAINES_, ILLINOIS.
The motion was then made by Alderman McKay and seconded by Wolf to refer the
proposed ordinance to the Municipal Developement Committee for study and report.
The Mayor put the question and after considerable discussion the Clark called
the roll with the following result: Ayes: Aldermen Wolf, Harm, McKay, Nayes :
Aldermen Johnson, Hansen, Vavrinek, Kehe, Paines, Halvrson, and Morava. The
Mayor thereupon declared the motion lost. The motion was then made by Alderman
Kehe and seconded by Morava to suspend the rules and pass the proposed ordinance.
The Mayor put the question and the Clerk called the roll with the following result:
Ayes: Aldermen Johnson, Hansen, Vavrinek, Kehe, Baines, Halverson, and Morava.
Nayes: Alderman Wolf, Harm and McKay. The Mayor thereupon declared the motion
lost and the proposed ordinance filed for second reading.
APPROVAL CF M1NUThS. The motion was made by Alderman Johnson and seconded
by Hansen to approve the minutes of April 4, 1949. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.
ADJOURNMENT. The motion was made by Alderman Halverson and seconded by
Harm to adjourn. The motion was voted_upon by acclamation whereupon the Mayor
declared the motion carried and the Council regularly adjourned at 1:45 P.M.
