the motion was made by Alderman Baines and seconded by Morava to reject all the

CITY ATTORNEY FRANK OPEKA TENDERS HIS RESIGNATION. The Clerk read the
following letter:

Gentlemen:
I hereby tender By resignation as City Attorney for the City of Des Plaines,
effective as of April 30th, 1949.
It has been a privilege to serve as Attorney for this City and the
many difficult problems that presented themselves were rendered easier by the fine
cooperation received from you.

The motion was made by Alderman Johnson and seconded by Hansen to accept
the resignation. The motion was voted upon by acclamation whereupon the Mayor declared
the motion carried and it was accepted with regrets.
APPROVAL OF MINUTES. The motion was made by Alderman Johnson and seconded
by Halverson to approve the minutes of the March 21st, meeting and the special
meeting of March 28, 1949. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
ADJOURNMENT. The motion was made by Alderman Baines and seconded by Harm
to adjourn. The motion was voted upon by aeclamtion whereupon the Mayor declared
the motion carried and the meeting regularly adjourned.

The committees did not have any reports. The motion was made by Alderman
Kehe and seconded by Vaiirinek to adjourn to Monday, April 25, 1949, 8:00 P.M. The
motion was voted upon by acclamation whereupon the Mayor declared the motion carried

MINUTES OF THE ADJOURNED MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY, APRIL 25. 1949, AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor G. Walter
Pflughaupt who presided with Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe,
Harm, McKay, Halverson, and Morava responding to roll call.
The City Clerk having a cold had his Deputy Katherine Schmidt assist
him in his duties.
OFFICIAL REPORTS. The Deputy Clerk K. Schmidt submitted the report of
Treasurer H. J. Ahbe for the month of March also the report of City Attorney
Opeka on the Umbach case that the hearing on a motion to dismiss on April 19, 1949
was continued by Judge H. Fischer to May 27, 1949.
City engineer Fletcher informed the Mayor that they were ready to
start on widening of Prairie Avenue and would like the inspector'appointed. On
motion by Vavrinek and second by Harm the appointment of Charles Fdrberg as
inspector for Prairie Avenue widening was approved.
CANVASS VOTES OF CITY ELECTION OF APRIL 19, 1949. Mayor Pflughaupt appointed
Alderman Kehe and Johnson and Harm as a committee to canvass the Votes of the City
Election held April 19, 1949 and the Mayor declared the recess for that purpose.
Alderman Baines made his appearance at this time. `
RESOLUTION DECLARING RESULTS OF ELECTION. After about one hour recess
the Council reconvened and the Deputy Clerk read the following proposed resolution:

THE CITY ELECTION HELD ON APRIL 19th.

WHEREAS, a regular election was held on Tuesday, April 19th, 1949, in the
City of Des Plaines for the purposeof electing a Mayor, a City Clerk, a City
Treasurer, a Police Magistrate and one Alderman for each of the five (5) Wards
in said City; and at said election, the proposition for the adoption of the Civil
Service Act was submitted to the voters of said City; and
WHEREAS, the Mw or and City Council, as by statute in such case made and
provided, have canvassed the votes cast at said election, find as'follows:

benefits of an Act entitled "An Act to Reg-
ulate the Civil Service of Cities," approved
and in force March 20th, 1895, as amended?
having received a majority of the votes cast upon said proposition, the said pro-
position be and the same is hereby declared carried and the proposition adopted.
SECTION 2. That KENNETH G. MEYER having received the highest number of
votes cast, be and he is hereby declared duly elected to the office of the Mayor
of the City of Des Plaines, Illinois, to serve the full term of four (4) years,
as is by law provided.
SECTION 3. That OTTO W. J. HENRICH having received the highest number
of votes cast, be and he is hereby declared duly elected to the office of City
Clerk of the City of Des Plaines, Illinois, to serve the full term of four (4)
years, as is by law provided.
SECTION 4. That LAWRENCE C. BARRETT having received the highest number
of votes cast, he and he is hereby declared fuly elected to the office of City
Treasurer of the City of Des Plaines, Illinois, to serve the full term of four (4)
years, as is by law provided.
