ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY, APRIL 4, 1919 AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor G. Walter Pflughaupt
who presided with Aldermen.Johnson, Hansen, Vavrinek, Wolf, Kehe, Harm, McKay, Halverson,
and Morava responding to roll call.
MR. WILLIAM HANCK, REPRESENTATIVE OF THE PARENT TEACHER'S ASS'N. Mr. Hanok
spoke regarding School finances.
OFFICIAL REPORTS. The Clerk submitted the monthly reports of Inspectors
Scharringhausen and Rieck, the City Clerk's report of receipts for March, Capt.
Becker's report of Parking Meter arrests and the following report of Supt.
Warnicke:

Gentlemen:
Following is a report of an inspection of the Oakton Street sewer made today.
. This inspection was made by Captain Stangor of the Fire Department, myself
and two of my men.
The Sewer was found to be in good sound condition free of debris or ob-
structions of any kind and there definitely are no cave-ins or broken tiles.
We also examined the junction. chamber where the City sever flows into the
Sanitary District interceptor sewer and found the back -water gate which during heavey
rains permits a free flow to the river to bei in good condition and perfect working
order, and the 15 inch sewer running from this junction chamber to the interceptor
was also found to be free of any obstruction.
This report will confirm my previous reports made to the Council concerning
the condition of our sewer system.

This will acknowledge receipt of your letter of March 24th regarding the Des Plaines
River and construction of dams.
I believe I am more interested in the Des Plaines River than any member of the General
Assembly. I introduced a bill this session providing for $300,000 for $ams. Last
session I introduced a similar bill, it passed both the House and the S nate but was
vetoed by the Governor because of lack of appropriations. Senator BidwiI1 and myself
have talked to a representative of the Governor and have been assured that if the
bill is again passed at this session, there will be noveto.

I have also introduced another bill to set up a committee to study,the Des Plaines River,
causes of pollution and ways and means to eliminate same.
I am enclosing both bills as I thought you might be interested.
If at any time I can do anything for you on this subject I would appreciate it it you

Your Zoning Board of Appeals, "sitting as a commission, pursuant to
your direction, held a public hearing it the Municipal Building on March 29, 1949,
after notice duly published, to consider the application to rezone from Class A
Residential, to Area District B., Multiple Family Dwelling, the following
described real estate:
Lots 18 to 32 in W. Stile's Re—subdivision
of Lots 149 to 157, Town of Rand, Sections 16,
17, 20 and 21, Township 41 N., Range 12 E. of 3rd
P.M.,
The area in question comprises south half of a block, the north half
of which is already zoned for multiple family dwellings. At present there are
at least two multiple family dwellings in the block. The general character of
the neighborhood appears to be of multiple family use.
There were no objectors to the rezoning at the public hearing held.
From all evidence presented, it appears that the hghest and best use
of this area should be for multiple family dwelling purposes, and therefore it is
recommended that the petition for a change form Class A, Residential, to Area
District B, Multiple Family Dwellings, be granted, and an ordinance conforming
with the recommendation is herewith enclosed.

WHEREAS, the City Council of the City of Des Plaines, Illinois, has hereto-
fore adopted ordinances providing for sewer water mains, sidewalks and paving im-
provements covering in part the premises hereinafter sat forth; and
WHEREA1L special assessments were levied to pay the costs of said improve-
ments and, pursuant to the Statute applicable thereto, said• improvements were constructed
and the report of cost and completion was in manner and form provided by law; and
WHEREAS, only a portion of installments of said special assessments levied
against said land have been paid and all other installments are now past due and
delinquent; and
WHEREAS, all other remedies available under the law have been without avail;

Gentlemen:
The undersigned are residents of the,West Side of Des Plaines and are
owners of property -and homes which will be directly affected by the use of the pro-
perty hereinafter described.
In 1942 the property hereinafter described was reclassified from -
Indnstrial District, Area District to Residence District, Area District A. The piece
of property hereinafter described was part of a larger area, all of which was re -zoned
as stated. The City Attorney of Des Plaines in a written report a to the City Council
has recently questioned the validity of this re-classification.
The Chicago and North Western Railway Company has just filed a petition
to have other portions of this larger area reclassified again from Residence District,
Area District A to Industrial District, Area District.
In order to protect the values of our properties, to prevent the expanlion
of certain undesireable uses of this area beyond reasonable bounds, and to clear
up any existing ambiguity in the legality of the area, it is requested that the
following described property be classified as Residence District, Area District A:

Gentlemen:
Attached is an application for the rezoning of two parcels of land owned by the
Chicago and North Western Railway Company situated within the corporate limits of the
City of Des Plaines.
This application is presented in view of the alleged defectiveness of the
amendatory zoning ordinance duly adopted on September 8, 1942 affecting the real
estate hereinafter described.
The C. and N. W. Railway Company has previously submitted a petition to the City
Council requesting that the triangular piece of property lying between the Hest
Wye right of way and the Des Plaines Valley Line right of way, immediately north of
the point at which these right of ways cross Thacker Street, be rezoned from a
residential classification to a light industrial classification. The area sought
to be rezoned by the railway includes the property now leased to the Coffman Coal
Company. A hearing on -this petition of the railway was held before the Boardcf
Appeals sitting as a Commission on Monday evening, April 11, 1949.
A map is attached hereto showing the property included in this present application,
the property being divided into two parcels. Parcel I is shown in solid red color;
Parcel II is shown in solid green color; and the property which is currently sought
to be rezoned by the railway is cross -hatched in ink.
A more specific description of the two parcels is as follows:

The East -- of the East ' of the South West fractional
quarter of Section 18 and all that part of the West of
the South East of said Section 18 which lies west
of a line drawn parallel with the 800 feet distant, at

It is requested that Parcel I be classified by an amendatory zoning ordinance
as Residence District, Area District A and that Parcel II to classified by an
amendatory zoning ordinance as Commercial District, Area District C.
This application is made on the assumption that the City Council is anxious
to find a just and equitable solution to the zoning problem in this particular area
which has been the source of so much difficulty in the past. It is believed that
a disposition of the problem such as requested in this application would represent
such a solution and therefore would not be subject to attack as being unreasonable
or arbitrary if ever exposed to the scrutiny of ajudicial body.
Assuming that the Council is of the opinion that the highest and best use of
the property lying emmediately between the two railroad right of ways and south
of Parcel II, as described above, is light industrial, and assuming also that the
City Council recongnizea the tremendous additional devaluation of the surrounding
residenlal property which might result if this industrial development is not con-
fined within reasonable limits, it would seem logical to attempt to not only confine
the industrial area but to also provide a better area in the form of commercial pro-
--perty between the industrial property and the residential property.
It is therefore respectfully requested that a hearing be held on this matter
before the Zoning Board of Appeals sitting as a commission. A check in the amount
of $35.00 in favor of the City of Des Plaines to cover the cost of printing, publishing
etc., is already in the hands of the City Clerk.

Application is hereby being made for a permit to hold the Annual Carnival
and Festival of Post 2992 of the Veterans of Foreign Wars of the United States ,
to include the dates June 13th through 20th on the plot of ground just East of the
junction of Busse Highway and Northwest Highway, presently owned by the Henry Valve
Company.
Permissipn,has been granted by Mr. Henry to use this property for the
purpose mentioned above and for the aforesaid dates.
This area is idealy suited for such a carnival by virtue of the location
and•absenee of many residences, thereby insuring the minimun of inconvenience
to neighbors.

CALL TO ORDER. The meeting was called to order by Mayor G. Walter
Pflughaupt who presided with Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe, Baines,
Harm, McKay, Halverson, Morava, responding to roll call.
The committees did not have any reports. The motion was made by Alderman
Kehe and seconded by Vatrinek to adjourn to Monday, April 25, 1949, 8:00 P.M. The
motion was voted upon by acclamation whereupon the Mayor declared the motion carried
and the meeting adjourned to Monday, April 25, 1949 at 8:00 P.M.
