03071949ao S MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS; MONDAY. MARCH 7 . 1949. AT 8:00 P. M. CALL TO ORDER. The meeting was called to order by Mayor G. Walter Pflughaupt, who presided with Aldermen Johnson, Vavrinek, Wolf, Baines, Harm, McKay, Halverson and Morava responding to roll call. Aldermen Kehe and Hansen were absent the entire meeting; Alderman Hansen due to illness, Alderman Kehe away on vacation. OFFICIAL REPORTS. The City Clerk submitted the monthly reports of Electrical Inspector, Arthur Rieck•and Building Inspector, Frank Scharringhausen. The Clerk submitted his own report of cash receipts for February and also a report from Captain H. A. Becker. City Attorney, Frank M. Opeka, submitted the following report: Mayor and City Council, City of Des Plaines, Illinois. March 7, 1949. Gentlemen: This ie to advise that Doctor J. I. Steinfeld filed a complaint for an injunction against the City of Des Plaines on March 3rd. On the same date I was served with a notice to appear before Judge Harrington on a motion for a temporary injunction to restrain the city from prosecuting under the charge now pending be- fore Judge Sengstock and further to enjoin the City from enforcing its ordinances against the usageof his property as a nursing home and convalescent home. The motion on the temporary injunction was set over for one week to give me an opportunity as Attorney for the City of Des Plaines to file an answer before proceeding further. In said injunction they are contesting the validity of our zoning ordinances. I suggest that this matter be defended to the utmost inasmuch as I believe that our ordinances will be sustained in this proceeding. Respectfully submitted, FMO*AGH Frank M. Alderman Vavrinek, Chairman of the Street Committee, made the following report regarding a driveway for the United Motor Coach Company: Your Committee on Streets has investigated the above and has found: that due to the narrow street and the turning radius required for long buses that a request for a driveway 25 ft. at the sidewalk and 45 ft. at the curb is not unreasonable. We, your Committee on Streets, therefore recommend: that Building Inspector, F. Scharringhausen, be authorized to issue a permit for -construction -of this driveway in accordance with the request of the United Motor Coadh Company. L. J. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. Alderman Vavrinek also reported the following in regard to the inquiry of P.' D. Bloomingdale concerning the improvement of part of Rose Avenue by "special assessment": Your Committee on Streets has investigated the above and has found: that at the Board of Local Improvements meeting of April 15, 1946, the petition of April 8, 1946 was presented and accepted. The City Engineer was instructed to prepare an Estimate of Cost. This was presented by the Citi* Engineer at the Board of Local Improve- ments meeting of January 20, 1947. No further action was taken. It is the opinion of this committee that the matter was dropped because of lack of -interest of petitioners. L. J. Alderman McKay, Chairman of the Municipal Development Committee read the following report: Alleged zoning violation by C&NW- Meyer Coal & Material Company. Des Plaines, Illinois, March 5, 1949. ao9 Mayor and City Council, City of Des Plaines: With further reference to the letter from the West Side Civic Club dated December 10th, 1948 above subject, and in connection with which this committee has already submitted two preliminary reports. In that dated Febru- ary 18th, we told of our meeting with Messrs. Clement and McCabe of the West Side Civic Club, Messrs. Meyer and associates, and representatives of the C&NW. In that meeting as stated in our previous report, it was agreed that Messrs. Clement and McCabe would submit a letter to the Committee by March 1st giving their views on the points presented by the Meyer-C&NW group. We are now in receipt of the following communication: "In accordance with the agreement reached at the meeting of the Municipal Development Committee on February 10, 1949, the under- signed and Mr. Frank J. McCabe, Jr., acting as representatives of the West Side Civic Association, have had under consideration the above-named subject matter and particularly the position taken by the C&NW and the Meyer. Coal and Material Company. 02/0 MUNICIPAL DEVELOPMENT REPORT, CONT'D. "Mr. McCabe has done some legal research on this matter and unfortunately is at the present time confined at his home, due to illness. The undersigned has had very little oppor- tunity to engage in such legal research because of the pressure of trial work and other unforeseen circumstances. Unfortunately, therefore, it is not possible to submit a complete report at this time. "The one fact which has become apparent, however, during the consideration given this problem subsequent to the meeting referred to above, is that there seems to be very little question, if any, as to the facts in the case. It is there- fore believed that substantially the entire question involves a point or points of law. "In view of this situation, it is the opinion of the under- signed and Mr. McCabe that the ultimate determination of this question should be made by the City Attorney of the City of Des Plaines, and if either side is dissatisfied with such a decision, it then will be necessary to resort to the Courts in an attempt to obtain a Judicial decision. It is therefore our present recommendation that the matter be turned over to the City Attorney for his study and recom- mendation, and that if he so desires, memoranda can be sub- mitted to him by each side in support of their positions. ' "Speaking generally, it is the belief of the undersigned and Mr. McCabe that the facts of this particular case dis- tinguish it from many of the cases of record, in that we here are concerned with a lapse of 5'years in occupancy and use of substantially vacant property, rather than improved property. However, we have'not yet prepared any'memorandum such as mentioned above in support of our position and in the interest of avoiding delay are making this recommendation that the matter be turned over to the City Attorney and any subsequent action taken by the West Side Civic Association will -be in the form of a memorandum submitted to that individual to aid him in reaching a decision." This letter was addressed to the Chairman of the Municipal Development Committee, and was signed by Mr. Howard W. Clement. We have conferred with City Attorney Opeka and he has agreed to submit written opinion to the representatives of the West Side Civic Association cover- ing both questions raised in their original letter, viz., status of the building erected under permit issued in February of 1945, also whether or not the non- conforming use of the area by the Meyer Company is a violation. As a matter of fact we gave the City Attorney's view in our report of February 18th, but Mr.Opeka is quite willing to write his opinion as above stated and the West Side Civic Association can then decide whether or not to take court action; and if they desire to press action by the City in connection with the building before the general question of non -conforming usage is definitely decided. Recommended, that the matter be referred to City Attorney for action indicated. S. E. McKay Chairman E. W. The applicant asked for a variation to allow the enclosing of a side porch, that is less than three feet from the lot line. The matter was referred to the Zoning Board by Mr. F. F. Prints were enclosed to indicate there would be no alteration in the present structure at the above address outside of enclosing the porch. With this in mind we advised the Building Inspector that we are granting the variation, and asked him to issue the building permit. This letter is written as a matter of record. REZONE TO COMMERCIAL THE NORTHWEST CORNER OF MANHEIM ROAD AND TO= AVENUE. The Clerk read the following recommendation: Honorable Mayor & City Council City of Des Plaines Des Plaines, Illinois Sirs: February 17, 1949 Pursuanttq law, your Zoning Board of Appeals, sitting as a committee, advertised for a public meeting at 8:30 o'clock (daylight saving time,) on the third day of August, A.D. 1948 in the Council Chambers, Municipal Building, Des Plaines, Illinois on the following described property. 3.027 acres of the E. of the SE of the SE of Section 29, Township 41 N., Range 12, E. of the 3rd PM in Cook County, Illinois, except the West 6 feet thereof, and except 66 feet conveyed to the Chicago & Wisconsin Railway, and except the highway. The purpose of this meeting was to seek a rezoning of the above legally described property from its present Class A area, residential, to area district Commercial. On the particular evening that this meeting was called, we had two other meetings, and it gotso late that we could not hold the meeting as described by the above. It took considerable time to get the principals and the Zoning Board, that were interested in this property, together, and the meeting was not held until November. At the time of the meeting Mr. J. E. Wiltgen, general manager of the Primier Rope Gardens represented the applicant for the amendment to the zoning ordinance. There were no objectors. This property runs 263.07 ft. along Touhy Avenue, 1025.60 ft. along the highway designated as LaGrange Road, and 1002.97 ft. at right angles to Touhy Avenue. As you possibly notefrom the above description, this property is a triangular shaped piece of property and terminates in a point along LaGrange Road. The property is not ideally located for residential purposes, as it is on two main highways and the shape of the property itself does not lend itself to residential development. We understand from the applicant that asked for the. rezoning, that they want to either lease or sell this property to one of the oil companies for the operation of a gasoline station. It is the unanimous opinion of your Zoning Board that this would be an ideal application for the piece of property involved. The Clerk read the following recommendation: City of Des Plaines, Illinois Honorable Mayor & City Council City of Des Plaines Des Plaines, Illinois Sirs: Your Zoning Board of Appeals, sitting as a Commission, held a public meeting at the hour of 8•o'clock on the 15th day of February A.D., 1949 in the Municipal Building, Des Plaines, Illinois. The property involved is as follows: That portion of Lot two (2) South of center line of pavement in Golf Road (except the West one hundred and sixty-five (165) feet thereof) except the South one thousand -two hundred thirty-seven and eight one hundredths (1237.08) feet of Lot two (2) measured at right angles to South Line there- of and except that part thereof taken for widening Golf Road in Owner's Subdivision of Section thirteen (13) Township forty-one (41) North, Range eleven (11) East of the Third Principal Meridian, in Cook County, Illinois. The amendment as proposed seeks to rezone the above legally described property from its present Class A area, Residential, to area district Commercial C. At the present time this property is subdivided into one acre tracts. The property is located at the Southwest corner of Mount Prospect Road and the City Limits on the lest. The owner of this property proposes to enter into a 'contract with one of the large oil companies for the installation of a gas station, and the owner intends to build a home on the West end of the property. At the hearing the only person who attended was the owner of the property. There were no objectors. This property is located a considerable distance from the Cumberland Terrace subdivision and is mostly farm land at the present time. The nearest gas station to this property is the gas station in Cumberland on the Northwest Highway. Your Zoning Board can see no objection to the development of the property as suggested, and it is the recommendation of your Zoning Board that the Owner's request be granted; that is, to rezone the property from Class A residential to Class C. The Mayor thereupon declared the motion carried and the proposed ordinance finally passed. BROWN-ORTH LETTER ON FIRE TRAP, 1567 ELLINWOOD STREET. The Clerk read the following two letters: March 2, 1949 Mr. LeRoy J. Vavrinek City Hall Des Plaines, Illinois Dear Sir: - The Roberta Mason tragedy makes us all doubly conscious of fire hazards. Therefore, we should again like to bring to your attention another fire trap in the city of Des Plaines. The building located on the east side of ours —namely 1567 Ellinwood Street - is a dangerous fire trap that could not only bring Des Plaines more un- favorable publicity, but could cost the lives of three children and ten or eleven adults. Froi reports of our insurance carriers, the building is over ripe for a fire and would burn so rapidly that the inhabitants would in all probability have little chance to get out. In addition to the hazards to the inhabitants of the building, the buildings on either side of 1567 Ellinwood would be greatly endangered if a fire did occur. The building on the east side has three families, approximately eleven people, living there day and nite who may have little or no opportunity to escape unhurt. In view of these conditions, which we believe to be of a very serious nature, we want to go on record that we called the matter to your attention. J. P. BROWN. AA. Brown President March 4, 1949 In Re: Dangerous Building 1569 Ellinwood Street Gentlemen: The structure at the above address should be condemned and demolished. Numerous visits have been made by myself, Mrs. Willer of the Health Department, and R. Kolze of the Fire Department, and we agree that the building and contents are unsafe and hazardous and should be condemned and demolished. The plumbing is not sanitary or in accordance with health requirements. The floors of the apartment are sagged and the foundation has settled so that the floors slope a couple of inches. The exhaust from the Laundry has stagnant fumes puring out from the side of the building. The sanitary condition of the entire building is very bad. Our Building Code requires council action on this matter. Article 24, Chapters 230 and 231. Recommend that the Council take immediate steps to correct this condi- tion by following Code proceedure. Walter Pflughaupt, Mayor The City Council City Hall Des Plaines, Illinois Des Plaines, Illinois March 4, 1949 Gentlemen: The School Patrol Commission, appointed by Mayor G. Walter Pflughaupt, met March 3, 1949 at 8:00 pm in the office of the mayor, City Hall, to elect presiding officers of the commission. Mr. Leslie Hedberg was elected chairman of the commission and Mrs. George W. Eastland was elected secretary. The other members of the commission are Elmer W. Johnson, chairman of the Public Protection committee; H. A. Becker, chief of police, and Mrs. George Gustafson. A recommendation from the Safety Council was read concerning lo- cations for stationing civilian patrolmen, which was approved by this cox,- mission. om-mission. These locations are: Perry and Lee streets; Prospect and Mannheim, and Prairie and Lee streets. It is recommended by this commission that the following two (2) men be employed by the City Council of Des Plaines to start this program. A third man is yet to be appointed. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. INSPECTOR SCHARRINGHAUSEN'S LETTER CONCERNING REPAIR OF AUTO. The Clerk read the following letter: Honorable Mayor and City Council City of Des Plaines, Illinois In Re: Automobile for Building Department March 7, 1949 Gentlemen: On March 2, 1949 the Police Department turned over the keys for the Squad ear which was to be used by the Building Department. The understanding was that the Building Department accept this auto- mobile in good working order. However, I cannot accept it as being in good working order. The City Clerk gave me an order to have same put in shape, but after thinking it over, I would like for the Finance Committee to get an estimate of the cost for redonditioning the car, as it may cost considerable. The tires are bald-faced, there isn't any jack or tire tools, and there are no wrenches. Respectfully, FFS:ik F. F. The motion was voted upon by acclamation, , whereupon the Mayor declared the motion carried. INSPECTOR SCHARRINGHAUSEN'S LETTER RECOMMENDING THE AMENDING OF THE BUILDING CODE. The Clerk read the following letter: March 7, 1949 Honorable Mayor and In Re: Building Code City Council Amendments City of Des Plaines, Illinois Gentlemen: Ceiling heights and Engineered Packaged Chimneys have been under dis- cussion for some time with the Building Department. Plans are coming in which indicate thereon this new type of engineered chimney for no basement single story residences. This chimney is supported by ceiling joist and extends from the ceiling up through the roof. (Specifications and diagrams and underwriters approvals are attached to this letter.) This type of chimney does not comply with our present Ordinance, which calls for a chimney to be on concrete foundation, on solid earth and to be of masonry* construction with flue lining. The Federal Housing Authority permits use of the new type of chimeny and guarantees loans on homes using this new type package chimney. Therefore I recommend that an amendment be made to our present Build- ing Code, permitting the use of the underwriters approved chimneys in one story baaementlesa buildings. There has also been questions concerning ceiling height requirements. Our Ordinances call for a minimum ceiling height of eight (8) feet and we could not accept any plan that was less than eight (8) feet from ceiling to floor. However, construction methods have changed considerably and along with it reduc- tion in ceiling heights, although not permitted in our City on account of Ordi- nances not having been changed to the minimum ceiling height of seven feet six inches. Heating and ventilating air conditioning create air changes within the room without opening windows or doors. Many of the homes in the lower cost bracket have plans showing seven foot six inches ceiling heights. This has been accepted by the Federal Housing Authority as a minimum. This would cover most plans made for prefabricated buildings and others in that class. See FHA Code 305-B. The meeting was called to order by Mayor G. Walter Pflughaupt, who presided with Aldermen Johnson, Hansen, Vavrinek, Wolf, Baines, Harm, McKay, Halverson, and Morava responding to roll call. The Clerk read the following report: Mayor and City Council, City of Des Plaines, Illinois. Gentlemen: Re: Doctor J. I. Steinfeld Vs. City of Des Plaines • March 21, 1949. The hearing on the motion for temporary injunction in the above matter was heard before Judge Cornelius J. Harrington of the Circuit Court on March 11, 1949, upon the complaint and the Answer of the City of Des Plaines, together with testimony offered by witnesses for both sides. After due consideration the motion for temporary injunction was denied and Doctor Steinfeld was given five days to file a reply to the answer of the City and the matter referred to Arthur Sullivan, Master in Chancery for said Court, to take testimony and make a report of his findings and conclusions of law and fact and recommendation to the Court. I advised the Court that the prosecution of the pending case before Judge Sengstock for violation of the Zoning Ordinance would be continued generally until the Circuit Court could dispose of this matter of determination of the va- lidity of our Ordinance. By the same token, Doctor Steinfeld was not to operate any business in the nature of a nursing home for the aged or convalescent home while this matter is being determined in the Circuit Court. His failure to abide by the Ordinance during that period subjects him to arrest every time that he oper- ates contrary to our Ordinance. This is a decided victory for the City up to this point and I feel confi- dent that the Ordinance can be sustained after a full hearing. It is apparent that delaying tactics may be pursued and I would like your recommendations as to whether I should use diligent effort to bring this matter to an immediate or early hearing, so that the matter may be disposed of as promptly as possible.
