APPROVAL OF MINUTES. The motion was made by Alderman Halverson and seconded by Morava to approve the minutes of Nov. 15, 1948. MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY. DECEMBER 20, 1948, AT 8:00 P.M. CALL TO ORDER., The meeting was called to order by City Clerk, Otto Henrich (due to absence of the Mayor) with Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe, Baines, Harm, McKay, Halverson and Morava responding to roll call. The motion was made by Alderman Johnson,and seconded by McKay,to appoint Alder- man Henry Kehe Mayor pro tem. The Clerk put the question, and he called the roll with the following result: Ayes: Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe, Baines, Harm, McKay, Halverson and Morava. Nays: None. The Clerk thereupon declared the motion carried, and Alderman Kehe took the chair. COMMITTEE REPORTS. Alderman Halverson reported that the Sewer Committee desired to defer action on the second reading of the Relief Sewer Ordinance to January 17, 1949. The committee decided to hold three. public meetings on Janu- ary 10, 11, and 12. The committee intends to send post cards to the three water districts, informing these individuals about the meetings. The motion was made by Alderman Halverson, and seconded by McKay, to defer action on the second reading of the Relief Sewer Ordinance until January 17, 1949. The motion was voted upon by acclamation, whereupon the Mayor pro tem declared the motion carried. REZONING APPLICATION * GOLF & MOUNT PROSPECT ROAD. The rezoning appli- cation of Frank Zeimet had previously been referred to City Attorney, Frank Opeka. The attorney said that this application should be referred to the Zoning Board of Appeals, and he would then take action with that board. The motion was made by Hansen, and seconded by Harm, to refer the rezoning application to the Zoning Board of Appeals sitting as a Commission. Des Plaines, Illinois December 8, 1948 Dear Mr. Fletcher: In compliance with your request, Sanitary District Sewer Permit No.1948-57 has been issued to the City of Des Plaines, to cover the construction of a storm sewer system to serve the Des Plaines Veterans' Housing Subdivision, Des Plaines, Illinois. Three copies of the permit are enclosed, and it is requested thatthe permit be duly accepted by the City Council and the copy stamped "The Sanitary District of Chicago" be properly signed and returned to this office. The Clerk read the following letter: CITY -MFT Des Plaines Improvement Resolution Mr. Otto W. J. Henrich City Clerk Des Plaines, Illinois Dear Sir: December 8, 1948 The resolution for Section 13-C.S. adopted by the City Council at its meeting November 1, 1948 was approved today. This resolution provides for the improvement of 970 feet of Prairie Ave- nue (Arterial Street No. 15) from Lee Street to Laurel Avenue by widening the existing 20 foot pavement to 36 feet with portland cement concrete pavement, resurfacing the existing pavement with an asphalt surface and the construction of concrete curb and gutter. This work is to be done by contract and $27,000.00 is appropriated from motor fuel tax funds for construction. The Clerk then read the following letter: December 13th, 1948 Des Plaines City Council Mr. Otto Henrich, City Clerk Des Plaines, Illinois Dear Sirs: You will no doubt recall action taken on several items recently recommended to you by the Des Plaines Safety Council for your consideration and action. The Safety Council at its meeting of December 7th received a report that its recommendation of September 14th, pertaining to furnishing bicycles with Scotchlight tape markers for better safety of riders and making it easier for drivers to see bicycles, too many of which have poor or no reflectors on rear, was deemed not practical due, we understood, to cost. DES PLAINES SAFETY COUNCIL LETTER, CONT'D. After some discussion on the report the Council instructed the secre- tary to write to the City Council and ask that its action on the matter be recon- sidered. It is the opinion of the Safety Council that license fees, if all bicycles are registered as required by law, should be sufficient to cover costs of furnishing tape needed; if not, it might be advisable in the interest of increased safety to increase the cost of license for bicycles, license and registration being good insurance in several ways should be worth more than twenty-five cents. However, costs or increase are left to your consideration and opinion. It is your aim and that of the Safety Council to make Des Plaines a safe city, and one of the various hazzards wehave is the use of bicycles poorly marked and carelessly ridden --that is, riding two or three abreast, waving or carrying another youngster on the handle bars. Use of the tape will, the council believes, be a much better marker than the reflectors now in use. You will, we are confident, agree that one accident avoided -by use of a better reflector would more than offset any small increase in the cost of furnishing tape. Walter Pflughaupt, Mayor City of Des Plaines City Hall Des Plaines, Illinois December 10, 1948 Dear Sir: The West Side Civic Association wishes to call to your attention the apparently illegal use currently being made of certain property lying within the City of Des Plaines in an area which is classified by a City Ordinance as a "residential district, Area District A." /7s WEST DES PLAINES CIVIC ASSOCIATION LETTER, CONT'D. The area in question is that portion of the property owned by the Chicago and Northwestern Railroad and presently occupied by the Meyer Coal and Material Company, which property lies immediately north of Thacker Street between the West Wye track of the Chicago and Northwestern Railroad and the main line right of way of the so-called Des Plaines Valley Company. This particular property is a part of that area of land which was classified as residential district, Area District. A, by an ordinance of the City of Des Plaines, dated September 8, 1942. It is the belief of this Association that the present use of the area in question by the Meyer Coal and Material Company as a building material yard was instituted subsequent to this classification, and as far as the Board has been able to determine, there is no public record of any official act or acts relating to the beginning of this use of the property in question. Inview of these facts, it is the opinion of the West Side Civic Association that the present use has been, and still continues to be, illegal. Since the powers granted to the corporate authorities in each municipality in the State of Illinois, under Article 73 of the Illinois Revised Statutes, are characterized in that Article as having been granted "To the end that adequate light, pure air, and safety from fire and other dangers may be secured; that the taxable value of land and building throughout the municipality may be conserved, that congestion in the public streets may be lessened or avoided, and that the public health, safety, comfort, morale, and welfare may otherwise be promoted," the West Side Civic Association hereby requests that immediate steps be taken by you, as the properly constituted authority, to bring about the termination of this violation of an existing zoning ordinance as outlined above, and that such penalties be assessed without compromise as by law required. We have reached the stage in this project where we would like to ask the constituted authority of Des Plaines for an indication of their reaction to this matter. In view of the fact that you are considering the matter of furnishing water to the Grove Avenue area, the Hawthorne Lane Civic Improvement Association would like to add their request for water to that of their neighbors. We should like to hear under what precise conditions the City of Des Plaines will be willing to furnish water to our area.
