11081948APPROVAL OF MINUTES. The motion was made by Alderman Halverson, and seconded by Johnson, to approve the minutes of the October 18, 1948 meeting. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. ADJOURN MEETING TO MONDAY, NOVEMBER 8, 1948. The Mayor informed the Coucil that he would like the Council meeting adjourned to nex Monday. The motion was then made by Alderman Halverson, and seconded by Kehe, to adjourn the meeting to Monday, November 8, 1948, at 8:00 P.M. HENRICH CITY CLERK /s7 MINUTES OF THE ADJOURNED MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY, NOVEMBER 8, 1948, AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor G. Walter Pflughaupt who presided with Aldermen Hansen,,Vavrinek, Kehe, Baines, Harm, McKay, Halverson, and Morava responding to roll call. J°H °s' City Attorney Opeka reported attending the meeting regarding the Nebel Trailer Park and said.they would meet again in two weeks and all attorneys interested are to be notified of this meeting. COMMITTEE REPORTS. Alderman Kehe, chairman of the Finance Committee, reported that the letter from H. Talcott for a Quit Claim Deed had been referred to their Committee and they recommended that the City Attorney prepare an Ordinance and Quit Claim Deed and submit same at the next regular meeting. The motion was made by Alderman Kehe and seconded by Harm to concur in the report. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. Alderman Wolf made his appearance at this time. PASS ORDINANCE FOR SALE AND ASSIGNMENT OF CERTAIN JUDGELENT LIENS. The Clerk read for second reading tie following proposed ordinance entitled: AN ORDINANCE FOR THE SALE AND ASSIGNMENT OF CERTAIN JUDGEMENT LIENS FOR CERTAIN OVER -DUE AND UNPAID INSTALLIyiENTS OF CERTAIN SPECIAL ASSESSMENTS HELD BY THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS. * * * The motion was made by Alderman Kehe and seconded by Harm to pass the proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe, Baines, Harm, McKay, Halverson, and Morava. Nays: None. The Mayor thereupon declared the motion carried and the proposed ordinance.passed. ADOPT PLATS OF DES PLAINES COUNTRYSIDE NO. 3 & NO. 4. The City Clerk presented two plats which the P,an Commission had approved and the Municipal Development Committee had studied before the Council meeting. -Alderman McKay then made the motion which was seconded by Alderman Hansen to approve the plats of Des Plaines Countryside No. 3 and No. 4. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. CONSOER, TOWNSEND,& ASSOCIATION CONSULTING ENGINEERS CONTRACT. Alderman c�N.fy .,_�,� Halverson, Chairman of the Water and Sewer Committee, informed the Council that the ,,. Ca„megTownsend and Associates consulting engineers regarding the relief sewers and would like the Clerk to read the contract. The Clerk read the following contract: ' CONTRACT FOR ENGIMERING SERVICES BETWEEN THE CITY OF DES PLAINES, ILLINOIS AND CONSOER, TOWNSEND & ASSOCIATES CONSULTING ENGINEERS CONTRACT, CONT'D. THIS AGREEMENT, made and entered into this 8th day of November, 1948, by and between the CITY OF DES PLAINES, acting through its Council, hereinafter called the CITY, and CONSOER, TOWNSEND AND ASSOCIATES, a co -partnership of Chicago, Illinois, hereinafter referred to as the CONSULTING ENGINEERS, WITNESSETH: That, WHEREAS, the C ity is contemplating the construction and installation of a city-wide system of relief sewers, and WHEREAS, the City has heretofore entered into a contract with its City Engineer to prepare reports, estimates, plans, specifications, and to supervise the cons- truction of aaid relief sewers, and WHEREAS, the City has hertofore entered into a contract with Barcus Kindred & Company and Edward Benjamin as agents for the financing of the said improvement, and WHEREAS, the City has deemed it advisable to retain consulting engineers for the purpose of assisting the City Engineer and the Financial agents in their duties of bringing said improvement to:a successful conclusion, and WHEREAS, the Consulting Engineers are qualified and experienced in the design and construction of relief sewers and the financing thereof, NOW, THEREFORE, in consideration of certain amounts hereinafter specified to be paid to the Consulting Engineers by the City, the Consulting Engineers agree to do, at their own cost and expense, all the engineering work hereinafter specified, to the full satisfaction of the City, and in compliance with the legal requirements of the statutes of the State of Illinois. DIVISION "A" - SERVICES PRIOR TO SUCCESSFUL BOND ORDINANCE Specif:scally, under Division "A", the Consulting Engineers shall: 1. Make a thorough study of the preliminary report, including Preliminary Plans and Specifications included in said Report, to be prepared by the City Engineer, checking the engineering designs, the need for the various units of the proposed project, the estimated cost of the project, and make such recommendations as this study refteals; 2. Make a thorough study of the financial report to be prepared by the financial agents, checking the financial feasibility of the project, and make such recommendations as the study reveals; 3. Make available to the City Engineer the Consulting Engineers' standard specifications for construction work on this type of improvement; 4. Assist the City Attorney in the preparation of the revenue bond ordinance; 5. Assist the City in the formulation and execution of a publicity campaign to familiarize the electors with the features of the project. It isunderstood that there will be made available to the Consulting Engineers all engineering information heretofore and hereafter obtained and compiled by the City Engineer and other City servants. It is further understood that the Consulting Engineers will make no charge for the services outlined under Division "A", the consideration being included in the chargefor services under Division " B " as hereinafter described. DIVISION "B" - SERVICES SUBSEQUENTTO SUCCESSFUL BOND ORDINANCE. Under this division the Consulting Engineers shall thoroughly check all designs, construction plans and specifications prepared or to be prepared by the City En- gineer, recommending changes and additions thereto to be made by him. In addition, the Consulting Engineers shall: 1. Make available to the City Engineer copies of their standard construction specifications, and other construction contract document standards, and will assist the City attorney in the preparation of bond forms and constrution contract documents; 2. Assist the City Engineer to interpret the results of soil investigations to be made iby the City; 3. Prepare financial forecasts as may be required by bond counsel; /J-9 CONTRACT, CONT'D. 4. Assist the City in publicizing construction contract lettings, and in interesting qualified bidders in the construction work;. 5. Attend construction bid openings, and assist the City in the evaluation of bids; 6. Attend conferences with City officials from time to time during the planning of thevork; 7. Assist the City Engineer during the construction period to the extent 1111 of giving technical advice to meet situationsnot contemplated in the design and planning of the project. • 1 There shall—be paid to the Consulting Engineers in consideration of the services hereinabove set forth a sum equal to one per cent (1%) of the awarded construction contract value of the work, payable as construction contracts are awarded. It is understood and agreed that if no bond ordinance becomes successful within three (3) years after the date hereof, this contract shall cease to be in effect, and no chagre shall be made for the services outlined under Division "A" hereof. If is further understood and agreed that should the City decide to abandon parts of the program after plans and specifications for such parts have been prepared by the City Engineer and checked by the Consulting Engineers, and after successful passage of a bond ordinance, then the payent to the Consulting Engineers shall be calculated upon the estimated construction cost of said abandoned parts of the work, as prepared by the City Engineer and concurred in by the Consulting Engineers. It is further understood and agreed that the Consulting Engineers may terminate this contract upon thirty -(30) days' notice to the City in the event that recommendations made by the Consulting Engineers are not followed by the City, resulting in harm, in the opinion of the Consulting Engineers, to the projedt and to the reputation ' of the Consulting Engineers. In this event, the City shall pay to the Consulting Engineers a sum equal to the actual engineering payroll expense up to the time of notice, plus fifty (50) per cent thereof to pay the cost of non—engineering payroll, -maintenance of offices, taxes, and other overhead, plus twentyfive (25) per cent of said engineering payroll expense for partners' compensation and -profit. For the purposes of verifying this charge, the payroll records of the Consulting Engineers will be made available to authorized representatives of the City. It is understood and agreed that the City will appropriate the necessary funds to over the services set forth in this agreement immediately upon successfuly passage of a bond ordinance. * * * * * * 3* IN WITNESS WHEREOF, the parties hereto have set their hands and seals upon the date first above mentioned. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. TRAFFIC HAZARD AT ALGONQUIN AND LEE. Alderman Baines reported of the traffic hazard at Algonquin Road and Lee Street. He said a tree and sign obstructed the view of motorists. The Mayor referred this to the Traffic Commission for study. Alderman Wolf said their should be a larger sign about at the "S" curve at Oakton and Mannheim Rd. Also a line painted on curve. The Mayor referred this to the Traffic Commission. MAC NEVIN MOTOR SALES, INC. SIGN. Building Inspector Scharringhausen reported that representatives from the MacNevin Motor Sales, Inc. were present and would like permission to present plans for a large sign on their building at Lee and Oakwood. After study by the Council the motion was made by Alderman Kehe and seconded by Halverson to perhit the erection of the sign requested. HEHRICH, CITY CLERK MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN -THE COUNCIL CHAMBERS, MONDAY, NOVEMBER 15, 1948 AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor G. Walter Pflughaupt who presided with Aldermen Johnson, Hansen, Vavrinek, Kehe, Baines, McKay, Halverson, and Morava responding to roll call. Alderman Harm was absent. OFFICIAL REPORTS. The City Clerk submitted the report of Treasurer H. J. Ahbe for the month of October. COMMITTEE REPORTS. Alderman Johnson, Chairman of the Public Protection Committee,reported the following on traffic hazard on Willow and Harding Avenues: That the Chief of Police has installed barricade at these intersections for a 90 day trial and the Traffic Commission will made a recommendation at a later date. The motion was made by Alderman Johnson and seconded by Hansen to concur in the report. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. Alderman McKay reported the Municipal Development Committee has studied the plat of Mr. Liedberg for vacating one street and dedicating another street. On Alderman McKays suggestion the Mayor declared a recess to allow the Council to study the plat. After reconvening the motion was made by Alderman McKay and seconded by Morava to approve the vacating of River Drive and dedicating another piece of land for a new River Drive as shwon on the plat with the agreement of Attorney K. Meyer to produce separate plats for vacating and dedicating River Drive showing set—back lines which plats will: be satisfactory to City Attorney Opeka. The motion was voted upon by acclamation, whereupon the Mayor declared the motion carried. Alderman Wolf made his appearance at this time. TRAFFIC: COMMISSION LET"'ER FOR SPECIAL POLICE AT PROSPECT AND MANNHEIM RDS. The Clerk read the following letter: November 15, 1948 Mr. Otto W. J. Henrich City Clerk Municipal Building Dew Plaines, Illinois Dear Mr. Henrich: We recommend that the City Council place a civilian guard with special Alice power at the intersection of Prospect and Mannheim during such hours as are necessary to protect the school children when going to and from school at that location, and that in their 1949 appropriation they provide for one or more similar assistants to the piice department for this purpose.
