The Mayor thereupon declared the motion carried, the rules suspended, and the proposed
ordinance before the Council for final passage. The motion was made by Alderman
Johnson, and seconded by Hansen, to pass the proposed ordinance. After discussion,
the Mayor put the question, and the Clerk called the roll with the following result:
Ayes: Aldermen Johnson, Hansen, and Morava. Nays: Alderman Vavrinek, Wolf, Kehe,
Baines, Harm, McKay, and Halverson. The Mayor thereupon declared the motion lost.
The motion was made by Alderman Johnson, and seconded by McKay, that
the City Attorney, Opeka, draft a new ordinance changing the license fee to thirty-
five (35¢) cents per seat. The Mayor being unable to decide on the voice vote in-
structed the Clerk to call the roll with the following result: Ayes: Aldermen
Johnson, Hansen, Vavrinek, Kehe, McKay, Halverson, and Morava. Nays: Aldermen Wolf,
Baines, and Harm. The Mayor thereupon declared the motion carried.
The City Attorney drafted the new ordinance which the Clerk read for
first reading. The motion was made by Alderman Johnson, and seconded by Hansen, to
suspend the rules and pass the proposed ordinance. The Mayor put the question, and
the Clerk called the roll with the following result: Ayes: Aldermen Johnson, Hansen,
Vavrinek, Kehe, Baines, Harm, McKay, Halverson, and Morava. Nays: Wolf. The Mayor
thereupon declared the motion carried, rules suspended, the ordinance before the
Council for final passage. The motion was made by Alderman Johnson, and seconded by
Hansen, to pass the proposed ordinance. The Mayor put the question, and the Clerk
called the roll with the following result: Ayes: Aldermen Johnson, Hansen, Vavrinek,

seconded by Hansen, to approve the minutes of the regular meeting of February 2, 1948,
and the adjourned meeting of February 9, 1948. The motion was voted upon by acclama-
tion, whereupon the Mayor declared the motion carried.

CALL TO ORDER. The meeting was called to order by Mayor G. Walter
Pflughaupt, who presided with Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe, Baines,
McKay, and Morava responding to roll call. Alderman Halverson and Harm were absent
due to illness.
REPORTS OF OFFICIALS. The Clerk submitted the reports of Building
Inspector Frank Scharringhausen and Electrical Inspector Arthur Rieck. The Clerk
also gave the report of the cash receipts for February.
ILLINOIS COMMERCE COMMISSION HEARING. The Clerk read the notice of
the hearing on Middle States Telephone Company's application of increase in rates.
City Attorney Opeka informed the Mayor he had received notice.
FOUR-WAY STOP SIGNS. City Engineer Fletcher reported of a meeting with
Mr. Arnold of the State Highway Department regarding the four-way stop signs at three
street crossings. Alderman Johnson then made the motion,which was seconded by Hansen,
that the Clerk write a letter to the State Highway Department requesting the four-way
stop signs at Touhy and Manheim and Algonquin and Lee Streets. And also four-way stop
and go lights at Lee and Prairie. The motion was voted upon by acclamation, whereupon
the Mayor declared the motion carried.
JUNIOR LEAGUE TAG DAY REQUEST FOR BABY CLINIC. The Clerk read the

The existence of a large pool of water in the rear of the 1900 block
on Illinois Street has been brought to ply attention. Upon investigation, I found it
to be a most dangerous hazard. The water is several feet deep.
The property where this is situated belongs to Wm. L. Kunkel & Co.,'
716 Lee Street, Des Plaines, Illinois.
Mr. Kunkel knows about this matter and has been requested to take
steps to abate this dangerous nuisance.
The inclosed pictures show the real menace and danger to the
children living in this area.

MRS. WILLER'S LETTER, CONT'D.
Mr. H. J. Ahbe, representing William Kunkel, informed the Council that
the hole would be filled or a fence placed around the section. He said that the
black soil had been removed by someone to landscape without permission.
PARKING FOR PHYSICIANS IN BANK BUILDING. The motion was made by Alder-
man Wolf, and seconded by Vavrinek, that the City in furnishing parking meters would
reserve a place for physicians in the Bank Building. After discussion, Alderman
Johnson made the motion,which was seconded by Kehe, to refer the matter to the
council as a committee of the whole. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
ADVERTISE BIDS FOR NEW GARBAGE TRUCK. The motion was made by Alderman
Vavrinek, and seconded by Morava, that the City Clerk advertise for bids for a new
garbage truck. The motion was voted upon by acclamation, whereupon the Mayor de-
clared the motion carried.
ADVERTISE BIDS FOR NEW SQUAD CAR. The motion was made by Alderman
Johnson, and seconded by Hansen, that the City Clerk advertise for bids for a new
squad car. The motion'was voted upon by acclamation, whereupon the Mayor declared
the motion carried.
MISS BENNETT'S BUILDING FOUNDATIONS. The Mayor informed the Council
that Miss Bennett had not completed her buildings. The Mayor then requested that
the following motion be made: that the City Clerk write to Miss Bennett informing
her to either complete the buildings or proceed to place floors on the foundations
to cover the excavations. The motion was made by Alderman Morava, and seconded by
McKay. The motion was voted upon by acclamation, whereupon the Mayor declared the
motion carried.

Alderman Johnson reported on complaint regarding the connection of
the catch basin on Golf Road to Cumberland sewer. City Engineer Fletcher said the
State Highway Department ordered the City Superintendent of Public Works to make this
connection. Alderman Johnson requested the Mayor to have the City Clerk write to the
Cumberland Maintenance Corporation, informing them of the facts. The motion was then
made by Alderman Johnson, and seconded by McKay, that the matter of disconnecting
the catch basin on Golf Road between Third and Fourth Avenues from the Cumberland
sewer be referred to the Sewer Committee. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
DES PLAINES AVENUE CROSSING TO BE REPLACED WITH CONCRETE SLABS. City
Engineer Fletcher said that the C. & N. W. Railway had in their budget the placing
of concrete slabs at the Des Plaines Avenue crossing. Mr. Fletcher asked the City
Clerk to write to the County Highway Department regarding this project.

REPORTS OF OFFICIALS. The Clerk submitted the report of the City
Treasurer, H. J. Ahbe, for the month of February. The Clerk read the following
report of City Attorney, Frank M. Opeka:

Pursuant to your request I attended the hearing in which the Middle
States Telephone Company made application for an increase in rates. The hearing
was held at Springfield on March 3rd, 1948 before Commissioners Helander and Wood.
The Telephone Company presented its case in full. I asked only
such. questions as were pertinent at the moment and reserved the right to further
cross examine upon its next hearing, which was set for April 14th at Chicago.
The Telephone. Company produced some 37 exhibits which went into the
record to establish their need for an increase as well as to inform the Commerce
Commission of their future plans. One of the exhibits in particular is of interest
since it reflects the amount of the earnings over a period of five years.
The net operating income in the year 1947 amounted to $152,904
represented by 18,165 telephones. The years 1944 and 1945 show a progressive
drop, in the net income. The year 1946 shows a net income of $183,991 but the
1947 net income is $106,624 based on 22,319 telephones. The total operating
revenues for the year 1947 amounted. to $1,135,048. Another exhibit that tends to
show the return on their revenue, if the new rates are given, would show that
there would be a net return of between 3.3% and 4.9%.
The difference in the return on the investment is predicated on
four methods at arriving at the net return, but in every instance the figures are
predicated upon the increased income if granted by the commission.
It was admitted by the Vice President in charge that the service
was not what they want to render but that it has improved and every effort will
be made to give better service. He also advised the commission that dial phones
will be installed and in operation by 1950 and that the service therefore will be
very good.

They require this increase in order that they may finance the cost
of new buildings, and the installation of a dial system. The contemplated expendi-
tures for Des Plaines and Park Ridge amounts to $2,738,163. They contend that if
they are to be successful in procuring finances for these improvements, it will be
necessary to show an earning statement which will indicate their ability to repay
such financing.
The various exhibits are available .for your inspection at any time
that you may wish to examine them and they shall be retained in my files.
I would appreciate it very much if you will advise me as to what
future action to take in this regard.

The full committee was present at this hearing, viz. Aldermen Johnson,
Hansen, and McKay and also Alderman Wolf and Mayor. Pflughaupt.
The City of Des Plaines was granted 10 days in which to state its
position on this application, and the petitioners were granted equal time to correct
a faulty petition it desired to, submit in favor of the reclassification.
Your Committee has met and considered the matter and hereby submits
the following recommendation for concurrence:
That the City Council of the City of Des Plaines
objects to the reclassification of the property
under consideration from an F (Farming) District
to a B-2 (Business, Tavern & Amusement) District.

That the City has no objection to a reclassifi-
cation of the property from an F (Farming)
District to a B-1 (Business) District, if the
petitioners should decide to amend their petition
accordingly, or if the Board of Appeals has the

Mayor and City Clerk be sent to the County Clerk,
Chairman of the Zoning Board of Appeals of Cook
County, and to Mr. Harvey M. Adams, Justice of
the Peace, Arlington Heights, the latter having
appeared as representative for the petitioners
at this hearing.

Thursday, March 11, 1948, my nine and a half year old daughter fell
in an excavation in the 1000 block on Prairie Avenue as she was coming home from
:illschool. She cut her head on the concrete foundation so as to require stitches and
a tetanus shot. This excavation has stood as a menace to school children fortwo years.
I have been to an expense for Dr. fees as well as having my daughter's face scarred.
I want the City to look into this and see if the owner has insurance and is bonded
for such emergencies as I would rather have this settled without having to turn it
over to my attorney.

tion in two weeks, or provide suitable protection around the foundations, until the

Gentlemen:
Our agreement with the City permitting us to engage in a light manufactur-
ing business in a commercial zone will expire on April 30, 1948. We request an exten-
sion of another 'year under the same terms and conditions as embodied in the existing
agreement. The reasons for this request are as follows:
We are still owners of some land onsBusse Highway }sear the intersection
of Mason Lane. We have had various estimates made of the cost of constructing a plant
and we'find that the costs remain prohibitive and that there still is a scarcity of
materials. The circumstances do not warrant construction at this time. '
We have, however, looked around and found a suitable place, properly
zoned,'for our activities. However, the place, which is located in Des Plaines, will
not be'available for our use until sometime in March of next year. We have made
arrangements to take this space, and with that as a primary reason for requesting
this extension, you have our assurance that we are conforming in every way with the
ordinance of this City and are making every effort not to disturb any of our neigh-
bors and keeping noise down to a minimum. '

GENTLEMEN:
Application is hereby made for a change in the zoning classification
of premises located in the City of Des Plaines, Cook County, Illinois, owned by the
Chicago'and North Western Railway Company and described as follows:
"That part of the West Half of the Southeast Quarter of Section 18,
described by beginning at a point on the West line of said West Half of the South-
east Quarter of Section 18, which is 850 feet south of the Northwest corner thereof;
thence running East on a line parallel with and distant 850 feet southerly from the
North line of said West Half of the Southeast Quarter of Section 18, a distance of
five hundred twenty-three feet, more or less, to the west Right of Way line of
Wolf Road; thence running southeasterly along the said Right of Way line of Wolf Road
five hundred feet, more or less, to the southeasterly Right of Way line of the main
line Right of Way of the Chicago and North Western Railway Company's Des Plaines
Valley Line; thence running along said southeasterly Right of Way line in a southerly
and westerly direction to the center line of Thacker Avenue; thence'running west
along the center line of Thacker Avenue to the west line of said West Half ofthe
Southeast Quarter of Section 18; thence running North along the West Line of said
West Half of the Southeast Quarter of Section 18 to the place of beginning." Except
that part of extra width right-of-way of Railroad Company located easterly of the
•main track of the Des Plaines Valley Line cross -hatched in black ink, consisting
of a strip 680 foot long by 50 feet wide beginning at the center line of Thacker Street
and running in a northeasterly direction 680 feet.
illThis tract of land totalling approximately 18.2 acres, was originally
classified as "Resident District, Area District A". In 1937, upon application of
the Chicago and North Western Railway Company, this area along with an additional 43.8
acres located to the east north, and west was reclassified to "Industrial District,
Area District C". The City Council, after considering the recommendation of the
Zoning Board of Appeals, expressed the belief that the highestand best use for said
land is for industrial purposes.
In 1942 the total area referred to in the preceding paragraph
(62.0 acres) was again reclassified from "Industrial District, Area District C"
back to "Residence District, Area District A" upon petition, we understand, of
dwelling house owners to the north. The Chicago and North Western RAilway Company,
the sole owner of this large tract of land, was not advised of the proposed change
of zoning, except by notice in a local newspaper. Such notice to a non-resident,
is, of course, inadequate, and the Railway Company was not represented at the Hear-
ing, and had no knowledge of the changed zoning until 1946.
In 1942 the area included in this petition had a railroad running
along the southeasterly side, another railroad running along the westerly side,
farm lands on the north, and numerous switch tracks on the east, and was partially
occupied by two coal yards and a bulk oil station. The same conditions prevail today.
This application is for a change in the zoning to "Industrial District A,I,ight
Manufacturing, Area District C" and the area will be used in connection with the expan-
sion needs of the existing industries located thereon.
In order to protect the residence development to the north, the northerly
eight hundred fifty feet of the Railway Company owned strip located between Wolf Road
and the railroad.on.the west has been eliminated in this application.
A,map is attached hereto showing in solid yellow color the premises
covered by this application, and there is also enclosed a voucher in the amount of $35.00
in favor of the City of Des Plaines to cover the costs of printing, publication, etc., as
required by your City.
I will appreciate it if you will arrange for a Hearing and advise me when
the Hearing is.to take place, in order that we may be represented.

REZONING APPLICATION, CONT'D.
The motion was made by Alderman Halverson, and seconded by McKay, to
refer the application to the Zoning Board of Appeals. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
MAYOR PFLUGHAUPT informed the Council that City Engineer, E. N. Fletcher,
was out of town, due to the death of his sister. Mayor Pflughaupt also stated that the
Council would meet as a Board of Local Improvements in the Mayor's Office, Monday,
March 22, 1948.
ALDERMAN HARM reported about the parking and signs (regarding parking
at Prairie and. Second Avenue). The Mayor asked the chairman. of the Public Protection
Committee to have this situation checked. Alderman Harm also reported on the mud.
holes at the bus -stand on Ellinwood Street and other holes in the various streets. --
The Mayor informed the Alderman that plans are being made for the repair of all
streets damaged by the winter weather. The motion was made by Alderman Wolf,and
seconded by McKay, that the City Clerk write the Motor Coach Company in regard to
placing some crushed stone in the mud hole at the bus stand.
APPROVAL OF MINUTES. The motion was made by Alderman Hansen, and
seconded by Johnson, to approve the minutes of the regular meeting of March 1, 1948.
The motion was voted upon by acclamation, whereupon the Mayor declared the motion
carried.
ADJOURNMENT. .The motion was made by Alderman Vavrinek, and seconded
by Baines, to adjourn. The motion was voted upon by acclamtion, whereupon the Mayor
declared the motion carried, and the meeting regularly adjourned.
