CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS, MONDAY
EVENING, JANUARY 5, 1948 AT 8:30 P.M.
CALL TO ORDER. The meeting was called to order by Mayor G. Walter
Pflughaupt, who presided with Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe, Baines,
Harm, McKay, Halverson, and Morava responding to roll call.
OFFICIAL REPORTS. The City Clerk submitted the monthly and annual
reports of Building Inspector, Frank Scharringhausen; Electrical Inspector, Art Rieck;
and City Clerk's report of receipts for December.
COMMITTEE REPORTS. Alderman Halverson reported the following on the
request of City water from Town Development Company:
"That due to the distance from the City Limit mains, and
due to the near capacity of our present softening plant,
we, your committee on water, therefore recommend that the
application for water be denied."
The motion was then made by Alderman Halverson, and seconded by
Vavrinek, to concur in the report. The motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried. The Mayor instructed the Clerk to notify
the Town Development Company of action taken.
--Alderman Halverson also reported that the roof on the Cater Well
had been repaired.
Alderman McKay, Chairman of the Municipal Development Committee,
reported the following on the letter from Cumberland Maintenance Corporation on
Section 16, Zoning Ordinance 5 foot setback:
"Your Committee on Municipal Development met on December 22, with
Mr. A. James representing the Cumberland Maintenance Corporation. It developed
that the corporation wanted to prevent the possibility of 5 foot setbacks on the
south side of Golf Road adjacent to Broadway, where a greater setback has already
been established. City Attorney Opeka, who was present, suggested that Mr. James
have the Cumberland Maintenance Corporation submit specific petition to the Council,
asking for amendment to protect the situation. Mn James agreed to convey this advice
to the organization mentioned." -Your Municipal Development Committee therefore recom-
mends concurrence in the above report, and the City Clerk to reply to' letter from
Cumberland Maintenan'`ce Corporation dated November 20, 1947, advising -them of action
taken as above outlined.
The 'motion was then made by Alderman McKay, and seconded•by Johnson,
to concur in the report. The motion was voted upon by acclamation, whereupon the
Mayor declared the motion carried.

Pursuant to law, your Zoning Board of Appeals, sitting as a Commission,
held a public meeting on Monday, December 22, 1947 at 8:45 p.m. in the Council Chambers,
Municipal Building, Des Plaines for the purpose of considering the following:
Amending the Zoning ordinance as recommended by the Aviation Committee of the City of
Des Plaines, regulating maximum building heights, as well as other structures that may
be erected in the future, with relation to possible hazards in connection with opera-
tion of aircraft flights to and from Orchard Place Chicago airport.
This recommendation was brought about by the Building Inspector,
Mr. Frank Scharringhausen relative to improvements that are about to be made at the
Orchard Place Chicago airport.
It is the recommendation of your Zoning Board of Appeals that you
follow the recommendation of the Aviation Committee of the City of Des Plaines,
County of Cook, State of Illinois.

Commission, held a public hearing Monday, December 22, 1947 in the Council Chambers,
concerning the rezoning of the following described property --

The object of this meeting was to reclassify the above legally des-
cribed property from Industrial District "l" to Residential Class "A" single family
dwellings. Your Zoning Board gave all parties present an opportunity to talk on
this proposed change in classification and we would like to point out that there was
only one property holder present who represented the side on the proposed change.
After careful consideration of the testimony given, your Zoning Board
came to the conclusion that the present classification would not affect the safety,
morals or well being of the neighborhood.
Therefore, your Zoning Board recommends that the petition to reclassify
the property be denied.
However, we would like to point out that one point did come up in the
general discussion, and that is clarification of our industrial classification as to
the distinction between light and heavy industry. The general feeling seems to be
if this property had been designated as light industry, that it would have had a more
desirable effect on the residents in the immediate vicinity of this property.

The motion was then made by Alderman Kehe, and seconded by Johnson,
to adopt the proposed resolution. The Mayor put the question. Alderman Kehe had
informed the Council that the entire Committee had not signed the reeolution. Alder-
man Harm said that he had not signed the resolution because he had had no opportunity
to check the bills -=and did not know what he was signing. The Clerk balled the roll
with the following result: Ayes: Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe,
Baines, McKay, Halverson, and Morava. Nays: None. Passed vote: Alderman Harm.
The Mayor thereupon declared the motion carried and said reeolution adopted.
TO ADVERTISE FOR BIDS OF NEW AUTO FOR WATER DEPARTMENT. Alderman
Halverson made the motion (seconded by Vavrine:k that the City Clerk advertise bids
for :few auto for the Water Department. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
LETTER FROM BOARD OF TRUSTEES FIREMEN PENSION FUND.

December 29, 1947.
Pursuant to Section 12 of " An Act to Create a Firemen's Pension Fund
in Cities, Incorporated Towns, Villages and Townships having a population of not less
than 5,000 nor more than 200,000 inhabitants and to repeal certain Acts therein named,"
as Amended, we herewith submit a report showing the amount necessary to be levied for
the year beginning January 1, 1948 and ending December 31, 1948. '
The Board of Trustees of the Firemen's Pension Fund of the City of
Des Plaines, Illinois; have determined and found that a reserve fund of $20,000.00
beestablishedas the minimum reserve to carry out the provisions of said Act above
mentioned.

deposits in approved savings and loan associations amount to $ 17,930.61

TWO REQUESTS FOR TAXICAB LICENSES. The Clerk read the following two
City Council

Des Plaines, Illinois
The latter part of October, 1947, I'made application for a Taxi license
to operate a Veteran Cab in Des Plaines.
At that time Irwin Pharr had left Des Plaines to operate a Flash Cab in
Chicago, and I assumed there would be a vacancy there after the first of the year.
The City Clerk wrote and said if I desired to, I could apply again the
first of the year. Since then, Mr. Pharr's license has been transferred to the Yellow
Cab Company , or at least that license evidently isn't vacant anymore.
In regard to Frank Pantano's Deluxe Cab license. He has two of them,
but only uses one license and one cab. Should Mr. Pantano ever give up one of those
licenses, I should like to apply for it, if the City Council would consider it.

I understand there is to be a taxi -cab license available. If there
is, I hereby make application for one.
Mr. Phar, one of the present licensed operators, has been using his cab
as a Chicago Flash dab for the past three months. Mr. Pantano holds two licenses,
but has only been operating one cab for the past three months. Thereby the public has
been denied the services of two cabs for quite some time.
In the event that I am granted the license, I will operate the cabs
in a businesslike manner and will give the public the very best of service.

HIGHWAY PERMIT. The Clerk informed the Council he had received a
Highway Permit from the State Department of Public Works regarding relocating a water
main arid the following resolution: Resolution:
WHEREAS, the City of Des Plaines located in the County of Cook, State
of Illinois, whishes to relocate and suspend an 8 inch insulated water main from the
floor of the bridge over the drainage ditch located on Rand Road between Dempster
Street and Thacker Street at Station 69 & 13 as shown on the white print attached
hereto and made a part of this permit. A hole shall be cut in each abutment without
dama:in: the structure. A sleeve shall be fitted to each hole and cemented in place.
The insulated water main shall be placed as close to the bottom of
the floor as possible. --Any future,changes in the bridge structure that would cause
THIS water main to be moved it shall be done by the City of Des Plaines at their
expense.

RESOLUTION, CONT'D.
WHICH by law comes under the jurisdiction and control of the Depart-
ment of Public Works and Buildings of the State of Illinois, and
WEEP AS, a permit from said Department is required before said work can
be legally undertaken by said City of Des Plaines now
THEREFORE, be it resolved by the City of Des Plaines County of Cook,
State of Illinois
FIRST: That we do hereby request from the Department of Public Works
and Buildings, State of Illinois, a permit authorizing the City of Des Plaines to
proceed with the work herein described.
SECOND: That we hereby pledge the good faith of the
CITY OF DES PLAINES
and guarantee that all work shall be performed in accordance with the conditions of
the permit to be granted by the Department of Public Works and Buildings of the State
of Illinois, and to hold the State of Illinois, Department of Public Works and Build-
ings, harmless on account of any damages that may occur to persons or property during
the prosecution of such work, and assume all liability for damages to persons or
property due to accidents.or otherwise by reason of the work which is to be performed

PASS 1242 APPROPRIATION ORDINANCE. The Clerk read for first reading
the proposed appropriation ordinance for 1948.
The motion was made by Alderman Baines, and seconded by Kehe, to suspend
the rules and pass the proposed ordinance. The Mayor put the question. Alderman McKay
inquired if it was necessary to pass the proposed ordinance at this meeting. The Mayor
informed the Alderman that there would be a payroll before the next meeting, and the
Clerk had to know what to pay the employees. Alderman.McKay suggested to hold it
over one week so that the public could see the ordinance. --The Mayor ordered the Clerk
to call the roll with the following result: Ayes: Aldermen Johnson, Hansen, Vavrinek,
Wolf, Kehe, Baines, Harm, Halverson, and Morava. Nays: Alderman McKay. The Mayor
thereupon declared the motioncarried,the rules suspended,the proposed ordinance before
the Council for final passage. The motion was made by Alderman Kehe, and seconded by
Vavrinek, to pass the proposed ordinance. The Mayor put the question. Alderman Harm
said he would vote for the proposed ordinance but wished to voice his protest to the
Municipal Band item, due to him having voted to again appropriate for a band at a
previous meeting. --The Clerk called the roll with the following result: Ayes:
Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe, Baines, Harm, Halverson, and Morava.
Nays: Alderman McKay. The Mayor thereupon declared the motion carried and the pro-
posed ordinance finally passed.
The motion was made by Alderman Wolf, and seconded by McKay, to publish
the ordinance in the Suburban Times. The motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried.
PASS SALARY ORDINANCE FOR 1948. The Clerk read for first reading the
following proposed ordinance entitled:

The motion was made by Alderman Kehe, and seconded by Baines, to sus-
pend the rules and pass the proposed ordinance. The Mayor put the question, and the
Clerk called the roll with the following result: Ayes: Aldermen Johnson, Hansen,
Vavrinek, Wolf, Kehe, Baines, Harm, McKay, Halverson, and Morava. Nays: None. The
Mayor thereupon declared the motion carried, the rules suspended, and the proposed
ordinance before the Council for final passage. The notion was made by Alderman Halverson,
and seconded by Morava, to pass the proposed ordinance. The Mayor put the question, and
the Clerk called the roll with the following result: Ayes: Aldermen Johnson, Hansen,

ELECTRICAL INSPECTOR A. RIECK RESIGNS. The Clerk read the following
resignation:
* The Mayor informed the Council he regretted to accept the resignation, but
that a motion was now in order. The motion was made by Alderman Kehe, and seconded
by Halverson, to accept the resignation. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
APPROVAL OF MINUTES. The motion was made by Alderman Wolf, and seconded
by Vavrinek, to approve the minutes of December 15, 1948. The motion was voted upon by
acclamation, whereupon the Mayor declared themotion carried.
The Mayor informed the Council that a Committee of the Chamber of
Commerce desired to meet with the Council Monday, January 12, 1948, to discuss the
Business Licenses.
ADJOURNMENT. The motion was made by Alderman Kehe, and seconded by
Morave to adjourn. The motion,was voted upon by acclamation, whereupon the Mayor
declared the motion carried and the Council regularly adjourned.

CALL TO ORDER. The meeting was called to order by Mayor G. Walter •
Pflughaupt, who presided with Aldermen Johnson, Hansen, Wolf, Vavrinek, Kehe, Baines,
McKay, Halverson, and Morava. (Alderman Harm was absent.)
OFFICIAL REPORTS. The City Clerk submitted the report of the Treasurer,
H. J. Ahbe for December, and the annual report of the Des Plaines Fire Department. The
Mayor commented on the Fire Department's report and requested the City Clerk to write
to the Fire Department, commending the report.
City Engineer, E. N. Fletcher, reported that he made up a report with
Superintendent E. R. Warnicke for the past year, and that a copy had been placed on
each official's desk.
City Attorney, Frank M. Opeka, reported the foreclosure on Homerican
Villas was nearly completed and that the subdivision would soon be back on the tax roll.
COMMITTEE REPORTS. Alderman Halverson reported on a large water leak
since last week. Th -hope to find this leak within the next few hours.
PUBLIC PROTECTION COMMITTEE. Alderman Johnson reported the following
on the "check up" of speeding on Northwest Highway at the Cumberland Station and also
reported on the removing of the white line on Bittersweet Court:
"Your committee on Public Protection referred the two
items mentioned to the Police Department. On item
No. 2, a check by two different officers found traffic
moving at a normal rate of speed. Their reports are
attached.
"Item No. 3, the white line on Bittersweet Court will
be removed as soon as the weather permits.
"We your committee on Public Protection, therefore
recommend that this report be made a matter of record,
and that the Safety Council be advised of the action
taken."

The motion was then made by Alderman Johnson, and seconded by Hansen,
to concur in the report. The :notion was voted upon by acclamation, whereupon the
Mayor declared the motion carried.
Alderman Johnson reported the following on parking meters:
"Your committee on Public Protection has investigated
the above and has found that in our opinion the Miller
Manual Parking Meter is, from the standpoint of depend-
able service and economical maintenance, the meter that
should be installed in Des Plaines.
"We, your committee on Public Protection, therefore
recommend that the Mayor and City Clerk be authorized
to enter into an agreement (having the approval of the
City Attorney) with the Duncan Meter Corporation,
Chicago,. Illinois, for the purchase of 400 meters,
more or less, at $79.50 per meter installed. Payment
for same to be made from parking meter receipts, 5
until fully paid for."

PASS 1948 APPROPRIATION ORDINANCE. The Clerk read for first reading
the proposed appropriation ordinance for 1948.
The motion was made by Alderman Baines, and seconded by Kehe, to suspend
the rules and pass the proposed ordinance. The Mayor put the question. Alderman McKay
inquired if it was necessary to pass the proposed ordinance at this meeting. The Mayor
informed the Alderman that there would be a payroll before the next meeting, and the
Clerk had to know what to pay the employees. Alderman.McKay suggested to hold it
over one week so that the public could see the ordinance. --The Mayor ordered the Clerk
to call the roll with the following result: Ayes: Aldermen Johnson, Hansen, Vavrinek,
Wolf, Kehe, Baines, Harm, Halverson, and Morava. Nays: Alderman iacKay. The Mayor
thereupon declared the motion osrried,the rules suspended,the proposed ordinance before
the Council for final passage. The motion was made by Alderman Kehe, and seconded by
Vavrinek, to pass the proposed ordinance. The Mayor put the question. Alderman Harm
said he would vote for the proposed ordinance but wished to voice his protest to the
Municipal Band item, due to him having voted to again appropriate for a band at a
previous meeting. --The Clerk called the roll with the following result: Ayes:
Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe, Baines, Harm, Halverson, and Morava.
Nays: Alderman McKay. The Mayor thereupon declared the motion carried and the pro-
posed ordinance finally passed.
The motion was made by Alderman Wolf, and seconded by McKay, to publish
the ordinance in the Suburban Times. The motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried.
PASS SALARY ORDINANCE FOR 1948. The Clerk read for first reading the
following proposed ordinance entitled:
AN ORDINANCE
DEFINING AND DESCRIBING THE SALARIES AND
COMPENSATION TO BE PAID TO THE MUNICIPAL
OFFICIALS AND EMPLOYEES OF THE CITY OF
DES PLAINES, ILLINOIS FOR THE FISCAL
YEAR, 1948.
The motion was made by Alderman Kehe, and seconded by Baines, to sus-
pend the rules and pass the proposed ordinance. The Mayor put the question, and the
Clerk called the roll with the following result: Ayes: Aldermen Johnson, Hansen,
Vavrinek, Wolf, Kehe, Baines, Harm, McKay, Halverson, and Morava. Nays: None. The
Mayor thereupon declared the motion carried, the rules suspended, and the proposed
ordinance before the Council for final passage. The notion was made by Alderman Halverson,
and seconded by Morava, to pass the proposed ordinance. The layor put the question, and
the Clerk called the roll with. the following result: Ayes: Aldermen Johnson, Hansen,
Vavrinek, Wolf, Kehe, Baines, Harm, ncKay, Halverson, and Morava. Nays: None. The
Mayor thereupon declared the motion carried and the proposed ordinance finally passed.
ELECTRICAL INSPECTOR A. RIECK RESIGNS. The Clerk read the following
resignation:
The Mayor informed the Council he regretted to accept the resignation, but
that a motion was now in order. The motion was made by Alderman Kehe, and seconded
by Halverson, to accept the resignation. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried.
APPROVAL OF MINUTES. -The motion was made by Alderman Wolf, and seconded
by Vavrinek, to approve the minutes of December 15, 1948. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
The Mayor informed the Council that a Committee of the Chamber of
Commerce desired to meet with the Council 'Monday, January 12, 1948, to discuss the
Business Licenses.
ADJOURNMENT. The motion was made by Alderman Kehe, and seconded by
Morave to adjourn. The motion,was voted upon by acclamation, whereupon the Mayor
declared the motion carried and the Council regularly adjourned.
