MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY, NOVEMBER 18, 1991 CALL TO ORDER: The regular meeting of the city Council of the city of Des Plaines, Illinois, was called to order by Mayor D. Michael Albrecht at a:05 P.M. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Monday, November 1a, 1991. ROLL CALL: Roll call indicated the following aldermen present: Childers, Christiansen, Healy, Schneck, Hardiman, Sarlo, Chiropolos, Haupt. Also present were: City Treasurer Fredricks, City Manager Asaro, City Comptroller Peters, Commissioner of Public Works Matula, Fire Chief Clark, Deputy Police Chief Randolph, Building Code & Enforcement Acting Director Moylan, Human Resources and Services Department Director Panouses, City Engineer Oakley, and City Attorney Kolman. PRAYER AND PLEDGE: MINUTES: BILLS PAYABLE: CONSULTING SERVICES/ GO BONDS: WATER RATE ADJUSTMENTS: The opening prayer was given by Pastor David Jones, First Presbyterian Church, followed by the Pledge of Allegiance to the Flag. Moved by Sarlo, seconded by Chiropolos, to approve minutes of regular meeting of the City Council held November 4, 1991, as published. Correction: Page Three, Paragraph Two, Line Six and Line Seven, delete the words "cost of $a4, 320, and." Following correction, motion declared carried. Moved by Schneck, seconded by Sarlo, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total: $4,336,491.29. Upon roll call, the vote was: AYES: a-Childers, Christiansen, Healy, Schneck, Hardiman, Sarlo, Chiropolos, Haupt NAYS: 0-None ABSENT: 0-None Motion declared carried. Moved by Schneck, seconded by Sarlo, to adopt recommendation of Finance Committee to accept proposal from Kane, McKenna and Associates, Inc., 150 N. Wacker Drive, Suite 1600, Chicago, IL 60606, to provide financial consulting/bond marketing services in the amount not-to-exceed $25,000; and accept proposal from Katten, Muchin & Zavis, 525 W. Monroe Street, Suite 1600, Chicago, IL 60606, to provide legal service as bond counsel in the amount not-to-exceed $6,500; for proposed $4. 95 million General Obligation Water System Bonds. Moved by Schneck, seconded by Sarlo, to adopt recommendation of Finance Committee to approve increase in City's water rate from $1.62/100 C.F. to $1.a2/100 C.F., effective January 1, 1992, and City Attorney be authorized to draft necessary ordinance. QUARTERLY REPORT: FENCE VARIATION/ 268 CORNELL: KEEPING OF PIGEONS: 130. 11/18/91 PAGE TWO Moved by Schneck, seconded by Sarlo, to adopt recommendation of Finance Committee that appropriate legal notices be published for Truth-In-Taxation Public Hearing for 1991 Tax Levy, to be held Monday, December 2, 1991 at 7:00 p.m., and a Public Hearing to discuss a proposed Property Tax Abatement, to be held on Monday, December 16, 1991 at 7:00 p.m. Motion declared carried. Moved by Sarlo, seconded by Childers, to adopt recommendation of Municipal Development Committee to concur with recommendation of Des Plaines Zoning Board of Appeals re Case 91-33-V to grant request for variations to permit a front yard of 18.22' along Wolf Road and a front yard of 41' along Wolf Road, reduce parking aisle along the north side of property (Touhy Avenue) to 10' and permit relief from B-6.12 combination curb and gutter requirement to allow 3 1 high retaining wall along south and west lot lines, all for property located at 545 E. Touhy Avenue; and City Attorney be authorized to draft necessary ordinance. Motion declared carried. Moved by Haupt, seconded by Childers, to adopt recommendation of License & Judicial Committee that since no agreement was reached on the wording of Ordinance M- 50-91 regarding motion to defer and Alderman Healy withdrew his request for such an ordinance, that this matter be dropped. Motion declared carried. Moved by Haupt, seconded by Childers, to adopt recommendation of License & Judicial Committee that the City Manager direct department heads and staff that no assignments to outside legal counsel are made except by the City Attorney; the City Manager to confer with department heads regarding assignments; the City Attorney to notify all law firms handling City business that assignments will only come from the City Attorney; and Legal Department's Quarterly Report be accepted as presented. Motion declared carried. Alderman Christiansen called for a vote on the motion deferred at the City Council meeting held on November 4, 1991, to grant request for 6' high solid wood fence, 8' back from the sidewalk starting at 3 1/2' and sloping to 6', for property located at 268 Cornell Avenue. Mayor Albrecht asked for a substitute motion that this matter go back to committee and that a meeting be held with the Mayor, the two parties involved, the Chairman of the Building Code Committee, Alderman Christiansen, and the alderman of the Ward, Alderman Chiropolos, to work out a resolution to this problem. That motion was so moved by Schneck, seconded by Christiansen. After further discussion, the substitute motion was withdrawn. Upon roll call on the deferred motion, the vote was: AYES: 0-None NAYS: 8-Childers, Christiansen, Healy, Schneck, Hardiman, Sarlo, Chiropolos, Haupt ABSENT: 0-None Motion declared failed. Moved by Christiansen, seconded by Schneck, to adopt recommendation of Building Code Committee that Section 6-3-14 -"Keeping of Fowl Prohibited" of the City Code be strictly enforced against present violators. At the request of Alderman Sarlo, Mayor Albrecht referred the matter of time extension for necessary action to complete various agreements with R. Franczak & Associates for development of property located at 1485 Ellinwood Street (approximately), due to expire on December 31, 1991 (originally granted on August 5, 1991), was referred to the Finance Committee. AND "DEVELOPMENT SPECIALIST," AND AMENDING THE POSITION OF "PERMIT COORDINATOR." The City Clerk's office will be advertising for bids for furniture for Second Floor Emergency Communications Center and Fire Prevention Offices, returnable by 3:00 p.m. on Wednesday, December 4, 1991.
