MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY, OCTOBER 7, 1991 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines, Illinois, was called to order by Mayor D. Michael Albrecht at 8:05 P.M. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Monday, October 7, 1991. ROLL CALL: Roll call indicated the following aldermen present: Childers, Christiansen, Healy, Schneck, Hardiman, Sarlo, Chiropolos, Haupt. Also present were: City Treasurer Fredricks, City Manager Asaro, City Comptroller Peters, Public Works Administrative Assistant Tozzo, Fire Chief Clark, Deputy Police Chief Randolph, Community Development Department Liaison D'Onofrio, Human Resources and Services Department Liaison Boho, City Engineer Oakley, and City Attorney Kolman. PRAYER AND PLEDGE: PRESENTATION: MINUTES: BILLS PAYABLE: BRADY'S RESUBDIVISION 1021-1031 PRAIRIE AVE.: PURCHASE OF LIQUID CALCIUM CHLORIDE: The opening prayer was given by Father Robert Setmeyer, St. Martin Episcopal Church, followed by the Pledge of Allegiance to the Flag. ESDA Coordinator, John Dini, presented the City with a check for $1,500 from the ESDA Professional Volunteers Association to off set cost of new equipment. Coordinator Dini also commended the ESDA volunteers for their assistance in finding a body on Forest Preserve property east of Oakton Community College. Moved by Sarlo, seconded by Chiropolos, to approve minutes of special meeting of the City Council held September 6, 1991, as amended and published. Motion declared carried. Moved by Sarlo, seconded by Chiropolos, to approve minutes of regular meeting of the City Council held September 16, 1991, as published. Motion declared carried. Moved by Sarlo, seconded by Chiropolos, to approve minutes of executive session of the City Council held September 16, 1991. The minutes were held for further review. Moved by Schneck, seconded by Sarlo, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total: $2,413,902.18. Upon roll call, the vote was: AYES: 8-Childers, Christiansen, Healy, Schneck, Hardiman, Sarlo, Chiropolos, Haupt NAYS: 0-None ABSENT: 0-None Motion declared carried. Moved by Chiropolos, seconded by Christiansen, to adopt recommendation of Engineering Committee to accept low bid for purchase, through Northwest Municipal Conference, of Liquid Calcium Chloride, from W & W Sales and Leasing, P.O. Box 486, Edwardsville, IL 62025, for City's requested quantity of 8, 800 gallons in the amount of $2,745.60/MFT Funds-Section #90-00000-00-GM; City Clerk be authorized to execute IDOT Form BLR 6103, and CHLORIDE (Con' t.) LIC. AGREE./ C&NW RE WESTFIELD GARDENS STORM SEWER: REPEAL OF ORDINANCE T-11-91: UNDERGROUND TANK REMOVAL/MAINE SCRAP METAL: ADVERTISING FOR BIDS: REPEAL OF ORDINANCES M-41-91, M-42-91, M-43-91: ILLEGAL ACTION: 116. 10/7/91 PAGE TWO Resolution R-26-91 be adopted at appropriate time this evening. Moved by Chiropolos, seconded by Christiansen, to adopt recommendation of Engineering Committee that Mayor and City Clerk be authorized to execute License Agreement with Chicago & Northwestern Transporation Company to permit City to connect proposed Westfield Gardens Storm Sewer improvements through railroad right-of-way to existing 72" dia. storm sewer in Prairie Lakes Park at a one-time rental charge of $1,350/1987 Sewer Bond Account, and Resolution R-27-91 be adopted at appropriate time this evening. Moved by Hardiman, seconded by Chiropolos, to adopt recommendation of Public Safety Committee that Ordinance T-11-91, allowing two-way traffic on Perry Street between Lee Street and Graceland Avenue, adopted by City Council on September 3, 1991, be repealed; City Attorney be authorized to draft necessary ordinance; and authorize traffic study of the area and report back to committee. Motion declared carried. Moved by Childers, seconded by Sarlo, to adopt recommendation of Public Works Committee to accept proposal from Braun Intertec Environmental, 1415 N. Dayton Street, Chicago, IL 60622, to remove underground tank at Maine Scrap Metal, Inc., 1274 Rand Road, at a cost of $5, 450 plus $57 /cubic yard for any necessary removal and disposal of contaminated soil, for a total not-to-exceed amount of $7 ,310. Moved by Childers, seconded by Sarlo, to adopt recommendation of Public Works Committee that City Clerk be authorized to advertise for bids for 1991 Leaf Disposal, returnable by 3:00 p.m. on Wednesday, October 23, 1991. Moved by Haupt, seconded by Healy, to adopt recommendation of License & Judicial Committee that Ordinances M-41-91, M-42-91 and M-43-91, adopted by the City Council on September 3, 1991, be repealed and City Attorney be authorized to draft necessary ordinance. Upon roll call, the vote was: AYES: 6-Childers, Healy, Hardiman, Sarlo, Chiropolos, Haupt NAYS: 2-Christiansen, Schneck ABSENT: 0-None Motion declared carried. Moved by Childers, seconded by Sarlo, that the reason that these ordinances were brought up for repeal was because the action taken by the City Council on Tuesday, September 3, 1991, in adopting these ordinances, violated City Code and was illegal. RESOLUTION R-27-91 IDOT AGREE. : RESOLUTION RE REFERENDUM: REAPPOINT- MENTS: ADJOURNMENT: 118. 10/7/91 PAGE FOUR Moved by Chiropolos, seconded by Sarlo, to adopt Resolution R-27-91, A RESOLUTION AUTHORIZING THE CITY OF DES PLAINES TO ENTER INTO AN AGREEMENT WITH CHICAGO AND NORTHWESTERN TRANSPORTATION COMPANY FOR THE PURPOSE OF CONSTRUCTING, MAINTAINING AND USING A 72 11 STORM SEWER UPON THE PROPERTY AND UNDER THE TRACK BELONGING TO CHICAGO AND NORTHWESTERN TRANSPORTATION COMPANY. Motion declared carried. Motion made by Healy that the City Council will refrain from passage of any ordinance placing on the 1992 Primary ballot any kind of referendum in order to give citizens group sufficient time to place their referendum on the ballot, but if for any reason the citizens group referendum should not get on the ballot, the City Council would then place, by ordinance, the same or similar referendum on the 1992 Primary ballot, died for lack of a second. Letters from Mayor Albrecht re reappointment of Susan Burrows and Sarah McConnell to the Des Plaines Library Board will come before the Council on October 21, 1991.
