012191CALL TO ORDER: ROLL CALL: 5. MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY, JANUARY 21, 1991 The regular meeting of the City Council of the City of Des Plaines, Illinois, was called to order by Mayor D. Michael Albrecht at 8:22 p.m. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Monday, January 21, 1991. Roll call indicated the following aldermen present: Childers, Christiansen, Wetter, Schneck, Hardiman, Sarlo, Chiropolos, Haupt. Also present were: City Treasurer Fredricks, City Manager Asaro, City Comptroller Peters, Commissioner of Public Works Matula, Fire Chief Clark, Police Chief Storm, Municipal Development Director Pagones, City Engineer Oakley, Human Resources and Services Director Panouses, and City Attorney Kolman. PRAYER AND PLEDGE: SUPPORT OF ARMED FORCES: MINUTES: EXECUTIVE SESSION: HAND GUN CONTROL: The opening prayer was given by Pastor Charles Cooper, Golf Road Baptist Church, followed by the Pledge of Allegiance to the Flag. Moved by Schneck, seconded by Sarlo, that a resolution be sent to the President of the United States supporting our armed forces in the Persian Gulf, that there would be a moment of silence at every Council meeting until the conflict is resolved, and the City Attorney be authorized to draft necessary document. Motion declared carried. Moved by Sarlo, seconded by Chiropolos, to approve minutes of regular meeting of the City Council held January 7, 1991, as published. Motion declared carried. Moved by Schneck, seconded by Chiropolos, to go into Executive Session to discuss liability, land acquisition and pending litigation. Upon roll call, the vote was: AYES: 8-Childers, Christiansen, Wetter, Schneck, Hardiman, Sarlo, Chiropolos, Haupt NAYS: 0-None ABSENT: 0-None Motion declared carried. Council recessed at 8:30 p.m. Council reconvened at 9:10 p.m. Roll call indicated the following aldermen present: Childers, Christiansen, Wetter, Schneck, Hardiman, Sarlo, Chiropolos, Haupt. Mayor Albrecht advised that a petition for an advisory referendum on hand gun control was filed on January 14, 1991 and a challenge to that petition was filed today, January 21, 1991; the Municipal Officers Electoral Board will convene within the statutory time period to hear the challenge. BILLS PAYABLE: GARBAGE- RECYCL ING CONTRACTS: MECH. VENTILA- TION/RESIDENTIAL BUILDINGS: PARKING RESTRICTIONS/ ASH STREET AND EVERETT ST.: ORDINANCE T-1-91 PARKING RESTRICTIONS/ MINER STREET: PAGE TWO 6 . 1/21/91 Moved by Schneck, seconded by Sarlo, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total: $491,812.63. Upon roll call, the vote was: AYES: 8-Childers, Christiansen, Wetter, Schneck, Hardiman, Sarlo, Chiropolos, Haupt NAYS: 0-None ABSENT: 0-None Motion declared carried. Moved by Childers, seconded by Wetter, to adopt the recommendation of Public Works Committee that City extend contract with Laidlaw Waste Systems, 3651 Blackhawk Drive, Rolling Meadows, IL 60008, for one year, to February 29, 1992, based on 75% of the 1990 Chicago CPI-U, which is 4.05%, to coincide with recycling contract, and then City rebid all contract s; recycling contract be amended to include plastics; garbage ordinance be amended that tree branches must be bundled in lengths no longer than 4' x 2" diameter per branch, and City Attorney be authorized to prepared necessary document. Motion declared carried. Moved by Christiansen, seconded by Hardiman, to adopt recommendation of Building Code Committee that Building Code be amended to add new Subsection 35.19-3 and Subsection 35.19-4, as outlined in memo from Building Department, dated January 10, 1991, pertaining to residential mechanical ventilation, and City Attorney be authorized to draft necessary ordinance. Motion declared carried. Moved by Hardiman, seconded by Haupt, to adopt the recommendation of Public Safety Committee that City Attorney be authorized to draft necessary ordinance regarding the following parking restrictions: Everett Street -north side from Lee Street to Mannheim Road -no parking at any time, Everett Street -south side from Lee Street to Mannheim Road -unrestricted parking, 1800 block of Ash Street -east side -3-hour parking from 10:00 a.m. to 6:00 p.m., except Saturday, Sunday and holidays, and 1800 block of Ash Street -west side -no parking f rom 10:00 p.m. to 6:00 a.m., except Saturday, Sunday and holidays -except for a student pick up/drop off area only on the west side of Ash Street across from 1871 and 1879 Ash Street. Motion declared carried. Moved by Christiansen, seconded by Chiropolos, to adopt Ordinance T-1-91, AN ORDINANCE AMENDING SECTIONS 10-5-5(D) (2) AND 10-5-17 SCHEDULE I OF THE CITY OF DES PLAINES CITY CODE TO REVISE PARKING RESTRICTIONS ON MINER STREET. Moved by Childers, seconded by Sarlo, to make substitute motion that this matter be referred back to committee for further review. Upon roll call, the vote was: AYES: 7-Childers, Wetter, Schneck, Hardiman, Sarlo, Chiropolos, Haupt NAYS: 1-Christiansen ABSENT: 0-None Motion declared carried. RE GROUP HOMES: PARKING RESTRICTION/ CENTER ST. : ADJOURNMENT: PAGE THREE 7 • 1/21/91 Placed on First Reading was Ordinance Z-1-91, AN ORDINANCE AMENDING ARTICLE 4,SECTION 4.2.2.6 "COMMERCIAL DISTRICT REGULATIONS," OF THE CITY OF DES PLAINES ZONING ORDINANCE (90-67-A). Mayor Albrecht referred request from Chicago Faucet Company that Nuclear Drive be changed to Clearwater Drive, to the Public Safety Committee. Letter from Des Plaines Plan Commission and Zoning Board of Appeals re Case 91-2-SU-V, 623 North Wolf Road, was referred to the Municipal Development Committee. Letter from Des Plaines Zoning Board of Appeals re Case 90-41-A, Text Amendment re Group Homes, was referred to the Municipal Development Committee. At the request of Alderman Christiansen, Mayor Albrecht referred the matter of parking restriction on Center Street, to the Public Safety Committee. Moved by Chiropolos, seconded by Sarlo, that the regular meeting of the City Council adjourn. Motion declared carried.
