The meeting opened with a prayer by Rev. Fred Krohne of Christ E & R Church, followed by the pledge of allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Prickett, I,Tri.ght, Bolek, Leer, Hinde, C2ubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Rateike, Szabo. Absent was Alderman Figard. Also present were: City Cotipt.roller Blietz, Police Marshall Kennicott, Police Captain Hintz, Fire Marshall ;krndt, Building Commissioner Schuepfer, Commissioner of Public Works Warnicke, City Engineer Fletcher, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: It was moved by Alderman Prickett, seconded by Alderman Rateike, to approve the Minutes of the regular meeting of December 4, 1967, as published. Motion declared Carried. OPEN BIDS: It was moved by Alderman Swanson, seconded by Alderman Sewer & Water Wright, to open bids received for the water and sewer Public Works mains to the Public Works Building. Motion declared Carried. It was moved by Alderman Wright, seconded by Alderman IIinde, to refer the bids for the sanitary sever to the Sewer, Finance, and Building and Grounds Committees and City Engineer for study and report. Motion declared Carried. Report of City City Attorney DiLeonardi reported the following: Attorney The condemnation suit on property located at 819 Graceland Avenue has been settled for an amount equal to the appraised variation. The Rand -Central zoning case scheduled for this morning was continued until the end of January. At the Sanitary District's request, the case was continued until January 9th. Suit- Contractor's It was roved by Alderman Trickett, seconded by Alderman Liee se fee Bonaguidi, to authorige the firm of DiLeonardi and Hofert to defend the City in the suit filed with the City Clerk December 13, 1967, attacking tide City's contractor's license fees. Oil roll call, the vote was: AYES: - 16 - Alderman Prickett, Wright, Bolek, Leer, IIinde, Czubakowski, Magner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Rateike, Szabo, Mayor. COMMITTEE REPORTS: ZONING CASE It was moved by Alderman Swanson, seconded by Alderman 67 -47 -SIT Prickett, that Council concur with the Municipal 2424 'Dempster St. Development Conmittee's report and recommendations on Zoning Case 67 -47 -SIT on property located at 2424 Dempster Street <as follows: 12/18/67 473 Page two ZONING CASE "The Special Use at 2424 Dempster Street is for a 67 -47 -SU retraining and remotivation center. This matter was Cont' considered by the Plan Commission at their regular meeting on September 25, 1967 and approved with the following qualifying conditions; (1) That no more than twelve beds be permitted within the subject building, (2) that driveways and off-street parking area,be constructed so as to prevent traffic hazards from occurring, (3) that the owner agrees to investigate complaints and to providd those services which will reduce or eliminate any nuisance to the neighborhood. The Zoning Board considered this rezoning on October 31, 1967 and on November 1, 1967, approved this rezoning subject to the restrictions imposed by the Plan Commission. We, your Committee on Municipal Develop- ment recommend that the recommendations of the Plan Commission and the Zoning Board of Appeals be concurred with and that the City Attorney be authori.ved to prepare the amendment to the Zoning Ordinance." Alderman Swanson read the letters from the State Department of Mental Health and from City Attorney DiLeonardi re licensing this type of center. Alderman Szabo voiced objections to the Special Use petition, posing the questions regarding building renovations necessary to comply with the Zoning and Building Ordinances of the City - also the nearby residents apprehension of the facility lacking twenty-four hour super- vision. On roll call, the vote was: AYES: - 9 - Alderman Prickett, Wright, Czubakowski, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, NAYS: - 6 - Alderman Bolek, Leer, Hinde, Wagner, Rateike, Szabo. Motion declared carried. PIM of Re- It was moved by Alderman Swanson, seconded by Alderman Subdivision Prickett, to concur with Municipal Development Committee's Forest Drive recommendation to authorize the Mayor and City Clerk to execute Plat of Resubdivision of two lots on Forest Drive, located outside the City limits. Motion declared Carried. ZON NG CASE It was moved by Alderman Swanson, seconded by Alderman 67-49-R Thomas, to concur with Municipal Development Committee's 1651 Rand Rd. recommendation to concur with the Zoning Board of Appeals recommendation to rezone property located at 1651 Land Road from R-2 to C-2 and authorize the City Attorney to I draft the necessary ordinance. Motion declared Carried. COrU�1TTEE Alderman Rateike, Chairman, set a meeting of the Fire MEETING Committee for Wednesday, December 27th at 7:30 to discuss extension of Fire Protection District contracts. Appraisal It was moved by Alderman Sh-illington, seconded by Alderman City Garage 11inde, to concur with Building and Grounds Committee's Property recommendation to authorize the Mayor. and City Comptroller F Blietz to secure an appraisal of the City Garage property, exclusive of the land to be retained for the water tower. Prospect and Thacker Street and authorize the City Attorney to handle the necessary legal aspects in closing said sale. COMh[ITTEE Alderman Shillington, Chairman, seta meeting of the MEETING Building and Grounds Committee with the Finance Committee and the firm of Holmes & Fox for 7 P.M., December 27th. Doreen & It was moved by Alderman Leer, seconded by Alderman Westfield Lane_ Trinde, to concur with Streets and Traffic Committee's that letters by written by Mayor Behrel informing residents who reside on the undedicated portion of Doreen and Westfield Lane that the barricade in the street would be removed by the City to permit garbage pickup and if the streets become impassable due to snow, the garbage be placed on the nearest passable City street. After discussion, it was moved by Alderman Shillington, seconded by Alderman Seitz, to defer action for two weeks and request that Mayor Behrel write the residents informing them of the action to be taken at the next meetyng. i 1 hour parking It was moved by Alderman Leer, seconded by Alderman ITinde, Prailie Ave. to concur with Streets and Traffic Committee's recommenda- tion for one-hour parking restrictions on the north side of Prairie Avenue from First Avenue 184 feet gest, and Author kepthe City attorney to draft the necessary amend- ment to the ordinance. Traffic Count It was moved by Alderman Shillington, seconded by alderman Seymour & Michaels, to authorize the City Engineer to secure a Alin traffic count at the intersection of Algonquin Rd and Seymour Avenue, if the count taken by either the State or County is found to be inadequate to determine the need for signalization. Motion declared Carried. Committee Alderman Leer, Chairman, set a meeting of the Streets and Meeting Traffic Committee for 11 a.m., December 26th, at Dover Lane with Mayor Behrel, Commissioner of Public Works Warnicke, Assistant Commissioner of Public Works Schwab, Fire Chief Arndt, and Police Marshall Kennicott. AWARD BID It was moved by Alderman Michaels, seconded by Alderman Removal of Rust Thomas, to concur with Water and Finance Committee's and Paint - recommendation to award the bid for the removal of rust Watet Tank and paint in the water tank at Chestnut and Froward to Craftsmen Painting Service in the amount of $2,460.00 and return the checks or bonds of the unsuccessful bidders. Motion declared Carried. 12/18/67 475 Page four Two Hour Parking It was moved by Alderman Wright, seconded by Alderman West Side of Center Swanson, to authorize the City Attorney to draft the necessary amendment for two hour parking restrictions on the Vest Side of Center Street, between Ashland and Oakwood from the 15 -minute sign limit 120 feet or 42 steps south to Oakwood. Motion declared carried. Elm Tree Disease report COMMITTEE MEETING Alderman Leer, Chairman, read the report of Corimissioner Warnicke, re the progress being made by Bishop Tree Service for the removal of Dutch Elm diseased trees, stating that due to inclement weather the program is behind schedule but should be completed by January 15. Alderman Michaels, Chairman, set a meeting of the City Code Committee for 7:30 P.M., January 4th. Library Expansion Mayor Behrel announced a meeting with the Library Board, Meeting Library Citizens Committee, and City Council to discuss plans for the referendum for the expansion of Library facilities. Insurance Committee Alderrian Bonaguidi, Chairman, reported that the Insurance Committee, has reviewed the City's Insurance program with the Insurance Brokers Association and finds the City to be adequately insured. BILLS PAYABLE; It was moved by Alderman Prickett, seconded by Alderman Swanson, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINTS THAT TEED FOLLOWING BILLS ARE DFTE AND PAYABLE AND TIIE MAYOR AND CITY CLERK ARE HEREBY AUTHOR IZED TO MAKE PAYMENT FOR SAME. Total $409.,192.17. Fla Mayor Behrel reported that the Code of Ethics governing the Hal Mast flying of the flag of the United States does not permit the City to fly said flag at half-mast Janizary 8th, the anniversary of Judge Sengstock's death. Alderman Rateike suggested that the City declare a Memorial Day - possibly January 8th - for all persons who have served the City and fly the,City Flag at half-mast that day.
