MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD
IN THE COUNCIL ROOM, CITY HALL,
MONDAY, OCTOBER 29 1967
CALX TO ORDER: The regular meeting of the City Council of the City
of Des Plaines was called to order by Mayor Herbert
11. I3ehrel at 8:10 P.M. The meeting opened with a
prayer by Father Earl Thomas of St. Mary's Catholic Church, followed by
the' pledge of allegiance to the flag.
ROLA, CALL: Roll Call indicated the following aldermen present:
N'igard, llinde, Czubakowski, Wagner, Swanson, Thomas,
Bonaguidi, Seitz, Shillington, Michaels, Rateike,
Szabo, Prickett, Wright, Leer. Alderman Bolek
arrived a few minutes after roll call.
Present also were: City Comptroller Blietz, Police Marshall Kenuicott,
City Engineer Fletcher, Commissioner of Public Works Warnicke, Building
Commissioner Sehuepfer, Fire Marshall Arndt, Assistant Commissioner of
Public Works Schwab, Police Captain Hintz, and City Attorney DiLeonardi.
MINUTES: It was moved by Alderman Prickett, seconded by
Alderman Bonaguidi, to approve the Minutes of the
regular meeting of September 18, 1967, as published.
Motion declared Carried.
OPEN 13IDS: _ It was moved by Alderman Wright, seconded by Alderma n
Wagner, to open all bids received for the fuel oil
and Section #7 of the Storm Sewer Program. Motion
declared Carried. The following bids were received:

REP�RTS OF CITY OFFICIALS: The Clerk submitted the report of the health
Department for September, 1967, which was
placed on file.
1113 12142 Building Commissioner Schuepfer reported that the
Btjilding Officials Conference of America recommends
that efforts be made to defeat 1113 12142 which denies
Federal funds to those municipalities that have not
adopted the Federal Building Code. It was moved by
Alderman Prickett, seconded by Alderman Michaels, to authorize and direct
the',City Attorney to draft a resolution indicating City Council's objections
to I'fB 12142 forwarding same to local representatives. It was moved by
Alderman Bolek, seconded by Alderman Leer, to defer action on this matter
for''two weeks to allow further study. On Roll Call, the vote was:
AYES: 11 - Alderman Ilinde, Czubakowski, Wagner,
Swanson, Bonaguidi, Seitz, Shillington,
Szabo, Bolek; l;epr, Mayor.
NAYS: 6 - Alderman Fil;ard, Thomas, Michaels,

Report (f City City Attorney DiLeonardi reported that Wednesday is the
Attorney scheduled date for the argument of the motion to dismiss
our complaints in the Metropolitan Sanitary District
case. Inasmuch as plans and specifications for the
proposed sewage treatrient plant have not been received for review, fie
will ask that the case be continued again to allow the City to take
advantage of the previous order.
City Attorney DiLeonardi reported that Judge MacNamara
overruled the objections of Mt. Prospect re proposed annexation of the
Kenroy property and that the pre -annexation agreement will be heard
beflore the Zoning Board and Plan Commission shortly.
City Attorney DiLeonardi further reported that fie met
with PTA and other interested groups re an amendment to the City's
bicycle ordinance. Suggested amendments were referred to the Streets
and!,, Traffic Committee for study and report.

It was moved by Alderman Swanson, seconded by Alderman
Prickett, to concur with Municipal Development Committee's
recommendation to refer back to the Plan Commission the
plat of Oakton Place Subdivision based on the letter
from Building Commissioner. Schuepfer. Motion declared
Carried.
Alderman Swanson, Chairman, set a meeting of the Municipal
Developrient Committee for 7:30 - October 9th.
It was moved by Alderman Figard, seconded by Alderman
Shillington, to concur with Police Committee's recommenda-
tion to purchase a Series 88 Dominator Traffic Radar.
Unit from the Dominator Corporation, at a cost of
,81345.00. On Roll Call, the vote was:
AYES: 13 - Alderman Figard, Hinde, Czubakowski, Wagner,
Swanson, Thomas, Bonaguidi, Seitz, Shillington,

Alderman Rateike, Chairman, announced a meeting of the
Fire and Building Control and Inspection Committees for
7:30 P.M. with Elk Grove Rural Fire Protection District
and 8:30 P.M. with other Corimittees - October 4th.
Alderman Bolek, Chairman, set a meeting of the License,
Ifealth and Inspection Committee for Thursday, October 5ti),
at 8 P.M.
AVA D BID It was moved by Alderman Leer, seconded by Alderman
SA T Bolek, to concur with Streets and Traffic Committee's
recommendation to award the bid for salt to one of the
low bidders, Diariond Salt Co., in the artrourit of $12.80
per ton and return checks or bonds of the unsuccessful
bidders. On Roll Call, the vote was:

Elm Free
Alderman Leer, Chairman, reported that the Elm Tree Disease

Committee has met with property owners who have known diseased

elm trees on their property and have requested that the trees
be rer:ioved as -soon as possible. IIe further reported that
all trees marked with an orange dot will be removed by
January 1st.

Alderman Michaels, Chairman, set a meeting of the City Code
Committee
Committee for Monday, October 9th at 7:30 P.M.
Civil. Defense
Alderman Czubakowski, Chairman, made a progress report on
the various activities of the Civil Defense Department -
said report placed on file.

Petition for The various petitions for annexation from property owners
Annexation in Douglas Manor subdivision were referred to the Municipal
Douglas Manor Development Committee for study and report.
Liqupr License The request for a Liquor License to serve beer only of
LumTs Joseph R. Palumbo who has a franchise agreement with Lum's
to be located on Elmhurst Road abort 150 feet from the south-
east corner of Elmhurst and Algonquin Roads was referred to
the License, Health & Inspection Committee for study and
report.
APPOINTMENT It was moved by Alderman Bonaguidi, seconded by Alderman
Father Wagner, to accept the resignation of Fattier Thomas Carmon
Fassbinder from the Youth Commission and concur in Mayor Behrel's
appointment of heather Richard Fassbinder to fill the
unexpired term to April 30, 1969. Motion declared Carried.
Accept It was moved by Alderman Prickett, seconded by Alderman
Resignation Bonaguidi, to accept the resignation of Dr. William Earl
Dr.n. Brehm Brehm= from the human Plelations Commission, as cited in the
letter read by Mayor Behrel, and to authorize the Mayor to
write a letter of commendation and obtain a suitable plague
to be presented to Dr. Brehm before leaving Des Plaines,
as a token of appreciation for the fine work he has done
in the City of Des Plaines. On roll call, the vote was:

$15.35, bringing the total to $800 in settlement of
the Anna Gillespie Sidewalk Case. On roll call, the
