MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINESP ILLINOIS, HELD.
IN THE COUNCIL ROOM, CITY HALL,
MONDAY, APRIL 170 1967
CALII TO ORDER: The regular meeting of the City Council of
the City of Des Plaines was called to order
by Mayor Herbert H. Behrel at 8:05 P.M.
The meeting opendd with a prayer by Rev. Donald Hall berg of Trinity
Lutheran Church followed by the pledge of allegiance to the flag.
ROLL CALL: Roll Call indicated the following aldermen
present: Czubakowski, Swanson, French,
Martin, Bonaguidi, Szabo, Prickett, Wright,
Bolek, Leer, Shillington, Figard.
Absent were Aldermen Wagner and Rateike.
Present also were: City Comptroller Blietz, Police Chief Kennicott,
Police Captain Hintz, Building Commissioner Schuepfer, Commissioner of
Public Works Warnicke, Fire Marshall Arndt, City Engineer Fletcher, and
City Attorney DiLeonardi.
There being a quorum present, the meeting was in order.
MINUTES: It was moved by Alderman Shillington and
seconded by Alderman Prickett that the
Minutes of the regular meeting of April 3, 1967, be approved as published.
Motion Carried. It was moved by Alderman Prickett and seconded by Alder-
man Shillington that the Minutes of the adjourned meeting of April 10,
1967, be approved as published. A correction was made on Page five,
Paralgraph 3, adding the words "sugar maple" in line three following 200.
Also a correction was made adding Alderman French to all roll call votes
as being absent. After corrections Motion Carried.

AWARD - ANNUAL Mr. Joseph F. Clark, Executive Drector
FINANCIAL REPORT of the Municipal Finance Officer Asso-
966 ciation of United States and Can da
presented the City of Des Plaine with
a Certificate of Conformance Awa d.
Mr. Clark stated that this award is issued only to the governmental
unit whose financial report is judged to conform substantially to
the high standards for financial reporting established by the sso-
ciation and that Des Plaines is the 15th governmental body to receive
such an award in the State of Illinois. He complimented City Comp-
troller Blietz for his diligent efforts to achieve this award in the
three years he has been with the City. Mayor Behrel in receiving
the award for the City complimented Mr. Blietz for his efforts and
expressed appreciation of the City Council.

necessary specifications. Motio Carried.
City Attorney DiLeonardi reported that
a motion to dismiss complaint has been
filed in ithe 253-55 Central Road Zoning
Case. Further that a motion to dismiss
complaint has been filed re Cook County
Zoning Docket #1111.
House Bill 1325 City Attorney DiLeonardi reported
Resolution R-6-67 corrective legislation is before
House, known as Bill 1325, which
allow municipalities to classify,
and restrict the use of property on the basis of family relatic
which family relationship may be defined as one or more persons
related to the other by blood, marriage or adoption and maintai
common household. It was moved by Alderman Martin, seconded by
B olek, that Council adopt Resolution R-6-67 supporting and advo
the passage of Y ouse Bill 1325 in this session of the Illinois
Assembly. Motion Carried.

Cook Co. Zoning City Attorney DiLeonardi submitted a written
Docket #1157 memo to Council re Cook County Zoning Docket
#1157. It was moved by Alderman Martin, seconded
by Alderman Prickett that Council file no ob-
jections to the rezoning of the property located
ori the South side of Algonquin Road, approximately
200 feet west of Elmhurst F oad in Elk Grove Town-
ship. Motion Carried.
Alderman Rateike arrived at this time - 8:40 P.M.

Millers Rd. Development Committee's recommendation to approve

Maple Grove It was moved by Alderman French, seconded by
Subdivision Alderman Prickett, to concur with Municipal Develop-
ment Committee's recommendation to approve Plat
of Maple Grove Subdivision located at Pratt north
on extension of David Drive to David Drive, and
that the Mayor and City Clerk execute same upon
receipt of the necessary bonds or cash for the
improvements. Motion Carried.

Beau & Kathleen man Shillington, to concur with Streets and Traffic
Committee's recommendation to authorize the City
Attorney to draft the necessary ordinance for

Considerable debate followed the motion as follows:
Alderman Leer submitted petitions signed by 211 surrounding homeowners,
which City Attorney ruled were not signed by frontage owners and therefore
would not require a 2/3 vote of all aldermen for passage of the ordinance.
Alderman Leer cited the Chicago and North Western Zoning Case before the
Appellate Court stating that to rezone subject property would be brought
to the attention of the courts, in his opinion, and would jeopardize
any change of zoning in this area. Alderman Martin reviewed the position
of the Des Plaines Park District and their efforts through condemnation
to aquire a portion of the subject property for park purposes stating
he did not believe the property should rezoned. Alderman Figard questioned
City;Engineer Fletcher to determine adequate drainage facilities for
development of the property. City DiLeonardi cited the criteria for
rezoning of any property in the City of Des Plaines, stating that he
belijved the subject property to be defendable R-2 Single Family Distract.
Aldermen Rateike and Alderman French spoke in favor of re -zoning in view
of the increased tax base it would provide. Alderman Swanson debated
that the property should remain R-2. At the end of discussion, Mayor
Behrel ruled that Alderman Bonaguidi would be disqualified from voting,
due to a conflict of interest. On Roll Call, the vote was:

C &}M RR fare Iiofert be retained to attend the hearing before
increases the Illinois Commerce Commission on April 27,
