Council Minutes 02/20/1967312 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLTNOIS, HELD IN.THE COUNCIL ROOM, CITY HALL, MONDAY, FEBRUARY 20, 1967 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:05 P.M0 The meeting opened with a prayer by Pastor Hubert Beek of Emmanuel Lutheran Church followed by the pledge of allegiance to the flag. ROU CALL: Roll Call indicated the following aldermen - present: Leer, Shilliongton, Wagner, Swanson, French, Martin, Bonaguidi, Rateike, Prickett, Wright. Abslent were Aldermen Bolek, Figard, Czubakowski, Szabo. Present also were City Comptroller Blietz, Police Chtef Kennicott, Police Captain Hintz, Building Commissioner Schuepfer, Assistant Comm- issioner of .Public Warks Schwab, Fire Marshall Arndt, City Engineer Fletcher,. and City Attorney DiLeonardi. There being a quorum present,--the-meeting was in order. MIMES: It was moved by Alderman Prickett and seconded by Alderman Rateike that the Minutes of the regular meeting of February 69 1967, be approved as published. Motion Carried, OPEN BIDS Snow Plow It was moved by Alderman Bonaguidi and seconded by Alderman Wagner to open. bids received for the Snow Plow. The following bids were received: Illinois FWD Truck & Equipment Company $964.00 Platt Inc. 850.00 Charles Equipment Co, 885.00 R. H. Lyons Equipment Co. 836.00 It was moved by Alderman Prickett and seconded by Alderman Martin to refer said bids to the Streets and Traffic and Finance Committees and Commissioner of Public Works for study and report. Motion Carried. Tr.ugk Bid City Clerk Rohrbach read the report of Commissioner of Public Works re investi- gation of receiving only one bid on February 69 1967, in which he stated that all ten dealers who were sent invitations to bid were informed that the opening sdat� had been changed to February 20th. The only bid received was the one',received at the February 6th meeting from International Harvester Company. It was moved by Alderman Martin and seconded by Alderman Leeir to return the aforementioned bid unopened and readvertise for bids thirty days hence. Motion Carried*. REPORTS OF CITY OFFICIALS: City Engineer t bpu der 5 ft. in diameter was wor City Engineer Fletcher reported that despite weath-er conditions six crews are working five days per week on the storm sewers. A found at River Road during the storm sewer He further reported that he expects State approval of the traffic lights at Maple and Touhy Avenue within a short time. Further that delivery of equipment for installation of the lights at Mannheim and Prospect Avenue is expected March 6th, at which time the contractor will begin installation. Do3�jtown Zoning Ordinance City Attorney DiLeonardi submitted to alder«* men and City Officials the draft of the -Downtown Zoning Ordinance, stating that same is is composite of the first drafts, plus changes of the Municipal Develop- ment, Committee and City Officials. After discussion, it was moved by 313 2/20/67 Page two Alderman Frendh and seconded by Alderman Prickett to authorize and direct the City Attorney to proceed with the necessary petition to the Zoning Board of Appeals to arrange for the public hearing on the Downtown Zoning Ordinances. Motion Carried. Compromise - WaterMain City Attorney DiLeonardi reporte that a Tap -on Fees contract was entered into betweei the City Central between Curtis of Des Plaines and James L. Ray ind Joe W. and Sycamore Waltmire, dated November 19, 196 .2, which provided that no tap -on permit would be, issued without first requiring a receipt and release from Messrs. Ray and Waltmire. However, a tap -on permit was issued to Walter F, Crowe on June 22, 1965, without afore entioned receipt and release;, The City Attorney reports that a tentative agree- ment hats been reached whereby the,City would reimburse Messrs Ray and Waltmire 2/3 of,eost of,tap-on fee or $669.00 and Mr. Walter Crow to pay the remainder of $300. It was moved by Alderman Wagner and seconded by Alderman Swartson to authorize the City Attorney to negotiate with Messrs. Ray and Waltmire as aforementioned and reimburse them in the amount of $669.00. On Roll Call, the vote was: AYES: -. 11 - Aldermen Leer, Shi lington, Wagner, Swanson, French, Martin, Bonaguidi, Rateike Prickett, Wright, Mayor, NAYS: - 0 None ABSENT: 4 - Aldermen Bolek, Fi ard, Czubakowski, Szabo There being eleven affirmative votes, Motion Carried, Quit Claim Deed - City Attorney DiLeonardi reported that the 25 ft. lot - Orchard St. owner of a twenty-five foot lot on Orchard Street is requesting a quit claim deed from the City of Des Plaines after payment of taxes amounting to $8.81. Said request was referred to the Finance Committee for study and -report. r S. A. 187 - Birch Street City Attorney DiLeonardi reportethat the Board of Local Improvements recommends the passage of Ordinance M-8-67, submitted to aldermen, providing for the improvement,of Totahy Avenue, C dar.Street, Birch Street and Orchard Estates Subdivision, by the installation therein of watermains and sanitary sewers, the cost thereof to be paid for by special assessment to be known as #187. REPORTS OF COMMITTEES: Plat of Dedication - It was moved by Alderman French nd seconded West 1 2 of Birch Street by Alderman Prickett that Counci concur with Municipal Development Commi tee's recommendation to authorize and irect the Mayor and City Clerk to execute the plat of dedication for th West 1/2 of Birch Street from Touhy Ayenue a distance of 1325.26 f et north. Motion Carried, Title Search - 10 feet It was moved by Alderman Martin and seconded Center of Birch street by Alderman French to authorize and direct the City Attorney to obtain a Title Search on the ten feet of land existing in the Center of Birch Street, north of Touhy Avenue, and incurr whatever ex- penses are necessary. On Roll Call, the vote was: AYES: - 11 - Alderman Leer, Shillington, Wagner, Swanson, French, Martin, Bonaguidi, Rateike, Prickett, Wright, Mayor. NAYS: - 0 - None ABSENT: - 4 - Alderman Bolek, Fig rd, Czubakowski, Szabo There being eleven votes, Motion Carried, ZONING CASE 67-2-R It was moved by Alderman French a d 60 W. Oakton Street from R-4 to C 2, Motion Carried Fir Protection - Unincorporated Areas Page three 2/20/67 314 It was moved by Alderman Rateike and seconded by Alderman Bonaguidi to author- ize the Mayor's Office to,inform President Ogilvie of the County Board of the problems with respect to fire protection existing -in the unincorporated areas. Motion Carried, Re ort of Fire Prevention The report of the Fire Prevention Bureau Bureau re City Hall with respect to exit violations in City Hall was referred to the Building and Grounds Committee for study and report, Im ovement of Devon an It was moved by Alderman Martin and seconded Hi ins between River Rd. by Alderman Bonaguidi that Council concur and'Mannheim with Streets and Traffic Committee's recommendation to refer to the Board of Local Improvements for public hearing the improvement of the north half of Devon and Higgins between River Road and Mannheim joining Rosemont in said improvement. Motion Carried. - Advertise for Bids It was moved by Alderman Leer and seconded Two Civil Defense Sirens by Alderman Shillington that Council concur and installation with Civil Defense Committee's recommendation to advertise for bids for two Civil Defense sirens and installation of same, bids returnable March,60 1967, and the Director of Civil Defense to draw the necessary specification. Motion Carried, APPfOVAL OF BILLS PAYABLE: Alderman Prickett, Chairman of the Finance Committee, presented the following resolu•- tion: :BE IT RESOLVED BY THE CITY OF DES PLAINFS THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITE' CLERK 13E AND HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total, $1109972,79, It was moved 1?y Alderman Prickett and seconded by Alderman Swanson that the aforesaid resolution be adopted: On Roll Call, the vote was: AYES: 11 - Alderman Leer, Shillingtony- Wagner, Swanson, French, Martin, Bonaguidi, Rateike, Prickett, Wright, Mayor, NAYS: 0 - None ABSENT: 4 - Aldermen Bolek, Figard, Czubakowski, Szabo There being eleven affirmative votes Motion Carried, - ORDNANCE M-8-67 It was moved by Alderman French and seconded S.'A. #187 by Alderman Rateike to waive First Reading Tou y Cedar, Birch and place on passage Ordinance M-8-67, providing for the improvement of Touhy Avenue, Cedar Street, Birch Street and Orchard Estates Subdivision, by installing a system of sanitary sewers, watermains, togetber with all necessary appurtenances, and by replacing of street pavement, the cost thereof to be paid by special assessment to be known as No. 187. Motion Carried, It was moved by Alderman Swanson and seconded by A Berman French to adopt Ordinance M-8•-67. Oakton St. 'by Alderman Wagner to waive Firs Reading R-4 to C"02 and place on passage Ordinance Z 5-67 rezoning property located at 60 . Oakton Street from R--4 to C-2. Motion arried, It was moved by ,alderman French and seconded by Alderman Swanson to adopt Ordinance Z-5-67. RESOLUTION - MFT Funds It was moved -by Alderman Rateike nd Energy - Traffic Lights seconded by Alderman Prickett to adopt the resolution appropriating -$&,000 of Motor Fuel Tax Funds for the purpose - of providing funds for the energy for traffic lights at various interse tions. Mayor Behrel further reported that the State Highway of Public Works will hold a public hearing in the Council Room at 10 a.m., March 14th, to d1sucss the improvement of Golf Road through the City of Des Plaines from 'Wolf Road to Elmhurst Road, Mayo* Behrel also reported•that he attended a legislative meeting of the Illinois Municipal League Friday nite and all day Saturday re bills before the Legislature.
