COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS
HELD IN THE ELEANOR ROHRBACH MEMORIAL
COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER,
MONDAY, NOVEMBER 1, 2004
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines, Illinois, was called to order by Mayor
Anthony W. Arredia at 7:00 p.m. in the Eleanor Rohrbach
Memorial Council Chambers, Des Plaines Civic Center on
Monday, November 1, 2004.
ROLL CALL: Roll call indicated the following aldermen present:
Beauvais, Christiansen, Murphy, Sayad, Brookman, Becker,
Smith, Argus.
Also present were: City Manager Niemeyer, Director of Finance Egeberg,
Police Chief Prandini, Fire Chief Heavey, Director of Engineering Oakley,
Director of Public Works Duscket t, Director of Cornrnuni ty Development
Bleuher, Building Official Molinari, Assistant City Attorney Bartel and
City Attorney Wiltse.

The opening prayer was given by Father George Bessinas,
St. John Greek Orthodox Church, followed by the Pledge
of Allegiance.
Mayor Arredia and Director of Public Works Dusckett
recognized Bill Mulderink of the Public Works Department
for his tireless work in keeping the downtown area of the
City clear regardless of weather and traffic; he was
presented with a plaque of appreciation for his care and
diligence.
Mayor Arredia introduced Joy Matthiessen, Executive
Director of the Des Plaines Historical Society, Board
Chairman, John Burke, and member Jim Whitcomb; Mayor
Arredia congratulated the Society on their recent award
by the Illinois Association of Museums as the Mid-Sized
Institution of the Year.
Mayor Arredia and Police Chief Prandini recognized and
congratulated Police Sergeant Kevin O'Connell and Police
Sergeant Timothy Veit, who recently received the Award
of Merit for Outstanding Service and Professionalism from
Cook County Sheriff Michael Sheahan.
Mayor Arredia introduced U.S. Congresswoman Jan
Schakowsky (9th District) , who received an award from
Vince Powers on behalf of the World War II Marines of the
gth Defense Battalion; and Sharon Smith, Executive
Director of the Des Plaines Cornrnuni ty Senior Center,
presented Congresswoman Schakowsky with a watch for her
invaluable effort in obtaining funds for the Senior
Center.
Mr. Marty Moylan, 1405 Oakwood Avenue, addressed the City
Council stating his concern about the billboards
permitted in the City; he believes that the City did not
have all the facts or received all the information; these
billboards are not up for just 20 years, but forever; no
specific sites were required; once the billboards were
approved, the owner then sold them to another company for
$12 million; he would like the City to hire an outside
litigator to handle these billboards; also an outside
investigation is needed to see if any wrong was done.
Mr. Brian Burkross, 2133 Webster Lane, addressed the City
Council regarding his concern that voters may be confused
with the wording of the referendums on the ballot
tomorrow; he encourages all voters to consider these
questions very carefully; it is important that voters
voted for both questions on the ballot.

with Staff recommendation to grant request from residents
at 2150 and 2172 Chestnut Street that City create Special
Service Area #6 for the resurfacing of their parking lot;
to be funded by the residents on their property tax bill
for the tax levy years 2004 through 2019 inclusive and
shall be in a total amount not-to-exceed $1,050 annually
(approximate annual cost per unit would be $87.50); a
public hearing be held on November 15, 2004 at 7:00 p.m.
in Room 102 of City Hall; and further recommend to place
on First Reading Ordinance M-73-04, AN ORDINANCE
PROPOSING THE ESTABLISHMENT OF SPECIAL SERVICE AREA
NUMBER SIX IN THE CITY OF DES PLAINES, ILLINOIS (2150-
2172 CHESTNUT STREET PARKING LOT) . Motion declared
carried as approved unanimously under Consent Agenda.

with Staff recommendation to grant request for a new
Class A Tavern Liquors Dealers License for property

Alderman Beauvais stated that she resents the fact that
IDOT made the decision to make this traffic restriction;
we were not even asked about this; she asked the Staff
that in the future the aldermen be notified of any
proposed changes like this.
Moved by Becker, seconded by Argus, to concur with
recommendation of Des Plaines Staff Traffic Advisory
Committee (STAC) to amend Title 7, Chapter 4
"Miscellaneous Driving Rules," Section 3 of the City Code
to prohibit northbound traffic on Mary Street to make a
left hand turn west onto Golf Road; and further recommend
to place on First Reading Ordinance T-17-04, AN ORDINANCE
AMENDING TITLE 7, "MOTOR VEHICLES AND TRAFFIC" CHAPTER
4, "MISCELLANEOUS DRIVING RULES" SECTION 3, "TURNING AND
BACKING MOVEMENTS" OF THE CITY OF DES PLAINES CITY CODE.
Motion declared carried. Alderman Beauvais voted no.
Moved by Beauvais, seconded by Christiansen, to concur
with recommendation of Des Plaines Staff Traffic Advisory
Committee (STAC) to amend Title 7, Chapter 4
"Miscellaneous Driving Rules," Section 3 of the City Code
to prohibit southbound traffic on Birch Street to make
a left hand turn east onto Touhy Avenue during the hours
of 7:30 a.m. to 8:30 a.m. and 2:30 p.m. to 3:30 p.m.; and
further recommend to place on First Reading Ordinance T-
18-04, AN ORDINANCE AMENDING TITLE 7, "MOTOR VEHICLES AND
TRAFFIC" CHAPTER 4, "MISCELLANEOUS DRIVING RULES" SECTION
3, "TURNING AND BACKING MOVEMENTS" OF THE CITY OF DES
PLAINES CITY CODE. Motion declared carried as approved
unanimously under Consent Agenda.

with recommendation of Des Plaines Staff Traffic Advisory

Code to prohibit parking on the inside of the cul-de-sac
on Orchard Court and extend the west side parking
prohibition from Greenview Avenue to the south property

meters and repair parts from Badger Meters, Inc., 4545
W. Brown Deer Road, Milwaukee, WI 53225, on an "as
needed" basis throughout the year at a cost not-to-exceed
$70,000/Budgeted Funds; it would be in the best interest
of the City that usual bid procedures be waived because
Badger Meters, Inc. has provided meters to the City since
1977 and approximately 95% of the City meters are Badger;
and further recommend to adopt Resolution R-125-04, A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DES PLAINES
TO WAIVE PURCHASING POLICIES AND GUIDELINES TO PURCHASE
WATER METERS AND REPAIR PARTS FROM BADGER METERS, INC.

The petitioner, Reverend Sunday Adebiyi, was not present.
A discussion was held on the number of parking spaces and
whether the property is presently being used as a place
of worship.
Moved by Beauvais, seconded by Argus, to recommend to the
City Council to DENY request, re Zoning Case 04-57-CU,
to permit a place of worship on property located at 2474
E. Dempster Street, Suites 107, 108 and 109.
Moved by Becker, seconded by Brookman, to adopt a
SUBSTITUTE MOTION to recommend to the City Council to
postpone until December 6, 2004, request re Zoning Case
04-57-CU to permit a place of worship on property located
at 2474 E. Dempster Street, Suites 107, 108 and 109.
Motion declared carried. Alderman Smith voted no.

COUNCIL BACK IN SESSION
Moved by Becker, seconded by Murphy, to suspend the rules
to permit public input on this matter. Motion declared
carried. Alderman Christiansen voted no.
Mr. Charles Wiercinski, McLennan Commercial Properties,
Inc., 25 N. Northwest Highway, Park Ridge, IL 60068,
addressed the City Council stating his opposition to this
ordinance; installing sprinklers should be left to the
new home buyers.
Mr. Richard Welton, Attainable Housing Alliance,1919 S.
Highland Avenue, Building A, Suite 227, Lombard, IL
60148, addressed the City Council stating that older
homes are the problem; it can be very expensive to add
sprinklers to a home; would like to see this as a
volunteer program.
Mr. Stan Zimmerman, 408 S. Wolf Road, addressed the City
Council stating that this ordinance will force more and
more people into substandard housing; sprinklers will not
cover all situations; fire prevention is the answer; we
should have freedom of choice as to whether we want to
have a sprinkler system in our home.
Moved by Brookman, seconded by Smith, to adopt Ordinance
M-57-04, AN ORDINANCE AMENDING TITLE II, "FIRE
REGULATIONS," CHAPTER 8, "AUTOMATIC SPRINKLER SYSTEMS"
OF THE CITY OF DES PLAINES CITY CODE.
Moved by Christiansen, seconded by Murphy, to adopt a
SUBSTITUTE MOTION to postpone until December 6, 2004, the
adoption of Ordinance M-57-04. Motion declared carried.
