HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL
CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY,
MARCH 18, 2002
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines, Illinois, was called to order by Mayor Anthony
W. Arredia at 7:00 p.m. in the Eleanor Rohrbach Memorial
Council Chambers, Des Plaines Ci vie Center on Monday,
March 18, 2002.
ROLL CALL: Roll call indicated the following aldermen present:
Beauvais, Christiansen, Murphy, Sayad, Brookman, Becker ,
Smith, Argus. Alderman Brookman left the meeting at 8 :25
p.m.
Also present were: City Manager Miller, Assistant Director of Finance
Jisa, Police Chief Ryan, Fire Chief Farinella, Acting Director of Public
Works Dusckett, Deputy Director of Community Development Molinari,
Director of Human Resources & Services Merriman and Assistant City
Attorney Bartel.

The opening prayer was given by City Clerk McAllister,
followed by the Pledge of Allegiance to the Flag.
Mayor Arredia and Fire Chief Farinella recognized Ronald
Paulson, Regional Branch Services Vice President and Paul
Dowd, Branch Manager, FindMRO Company, a Division of W.
W. Grainger, Inc ., and a plaque of appreciation was
presented to them for their donation of more than $15,000
of rescue equipment to the Fire Department .
Mayor Arredia and Police Chief Ryan presented Honorable
Mention Certificates to Police Officer Malea Held and
Sergeant Richard Rozkuszka for their apprehens i on of a
drug dealer from a traffic stop, which also led to the
arrest of another source of drug distribution and the
recovery of a large quantity of drugs intended to be
distributed in the Des Plaines area.
Mayor Arredia and Police Chief Ryan presented a Citizen
Appreciation Award to James Albrecht who alerted 9-1 -1
to a suspicious-acting person standing at his neighbor 1 s
front door, which resulted in the arrest of a v i ol ent
criminal and clearance of other criminal acts t hat t h e
offender was responsible for, and the prevention of
future criminal acts against Des Plaines residents by
this offender.
Mayor Arredia read a proclamation declaring the week of
April 7-13, 2002, as International Building Safety Week
2002, to help educate the public about the efforts of
code officials worldwide, and their cooperative
relationship with the construction industry, in the
administration of their health and life-safety standards .
Alderman Christiansen requested that Item 1 be removed
from the Consent Agenda; Alderman Sayad requested that
Items 3, 3a and 18 be removed; and Alderman Smith
requested that Items 5 and Sa be removed.
Moved by Beauvais, seconded by Becker, to establish a
Consent Agenda except for Items 1, 3, 3a, 5, Sa and 18 .
Motion declared carried.

Motion declared carried. Minutes were approved; Staff
recommendations and requests were approved; Ordinance z-
4-02 was adopted; Ordinances M-17-02, M-18-02, M-19-02,
M-20-02 and Z-6-02 were placed on First Reading; and
Resolutions R-25-02, R-26-02, R-27-02 and R-28-02 were
adopted.
Alderman Christiansen requested that the minutes of the
regular meeting of the City Council held on March 4,
2002, be amended as follows: Page Five, second heading
"Social Svs. Agencies/Organiza. Funding," last line of
last paragraph, ADD "and abstained from voting on funding
for The Center of Concern (conflict of interest)."
City Clerk McAllister stated that Alderman Sayad has
requested that the minutes be amended as follows: Page
Six, fourth heading "Fines/Parking Violations," after
second paragraph, ADD "Alderman Sayad noted that the fine
for parking in a tow zone was increased from $50 to $55
and approved for recodification by the City Council last
year; he asked if there are any tow zones in the City not
part of the snow route ordinance, handicapped parking
ordinance, resident-only ordinance, etc.; if there are 1
where are they located? Alderman Sayad was told that the
Staff would research this and get back to him."
Moved by Christiansen, seconded by Sayad, to approve
minutes of the regular meeting of the City Council held
March 4, 2002, AS AMENDED. Motion declared carried.
Moved by Beauvais, seconded by Argus, to approve minutes
of the Executive Session of the City Council held March
4, 2002. Motion declared carried as approved unanimously
under Consent Agenda.
Moved by Sayad, seconded by Argus, to concur with Staff
recommendation to amend Title V, Chapter 46
"Registration of Solicitors" of the City Code to add a
new Section 14 "False Personation" to help avert
solicitors, primarily telemarketers, from defrauding
residents in an attempt to elicit contributions; and
further recommend to place on First Reading Ordinance M-
17-02, AN ORDINANCE AMENDING TITLE V, "BUSINESS
REGULATIONS" CHAPTER 46, "REGISTRATION OF SOLICITORS" TO
ADD A NEW SECTION 14 I II FALSE PERSONATION I II OF THE DES
PLAINES CITY CODE. Motion declared carried.
Moved by Beauvais, seconded by Argus, to concur with
Staff recommendation to amend Title V, Chapter 5, Section
34 -"Intoxicating Liquors" of the City Code to add a new
Section 6.1 -"Beer Kegs" which requires each beer keg
sold to be affixed with a tag, and requires documentation
of identification and signature of purchaser of the beer
keg, to provide means to identify persons who might
furnish alcohol to minors; and further recommend to place
on First Reading Ordinance M-18-02 I AN ORDINANCE AMENDING
TITLE v I "BUSINESS" CHAPTER 5 I "OTHER BUSINESSES II SECTION
34, "INTOXICATING LIQUORS" OF THE DES PLAINES CITY CODE
TO ADD A NEW SECTION 6.1 "BEER KEGS." Motion declared
carried as approved unanimously under Consent Agenda.
Moved by Smith, seconded by Becker, to concur with Staff
recommendation to amend Title VI -"Police Regulations,"
Chapter 1, of the City Code to add a new Section 6-1-62 -
"Parental Responsibility" which makes it unlawful for a
parent or legal guardian of a residing minor (above the
age of 11 but not yet 19 years of age) , to fail to
exercise proper parental responsibility and would hold
the parent or legal guardian liable for actual damages
for the willful or malicious acts of such minor which
cause injury to a person or property; and further

Staff recommendation to award bid for 2002 Public Works
Street Resurfacing Program to the lowest bidder, Orange
Crush LLC, 321 S. Center Street, Hillside, IL 60162, in
the bid amounts of $176, 286. 25 for Surface Removal;
$17,500 for Prime Coat Application; and $265,296.50 for

to the City Council approval of the March 18, 2002 -

and further recommend that Resolution R-29-02 be adopted
at appropriate time this evening. Motion declared
carried (Alderman Christiansen abstained from voting for
funding for the Center of Concern, Page 9 -conflict of
interest, and the Self-Help Closet & Food Pantry, Page
10 -conflict of interest; and Alderman Murphy abstained
from voting for funding for the Maine Center for Mental

LEGAL &: LICENSING Alderman Smith, Chair
Alderman Smith reviewed City Attorney Wiltse 1 s memo of
March 8, 2002, regarding the proposed changes to the
Class B-1 Liquor License to permit this license to be
contained in smaller stores; and a new Class B-2 for beer
and wine carryout only.
Alderman Brookman stated that she is concerned about
these changes; when you make a sweeping change like this,
many convenient stores can apply for these licenses;
there are a lot of people in town opposed to this; she
will be voting no.
Alderman Murphy stated her concern that this ordinance
will not be as strictly enforced as in other stores; she
is not sure that this is necessary.

Mr. Pat Gillespie, 1038 Everett Lane, addressed the
Committee of the Whole stating his opposition to this new
ordinance and presented petitions to the City Clerk; why
are you changing an ordinance when you don't have a
broken wheel; there doesn't seem to be a problem.
Mr. Garry Danfield, 655 S. Des Plaines-River Road,
addressed the Committee of the Whole stating his concern
about the kinds of petroleum products that will be sold
in this store; you should look at this again.
Alderman Beauvais stated that she was under the
impression that this ordinance would be to just clarify
some wording from the old ordinance; it would clean up
the wording; she didn't think we would be doing this for
small businesses.
Moved by Brookman, seconded by Sayad, to recommend to the
City Council to NOT approve the proposed amendment to the
Class B-1 Liquor License to permit this license to be
contained in smaller stores; and the proposed new Class
B-2 Liquor License for beer and wine carryout only.
Motion declared carried. Alderman Smith voted no.
COMMUNITY DEVELOPMENT Alderman Becker, Chair
Deputy Director of Community Development Molinari
reviewed his memo of March 5, 2002, regarding request to
permit construction of 6' high, solid fence in the
secondary front yard and a portion of the primary front
yard on property located at 2130 S. Des Plaines-River
Road.
Ms. Lidia Mackay, a representative for the petitioner,
Tadeusz Zmuda, addressed the Committee of the Whole
stating that this variation is being requested to help
eliminate dust and noise pollution; there are two (2)
homes across the street that have 6' fences.
Mr. Ronald Schumacher, 2053 Welwyn Avenue, addressed the
Committee of the Whole stating that the fence would be
right up to his house; he would have no place to put the
snow; there would be no view from his house; it will be
hazardous to get out onto River Road.
Mr. Garry Danfield, 655 S. Des Plaines-River Road,
addressed the Committee of the Whole stating that this
will cause a problem; people will not be able to see
traffic coming; it is not fair to the people; they will
get hurt; look at this again.
Alderman Becker stated his concern about the possibility
of a blind spot being created by this 6' fence; he will
be voting no.
Motion by Alderman Christiansen to recommend to the City
Council to approve the proposed fence layout ( #2) as
recommended by the Des Plaines Zoning Board of Appeals,
died for lack of a second.
Moved by Smith, seconded by Becker, to recommend to the
City Council to deny request to permit construction of
a 6' high, solid fence in the secondary front yard and
a portion of the primary front yard on property located
at 2130 S. Des Plaines-River Road, BUT permit a 6' high,
solid fence along the west and south side of the house
and a 4' high, 50% open fence 25' from the front property
line on the north side and along Welwyn Avenue, and along
Des Plaines-River Road. Motion declared carried .

recommendation to award bid for 2002 Street and Utility
Improvements -Contract B, to the lowest bidder, Orange
Crush LLC, 321 Center Street, Hillside, IL 60162, in the
total bid amount of $2,331,930/General Improvement Fund
($2,031,930) and Water Fund ($300,000). Upon roll call,
the vote was:

action taken by the City Council on March 4, 2002, to
concur with consensus in Executive Session that remaining
portion of property located at 1925 Busse Highway, not
purchased by the City for the construction of a pumping
station and tide gate as part of Phase I of the proposed
improvements of Prairie Farmers Creek for flood control ,
be rezoned from M-1 Manufacturing to C-3 Commercial
District with limited exceptions, i.e. no gas station or
auto repair station; and City Attorney be authorized to
take all actions necessary to change the zoning
classification for this property; AND adopt Resolution
R-30-02, A RESOLUTION AUTHORIZING THE EXECUTION OF A
"PURCHASE CONTRACT" FOR THE PURCHASE OF APPROXIMATELY ONE
ACRE AT 1925 BUSSE HIGHWAY, DES PLAINES, ILLINOIS
(authorized by the City Council on September 17 , 2001 ).
Upon roll call, the vote was:

Alderman Christiansen stated that he is opposed to the
fine increase for Section 10-5-5H -Overtime Parking 1,
2 and 3 Hour Limits from $3 to $20.

Reading Ordinance T-1-02, AN ORDINANCE AMENDING TITLE X,
"TRAFFIC" CHAPTER 5, "STOPPING, STANDING AND PARKING" AND
CHAPTER 11, "PARKING LOTS" TO INCREASE CERTAIN PARKING
FINES. Motion declared carried. Aldermen Christiansen,
Brookman and Becker voted no .
Moved by Sayad, seconded by Christiansen, to concur with
recommendation of Committee of the Whole to adopt
Resolution R-29-02, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE
DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND
ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total:
$2,154,169.31. Upon roll call, the vote was:

Moved by Beauvais, seconded by Sayad, to concur with
recommendation of Committee of the Whole to NOT approve
the proposed amendment to the Class B-1 Liquor License
to permit this license to be contained in smaller
stores; and the proposed new Class B-2 Liquor License for
beer and wine carryout only. Motion declared carried.
Alderman Smith voted no.
Moved by Christiansen, seconded by Becker, to concur with
recommendation of Committee of the Whole to DENY request
to permit construction of a 6' high, solid fence in the
secondary front yard and a portion of the primary front
yard on property located at 2130 S. Des Plaines-River
Road, BUT permit a 6' high, solid fence along the west
and south side of the house and a 4' high, 50% open fence
25 ' from the front property line on the north side and
along Welwyn Avenue, and along Des Plaines-River Road .
Motion declared carried. Aldermen Beauvais and Sayad
voted no.
At the request of Alderman Argus, Mayor Arredia referred
the matter of increasing the size of banquet hall signs
to Staff for review and report.
Alderman Christiansen, Chairman of the Engineering
Committee, announced that disposition of the surplus
funds from 2002 Street and Utility Improvements
Contract A and B, and the surplus funds from the
Resurfacing Program, will be discussed by the Committee
of the Whole on Monday, April 15, 2002.

meeting of the City Council adjourn. Motion declared
carried. Meeting adjourned at 8:32 p.m.
